Today XXXX/XXXX/XXXX I was contacted by XXXX XXXX ( which they say the name in such a way you ca n't fully understand and ca n't find on the internet ) and told that I was going to be served w/in the next 24 hrs on an old debt. I called them back and kept being told that it was strange I had called prior to being served, and they kept trying to verify that I had not been served - which I had not. I spoke with one gentleman at length who told me I owed {$15000.00} ( this amt included what I was owed, plus late fees, Atty fees etc ), but they would take {$4900.00} on settlement today. I explained that I could not pay either amt today or the $ XXXX by the end of the month but I would like to try to make a payment plan to pay the money back. I was transferred to a gentleman named XXXX XXXX who identified himself as a XX/XX/XXXX. He gave me his direct number XXXX and case # XXXX. He then explained the timeline as follows : Loan is taken out XXXX/XXXX/XXXX Vehicle repossessed XXXX/XXXX/XXXX Vehicle sold at auction XXXX/XXXX/XXXX - the amt owed ( $ XXXX ) is greater than the original amt of the loan. Charge-off XXXX/XXXX/XXXX - XXXX XXXX informed me that they have a 5 yr statute of limitations from this date. letter mailed ( to the incorrect address in GA ) XXXX/XXXX/XXXX ( I had XXXX XXXX verify the address they sent it to before telling him that it was incorrect ) Letter supposedly offered a settlement by XXXX/XXXX/XXXX ( which would have been 6 years since last payment ) Today he first offered the $ XXXX again, and when I explained that was not possible to pay today he put me on hold for several minutes while he " talked to the attorney '' and came back stating that he had two offers for me since it was the end of the fiscal year. He offered a 20 % settlement of {$3000.00} if {$300.00} was paid today and the remainder by XXXX/XXXX/XXXX. Or a 10 % settlement of {$1500.00} if paid in full by 6 pm today. I had him verify the full amt of {$15000.00} which I was told included all fees ... which he said did not include late fees or attys fees and if I went to court it would be a lot more. XXXX XXXX said he would email both offers to me so I could have the offers in writing. He also informed me that they could garnish my husband 's wages ( told him I 'm not married ) if I chose to go to court over this. When I explained that neither was possible, but that I could pay {$100.00} today and possibly the remainder in XXXX or XXXX XXXX he began to get very hostile and rude. He suggested that I swallow my pride and either get another loan, or ask someone for the money, or I would be served within 24 hrs at my place of employment. I told him it did not make sense to go into debt to pay the debt, and I was not willing to do that when I could make payment arrangements with them. Finally, he yelled at me that " this is how much I care if you can pay or not! '' and hung up on me. After doing research I know that the statute of limitations for this debt in both GA ( where I lived when assuming this debt ) and in XX/XX/XXXX ( where I live now ) is 6 years from last payment which was before XXXX. Therefore this company can not sue me for this debt as the statute ran out in XXXX of this year and they are continuing to do so.
