On XXXX XX/XX/XXXX - My mom XXXX XXXX and I looked at a home built by XXXXXXXX XXXX in XXXX TN XXXX XX/XX/XXXX I looked at the house again XXXX XXXX stated they had to write up the contract since it was on a builder contract and would not use the TAR form ( contract created by the State of TN ) and they would not let XXXX or I write it up, we are TN XXXX XXXX. XXXX XXXX XXXX XXXX XXXX also said it was mandatory to use their lender and that it was their preferred lender. XXXX told him that she wanted to use her preferred bank, he stated it was NOT allowed. Being a XXXX, we are supposed to suggest at least XXXX banks/lenders if we recommend one to a client to prevent any bias. We did reach out to their bank " Accurate Mortgage Group '' and spoke to XXXX. XXXX explained her income, bank statements, XXXX 'S, rentals, XXXXXXXX XXXX XXXXXXXX XXXX that she does part-time. I also explained my situation regarding credit, divorce and income, as well as that I had no where to go because my home sold and that the buyers would not allow an extension. I explained that my kids would have to stay somewhere else than me while we work this out since they did not meet either of their closing dates, on or before XX/XX/XXXX and XX/XX/XXXX. My mom told them she did not want her credit ran till they could confirm yes or no for financing based on documents that she and I submitted. I sent a text also stating do not run the credit until all docs are viewed. We submitted everything in writing on XX/XX/XXXX regarding all finances, bank statements, lease agreements, loans, a home that XXXX purchased and notified the lender that this home was under an extensive restoration job. She also explained that her bank account held that money for that job. That they could see the money, but do not account for that on closing. She told them that had {$45000.00} to put down and that was the only amount that she could pay for closing. She had contractors that had to be paid with the other funds. They said she was approved for a XXXX percent loan. That she only needed XXXX percent down. She told them that she had {$45000.00} down and that she needed the payment to be at or under {$2000.00} because this home was going to be my primary residence and that is what I could afford to pay due to divorce and paying bills alone. They said that yes they could help us based on reviewing her docs. Then they ran her credit, and said it was good which we told them what her scores were based on online apps. She got a disclosure stating it was {$24000.00} in closing cost with an XXXX interest. XXXX contacted the lender and argued this amount/interest rate. They changed it to a XXXX interest rate and said that was the best they can do. She called her personal bank and asked about their rates, she informed the listing Realtor that she was going to use her bank, but he stated that she could not do that and that she had to use their preferred lender. Accurate XXXX contacted her and asked why she was contacting her own bank and then was informed again that she could not use her own bank and had to use the lender referred by XXXX XXXX.. A buyer can use whoever they want when making a purchase, there is no requirement to use a specific lender. After this argument with their lender, they went back and gave me a XXXX interest but it was never printed on a disclosure/documentation. The closing cost & appraisal cost of {$1600.00} and XXXX argued that down to {$600.00}. XXXX did not agree with the terms, so they will not approve the loan and they will not deny her either. Accurate mortage lied, they never had a XXXX interest rate, XXXX XXXX stated they will withdraw the contract, XXXX stated to them that they do not have permission to withdraw it, that they are to approve it with agreeable terms that their lenders XXXX and XXXX. The next problem is that they told her that she had to bring $ XXXX down at closing- and we both informed them that neither of us had that kind of money. XXXX called me and stated that the loan was denied then backtracked and said that they went another route behind the scenes and got it approved. they never told us it was denied until that phone call. They never gave us a choice to proceed or not if it was denied. If they would have denied it, that would have given me notice to start looking for other housing options as I was limited on time and running out of time. When he told me that the loan was denied and I questioned it, he then stated that she might have to bring more to the table, about XXXX XXXX more and I asked " what if she does not have that? '' as I do not know how much money my mom has and that is frankly NOT my business. He then stated remember that this is a bank statement loan and that's the bad part about a bank statement loan, he can see how much she has in her account and that she had more than enough in her account, so she will not be denied. After we hung up, I called my mom and notified her that he stated at first that we were denied then that he said they did something to get it approved and then made a comment about how she won't be approved because she has enough in her account and more. My mom was very upset about how XXXX handled that phone call, admitting her personal information etc and we made a XXXX way call. Of course, XXXX denied stating that the loan was denied. XXXX denied stating any of this to me. Like I told him on an email, I have no reason to lie about what he says and maybe they should record their calls so they can prove that I was telling the truth. On that day, we made XXXX phone calls to him with follow up questions and trying to get clarification. My mom told him again that she has funds in her account but some of that money could not be touched because it was payment for a contractor.Then he proceeded to tell her that she had to put XXXX percent down plus closing cost, in which she reminded him that she could not do that Unless we use to the commission from my side. They would not reduce the price of the home by the amount of the commission. Without discussion, he tried to get her to waive her commission, instead of taking it from closing down payment or off the price of the house, this also was not documented on disclosures. XXXX did ask the agent why she would do that, it did not make sense to waive commission with no positive intention behind this move. Agent stated he didnt know why they took off commission. One of the problems, Accurate XXXX wanted XXXX to lie on primary residence, she was not going to lie for them or help them cover up whatever they were trying to do. They wanted her to sign papers stating that she will be living there with me and my kids. They asked her to text this info as well so they could have that in writing. She would not do that. Every time I sent them a letter stating it was going to be my primary, they would resend an email or letter in their words. She wouldnt sign it. They lost bank statements, I had to resend multiple times, then again toward the end they wanted more statements that was already submitted. She explained that they already had them and how hard it was for her to keep getting the same documents or more documents from her bank due to location/not local. She paid the contractor, they were angry over that because the money was no longer available for them. They wanted XXXX to go get the contractor money back and put back in the account. She told them no she could NOT go get the payment back from the contractor. She owed this person money and he was kind enough to wait an extra month while we attempted to sort through this situation. The realtor called and she needed to go and get the money back. Do they really think the contractor was going to give money back to her when she OWED him? He would then be taking another risk of not getting paid for a service that he provided. I am asking for a denial letter to get earnest money deposit back on behalf of XXXX XXXX XXXX The XXXX XXXX will not give back due to no denial letter and they would not approve the loan either because they still wanted more documentation. Due to XXXX XXXX, I was homeless for almost 4 weeks. I had no place to sleep. My kids had to stay w/their friends. I had to pay and provide groceries. I had to pay for a hotel as well. Not only did we lose money on earnest money deposit, I lost money by delayed closings, having to pay other people to keep my kids, hotel and food expenses, time in dealing with this situation, time in attempting to find a place to live, lost out on a rental home because of the back and forth with XXXX XXXX. THIS WAS A NIGHTMARE.

I did reach out to their bank " XXXX XXXX XXXX '' I explained my income, bank statements, XXXX 'S, rentals, XXXX jobs, cleaning jobs that I do part-time, I told them I did not want my credit run till they could tell me yes or no if they could finance me, I submitted everything in writing on XX/XX/2022 regarding all finances, bank statements, lease agreements, my loans, my home that I recently purchased with it being done and it was under an extensive restoration job. I also explained that my bank account held that money for that job. That they could see the money, but do not account for that on closing. That I had {$45000.00} to put down and that was it. I had contractors to pay. They said I was approved for a XXXX percent loan. That I only needed XXXX percent down. I told them, I had {$45000.00} down I needed the payment to be at or under {$2000.00} because this home was my daughter 's primary residence since she had a divorce and needed my help. The next thing THEY SAID was ABSOLUTLEY, Then they ran my credit, and said it was good, and the next thing I get the disclosure stating it was {$24000.00} in closing cost with an XXXX interest. I argued with them. They changed it to a XXXX interest rate and said that was the best they can do. My bank i called and asked about their rates, I told the listing realtor I was using my bank, but he stated NO, I had to use their preferred lender. Not even XXXX minuets later, XXXX called asking '' why am I calling my bank? ' I said, " I am going to use my bank '' He stated I am not allowed to use my lender ''. I do not see why any lender or home builder would be ble to justify this. As a buyer, I have all rights to use who would fit for me and my best interest. After this argument with their lender they went back and gave me a XXXX interest but never saw it on disclosures. The closing cost & appraisal cost of {$1600.00} was ridiclous. The disclosures I did not agree with their terms, so they are they will not approve my loan nor will they deny me. Accurate mortage lied, they never had a XXXX interest rate, XXXX XXXX stated they will withdraw my contract, I stated they do not have my permission to withdraw it, that they are to approve it with agreeable terms that their lenders XXXX and XXXX stated. The next problem was the amount i had to bring to the table was {$77000.00} - I told them i did not have that kind of money for down payment. XXXX called my daughter stating I have that money in my account. We did a third way call, I was angry- he had no business telling mydaughter what I had in my accounts without my permission. Then I reminded him of my contractor having to pay, I can not use all the funds that are in my account. Then he proceeded with XXXX percent down plus closing cost. I can not do this i told him. Unless we use to the commission from my side. Next thing i know, hes having me waive my commission, instead of taking it from closing down payment. Waiving commission yet its nowhere on disclosure. I asked listing agent why would i waive my commission and price doesnt go down, or they don't use it for anything? it didnt make since. Agent stated he didnt kknow why they took off commision. If it was going toward down payment, I would had. One of the problems, XXXX XXXX wanted me to lie on primary residence, I woudnt. They wanted me to sign papers stating I will be living there. They asked me to text them this as well. I wouldnt. Everytime I sent them a letter stating it ws my daughters primary, they would resend me aletter in their words. I wouldnt sign it. They lost bank statements, I had to resend, then again toward the end they wanted more statements that was already submitted. I explained to them they had them. I paid the contractor, they were angry over that, They demanded for me to go get the contractor money back and put back in my account. I told them no way, I could go get the payment back from the contractor. I owed him and he was kind enough to wait an extra month. The realtor called and said I need to go get the money back till after closing. This is absolutley absurd! Why would I do this? I am asking for a denial letter to get my XXXX back, this is not right. The XXXX XXXX will not give backdue to no denial letter.

Acopia Home Loans, the loan was schedule to close on XXXX XXXX, 2015, and XXXX XXXX called me two days before the closing on XX/XX/2015, and stated that his company had a conflict of interest because he did my taxes and charged me {$450.00} for an appraisal. Note : XXXX XXXX admitted that he has done other clients taxes and loans through Acopia and never had a problem ... I received a call from XXXX XXXX on XXXX XXXX, 2015, he stated it was n't because of your taxes ... It was because of your self-employment the other clients were W2 's however, I received a denial letter stating a " Conflict-Of-Interest. '' It is believed that I was discriminated against this company due to racial profiling. The Seller listing agent : New Beginning Reality, XXXX XXXX XXXX located at : XXXX XXXX XXXX XXXX, XXXX, GA XXXX, PHONE : XXXX, ext. : XXXX, refused continue with the loan process until I provided a denial with the statement ... The listing agent then said we will continue the process if you allow us to keep the {$1000.00}, I ask him did he talk to the second mortgage guy at XXXX to see if the loan would close? He stated yes ... I was convince and deceived that the loan would close ... the seller initially ask me to put up {$2000.00}, and they could keep if it did n't close ... I refused and ready to walk away ... but they would n't ... I ask the seller just go forward I CA N'T AFFORD TO GIVE YOU MY MONEY ... I 'M A XXXX AND IT TOOK ME 3/YRS TO SAVE THIS MONEY. We were scheduled to close on the house we were selling and the house we were buying on XX/XX/2016. After signing all of our papers, we learned that Accurate Mortgage here in XXXX, TN made an error when approving their client for purchase of our house. They were aware of this on Thursday and that closing could not occur, but they tried to add a buyer to the property we were selling without informing us of the change. On Friday morning we had the XXXX removed from our house, threw away all of our food ( house we were closing on did n't have a fridge ), packed the uhaul, and removed all contents from the house. However, Accurate Mortgage knew on Thursday closing could not occur on Friday. I then spent all day on Friday ( taking off work ) with my title company waiting for Accurate to close. When they did not, we had to return to our empty house with no possessions and wait 10 days for the new buyer on the loan to be approved. Because Accurate did not follow proper closing prep documents, they were unaware they could not fund their clients until the day before closing. Then, they did not inform us and we had everything taken from the house and were forced to wait 10 more days. Our realtor called the Agent and this was his response : " The loan officer for your buyers was XXXX XXXX, pointed the blame towards Accurate Mortgage company procedures as far as not catching the glitch in underwriting sooner, not notifying anyone of a potential issue that could delay closing and of course, sending out the closing package without having the clear-to-close '' Because of their negligence my wife and XXXX year old son were left in an empty house for 10 days sleeping on air mattresses and having to buy everything needed to live for another week. This includes : having utilities transferred back to our name, groceries, clothing, paying to keep the XXXX 10 more days, food, doing laundry at our church, and other stresses and difficulties of living in essentially a vacant house.

On XX/XX/2021 i signed and XXXX XXXX agreement for a home loacated at XXXX XXXX XXXX XXXX loacted in XXXX. alabama XXXX I put down Earnest money to secure the property! the sell was to close and deed delivered on XX/XX/2021! I recieved approval for the loan from acopia home loan XXXX XXXX with condtions of providing documents such as unnecessary things and a gift letter for closing! on i signed loans papers with acopia home loans XX/XX/2021. I never made it to XXXX XXXX in XXXX XXXX for closing but they told me it had already closed! XXXX i did my investagtion and found the loan at XXXX serving where they sold the loan to XXXX XXXX! I have emails and documents to prove what in saying XXXX XXXX at XXXX XXXX told me that if i never got approve it wont never made to the pipe line! I really think acopia homes is doing fruad! I was adviced by exchanged bank what just happen was fruad and they hope i get it solved when i went to cash the escrow check that XXXX XXXX wrote me! Basically, I first of all contacted XXXX XXXX on XX/XX/2023 in regards to a refinance! After several phone calls I finally reached him! After applying I was told by XXXX it was taking more time than expected so I waited a week! Then I contacted XXXX again he instructed me that I had a XXXX score and I needed a higher score! He said if I paid off credit card we could do a rescore and it would push my score up to where it need to be! I paid the credit card off in full! He told me I should have an answer within 24 hours! After several attempts to reach XXXX he told me its taking more time! So I contacted the regional manager and asked if I could get someone else to help me out! Finally I was forwarded to a new person who was XXXX XXXX! So now XXXX instructed me that there were other things showing on my simulator report from XXXX XX/XX/XXXX that need to be paid! I asked why is it XX/XX/XXXX over XXXX weeks later and I had no knowledge! XXXX told me he didnt wan na talk about past stuff lets just move forward! He said can u pay the other stuff so I can run a rescore for u! I said I was told XXXX weeks ago that it was ran by XXXX so obviously I had to start over! So after realizing that XXXX had never done anything I got frustrated and told them I rather just go to another company bc I was not properly informed! Ive been waiting I dont like the treatment! And plus XXXX had been deceptive!

Acopia refuses to correct its record to reflect my correct payment dates. My XXXX and XXXX payments were cleared/received by Acopia on XXXX XXXX and XXXX XXXX, respectively ( which Acopia acknowledged ) ; however, Acopia recorded my XXXX and XXXX payments as XXXX XXXX and XXXX XXXX, respectively, and refused to correct its errors. The reason Acopia gave me is that its prior servicer forwarded my XXXX payment to them on XXXX XXXX and it applied my XXXX payment to XXXX 's balance due. The fact that Acopia changed it 's servicer is not an excuse to record my payments inaccurately. I paid my mortgage payments timely, and now Acopia recorded it as late. Although no late charge was assessed, I can not accept the incorrect recording of my payments, which would probably affect my credit history. I have brought this matter to Acopia 's attention since end of XXXX when I did n't see my XXXX payment on the XXXX statement. Numerous follow-up were made since then. Acopia acknowledged that my payments were received on XXXX XXXX and XXXX XXXX but refused to correct it 's accounting errors : their records are now showing my XXXX and XXXX payments were received on XXXX and XXXX, instead of the correct dates of XXXX and XXXX. Attached are two sets of recent communication with Acopia.

Acopia Home Loans is not following the regulations of XXXX XXXX when consumers are applying for home loans. I was flabbergasted when I was told by the loan consultant that my monthly payment documentation for XXXX student loans is not acceptable due to the deferment and was adamant that " the most we can do is assess .5 % '' of the loan balances. I was shocked that this loan company 's Underwriter submitted this information to a consumer -- making up their own rules and ignoring XXXX XXXX guideline. The statute states the loan company " must '' use documentation when the monthly payment is not specified on the credit report. I submitted three pieces of documentation as to the monthly payments of my XXXX student loans. I am amazed at the deliberate tactics of loan consultants/underwriters here in Alabama to assess this 1 % rule for XXXX XXXX Conventional Home Loans when infact the guideline is clear -- '' must '' use documentation. I had one loan consultant assessed this 1 % rule on a small student loan without my knowledge while I could have furnished documentation, but stated that he is not going to change or correct the issue because closing is on XX/XX/2021. Consumers are being cheated out of qualifying for home loans big time in this state.

I gave all of the information for my application over the phone on XX/XX/2022 that same day the XXXX XXXX XXXX with Accurate Mortgage XXXX TN, called back and told me the interest rate was 5.5 % she gave me the payment amount of {$2200.00} and closing cost were {$11000.00}. I told her to lock the rate and that Id like to proceed. On the XXXX I asked here where the XXXX was, that I hadnt seen it yet, she told me since I hadnt give her the real estate contract she hadnt locked it in. She then told me the rate went up and the payment would be higher. I then asked to speak with her manager and told him that I knew the laws and that I was entitled to an XXXX and the rate she quoted me. He then said he could lock the rate as it was at XXXX so I said ok. When he sent the XXXX the closing costs went up to {$17000.00} and they want me to sign the application dated XX/XX/2022. XXXX not comfortable signing an application dated 11 days after my application was taken and feel like Im being asked to lie to cover up their lack of compliance with TRID-RESPA. I finally received an XXXX by email today Monday XX/XX/2022.

I first tried to do conventional, however the home is in XXXX XXXX XXXX and has to go FHA for whatever reason. The first Loan place, XXXX- XXXX XXXX XXXX NMLS # XXXX XXXX XXXX XXXX XXXX XXXX , XXXX XXXX phone XXXX did the appraisal. this lender could not do FHA so i had to go thru a different lender. XXXX XXXX NMLS # XXXX Loan Processor XXXX XXXX XXXX, XXXX. NMLS # XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX , XXXX XXXX XXXX Phone : XXXX XXXX. XXXX Fax : XXXX the first lender did the appraisal and refuses to give to the new loan officer. and FHA will only take the first appraisal so i can not have another done. XXXX XXXX is trying to wait as long as possible to make me loose this house as my closing date is X/XX/2017 and if he does not hurry up and turn over the appraisal i can not get everything done it time.

I sent Loan Officer XXXX XXXX from XXXX XXXX XXXX with NMLS # XXXX a buyer to get approved for a loan. XXXX XXXX was keeping me informed at the beginning with updates & after a while I could n't reach him and after researching XXXX XXXX closed my clients and also stole my real estate commission which XXXX never said he was a Realtor as well.
