This Report complaint have been update from original send from this website CFPB on XX/XX/XXXX. YOUR COMPLAINT create on XX/XX/XXXX I have been victimized by illegal debt collection practices from the company name is ADIR international LLC DBA as XXXX XXXX. I receive a mail offer to apply for their credit card. Application was approve via online The Reference account I am disputing specific a creation of sub account or second account in addition to the main account that was create from an online purchase. During the purchase there was not any indication that the purchase made will have a different contract agreement and payment plans. During the checkout there was no indication nor there was any information from the receipt of purchase printout. This additional account was create without my consent the term of this account have monthly fix payment amount. It was when I receive the bill that I notice that one of my purchase was under as sub account with fix monthly payment the remainder of the other purchase I have made simple monthly base on the balance which then is how the monthly minimum payment is calculate. To my surprise the amount on the bill was double of what I was expecting, an amount twice as much the anticipate amount, if I would have been informed which I was no, I will have not have made the purchase. What I have purchase was base on my monthly budged amount. What is misleading is they never mention nor during the process of purchase no during the finalization of the merchandise because of having this not be presented nor did I have sign any other documents reflecting the creation of such sub account with or under different term. If there was a condition then the time to present this to the buyer would have been during the checkout or prior the purchase become final then that should have been the time to present it, but that never happen. In conclusion because of that along the fraudulent information provide to the credit bureau destroying my credit file score on a monthly base, is spite that I try to establish a payment plan but they never when forward with it, but they were ruining my credit file and it was done with knowledge with the intention to so, no there where not trying to collect a debt. This are the main reason of this complain which I will continue to explain on this report in the must simple clear and precise way I can. Is important for to say I did not apply or have consent XXXX to create any new term if such term were part of this contract it was misleading marketing. Regardless I did not consent for that I have requested for documents supporting this term before I could have made my point to dispute with creditor they never provide me with one, no providing one because technically there was none. To this day I have not received any documents in spite of countless of time I have requested. The request was made by mail, phone call and by using the internet costumer service. I have kept proof for supporting my inquiries for the claim in dispute. Again not proving me with any type of anything with a sign contract will have been invalid. With not prove of the term there can not be a claim and to demand a different payment amount which I never agree with, and when trying to return merchandise was, base on their policies was passed the time frame for return merchandise Like to further clarified I was disputing the purchase or the account itself, but I was disputing the validity of the term I was forced without proper documentation to support of such term The account was market as credit revolving account the minimum payment was base on account balance, for my understanding this credit card was structure like any bank credit card. Under the contract that I read there was mention very briefly a sub account but nothing in term of specific. Other than you need apply or ask for it or be offer to you by XXXX for that type of line as an addition added to the account, so was something that would have happen automatically. Made countless request to return merchandise as a way to resolve the matter. That was not possible they keep giving me some irrelevant excuses. So on their mind I have broken the contract when in reality they have breach the contract and they are not seeing that. In any contract both parties have obligation and they felt with their obligation by not keep accurate update information to costumers, but they claim I was the one that committed breach of contract which let this account to collection. Regarless of trying to come up with a payment plan, they refuse it and insist to pay an amount that was not possible which is the point to this dispute, but then using the credit reporting as a tool for their iligal practice constantly breaking the law. Shame on them They declare the account in default as a charged-off and reported to credit bureau which they have intentionally provide false information such as account balances , lane of credit passed due amount, this information was change monthly with the intention to ruin my credit file, in spite that when reporting a charged off account is one time reporting, but instead my credit line have increase on a monthly base, as well the amount own. In doing so they in violation of The Fair Credit Reporting Act. XXXX then file a fraudulent lawsuit against me in a small claim court which is where all this got very complicate and is were XXXX has violate the law in several aspects. They never notified my as is the normed they lie saying that I was serve document for the court case, that was not true. The file a small claim with misleading and false information including the amount own and main reason for the lawsuit. I learned of this lawsuit when two weeks before the trial I receive a letter from XXXX saying they have file a lawsuit, the letter state the case information, date and court. With such short notice I did the search online about the case with the court and there it was. I did call XXXX again trying to get some mutual agree and to tell them that I have knowledge of the activities they were involve when trying to recover account in default. I manage to have the case be dismissed which the judge dismiss the entire case for lack of evidence and for XXXX not been present. They lie by saying will request the court to have dismiss the case, another lie. They never did So this complain is to have someone to further look into this as I think is a serious matter an there is a strong evidence of wrong and illegal practice when collecting debt. There is need for immediate resolution is warrant, this should not be allow period. Is my obligation for reporting this to you ( CFPB ) that monitor and address to who/whom is and when committing illegal activities. I consider what they are doing under the current law and is view as fraud. Let alone all the modification they have created in alleged account in dispute when reporting information to credit reporting bureau ( XXXX-XXXX and XXXX ) The also File a case in court with the small claim court and here is where everything gets complicate in term of what I have found this company is doing wrong and it needs to be investigate which is my hope this complain will accomplish to the discovery what this firm have been practicing for quiet sometime to many of their client that they have offer credit lines with the intent to damage costumer credit profile among other things file fake document representation. They presented fake license representing the firm when they file case in court misleading information. I responded to the allegation by presenting to the judge relevant important facts for the judge to have dismissed the entire case with prejudice which was the conclusion the judge have made on the case. I dispute and report to the credit bureau agencies the validity of their report toward my account with them, but I got not support from the bureau to resolve the matter. They conducted no proper investigation. I am in the process to report then for lack of responsibilities and to be in compliance of their obligation were not practice when responding to the credit bureau from my demand to verification of the account validity with the credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is. They have intentionally damage my credit file month after month in a blatant an unashamed behavior putting on and off false information as account balances own opening date of account they have re-age the account every other week making my credit score to drop tremendously. Every trade line in the account was wrong. It was clearly done intentionally to further damage my credibility They try to intimidated me and I let them but now after I have learned and I am well aware of what my right are. It will be irresponsible of me not to use it in spite of the current laws is clearly that it did not provide sufficient restraints to then as to follow the rules as a way to practice their obligation they are furnisher of information to credit reporting agencies when reporting is to be accurate and true full information is a must, as is their obligation to do so and they have fail to obeyed the law

VIOLATION of FCRA and the FDCI The purpose of this letter as I have explain to you over the last phone conversation we had is to advise you that XXXX have engage and conducted in reporting this to your agency as well as other credit reporting agencies Is unfortunate that because of their action and in the way they engage my credit file and score file have taken a bid dip since this has been going on for over a year now. I have included all documents relate to each violation that took place, as your review them you will quickly learned that none of that should have taken place to an account that is listed as a charged-off. Violation ( 1 ) Intentionally Reporting Inaccuracy XXXX XXXX XXXX XXXX department have failed to provide accurate account information and verification disregarding the rule on what can, can not be done ones the account is a charged-off therefore several violation have taken place, because of each act each this took place damage my score Violation ( 2 ) of Fair Credit Reporting Act and Federal and State laws From XX/XX/XXXX XXXX made changes which should have happened because of status to which the account was Charged-off Code of Federal Regulation E Regulation 1026.5 ( b ) ( 2 ) ( I ) Statement Required. If the creditor has charged off the account in accordance with consumer credit account-loss provisions and will not charge any additional fees or interest on the account, fees that it is unable to collect when determining the appropriate fee amount. Fees that the card issuer is unable to collect include fees imposed on accounts that have been charged off by the card issuer or if furnishing the statement would violate Federal law. Violation ( 3 ) for Later Fee and Finance Charges 1. This process, referred to as " purification, '' follows generally accepted accounting principles ( GAAP ) .9 For example, suppose a cardholder stops making payments on an account with a {$1000.00} balance that is current in XX/XX/XXXX. Six months later, with the accrual of late fees, over limit fees, and finance charges, the account holders balance will have climbed to {$1300.00} Before charge-off, the issuer subtracts the {$300.00} in uncollected interest and fees from the balance and reverses these amounts against the appropriate revenue line items. The Federal Trade Commission - The Fair Credit Reporting Act Mandate If creditor report information about a delinquent account thats after reach 180 of no payment, under such is require to follow regulatory requirement an write off as a lost in your books will need to be reported as a charged to profit or loss, or subject to any similar action, you must, within 90 days after you report the information, notify the CRA ( credit reporting agency ) of the month and the year of the commencement of the delinquency that immediately preceded your action. This will ensure the CRAs use the correct date when computing how long derogatory information can This has created permanent damage ongoing since the moment it started regularly and continuity which has a mayor effect on credit score file is counted as a violation each time it was recorded, each violation the number of time and the severity to the damage. This type of behavior is consider irresponsible and is no allow under any circumstance period the fact that this has taken place countless of time ( See attach documents which demonstrate and it was record each time with the credit reporting agencies, it will be hard to say and to prove that it was an error when the records prove otherwise. Please be advised that continued reporting of this account to the credit bureaus after you have been notified of the violation that have not been cure, is considered a violation of the state and federal laws in accordance with FCRA AND FACTA. Please advise the creditor to not sell, and/or transfer information about this account with any other entity after been found and now is officially recorder. The reason for this letter is to put in record for there is some conflict, as what the nature of my complaint with the nature of the current lawsuit or litigation which XXXX XXXX XXXX has been assigned On the matter XXXX XXXX XXXX has combine two complaint into one complaint which is irrelevant to what has been my request all alone. I am surprise for their conclusion and affirmative and the only correct answer which undermined my right of my genuine request for resolution. Not having have a fair course of action where you will need to hear the other side which suggest base on your accusative and unethical allegation which again under mind the nature and my rightful right for that. No having have a proper and accurate investigation, which to this day there has not been any respond from the party which the demand was requested before your firm was assign to represent them. As in this case you are responding to the CFPB to a complaint I have file which if you have read it, it clearly stated what is that I am asking for XXXX to respond and to correct, I am not making false accusation, If they have responded accurately which they have not responded at all, but if you can proof they have then why is not show they have? I was incline to respond to your letter as CFPB is not a court to determine or inquiry who is right or wrong, but I believe their purpose is policing weather or not a firm, is conducting as the law is in place for that case I am not disputing the account not to be mine to the contrary, I am disputing the information which you dont mention on your letter. In order for this to start accurately for your firm to get a grip You and I will need to establish what the nature of the problem in violation is and your firm will need to provided or have the answer to the following so that we can go forward here they are 1. Date when account was reported to the credit bureau and became a charged-off account? 2. When the account was reported closed? Date and month? It should be the same time when it was charged-off 3. What was the balance on the account? 4. How was the balance calculated? to affirm the accuracy 5. When was the first data date reported of delinquent was reported? 6. What was the credit limit on this account before becoming delinquent? 7. What months the creditor have on their file, date and months, was that reported? This is asking no when I say I paid is what records do XXXX have that has been confirm a credit to the account 8. Account type? Meaning one owner, joint account, authorize user if any? If you think that what I am asking is no between XXXX responsibility to respond then please put it writing, but they have respond to that, and in order to put and end to this so that this can get resolve your client is required to respond, again I am not disputing the account itself of the charged off result what is ask is how all the question that are ask for their records, I am requesting that because Two factor and is for an account that is reported Charged off on is a one time reporting unless there is any changes, but changes as balance amount, credit limit late payment amount payment due does not change, it should remain the same, again unless payments are made the account gets update. The second factor when a charged-off account following the first report as a charged-off anytime after that that there changes to it is what is call manipulation to make the event as very resent therefore each time that takes place is not consider accurate reporting as you claim they have and are when reporting account to credit bureau, what that does it making score lower and lower, and that is what they have done for quiet sometime. The intention of credit reporting bureau is no intended for that type of reporting and revenged if an account have not been paid or was paid. As you can see my complaint has not relations to the current lawsuit against your client and you see that this was no event presented on the declaration either This is what I have ask for XXXX to confirm with me, is not that the account is not mine, there is more to it and has long as this in not clarified then they are in violation of the account been reported and why because it is documented with the credit reporting bureau, the activity on this account that is permanently record which I have record but you can confirm that with them, considering that you have accuse me with perjury either way XXXX still need to correct this, but because they reported in many many times with intend of ruin my credit file by changing the date which I will attach documents for your review I am not disputing it, but there should be a date when that took place and that date does not change. On the morning of Friday, XX/XX/XXXX I was notified by the company that I needed to make my minimum payment due on my account. This was very confusing to me as I had a XXXX balance with them because of credit protection that is offered through their company for XXXX XXXX and within the last two months, my account was to be closed and, XXXXXXXX XXXX because of my total XXXX. So I contacted the credit department at the company to have them tell me that I had multiple purchases on XX/XX/XXXX XXXX XXXX When I inquired about those they notified me that there were five different online transactions made for a total of {$1200.00} or so. I then for several hours tried tried to reach out to their customer service to no avail, and have this all recorded. The customer service representatives were very rude and unwilling to help me get this resolved even though I mentioned to them multiple times, about seven times, that they were fraudulent purchases. I finally was able to get a hold of a sup named XXXX XXXX who helped me get some information together, and stated that he would make an escalation to the customers executive relation team with the office of the vice president. And that he would notify the fraud department that this was all fraud. During that phone call, the supervisor was very helpful and helping me find out some more details about the XXXX transactions that took place. I then notified him that on XX/XX/XXXX. I had received a text message from their company saying I needed to provide a XXXX notification code for the online orders. And how I called customer service and the customer service representatives told me just to ignore that that there mustve been some mixup that it was nothing to do with my account. When I checked later in the evening on XX/XX/XXXX. There were no orders on my account so I had no further concerns. I then also notified the supervisor that on XXXX XXXX I received a text message saying they were processing my order and I called his customer service again to inquire about that and I was told again by the representatives that day that I had no orders on my account. I also have attached screenshots From my account showing that there are no purchases of mine. While talking to the supervisor, he provided me the shipping information for the orders. And to much my amazement they were sent to a hotel in XXXX XXXXXXXX XXXX. A location that is seven hours away from my home. So while I was on the phone with him, I contacted that hotel, which is a XXXX XXXX XXXX XXXX, and spoke with a assistant manager, who had stated that they received multiple of the shipments that were sent and refused one of them. I relayed this information to the credit company, and even the supervisor was shocked to learn the details. He said that it was very obvious. These were not purchases on my account has even the information from the website such as email address used was not mine. All of these phone calls were very carefully recorded on my behalf, so that I have proof of how XXXX this company has treated me during this process. Later in the evening on XX/XX/XXXX I reached out again to customer service to get further details for the fraudulent transactions. A representative was very kind to help me and provide me with the order numbers, the tracking numbers for the orders, the items and the cost of the items as well. Even that representative was shocked that the order went through because there were many red flags to her as well, and why they shouldnt have been placed or sent. The orders were placed through the companies, website, and details that shouldve been red flags for the company were ignored by them. And they sent Knott one but six different packages to an address that is not remotely close to mine to a name that is not mine on the account, and to an email address and phone number. That is not even mine. The evening of XX/XX/XXXX at around XXXX XXXX a very rude representative by the name of XXXX contacted me from the companies fraud department. I stated to her all of the information as well as the police report number from me, filing a police report with my local police department, and she told me we dont care about a police report and started telling me a bunch of stuff that they want me to do which I am not required under any law to do or provide them. I provided them a very detailed statement, and even more information than I needed to buy tracking down where the items were sent and who possibly did the fraud. It is very apparent that it was somebody with this company that committed the fraud and they just want to try to cover their tracks so that they dont look like they had a date of breach which they obviously had. The hotel did confirm that somebody picked up a few of the packages on XX/XX/XXXX but did not pick up one other package. The hotel has confirmed that it was not me who picked them up and I have tried to relay this to the credit company but they absolutely refuse. Over the last five days, I have tried repeatedly to reach out to the fraud department with this awful company to no avail. This is on my credit report, and it is affecting me greatly. I have notified them that they will be liable civilly for any detriment that this causes, since they are refusing to help me with this. I have sent them a statement with all of the events and information and they are asking for more stuff from me, which I am not legally required to do. They just dont want to do the job themselves.

On XX/XX/XXXX I placed on online order with XXXX using their credit card for a cell phone. They sent me an email stating that my item had shipped and that I would receive my item by on XX/XX/XXXX by XXXX. However, a few hours later XXXX sent me an email stating they could not deliver the item to me on XX/XX/XXXX because only the shipping label had been created and they had not received the cell phone. I called XXXX to confirm this. I emailed XXXX customer service and called a Mr XXXX in the Escalations department as well. At first, everyone I was dealing with kept insisting the item had shipped. Mr XXXX " looked into it '' and finally agreed the item had not been shipped. However I was charged {$870.00} when I placed on the order on the XXXX. In light of this, I asked if he could just arrange for me to pick up the item as their main store is a few blocks from me. He stated he could call me back. Then, I began getting emails from XXXX XXXX in Customer Service. She advise me that the item I wanted was out of stock and asked if I wanted to wait for it or cancel the order. I responded that I wanted to cancel the order. Then she wrote back that item had shipped and she could not cancel. How can an out of stock item be shipped? We went round and round and I kept insisting the order be canceled and the charge be taken off my account. She finally agreed and said they would honor my request for cancellation. She asked for some information and I never heard from her again. I attempted to reach her two more times but I was ignored. In the meantime, I was still speaking with Mr XXXX. I had asked repeatedly for my order to be cancelled. He started promising to call me back but did not on two occasions. The last time I spoke to him on Friday XX/XX/XXXX he suggested I drove 20 miles to another store location and pick up the phone. I got very upset, explained I do not drive and did not want to do that. I again asked for the charge to be taken off my account. His entire demeanor changed because I didn't want to do what he wanted me to do. I again asked for the charge to be taken over by account and an email confirm this. I asked that it be done by close of business to which he agreed. It was not done. I checked with XXXX again and found that XXXX cancelled the shipping label. Yet the {$870.00} charge still sits on my account. I even gave them a few days to comply before filing this complaint. I have documentation to substantiate this entire account of what happened. I have no faith in them as an ethical business anymore. I have been in good standing with them and deserved far better treatment than this.

XXXX XXXX is reporting a chargde off account on my report incorrectly. It opened in XX/XX/XXXX and the last payment was XXXX.It was a toy car for a kid. The item immediately broke andthey refused to honor the warranty for the defective merchandise. I returned the item to thestore to be fixed and they kept it. Now they are illegally re-aging the account trying to showthat the account is constantly 90 days late every month since then to hurt my credit eventhough this has charged off over almost 6 years ago. The credit report erroneously showsthat that the account is 90 days delinquent every month since XX/XX/XXXX. It also shows thatthe account closed in XX/XX/XXXX. An account can not be closed and be late every monthand be charged off all at the same time. This account is hurting my ability to obtain fair andreasonable housing and I am seeking the advice of counsel and the fair housing authority. I have already submitted a complaint to the CFPB about this exact issue stated above and it was closed by the CFPB after La Curacao responded and denied that they were illegally re-aging the account. In their response they attached a XXXX accounting report showing that the account was closed in XX/XX/XXXX. The reason why XXXX does not show any 90 day late payments or the account being derogatory is because the derogatory account is reported through XXXX and NOT XXXX.I do not even have a XXXX score assigned to me from XXXX. I believe La Curacao is either intentionally or unintentionally trying to mislead the CFPB into thinking that the account is reported through XXXX and not XXXX by only providing information from a single bureau. The CFPB closed that complaint wrongfully without fully investigating what credit bureau it was coming from so I am creating a new complaint in hopes to get fair resolution to my issue. I am attaching an image of the derogatory account from a credit report that was pulled on my behalf. It quite clearly shows that the account was closed in XX/XX/XXXX. It also shows a list of all the 90 day late payments from XXXX which again is impossible if the account was closed as a charge-off in XX/XX/XXXX. It also quite clearly shows that XXXX is the bureau responsible for reporting and NOT XXXX. This can be confirmed by XXXX if need be. I hope this is thoroughly investigated by the CFPB this time around to resolve my blatantly obvious credit reporting issue.

I first received a notice of a new account appearing on my credit report in my name on XX/XX/2022. I then checked my credit report and a new account had been added but from a company I had never heard of. I sent an email to the company ( Curacao ) regarding this fraudulent account but never received a response. On XX/XX/2022 I received an invoice in the mail from Curacao and on XX/XX/2022 I called customer service and spoke with XXXX at XXXX regarding my issue and she stated that she had started a fraud ticket and that the fraud department would be in touch with me. While waiting I froze my credit accounts and also sent a dispute letter with a copy of the invoice via certified letter on XX/XX/2022 and it was received on XX/XX/2022. But I received no response. I then received a physical credit card in the mail from Curacao and I then called customer service and spoke with XXXX on XX/XX/2022 at XXXX am where he told me that the account had been blocked and not further purchases could be made. I then inquired where the actual fraud took place and he told me at their store location in XXXX, Arizona. I filed a police report immediately with the XXXX Police Department regarding the identity theft and it was approved XX/XX/XXXX. On XX/XX/XXXX I was then contact by XXXX regarding the disputed account and both XXXX and I both spoke with XXXX, the fraud analyst from Curacao, on the phone. She informed me that she would be sending an affidavit that I would have to fill out and get notarized so she could further investigate. I received the affidavit on XX/XX/XXXX, but she also required several other documents in order for the claim to be further investigated. On the letter it stated that, " You must respond within the required time frame, or our company will consider that you accept full responsibility of this debt. '' I sent the forms required on XX/XX/2022 and they were received on XX/XX/2022, why weren't all these forms required when this account was opened in my name? I sent an email to XXXX on XX/XX/XXXX regarding the certified letter that I sent and she responded saying that she would follow up once she received the certified mail. I sent another email on XX/XX/XXXX and I have not had any emails or voicemails from XXXX.

On XX/XX/2021 @ XXXX XXXX ( PST ) I the natural person/consumer spoke with a customer service representative who identified herself as an employee representing the entity operating as a debt collector that goes by the name " XXXX XXXX XXXX dba XXXX '' I demanded on this date that this company cease all communication in regards to this alleged debt UNTIL the company was able to provide me with legal notarized validation of this alleged debt. The representative agreed and the call was ended. Please note that these calls are " monitored and recorded. My name is XXXX XXXX a federally protected consumer, and I am making this complaint against CURACAO for committing identity theft. I have never given CURACAO any permission to use any of my identifying information to commit mail fraud by contacting me about an alleged debt they claim I owe. I am aware that the that in accordance with Article 9, the assignment of a defaulted note is illegal. Both the assignee and the assigned are both liable for violations under 15 U.S. Code 1692e ( 12 ). I have never received any documentation requesting validation from CURACAO before they committed multiple violations under the FCRA and the FDCPA by furnishing this alleged debt to my consumer report including but not limited to 15 U.S. Code 1692d ( 4 ) which the FTC defines as debt parking. If CURACAO can not provide me with proof such as a tracking number that they attempted to lawfully validate this alleged debt with me, the consumer, prior to furnishing it on my consumer report, this has been a fraudulently furnished account with forethought and malice as an attempt to bring harm to me and my financial reputation. I am legally refusing to pay this debt pursuant to 1692c ( c ). To whom it may concern, For several months I have disputed inaccurate reporting to all 3 major CRA'a ( XXXX, XXXX, and XXXX ) regarding a company called Curacao or La Curacao. Curacao is the original creditor in this matter. Curacao charged off the debt and sold the debt to a collection agency in the XX/XX/2016. The collection agency that owns the debt and reports to all 3 major CRA 's is listed as XXXX XXXX. I've never received anything from XXXX XXXX, but I know this from reviewing my credit reports. The issue is, even though Curacao sold the debt to a collection agency, Curacao continuously reports a balance due and past due balance to XXXX, XXXX, and XXXX. To my knowledge and research, once a debt is sold to a collection agency, the original creditor may not report a balance to the CRA 's ; they would have to report balance as XXXX ' XXXX since the collection agency is now reporting the balance and collecting the debt. Every time I have disputed the inaccurate information to all 3 CRA 's, Curacao responds that the information is accurate. So now it's double jeopardy on my XXXX, XXXX, and XXXX reports. The same debt balance is reporting twice. Also, Curacao, on several occasions, has reported different " current balances '' ( they fluctuate the balance ), and they also periodically change the credit limit on the account ( the account has been charged off for 4 years and was sold 4 years ago to collection agency ). I have called attorney 's for legal advice and know that Curacao is inaccurately reporting. This has caused a lot of stress and anxiety to me and has caused obstacles in my life. In early XXXX I became aware of an ongoing identity theft and fraudulent debt issue against me when my legitimate XXXX Credit Card, which was in good standing, notified me that they were drastically decreasing my credit limit. When I got a credit report to investigate the unexpected issue, I discovered there were several delinquent credit card debts in my name, with my Social Security Number that I had never opened or were aware of. Some of them were fraudulent and in good standing, most were delinquent and one of them was already in collections. An account was opened in my name under La Curacao on XX/XX/XXXX in the amount of {$1000.00}. I contacted XXXX and XXXX credit reporting companies several times in XXXX and received a credit report with my legitimate and fraudulent charges and sent in paperwork to contest the fraudulent charges. They notified me that what I claimed were fraudulent charges had been verified by them as charges made by me. However, the fraudulent charges on my report are apparently being made with my actual Social Security number and from a person using my name and a middle initial, which I don't have in my Social Security record. The addresses associated with the fraudulent charges are not the same as my actual address where I currently live and have worked from for more than 10 years. While I worked to resolve this, I asked that the credit reporting companies freeze my credit in XX/XX/XXXX, which they said they could and would do. However, two more fraudulent credit charges were made after that. That is where the matter stands now and why I am contacting your agency.

On XX/XX/XXXX I noticed there was an account on my credit report that had missed payments. I did not open this account. I called XXXX and opened up a dispute stating that this debt is not mine because I did not open the account. The account was under a company called CURACAO, which I have never shopped with before. I have never opened a line of credit with CURACAO. After submitting my dispute with CURACAO, I called the company to see if they could assist. They were unable to locate any account associated with my name or address. This was alarming given that the account was still filed under my identity. The credit report only gave me a partial account number which CURACAO said was not enough to pull up any information regarding the late account. CURACAO stated they would send me a packet of information to fill out and return to them to assist, but they never did. Two weeks later, XXXX updated the dispute and stated the account was mine ( as stated by CURACAO ), and dropped my credit score due to late payments. I called XXXX back regarding the dispute, and they stated that I didn't identify the account as identity theft, stating that I only mentioned the account wasn't mine. XXXX advised me to register a report with the FTC regarding identity theft. XXXX also stated that there were two accounts opened with CURACAO under my name. They stated one was in good standing, and that the other one listed late payments. Neither of these accounts are mine. I have never opened an account under CURACAO.

Good afternoon, On XX/XX/2021 I paid off my account with CURACAO. I submitted a payment in the amount of {$790.00} as full and final payment ( I called prior to submit payment and I was given such amount by automated system ). On XX/XX/2021 I received an email from my transUnion report showing CURACAO account as paid off. On XX/XX/XXXX, a late payment red flag was added to my credit report by CURACAO. Now, account shows an outstanding balance of {$27.00}. My credit score went down XXXX points on XX/XX/XXXX. I reported the issue to CURACAO. Spoke with XXXX, XXXX, and two other representatives in several occasions and they indicated that it was an issue generated by the system and that they will take care of the issue. As of today, nothing has been done. I called this morning and they said " don't worry XXXX, your account shows XXXX balance now '' I said, " that's not the main issue... the main issue is the red flag on my credit report ... the missed/late payment report caused a huge negative impact to my credit score, which I don't think is fair when I paid off my account before my contract is up '' I asked to speak to a supervisor/manager and they just continued transferring my call to different departments. I'm extremely frustrated and upset. They should be treating consumers with respect, and stop taking advantage of loyal, reliable, and responsible consumers. Very inefficient staff.

Company has placed incorrect info on XXXX Credit Report for XXXX XXXX as late. Late appears on XXXX credit report twice as late for XXXX for same date i.e. XXXX XXXX. Filed Dispute with company and with XXXX XXXX XXXX. Visited company Twice on Sunday XX/XX/XXXX and again on Monday XX/XX/XXXX.Spoke with Representative and agency indicated my account is not pass due for the month of XX/XX/XXXX. After several visits and phone conversations no positive results or correction or corrective action taken to Account. Filed a dispute with company XX/XX/XXXX and was told investigation into matter will be taken and I will receive phone call with results, but no call or results for more than 20-days.I was told I would be contacted at a later date and billing statement would be sent out within 30 to 45 day 's. Billing statement was sent out but mail was returned for bad address reported by company on XX/XX/XXXX. Late charge on report indicates after a attempt was made by mail for billing. Address is valid and has not changed. Called company for follow upon billing and company indicated some information for billing is or was wrong and placed by company. Sometime around XXXX, I became aware that my credit score had dropped significantly. When I inquired as to why, I found that someone had opened an account with a XXXX department store in XXXX XXXX on XX/XX/2022. I never opened this account. I immediately reported this fraudulent account to the company. Their response was " call the credit bureaus and report it, '' which I did. Within a few weeks, the credit bureaus rejected my dispute and claimed XXXX considered the account valid. I filed a police report with the local police department and re-filed the dispute with XXXX. Now, XXXX XXXX XXXX department sent me a letter asking for the following things : 1. I notarized affidavit that I'm not responsible. 2. Copy of my ID 3. XXXX XXXX ( the creditor ) failed to mail me billing statements. Because of this I notified them every month in writing and by phone that I had not received any of my billing statements. The creditor stated that they would be sending out the statements in the mail and that their system keeps having issues with not sending the billing statements. The creditor never sent me billing statements. Because of this I was unaware if I had a balance on my account. I was also unaware if I had a minimum payment due. I did not make any payments as I did not receive instructions on how to pay my bill. The creditor reported my account as late ( delinquent ) to all 3 major credit bureaus ( XXXX, XXXX, XXXX ). After a couple of months/years, the creditor finally sent me a collections notice requesting immediate payment of a specific dollar amount without explaining what the amount was for. Because I did not want negative information on my credit report, I paid the amount that was requested of me. The creditor reported my account as charged off. The creditor violated several consumer protection laws by not reporting my account as current ( never late ) and closed. The creditor does not have tracking information showing that I received the billing statements they were required to send me.

On XX/XX/XXXX and XXXX, 2021 there were hard credit inquiries to my credit report. XXXX XXXX, XXXX XXXX XXXX, and CURACAO. I reported the fraudulent inquiries to each financial institution listed. XXXX XXXX and XXXX XXXX XXXX, have sent me letters acknowledging the fraud. CURACAO has not. On XX/XX/2021, CURACAO opened a charge account in my name. This account was fraudulently opened with a credit limit of {$3100.00}. The account was immediately charged the full amount of {$3100.00}. I subsequently placed fraud alerts on all three credit bureaus. I contacted CURACAO customer support ( XXXX ) on XX/XX/2021 and he documented the information. He stated the account was opened and approved online and two XXXX devices were purchased. He also provided me with the last four of my SS number and an old address that was used. ( Old address is from over 7 years ago ). XXXX provided me with a name and email in their fraud unitXXXX XXXX XXXX I attempted to reach her by email with no response. I called CURACAO back today, XX/XX/2021 to get an update but there is no update. So far, CURACAO has not removed the hard inquiry nor have they removed the credit account from my credit reports. Curacao ran my credit on XX/XX/XXXX and reopened an old account that was last used in XXXX and charged $ XXXX, then ran my credit agin on XX/XX/XXXX. I did not re-open this account. I contacted them but they seem to not care. Ive filed a police report and completed a notarized fraud affidavit with a copy of my ID and social security card so they can see it is not me who re-opened this old account. Ive also filed a complaint with the XXXX I visited the Curacao headquarters in XXXX on XXXX, but the fraud investigator did not want to speak with me and the people there did not want o give me her name or email or phone number either. What kind of business is this that re-opens old accounts fraudulently? Ive explained I didnt re-open the account and the address they have on the account is in XXXX XXXX CA Ive never lived in XXXX XXXX Also the phone number is a XXXX area code and Ive never had a number like that. I gave Curacao a copy of my utility bill so they see where I live. I dont know what else to do to get this account closed and the address removed from my credit report. I contacted the company XX/XX/XXXX & XX/XX/XXXX ' XXXX to dispute this account as a fraudulent account not belonging to me, after receiving a alert from my credit union that this account was opened in my name and showing up on my credit report. The account was opened XX/XX/XXXX. I didn't open this account and had no knowledge of this company. I disputed this account with all three credit bureaus as well as notified my bank. When I called the company ( CURACAO ) directly as noted above, they refused to talk to me, as my information/phone number did not match that of the account. Well wouldn't that be a possible indicator of fraud? Now the card holder is delinquent on her account, that's being reported on my credit report and it's causing my credit score to fall. I do not get any correspondence such as billing ( The bill does not come to my address that I've lived at for nearly 18 years ) due to this not being my account. Not only does my phone number not match this account, neither does my address match this account. Because it was obviously opened by someone other than me who did not have my phone/address information.

Curacao issued credit in the amount of just over {$1000.00} to an individual using my social security number. The name and the address did not match mine, and a credit history was never run on my credit. The debt was not payed and I did not learn about the credit issued until a judgement of a charge off was entered on my credit report. When I contacted the company, the fraud analyst, XXXX XXXX, asked me to complete a fraud affidavit, notarized, which I did. She asked me to send a copy of my driver 's license and utility bills, which I told her I would show her in person, but not provide a copy of. She declined citing " covid '' concerns, even though we are in XXXX of 2022 and mask mandates have been lifted in XXXX XXXX, and her store front is open to the public. This company is issuing credit without running social security numbers to check for a credit freeze, which my credit has. This is irresponsible. On XX/XX/XXXX I opened my first credit line with Curacao and purchased a laptop with my {$700.00} credit limit from XXXX I paid the laptop off and never missed a payment. In XX/XX/XXXX I was being charged without my consent from Curacao apparently for a virus protection program I never agreed to. It was installed for 12 months free and charged me without knowing I had it on my laptop. I have noticed that this company had begun and continues to incorrectly report an account as derogatory and 30 days late exactly one year from settlement. I called this company multiple times since XXXX to correct the issue at which point they acknowledged there was something incorrect on the report and advised me it would be fixed and updated. At this point the reporting continues to be done incorrectly and no attempts to correct the inaccurate information from them to my reports have been made. On XX/XX/21 my car was broken into and thieves stole all of my identification, my passport card, social security card, debit and credit cards. Called Curacao Thursday XX/XX/2020 to complain about inaccurate collections reporting on my credit bureau. Said they couldn't do anything. Then turned around on XX/XX/2020 and updated my XXXX report to 119 days, or 4-5 months late. This account was never late on minimum amounts due, and is reporting also 30 days late and 60 days late. Also reporting installment account, incorrect amounts and incorrect terms, when this is a revolving account that has been closed for a while, plus I requested to close the account, not the grantor.! Back in XXXX I went to collections for a minimal fee at Curacao. I think it was for a dollar. It's been paid and when I get my credit report the report says that it's been " closed by credit guarantor. '' It also shows pay status as " PAID IN FULL '' however, it's still popping up on my credit report.
