Under 15 USC 1681 of consumer laws, a company must adhere to certain guidelines when charging off an account and reporting it to the IRS, as well as reporting late payments. If an account has been closed and charged off, and a request for a 1099c was made, the company must comply with the request. Additionally, if the company has put the account back on the consumer 's credit report without authorization, this may constitute a violation of the Fair Credit Reporting Act. Only authorized credit reporting agencies may make such changes to a consumer 's credit report. In this case, it appears that XXXX and XXXX has acted outside of its authority by putting the account back on the consumer 's credit report. The consumer may have grounds for disputing this information with XXXX and seeking its removal from their credit report under the Fair Credit Reporting Act.
