I am filling a complaint against Allied Servicing Corporation and the President XXXX XXXX ( NMLS ID XXXX ) located at XXXX XXXX XXXX XXXX, XXXX XXXX, WA XXXX. I am filling this complaint on behalf of my aunt XXXX XXXX XXXX ( Allied account # XXXX ) who owns the property at XXXX XXXX XXXX, XXXX XXXX, CA XXXX ( APN : XXXX ). XXXX is currently making monthly payments of approximately {$280.00} to Allied Servicing Corporation for a loan that they do not own. On XX/XX/XXXX, XXXX received a letter from XXXX, XXXX stating that her mortgage had been transferred from XXXX XXXX, XXXX to XXXX, XXXX. On XX/XX/XXXX, XXXX received a letter from Allied Servicing Corporation stating that they purchased her mortgage loan from XXXX XXXX, XXXX. I am unclear as to how two separate companies were both able to purchase her loan from XXXX XXXX, XXXX at the same time? The last letter XXXX received was from Allied Servicing Company on XX/XX/XXXX claiming they own XXXX loan. However, I have reviewed all of the documents in the XXXX County Recorders Office and I do not see a document that Allied Servicing Corporation owns XXXX mortgage. A document was recorded on XXXX property ( XXXX County Recorder Doc # XXXX ) that has her Allied Servicing Corporation account number on the top of the first page ( Allied account # XXXX ). This document is a Notice of Default and Election to Sell Under Deed of Trust. This document states that XXXX XXXX owes {$29000.00} and I want to know why she owes this amount and where this number came from. This document is stating that XXXX XXXX property is in foreclosure. However, XXXX primary mortgage is owned by XXXX XXXX XXXX , XXXX and her payments are current. This Notice of Default and Election to Sell Under Deed of Trust states that XXXX must contact XXXX, XXXX or Allied Servicing Corporation to make payment arrangements. I can not figure out how Allied Servicing Corporation owns this loan? On the last page of XXXX XXXX County Recorder Doc # XXXX ) Allied Servicing Corporation checked the box that requirements of CA Civil Code 2923.5 do not apply because the loan is not secured by a first mortgage or first deed of trust that secures a loan. This seems to state that Allied Servicing Corporation does not own the 2nd mortgage on Patricias property and they have no authority to collect monthly payments from her. In an effort to obtain loan documents, XXXX sent XXXX XXXX XXXX ( employee at Allied Servicing Corporation ) an e-mail on XX/XX/XXXX for copies of all of the loan documents. XXXX e-mailed XXXX the documents and within the documents there were 4 allonges. These Allonges were never recorded on Patricias property and were not on file with the XXXX County Recorders Office. XXXX received a Forbearance Agreement from Allied Servicing Company on XX/XX/XXXX. Within this document they are penalizing XXXX back interest at 11.00 % on her mortgage loan from XX/XX/XXXX to XX/XX/XXXX. Allied Servicing Corporation does not own her mortgage now and they did not own it starting on XX/XX/XXXX. How do they have the right to collect back interest on a loan that did not belong to them? During XXXX discussions with Allied Servicing Corporation regarding the Forbearance Agreement, they were harassing her over e-mail to get the roof of her home fixed. The Forbearance Agreement was contingent upon her getting the roof to her single-family home repaired. In fact, Allied Servicing Corporation stated that XXXX must get the roof to her home fixed within 6 months of forbearance. They stated that failure to complete a code-compliant roof fix in that time would result in reversion to defaulted status of XXXX loan! Prior to Allied Servicing Corporation owning XXXX XXXX XXXX mortgage it was being serviced by XXXX, XXXX ( XX/XX/XXXX ) who also purchased XXXX mortgage from XXXX XXXX, XXXX. I filled a complaint against XXXX, XXXX with the CA District Attorneys office because I do not believe that they ever purchased XXXX mortgage. Allied Servicing Corporation sent XXXX an Authorization to Release Information and it had XXXX XXXX name on it as being a representative for XXXX, XXXX. In researching XXXX, XXXX on the State of Oregon Secretary of State website ( Registry Number XXXX ) I was unable to find that XXXX XXXX was officially affiliated with XXXX, XXXX. However, XXXX XXXX XXXX NMLS ID : XXXX ) was an employee with XXXX XXXX XXXX Mortgage XXXX XXXX XX/XX/XXXX to XX/XX/XXXX ) during the time period in which XXXX XXXX primary mortgage account was being serviced. Patricias mortgage loan was transferred from XXXX to her current servicing company XXXX XXXX XXXX on XX/XX/XXXX. In the response letter that I received from the CA Attorney General, XXXX, XXXX claims that XXXX XXXX was a typo and a mistake made by Allied Servicing Corporation. Now I am questioning the validity of all of the documents being produced by both XXXX, XXXX and Allied Servicing Corporation. I need proof they actually own the mortgage and that the paperwork they are producing is valid. I am helping my aunt XXXX XXXX XXXX with this situation because she is 100 % XXXX with a XXXX XXXX XXXX and I believe that she has been scammed. I am hoping that your office can assist in following the paper trail of ownership of the Interest Only Fixed Rate Note ( 2nd mortgage ) for {$31000.00} originated by XXXX XXXX , XXXX on XX/XX/XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, CA XXXX ) that has since gone out of business according to ( CA Dept. of Real Estate License ID : XXXX ). I should note that this 2nd mortgage is not on her credit report. In addition, from the day of origination with XXXX XXXX , XXXX ( XX/XX/XXXX ) until XX/XX/XXXX ( letter from XXXX, XXXX XXXX she had not received any bills from any company trying to collect monthly payments on this loan. XXXX established an 80/20 spilt with XXXX XXXX , XXXX and was informed that the 1 monthly mortgage payment would cover both loans.

Please help me with my zombie mortgage situation. In XXXX got an XX/XX/XXXX on a {$100000.00} mortgage. My first was with XXXX and XXXX was with XXXX mortgage. In XXXX I lost my job as a XXXX XXXXXXXX and fell behind. I tried to do a modification after getting a job at XXXX XXXX making much less than I was making. XXXX modified but XXXX went bankrupt, they wanted to settle for XXXX cents on the dollar, even though it was only {$2000.00} I did not have it and had no where to get it. XXXX told me not to worry my loan was one of the ones that would become unsecured debt and charge off due to being severely underwater. I asked for something in writing and was told they would mail me something after their BK court hearing. I never heard anything again. I did not receive any statements and did not even think about it since XXXX told me not to make payments. I assumed I no longer had a second. 7 Years went by and I started getting documents that my XXXX mortgage was sold to XXXX XXXX XXXX XXXX then to XXXX XXXX XXXX then to XXXX XXXX. XXXX called me from partners of payment relief saying that I needed to work with him to avoid foreclosure. I told him I did not have a second mortgage and hung up. The same man XXXX XXXX called me saying he is now with XXXX XXXX and they had started the foreclosure. I talked with him and he said they would modify my loan and forgive all the late fees for the years of no payments. I would just need to make payments every month. They posted a note on my door that my home would be sold at auction in 30 days. I did not know what to do or who to reach out to. My back was against the wall and I had a foreclosure sale date. I had no where to turn, I had no choice but to work with them. I did the modification to avoid the foreclosure. Instead of waiving the late fees and charges they tacked on more fees and waived nothing. I was told that they do things a little different I need to sign before they could waive the fees. I dealt with the man named XXXX and XXXX XXXX, she was the one that drew up all the documents and told me I had to pay {$1500.00} in order to get the modification and she worked with partners to payments, commercial Partners and now XXXX XXXX services by ASC. I fell behind on payments due to illness and had to file a XXXX XXXX XXXX to avoid them from foreclosing. I have struggled for years to keep my home due to this loan and there is no solution in sight. I had a gut feeling what they did to me was illegal. How could this be legal? I am still in a XXXX XXXX because of this loan. My 1st mortgage is current. Even after I am done with my XXXX XXXX I will still end up in foreclosure because this loan is impossible to get out of. My original loan amount was {$21000.00} with at 9 %. This is what they claim I owe : 1. Ongoing mortgage {$18000.00} plus {$2900.00} interest = {$21000.00} 2. Pre petition arrears {$7100.00} plus {$2300.00} = XXXX XXXX. Forbearance amount due in full in XXXX {$9100.00} ( for missed payments, late fees and interest ). There was no where to make payments if I wanted too and I was told not to worry it would charge off and become unsecured debt. 4. Legal fees outside the Bankruptcy : {$6100.00} Grand Total : {$45000.00} They keep adding to it so that amount could and more than likely will go up. I filed bankruptcy in XXXX of XXXX and am still in the XXXX XXXX to this day ASC has tacked on more and more fees. I have already paid almost {$40000.00} in BK payments and I filed for a past due amount of {$4200.00}. I still owe ASC over $ XXXX with a lump sum of {$9100.00} due in 3 1/2 years for an original loan amount of {$21000.00}. I can not get accurate figures from ASC. Even the principal balance keeps going up and down. They change it anytime

I am currently under a modification with Allied Servicing Co. I have attached a copy of the modification agreement, which I clearly signed under desperation in order to avoid being homeless. It is important to note that this agreement was only reach through forced foreclosure court proceedings as Allied Servicing refused to work with me initially. Part of the agreement was for me to be able to refinance my 1st and 2nd mortgage prior to XX/XX/2020, which I was unable to do within the year due to my credit score. Then, Covid happened. The agreement states that unless I refinance before XX/XX/2020, I will have to pay the full amount owed ( approximately $ XXXXXXXX ). I obviously do not have $ XXXX to pay out in a lump sum. I did not have any issues with my first mortgage company ( XXXX XXXX ) granting me a deferment for my mortgage payments nor with any of my other creditor. Once again, Allied Servicing is refusing to work with me and are demanding that I show proof of denial for refinance from three different lenders. As we all know, not all applications with mortgage lenders are subject to soft inquires, so I have had hits on my credit as a result of applying. This is not the first time Allied Servicing Co. has refused to work with me without forcing me into legal proceedings. Such legal proceedings have clearly added to my debt as they have unreasonably tagged on legal fees as well as other fees. I don't understand how forcing anyone into additional legal proceedings which lead to unreasonable fees is helpful to someone struggling with finances. I clearly do not have $ XXXX to pay off this second mortgage with Allied Servicing Co. by next month. I do not have any other means of income other than my employment. I am not asking for a deferment. I am simply asking for an extension of my modification for at least 6 more months so that I can refinance accordingly. My payments have been on time as per the agreement. I find the request of Allied Servicing Co. to be unreasonable and discriminatory, especially during this difficult time. Looking at my history with Allied Servicing Co., I believe their actions are due to the fact that I am am a woman of XX/XX/XXXX. I have attached relevant documentation for your review. My house loan was sold to another loan place in XXXX of XXXX from XXXX to Allied Servicing Corporation. My house taxes became due in XXXX XXXX, I had no idea they were not paid until i received a letter in the mail from XXXX XXXX clerk office in XXXX stating that they needed paid by XXXX XXXX to prevent my name from being in the paper, so I called Allied and asked them about it they kept giving me the run around on the situation I then talked to a XXXX XXXX on the XXXX of XXXX and she said she got it straightened out with XXXX which is the girl who takes care of the escrow stuff XXXX XXXX said that they were being paid that day, well I called back on the XXXX to double check and XXXX XXXX told me that they were being paid, I then called the XXXX XXXX office on XXXX XXXX just to make sure that they were paid well they told me that they had not been paid yet so I called Allied back and once again I talked to XXXX XXXX she then told me that they were not paid and they would not be paid because I was negative in my escrow account I preceded to ask her why they were not paid and why she told me on the XXXX and XXXX that they were going to be paid well she would n't give me an answer she was very rude and then she said I am hanging the phone up and the phone went dead, I tried for an hour to call back they would n't answer so i called back on my cell and XXXX XXXX answered and I asked to speak with a manager and she said there was not one available and she hung up. I do n't understand why they are n't paid and then they could do an escrow analysis to make up the difference. Would you please help me with this situation because Allied wont talk to me. I home was discharged on XXXX bankruptcy XXXX at that time I had XXXX mortgage lenders. I made payments on XXXX loans until XXXX, when XXXX XXXX my attorney informed me I did n't have to make payments on my second due to lack of money. Since then I have made all my payments on my first on time every month. Now Allied my second lender has sold my loan to a private party. I filed a complaint with XXXX and was also told this may also help too. XXXX XXXX XXXX XXXX was my attorney in this matter and mediation was done with XXXX XXXX and XXXX XXXX attorney for the private party whom was no present only by speaker phone. My understanding was make them an offer and pay them of and that would be that. About a month before XXXX and I talked on the phone and agreed XXXX would be a good start. We never heard anything back from them til XXXX day of mediation. That was the first time XXXX and I meant I said what do you think they accept or reply he said h did n't know but, maybe we will have to go to XXXX which was the max. Well to make this short things did not go well the guy on the phone was rude and I came out of that meeting homeless. I told XXXX and XXXX I had no idea that I was going to lose my home XXXX told me that he has settled a lot of cases and that it 's all about the money. Well that was n't the case. I want a chance to buy back my loan for the same price Allied sold it for they should of came to me first and made me an offer, Please help me keep my home. Allied Servicing Corp., whose address is XXXX XXXX XXXX XXXX, XXXX XXXX, WA XXXX, has published a Notice of Trustee 's Sale thru XXXX XXXX XXXX XXXX XXXX ( XXXX ), whose address is XXXX XXXX XXXX, XXXX, CA XXXX, advertising that my property is scheduled to be sold at a public sale scheduled for XXXX XXXX XXXX at XXXX XXXX, at the City Hall in XXXX, CA. Please address the following : 1. Allied Servicing Corp. claims that it is the Appointed Trustee of an alleged mortgage loan with former XXXX XXXX XXXX, which later changed its name to XXXX XXXX. I have verified with XXXX that my mortgage is not under default. Please stop the Notice of Trustees Sale. 2. Allied Servicing Corp. is demanding an immediate payment of more than {$30000.00} to bring the loan up to date, and offering refinance option for the remaining {$250000.00}, which has no basis since the loan has been charged off by XXXX XXXX. 3. Allied Servicing Corporation serviced a mortgage loan for my lending company, XXXX XXXX. This loan was paid off by my borrower with payoff funds received by Allied on XXXX XXXX. I requested by email the forwarding of the payoff funds and original loan documents from Allied on XXXX XXXX, XXXX XXXX, XXXX XXXX, and XXXX XXXX ; and by phone calls on XXXX XXXX and XXXX XXXX ; and by formal letter XXXX XXXX. I received no responses from Allied. After being forced to retain a lawyer and threaten a lawsuit, Allied finally forwarded the payoff funds on XXXX XXXX. However, despite my last email request on XXXX XXXX, I have yet to receive the return of the original mortgage loan documents required to close out this mortgage loan. Your assistance is appreciated.

We applied home equity of credit in XX/XX/XXXX through XXXX XXXX when we settled for a new home. We have been paying until the home market occurred and had difficulty. XXXX offered a settlement lowering balance to XXXX and have been paying XXXX monthly for yrs. Next thing we know we heard the company went bankrupt and did not hear anything on the home equity balance. suddenly this last month got a letter from Allied Servicing regarding the account and telling us for a foreclosure. I paid XXXX and the balance is XXXX SINCE XX/XX/XXXX. I don't know why they waited for nine yrs. I have attached copy of my account and statement.

Hey I'm have a problem with my loan company with missed information about an house me and my kids mom purchased. I am asking for assistance on a modification or reinstatement. Their is an amount of XXXX due for a note of {$5000.00} an i 'm offering to pay {$5000.00} and commence payments of {$200.00} a month with the intention of paying all past due withing a year with a Refinance.
