I applied for a mortgage refinance. I understand that this process will create triggers that other lending companies pay for to send other offers to entice me to go with a different company instead. I received many of these letters. There was one in particular that was not easily identifiable as an alternative loan pre-qualification offer. It does not have the name of the company at the top, and the wording of the offer makes it seem like I need to call this company as there might be something wrong with my existing refinance application. " We have important information regarding your mortgage loan and a new monthly payment option ... It is important you call our Loan Department ... '' Although all of the fine print at the bottom is similar to other offers, this offer seems somewhat predatory in nature. I found the name of the company providing the offer at the bottom of the letter : Activus Home Loans, XXXX XXXX XXXX XXXX XXXX, XXXX, CA XXXX. I am not a customer of this company.

I am a mortgage originator and have been for almost 15 years. There is a Company Activus Home Loans that is using misleading marketing materials to my clients making them think it is coming from me. I have had over 10 calls from clients that have said I sent them something regarding refinancing which I never sent. One of my client sent me a picture of what it was. On the very top it has my companies name.. on the bottom footnote in tiny writing it does have a disclaimer stating not to be affiliated with my company, however where the problem lies is they are putting our company on very top in larger font than what they have their company name at. Very misleading for consumers.. I believe they are purposely misleading by the way they have structured their marketing material..

I receive nearly every month letters from XXXX XXXX XXXX. These letters are intentionally designed to appear as though they are coming from my current lender and make it sound like I urgently need to contact them about my rate. There is no mention of who the letter is from anywhere in the main text of the letter. It is only at the bottom in the fine print that it is disclosed. Fortunately for me I work for a financial institution and know where to look in the fine print to identify who the company is sending me this letter. Others have likely been fooled. This looks like a deceptive banking practice by a mortgage lender.
