I am writing in regard to a case pertaining to Alaska Cascade Financial Services Inc. I was improperly served a summons and now having my bank accounts garnished for debt that I have no knowledge of owing and do not owe. The summons was dated XX/XX/XXXX and I didn't receive the paperwork until returning to find it under my door around XX/XX/XXXX. When following up on this matter contacting Alaska Cascade to get further information I was informed that the contact listed ( XXXX XXXX ) on the summons was no longer working on the case and to reach out to XXXX XXXX who was I was told no longer worked for the company and then was provided follow up contact information which I left a voicemail and never got a response. As time past and I reached out to the XXXX XXXX XXXX for legal advice, I was told to contact that XXXX to dismiss the case on the grounds of the summons process being compromised and no being served in the 90 day window to do so. As well as the plaintiff not complying with any of the court case schedule. I gave XXXX another call and again never received a response, so I went forward to preparing my documents and witnesses for the trial to find out that there was now an application for a writ of garnishment that was sent out that I didn't receive until after finding out that there was a judgement already in place and my funds held by my bank although the trial date for the case was set for XX/XX/XXXX. Being effected by XXXX this has been a further hardship financially and a burden mentally. I called XXXX again and finally got the chance to request a detailed summary of what I was owing and why, he said that he'd send me that information and never did! After going through the proper channels to respond to all the documents to seek exemption from the claims and to recoup my monies that are being improperly held I obtained a new trial date in regards to the Writ of Garnishment XX/XX/XXXX that the plaintiff no showed. Weeks later I received new trial date for " proposed judgment on answer and order to pay '' for XX/XX/XXXX. I received the summons and complaint but service was not correct as required by law. I do not owe this debt. I disagree with the amount stated. There was a violation of good faith and fair dealing. I did not opt into or receive the product or services that the plaintiff is saying that I did.

This is the statement I sent to the Collection Company. It sums up the situation ; First of all this case is from XX/XX/XXXX. If. You Alaska Cascade have owned it since XX/XX/XXXX why am I just know hearing from you? You have an obligation to attempt to collect on debts. I have request twice from you and or Alaska Cascade to provide if any attempts to collect this debt. But, you are unable to provide any proof. I have NEVER received anything from you regarding this debt and I have had the same mailing address for over 10 years. Nor, has this debt EVER been reported to any of the XXXX collection agencies. I would have like to have been contacted at anytime during the last 9 years so I could have paid this debt. You also state that you find it hard to believe I am unaware of this debt since it was part of a XXXX case. Again, this case is almost XXXX years old and I did receive a statement via e-mail from the XXXX County Court stating that this case and the judgment were satisfied in XX/XX/XXXX. So, I am sure you can see my confusion with getting such a statement from the court and for having never been contacted that the debt was valid and Alaska Cascade was looking to resolve the debt. With all of this confusion and Alaska Cascades inability to provide any proof that you have ever ethically attempted to collect this debt at any time in the last 9 years I feel it would be fair if I be allowed to pay the debt and have the interest removed. Please understand that if we are unable to come to an agreement I will be forced to seek further action on this as I do not feel that you have held up to your obligation as a Creditable collection Company. You can not just sit on a debt and collect interest for almost 9 years and not allow the debtor to make right by what they owe.
