In XXXX of 2017 I secured a loan for a vehicle through XXXX XXXX XXXX. Almost immediately after driving the car off of the lot, I began to experience issues with it. I purchased the car at a XXXX but I wanted a thorough unbiased opinion so I took it to the dealer of the car manufacturer which is XXXX. They performed an assessment of the vehicle and advised that the issues with the car were due to lack of appropriate maintenance and poor conditioning by XXXX. The was only 1 new tire placed on a vehicle with three older tires that contributed to excessive pull, and misalignment of the vehicle. Additionally, the vehicle required additional maintenance that should have reasonably been performed by the seller. I spent a couple hundred dollars or so at the XXXX dealer getting some of the issues addressed. A few months passed and I continued to experience several problems with the car. The brakes were worn, and stopping was almost impossible with reasonable driving in wet environments. Even after properly turning the vehicle off, I would come back out 45 mins to an hr later and the engine would be running with an indicator light saying that the key needed to be inside the vehicle to function. At very random times while driving, the passenger seat belt alarm would began to ping loudly and rapidly and the seat belt convenience slider would push forward and backward. There would be nothing in the seat or in front of the passenger leg rest to prompt any sensors or cause the car to react that way. I was traveling and during my stop in the western states, I was driving and the dashboard panel flashed and said that the tire sensors were malfunctioning. I pulled into a service station, checked and everything was fine. I resumed driving and the issue went away. Later that evening I realized that the headlights for the vehicle were not turning on. I tried to turn them on manually and they would not work. I pulled over, turned the car off and back on again and a new error message came on saying adaptive headlights malfunctioning, please schedule service appointment. I had a friend come and pick me up out of fear of jeopardizing my safety by driving at night without visibility. I left the car parked and moved it the following day. I waited until I could have a mechanic take a look at the car and he explained that many of the issues with the car are electrical in nature and after reviewing repair costs, I was quite shocked when I researched the actual value of my car ( 14k-17k ) versus my loan amount ( XXXX ) and saddled with a lemon and having payments to make I immediately contacted American Credit Acceptance on XXXX XXXX at XXXX and explained to the representative on their recorded line that I was not able to deal with the issues of the car nor make the payments. I was very direct in explaining my desire to surrender the vehicle and after they provided the final assessment of charges, I would need to include it in a bankruptcy from the burden of having to pay for a car no longer in my possession. The rep advised they would prefer to keep me in the car and advised of a postponed payment plan which I reluctantly agreed to and submitted their form signed back to them via email which they acknowledged was an acceptable form of communication for the account and legal documents like the signed one I submitted. As the repair estimates piled up and I was concerned about investing and having additional issues occur with the vehicle. After reviewing my contract during a consultation with a third party credit advisor regarding the loan and the issues I was having with the car, I was explained in detail the terms of my loan in a way that I could understand - and was made aware that out of the {$820.00} dollars that I was required to pay each month, XXXX XXXX XXXX applies only {$170.00} or so to the principal of the loan and applies the rest of the payment towards a predatory 29 % interest fee. The breakdown of how payments are applied are not explained appropriately during the process because no person of sound mind would agree to pay {$650.00} or so in pure interest every single month. That is over {$47000.00} in interest fees alone over a 72 month term not counting the principal owed. When I first contacted them early in the process I pleaded for them to review the loan and apply a reasonable interest rate because I noticed that I had made payments but the amount of the loan balance never changed at all. I didnt fully understand until I had a third party break down all the components of my loan piece by piece to me. On XX/XX/XXXX I contacted them at XXXX and was not able to reach a representative. On XX/XX/XXXX I learned that no lender would offer a refinance on a car with so many issues and over 10,000 worth of overinflated value in the loan on top of the actual value of the car itself. On XX/XX/XXXX I contacted them via their online portal message tool while logged into my account and explained I was requesting a pick-up of the vehicle/voluntary surrender and that I needed them to contact me ideally in writing via email ( which based on my experience with them they had set the expectation that email is an acceptable form of account communication ) so that everything could be settled out and that I would file for bankruptcy for whatever the remaining balance owed. I received no contact from the company. I only have an email record from them that day confirming that I confirmed my email address in the online portal account center. XX/XX/XXXX I sent a copy of the loan documents and the car key to XXXX XXXX XXXX XXXX XXXX, SC XXXX requesting that they pick up the car. I was not able to leave it at the police station in the town where I was visiting but it is parked in a rear parking lot adjacent to the police station. There was no damage to the exterior nor to the interior of the car itself but I have read several reports that the asset recovery team employed by XXXX XXXX XXXX routinely drives the vehicles and damages them. I have taken every precaution and photographed the entire exterior, and interior of the vehicle and I made sure to photograph the warning messages from the dash screens as well. I can see on my cell phone locator that the car is still in its position and has not been retrieved by XXXX. I have exhausted every opportunity and have tried to resolve this with them. They were not willing to provide a reasonable interest rate closer in line with having {$170.00} or so principal being applied out of an {$820.00} payment, and the issues that the vehicle has are likely to be on going. If the car is still there at the end of 15 days from receipt of this complaint, I intend to have the state pick it up for abandoned property and given their cavalier disregard for addressing this issue I intend to file suit against XXXX for predatory lending practices, accusation of concealment of property and harassment of known associates without communicating with me. To date, I have not been emailed related to the loan or vehicle itself. I am not going to allow their company to bully or berate me as they have done to countless others. Given that I am not able to resolve this with them directly, prior to filing suit, I am very earnestly requesting a thorough review of their business practices along with other loans that are structured like mine and into the abuses of their customers like me. I have bought a car 2years ago and after a bankruptcy, I had to go with this company.First I was all glad someone took me, but now I know why. This company does not record all calls, as I had problems to pay I called and spoke to an agent letting him know the money was going to be late, nothing was recorded so car got picked up without a notifaction after 60 days. Next day the money I was waiting for to make the payment arrived, of course now it went thru other cost then really what it was ment for. But that is not my mayor issue with them. In XX/XX/2020 we had hail and car got damaged per estimate it was over {$6200.00}. I did my part and called every place from Insurance, GAP and XXXX XXXX XXXX reporting it sending needed documents and exchanged with every company information as well as contact info. As the Insurance payed part of the loan of GAP insurance ask to receive a copy from AAC after it was received and cashed. So I called, email and chatted with AAC to make sure they will send needed doc out, my first attempt after reporting the hail damage was XXXX XXXX, next XXXX was XXXX XXXX, another time was XX/XX/XXXX XXXX then XXXX XXXX and continued in to XX/XX/2020 several times. I either got someone who didn't know what they where doing or didn't want to, I was told from we don't send a copy out has to be the insurance to we did send you a copy as well as to your GAP insurance. NONE was true! I called insurance again to verify and GAP to ensure i had the right information. So I called again and again and email over and over! I got to talk to several agent and comment where from, you will not be charged since car is write off, to you are late you need to pay now! The car has not been in my possesion since XXXX XXXX! I made payment till XXXX and partical for XX/XX/2020. I am not going to pay for anything else after AAC received on XXXX XXXX a check over {$6000.00} and the rest was supposed to be payed by GAP. That could of been done already in XXXX after GAP assured me all what was needed was the Copy of the Check, I had send everything else in by XXXX XXXX to be sure it was done correct. This 1 piece I couldn't not send in is main key to get it payed off completly. So I called again in XXXX every third day to check on the status and checked my e-mail daily after I ask for a copy to be send to me as well for proof that is was done, of course I was told over and over it is send. NOTHING!!!! On my last call on XXXX XXXX I was finally told the truths, copy was never send it was requested but never got followed up by department in charge of it! Also that GAP had requested copy a second time as well now! This agent this time was really helpfull and called all supervisors till she had the copy and send it to my email and to GAP, as I ask her what about my credit score and the intrest accumulated in this time, she had to transfer me to a different department. This agent was not willing to listen and ignored the fact that it is not my fault that GAP hadn't payed yet, due not receiving needed copy of check from ACC. THIS IS REDICLESS I should not have to pay any fees or intrest for this time frame your employees straight lied by saying it was send in XXXX and XXXX, what was not the truths, neither should GAP have to pay for the delay on AAC side! As I tried to explain to agent with them taking there sweet time and making faults statements, its showing late- past due and accumulated over {$380.00} of intrest, she told me I needed to pay my regular payment plus my intrest! She also mentioned oh the copy was send out if GAP pays before end of XXXX it will stop and no more intrest will be accumulated, I was stund over her answer and ask her serious do you even know what you are saying is not possible? IF you guys just got copy today and mailing out today it wont be there till Monday or Tuesday, on top Monday was a Holiday so by the time this will be looked at by GAP insurance it will be thursday XXXX XXXX or XXXX XXXX you expect them to cut a check and have it mailed to you by less then 2 days? Things you can't even process in one month you expect them to get done right away. Serious??? I ask her to let me speak to a supervisor what she refused with the phrase it is escalated, and if you don't want to pay we are getting the car!!! Serious I don't even have the car anymore it already got picked up by insurance company! I have wrote since then several emails and no response.My account now shows 60 days late! Redicless all you are doing it making extra money on expenses of your customer! I check daily to see if GAP has payed yet but even if you get a check from them you might not even cash it out of spike! I will rebattle any credit score you will enter, I am to the point to report this if you aren't fixing this issue! I am done being cooperative and doing what was needed as soon as it happened! I am warning people not to deal with this Credit company, no remorse this is a fraudle behavior! Companies like this should be closed!

In early XX/XX/XXXX I began the process to refinance my home. The plan for the refi was to pay off some loans that were still active include a loan with XXXX XXXX XXXX or ( XXXX ). I missed two months of payments or around XXXX $ each. XXXX stated I could defer payments if I gave them XXXX $ in XX/XX/XXXX that amount was satisfied and the contract was sent for me to sign for the deferment. Almost a week later first or second week of XX/XX/XXXX I found put during a conference call wo th my loan officer XXXX XXXX at XXXX XXXX that XXXX did not show the deferment on my credit statement when I called them they stated that the contract needed to be wet signed. XXXX failed to ever contact me to advise me that the contract was approved or disapproved. Then a week or two later in XX/XX/XXXX my credit checker for the refi called XXXX with myself on a conference call to obtain a payoff amount I do n't have the exact amount available to me but it was XXXX and some change the check for that money was sent to XXXX one week before the XX/XX/XXXX. When I contacted XXXX today the XX/XX/XXXX the business informed me that there was a fee even though we obtained a payoff amount. The fee was XXXX $ the business failed to inform me that there was a fee and failed to provide that information when asked for the payoff amount. I believe XXXX 's intent was to extort me out of more money upon them receiving a large payoff amount for the loan. XXXX also said that it would take longer if I did not pay them the XXXX $ to investigate the issue.

XXXX XXXX called me on XX/XX/2019 from the number XXXX. She indicated that she was an attorney working for the American Acceptance Law firm and that I owed her over {$4000.00} for debt and legal fees for an account with XXXX XXXX XXXX. I have never had an account with this bank and this debt is not mine. She somehow had my Full SSN and threatened release it. She also informed me she would be contacting my employer to garnish my wages. When is started asking for details she told me that she could drop the legal fees if i would pay her the amount of {$360.00} now over the phone. Again i told her this is not my debt and I will not pay. She then told me I had been " served '' and she will reach out to my employer to garnish my fund for the full amount in excess of {$4000.00} amount and hung up on me. I looked into the company and this is not a law firm but an LLC. They are not licensed in the Stare of Florida rather the state of Colorado. This seems like a scam to me.

XX/XX/XXXX my son purchased a car from XXXX in XXXX XXXX TN. He signed the papers, paid a {$200.00} down payment, and they gave him the keys. On XX/XX/XXXX they called and said they needed additional paperwork. They wanted cancelled checks off his employers account. He told them that he would try to get this but that he didn't know if he could. He talked to his employer and was told they would get them ad soon as they could, but it took time. The car lot continued to call daily for these papers. We had given them proof of income in the form of paystubs and they said that was good when he signed the contract. They never gave him copies of the contract and we had to call and argue to even find out who financed him. They say he was financed by XXXX XXXX XXXX. Finally, after not being able to satisfy their needs for proof of income, he returned his car. Upon returning the car they refused to give him his down payment back or copies of the papers he signed.

I have tryed to tell them need payment moved to a different date in comes due with insurance payment making it hard to keep paid on time and also I have told them I get income once a month low income disiabitly and they will not work with that been fighting with them about this over a year and now late charges and its high interest rate to start with they refuse to work with me and they call my phone every day and all hours I ca n't deal with telling them every time they call XXXX XXXX XXXX is high interest its unreal never again will I have some though them and they refuse to work with a person I been paying for over 3 years now and hope to have it paid off in the next 8 months if they stop adding to it

I have contacted XXXX XXXX XXXX and to all 3 credit agencies. XXXX removed the account but XXXX and XXXX is still reporting false information of a debt that do not belong to me. This debt was created as a result of identity theft. I have submitted to them identity theft forms and they still have not remove this account from my credit profile. I would like your help in getting this matter resolved. Please fine this company or have them remove this account from my credit file.
