On the day of XX/XX/XXXX My husband was called by a woman that identified herself as an employee of XXXX XXXX XXXX and that a bill for our daughter needed to be paid. My husband was not aware of what this debt was for, was not informed of when the debt was incurred and made a faithful payment to who he thought was XXXX XXXX XXXX. The amount of the payment was {$59.00}. My husband was not informed ( to my knowledge, since My husband was at work, working ) that this woman was collecting on XXXX separate accounts, XXXX for our daughter with XXXX XXXX and another for myself with XXXX XXXX. This woman that said her name was XXXX called from a phone number associated with Advantage Financial LLC of XXXX Idaho, a debt collection business. As required by law she was required to inform my husband that she was a debt collector trying to collect a debt and that any information obtained would be used for that purpose. She falsely identified herself as an employee of XXXX XXXX XXXX and used my husbands debit card to complete the payment. Again he made this payment because he thought this was a current debt, not one that should have been discharged in our bankruptcy. This payment was not made voluntarily since it was Advantage Financial calling him to collect on this debt, he did not make any effort to contact this company to make a payment. This payment was taken by a company committing a crime by falsely identifying themselves. My husband and I filed bankruptcy in the State of Idaho. Our BK was filed on XX/XX/XXXX, after the dates of the debt being incurred. On XX/XX/XXXX I called the number that my husband sent to me via text message as a screen shot from his work phone. I called the phone number and reached a company called Advantage Financial. A debt collection agency. This alone proves that this company falsely identified themselves and that they were the ones contacting my husband to collect a debt not that he was voluntarily contacting them to make a payment. Proof with be submitted with this complaint. When I called Advantage Financial I left a voicemail stating they were not to charge our bank account that it was my belief as well that this debt was incurred after our BK. That our daughter should have been covered by my husbands employers insurance and XXXX. I did not find out that it actually should have been covered by my own work insurance as primary and then my husbands as secondary until I was transferred to a manager named XXXX. My voicemail specifically stated that I requested a phone call back to resolve this issue. Once I finally got through the automated message at Advantage Financial I was transferred to XXXX ( a manager ). I was then informed by her that she will not be issuing a refund, that it did not matter that this debt was incurred before we filed for our BK on XX/XX/XXXX. That it was my husbands job to " support '' his family and that his payment was voluntary. As stated above proof shows it was not a voluntary payment. It was a payment made on good faith that the woman XXXX was who she stated. An employee of XXXX XXXX XXXX, not Advantage Financial. on XX/XX/XXXX I tried called the actual billing dept of XXXX XXXX XXXX and XXXX XXXX, both of which are handled by the same company ; XXXX XXXX XXXX in XXXX, Idaho. I was contacted by XXXX XXXX on XX/XX/XXXX ( today ) and informed that they would not be refunding our money either, that it is Advantage Financial that I had to take up my issue with. Now onXX/XX/XXXX I spoke with XXXX at Advantage and was hung up on after I argued with her about this debt and how it was not voluntary and that I expected to be reimbursed. on XX/XX/XXXX I was contacted by XXXX XXXX and was informed that they had called my attorney that did our BK and that she was waiting for a fax from my attorney regarding our BK and actual date of filing. That they would note our accounts with XXXX XXXX and XXXX XXXX of our BK. My attorneys office also called on XX/XX/XXXX and informed me that my husband should just accept the payment as a loss, that he ( the attorney ) would charge us more than the disputed amount paid to Advantage, that in the future he needs to be more aware of how collection businesses work, what debts were discharge or not with our BK, and that he just made a " bad '' call. According to Fair Debt Collection Practices a " debt collection agency must identify themselves as such, that a debt collector may not use any name other than the true name of the debt collector 's business, company, or organization. '' That " The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.

812. Furnishing certain deceptive forms ( a ) It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. ( b ) Any person who violates this section shall be liable to the same extent and in the same manner as a debt collector is liable under section 1692k of this title for failure to comply with a provision of this subchapter. '' All above regulations have been violated by Advantage Financial because they called my husband and collected a debt that is not owed and was falsely represented as being paid to the original creditor XXXX XXXX XXXX not Advantage Financial.

I went to XXXX XXXX XXXX on XX/XX/XXXX. I never received a bill or statement. in XXXX XX/XX/XXXX, I got a call from Advantage Financial Services saying I owed money on a medical bill. The representative gave me the medical bill provider information and I called to see what it was for. It was for the medical service on XX/XX/XXXX. I stated to them that I never received any communication on this bill. On the first call with the 3rd party bill, I was told they sent 1 statement on 2/25/23. I found out my rights and called back to the 3rd party biller and spoke to someone else, that representative told me there was XXXX statements sent out on XX/XX/XXXX and XX/XX/XXXX. The XXXX party biller said that was all the are required to send out. I also disputed I got these and they made changes to my account for future communications. I then called the office XXXX at XXXX XXXX XXXX, XXXX. i went over with her that I could have got the statement but I do not recall getting anything. I said that I have made arrangements or taken care of every other medical bill related to the XXXX from the XX/XX/XXXX visit. She then called me back on XX/XX/XXXX to say they listened to the call with the XXXX party biller and there was nothing they could do and the bill would stay at the collection agency. When I initially spoke to XXXX she agreed with me that XXXX statements mailed out, no phone call, no other attempt to contact me did not seem right. I have taken care of all other medical bills, so why would I not contact them if I knew about the bill. I have verified they made not other attempt to contact me than the supposed XXXX statements sent. I had saved money on my XXXX XXXX XXXX pay any smaller medical bills before I paid the largest XXXX. I waited until May, I figured by that time I would have all the bills in and budget how to pay. I could have and would have paid this bill had I received. I will not be letting this go. What they did is wrong on XXXX even said that on our initial phone call.

Advantage Financial Services LLC. XXXX Idaho has been attempting to collect a debit for XXXX XXXX XXXX XXXX. XXXX XXXX XXXX failed to bill insurance correctly and was denied payment due to failing to provide documentation to adjudicate the claim then noted to balance billed me for services. XXXX XXXX XXXX was prohibited from balance billing on this claim due to in-network contract with XXXX XXXX ( insurance provider ) and ACA laws which state provider are prohibited from balance billing members XXXX XXXX submitted the bill for collections despite no legal right to do so. I have disputed this bill with XXXX XXXX XXXX, Advantage Financial Service, and all 3 credit bureaus. Every time Advantage Financial Services claims the debit is valid because they have a bill. Advantage Financial Solutions fails to properly validate the bill as a legal and lawful debit. XXXX XXXX XXXX own documentation asserts that the patient is responsible for the debit despite being prohibited by contract and law. Advantage is now suing me for the debit, interest, attorneys fees, and court costs. Their assertion is I contracted with XXXX XXXX and am liable for the debit, collecting from Insurance is up to me. However, I never contracted services with XXXX XXXX XXXX. My primary provider XXXX XXXX XXXX outsourced XXXX services to XXXX XXXX. XXXX XXXX XXXX was paid for services, the XXXX who performed the tests was paid on their claims. XXXX XXXX failed to provide documentation to adjudicate this claim and was not paid by insurance. XXXX XXXX failed on their part to submit documentation to get paid. Then violated their own contract with XXXX XXXX and the XXXX XXXX XXXX by balance billing me for services. I owe no debit to XXXX XXXX so Collections on this account is unlawful and fraudulent.

I was contacted in XX/XX/XXXX at work by Advantage Financial a debt collection agency. I told her I had never heard of them and asked what it was for. She told me she had my signature on file for a document saying I would pay it I told her I 'd never signed anything and I do n't know anything about what she 's talking about. I asked for a copy of these I never receive them I called week later asking for them they said they would send them I still have n't received them. Two days ago I was served paperwork by their attorney. I called Advantage Financial to find out why I had never received the paperwork. The lady who works there told me they sent them to an address when she told me the address I told her I had never lived at that address and do you know what she was talking about. When I told her I still had no idea about this debt and I did n't know what she was talking about she proceeded to tell me it was medical bills for my daughter. I told her I do not have a daughter and this was not my debt. She then said she needed to speak with her supervisor and to call her back. When I called her back she said she was no longer able to speak with me about this and I needed to speak with her attorney. When I spoke with the attorney she threatened if I did not pay this they were going to garnish my wages. I told her I do n't have a daughter and she said yes I do this is my step daughter 's Bill and they have witnesses and me signing it. However I 've never been married and I do n't have a stepdaughter I do n't even have a daughter. I have since then ask for a copies of this debt and I still have not received it.

In XX/XX/2016 my husband and I were closing on a home equity line of credit with our credit union. They mentioned that there was a negative item on our credit report and that it appeared to be a medical billing. I asked for a copy of the credit report ( s ), they were unwilling to provide a copy but did say that the collection agency was Advantage Financial. During the closing, the credit union loan officer said she might try to contact the collection people to see what she could find out. I told her that I would get in touch with the collection agency myself. I was quite surprised when the credit union later advised that they had contacted the collection agency and had forwarded money out of my Heloc account to pay off XXXX items in collections -- XXXX for my husband and XXXX for me. I immediately contacted the credit union and told them they had no verbal or written authorization from me to make that payment and to reverse it, which they did. I would like an explanation from Advantage Financial as to : All information disclosed to the loan officer at my credit union ( for example, were the names of the creditors released? ). How did the loan officer find out about a collection item for me that does not appear on mine or my husband 's credit report? How did the credit union find out the exact amounts due including current interest amounts? What authorization did the credit union provided to Advantage Financial for them to disclose my personal information?

Received notice from Mortgage broker that had collection account on my file from Advantage Financial Services, called company requesting a validation od debt, advised they would not do it, should get from original creditor, stated they would make sure thus stayed on my credit report, even if not accurate information. I called original creditor ( XXXX XXXX XXXX XXXX, who emailed me a statement, showing that there charges were based on a physical inspection made on premises XXXX/XXXX/XXXX, this was amazing since I didnt move my property out until XXXX/XXXX/XXXX, have pics and phone logs showing I called original creditor, to set up walk thru time for premises, subsequently call Advantage back. spoke with XXXX, stated she does see the XXXX/XXXX/XXXX date, as date of inspection, but does not care if information is not correct, advised her that her company under FCRA has obligation to provide accurate information to credit bureaus, stated it is her job to collect money and does not care if my credit report is not accurate, threatened to sue me and I advised her that would be perfectly fine. Every company has an obligation to make sure the information they provide is accurate to Credit Reporting Agency and these people will not confirm information is correct, costing a higher interest rate on my mortgage.

Advantage Financial Services/XXXX XXXX XXXX Orginal Amount of Debt : {$1300.00} Interest being charge : {$43.00} ( 12 % annual ) Received a phone call middle of XXXX to collect a payment that was charged in XXXX. I never received notification via phone or email that this debt was outstanding prior to this call. Confirmed with the representative that they had the incorrect address. A new statement was sent to correct address on XX/XX/XXXX. They are attempting to collect 12 % interest. I refuse to pay interest on a debt I was never notified on. On XXXX I called to pay original amount and close account. The account representative, XXXX, informed me that they attempted to call and that they left multiple voicemails, claiming they have been calling since XXXX. I never received a call from them until XXXX and when I asked for verificationproof of calls he stated that they are not required to do so and he told me to call back at a later date. I called the original provider, XXXX XXXX XXXX XXXX XXXX, they outsource the medical billing to another company called XXXX XXXX XXXX. Confirmed that they had the incorrect contact information. Advantage Financial Services in XXXX ID had sent me a letter stating that I owed XXXX XXXX XXXX money and that they were asked to collect. I informed Advantage Financial thru email on XX/XX/XXXX as well as faxes and phone calls that I had paid XXXX XXXX in full ; I supplied copies of my bills from XXXX XXXX, my EOB 's from XXXX XXXX as well as canceled checks showing them that I had paid this bill in full. XXXX XXXX says that I owe money from XXXX but according to XXXX XXXX it was past the date allowed to be filed and that I didn't owe this money in the amount of {$220.00} from service dated XX/XX/XXXX because they didn't send me a bill XX/XX/XXXX I don't feel that I owe this money. I had sent everything that I am sending to you to Advantage on XX/XX/XXXX and because I never heard from them I was under the impression that this matter was settled now here I am in XXXX and they are still showing this amount due on my credit report and calling me over a year later since I sent them the information even though they have NEVER sent me anything in the mail stating that I still owe this money since XXXX. I have tried emailing them again on XX/XX/XXXX with this information but still have not heard anything from them, I don't think that they have even looked at what I sent!

The document included is to outline specific terms in the contract that XXXX XXXX XXXX has violated. This violation of the contracts deems the termination fee void. Therefore, the company does not have the right to seek to obtain the remaining fee of {$370.00} via the collections agency, Advantage Financial Services. A copy of the contract has been included for independent review as well. XXXX XXXX XXXX and I had a contract that lasted from XX/XX/XXXX to XX/XX/XXXX. I was an XXXX XXXX at one event, in which I personally purchased all the supplies for. Overall, I have received no monetary compensation, no advertising to assist me as an XXXX, and no confidential information that has personally benefited me as an XXXX. The collections agency received my dispute onXX/XX/XXXX. Allowing the 30 days for XXXX XXXX XXXX to reply to the dispute, I have been notified they deem the contract valid and will continue with the collection attempt. However, I disagree. Hopefully, ( as I have outlined ) both parties are at fault, and therefore, the contract is no longer valid. The collections agency has stated my only option is a lawyer. However, since I do not find the investigation adequate by Advantage Financial Services on my behalf, I am seeking an alternative solution.

Debt was with XXXX XXXX XXXX XXXX ID. I already paid this company XXXX to XXXX dollars. However they kept saying they needed more time. They needed to do more applications. After 5 month of this I was fed up. I paid their first fee of XXXX or XXXX. With no results. I had renters bothering me daily. So I called up XXXX and had them come out for about XXXX dollar and they finally took care of the issue. XXXX however says I still owed them XXXX dollars. Which I refused to pay since they did not take care of my issue. They then put a XXXX dollar fee on to the XXXX making the sum XXXX dollars. Or XXXX. I forget. XXXX XXXX XXXX has now sold the debt it appears to Advantage Finacial Service XXXX. They have now said the past bill was XXXX, and they are now charging interest bringing the bill to XXXX. As far as I know collectors can't charge interest. Even if they buy out the debt. I WILL NOT PAY ANY ADDITIONAL SUMS on this since they did not meet their obligations of getting rid of the pests.

On XX/XX/2019 a medical company in the name of advantage financial services reported on my credit of a unpaid past due bill. The bill was paid by my medical insurance beforehand. There was nothing on my side that made me responsible for this debt. I disputed the information after seeing my credit score drop from XXXX to just about 700. I disputed the charges with XXXX. I was told that the Advantage would not take it off. I then received proof of when my medical insurance paid it and that it was not paid late. I disputed it again. The only change is the amount was dropped down to XXXX with the conment added paid under original amount. I have been getting my credit turned down because of this and the ones that approved me want 3.0 % more!! This is ridiculous and has devastated my situations where I have needed credit. Please get this off

The state of Idaho follows the federal FCRA, and with debt that did not have interest applied to it before going to collections, then it can not have interest applied in collections. The debt was from XXXX XXXX initially, they charged no interest or late fees. I have a debt from them with another collection agency and they have never charged me interest or late fees. The company alleges that part Idaho laws they are allowed charge 12 % interest in debt, this is incorrect. Idaho has a bad check law that can have an addition 12 % interest charged for willfully writing bad checks, this is not the situation There is no payment agreement with this collection agency, therefore no late fees or reported late payments. Idaho has a statue of limitations of 4 years for this type of debt, these accounts are from 2014.

I have already informed you about it in the past. Advantage Financial Services signs their own complaints. No attorney signs them. I have found that to be so in our case and I am in connect with another person that it has happened to. The signatures on the Complaints are not AFS 's attorney. Called and left voicemail confirming call was for a debt on voicemail. I returned call, XXXX stated the debt was for XXXX medical bills, did not confirm who I was. When I mentioned an attorney, she said she would note the account that they do not have the information and hung up on me. I called and asked for a supervisor, whom also would not take my attorney 's information and hung up on me. Advantage financial services LLC located in XXXX Idaho has three medical accounts in collections. None of these accounts are suppose to have interest or late payments, when I contacted AFS to resolve the issue. The employees there said that I don't know what I'm talking about, that they can change interest if they want to, and that it's my own fault for being irresponsible for my debt. The staff yell, threaten, and are very inappropriate.

I am going to be mailing in a complaint about Advantage Financial Services, a collection company in XXXX, ID. They have in the past tried to collect medical bills from my wife and minor daughter. They also violated other parts of the FDCPA. I have discribed each violation and will including all the and supporting documents. In 2015 I was the victim of identity theft. A family member used my information resulting in medical collections in Idaho where I never sought treatment. I have been able to remove all but one of these accounts from my credit. Unfortunately Advantage Financial Services is still attempting to collect a debt from XXXX XXXX XXXX that does not belong to me.

Left message not identifying themselves or where they were calling from. Messages just said " this is XXXX call me back '' When I called and spoke with a supervisor she yelled at me.
