My former roommate put out information that was inaccurate and has not been addressed in a court setting also she has missed court hearings on the matter. My partner and I have been personally affected by COVID 19 me working in the school systems my partner worked at XXXX. My partner who at the time was full time was no longer employed and my hours had been completely reduced because school was not in session and I received XXXX as compensation every week and this was to take care of rent which was XXXX a month and to actually survive as two weeks went by we were beginning to see that it would be hard to keep our home especially because our roommates were hassling us over paperwork getting signed and rent being paid even though it was abnormal for us to not pay on time being that we paid the most. So over the course of time I could only help to pay bills keep everyone comfortable as my partner did instacart to help pay for us to be able to eat. In the midst of everyone in the house naturally struggling I had a roommate who was not happy with late rent payments and was not polite nor understanding of the situation oddly. We had filed for unemployment but as we all know unemployment began to back up heavily and so we were unable to pay and be on time we kept up as well as we could. Essentially we ended up not being able to keep up long enough so we were asked to sign paperwork to ensure that we and neither would the other tenants be penalized by us not being able to pay rent in the full amount while we kept in close contact with XXXXXXXX XXXX XXXX and the owners of the home the roommate began to show signs of annoyed behavior with us as we ended our last few days at the home my partner and I ended up moving out our things on the XXXX of XXXX where an altercation between her and my roommate took place started with my roommate expressing to my sister who was helping us move out her issues with us and my partner didnt like the accusations being said she approached the roommate after being mocked due to her weight size and they then began for fight me in shock I go to pull my partner off because it was our last day and I was honestly disappointed that she allowed herself to get out of character especially because this was the day before our official move out day and we had lasted so long without any altercations no matter how uncomfortable we did feel. In the midst of me breaking the fight up the roommate is kicking back to back I get kicked in the process of pulling the two away from eachother with force used for my partner we were not surprised to get paper work from the courts about her because she fought however when I received paper work I was confused because I did not fight her. Later on that day after me and my partner had left the premises my partner and her father went back to the home to finish retrieving her items. XXXX enough she was able to walk in and do her last sweep thru and the next day my partner had also asked renters warehouse if it would be okay to return the house to retrieve the remainder of my items and she agreed. I could however my personals such as my ssn and my ID all missing along with some disheveled items of mine my roommate had trashed the room however me my partner and our mutual friend XXXX had helped me move out the remainder of my items. This to say she has written two false statements claiming I fought her and claiming we destroyed property all while she was home. I made sure to take pictures of documentation of messages emails etc because it shows the aggressor in this situation and after awhile of taking in the energy I refused to speak with her and would much rather allow renters to speak to her on the matter.

I applied for a XXXX with XXXX XXXX XXXX XXXX XXXX XXXX back in XXXX 2016. I went thru a phone interview with a HR Rep named XXXX XXXX a XXXX XXXX employee, accepted for the next step, a background. I received a stack of paperwork from XXXX XXXX XXXX XXXX ) by mail, completed it and sent it back. I was told by XXXX it will take 2 weeks to have your background completed, somewhere between XXXX/XXXX/16 -- XXXX/XXXX/16. I waited until the XXXX of XXXX to figure out the next process. I called and left messages. I waited until the holidays to be finished so a week later in XXXX around the XXXX I called XXXX XXXX XXXX XXXX XXXX about my status, XXXX stated " I have to contact some of your employers because they were off during the holiday. '' I waited a couple of more days to hear if XXXX got in contact with anyone, contacted her and she told me she only left messages and no one called her back yet. XXXX then told me that I need to start calling my previous employers to complete some paperwork and have them sent back to her. I contacted a few of my previous employers and stated what my reason of calling is. XXXX out of the XXXX stated " We 've tried to contact XXXX XXXX several times but no call back on her side and we just can not continue to put things on the side for this. '' The other employer stated similarity " I 've fax that sheet many times but the fax machine on her side are having issues. '' " Contact her back and let her know. '' I re-called XXXX back several times and left messages. A few days later in XXXX I called XXXX XXXX Headquarters located XXXX, spoke to a SR. HR Rep ( Benefits ) about all this and she replied to document all this and report it in the long hall. Here is the long hall ... .. I was told by this Sr. HR Rep ( Benefits ) to contact a HR Rep Regional office in XXXX XXXX XXXX XXXX by the name of XXXX XXXX XXXX so I did by emails, I copied and pasted all emails with XXXX and I and waited for XXXX XXXX to contact me back. A few days later i received a email from XXXX XXXX telling me it takes 2 months for your background to come back because its a XXXX. I made another contact with XXXX checking on my status and XXXX told me she received the forms from my employers and waiting on a few more things and she will call me back. Never heard from anyone. A few weeks later in XXXX I received a letter from a XXXX XXXX employee named XXXX XXXX ( Director of Recruiting ) with a letter head from XXXX XXXX 3rd party background check company by the name of Accurate Background located in XXXXXXXX XXXX. I read the findings that this 3rd party did, I disagreed with there findings to prevent my application in moving forward. Accurate Background told me they have nothing to do with the decision in my application call XXXX XXXX. Nobody from XXXX XXXX is responding. They are using my calls to Headquarter, which they gave me the name of XXXX XXXX and after reaching XXXX XXXX about this problem with XXXX XXXX resulted to this.

To whom it may concern : In XX/XX/XXXX of this year, a friend of mine suggested that I take a short trip to the local XXXX XXXX retail location, and talk with his " friend '' about a part time employment opportunity. Right then and there we got in the car, arrived at the location in XXXX, CA, and I met with the manager " friend '' We like one another, he then asked me to come back for a " short interview '' and about three days later I did just that. We spoke for a matter of minutes, and we mutually decided that this was a go. At that time, I went to a computer as provided in the store, and completed a quick questionnaire, that was obviously going to lead to a background check. Since I have a license to XXXX XXXX with the XXXX, as well as the California Department of XXXX XXXX, both of which performed extensive background checks prior to enabling me to qualify for and receive the licenses, I saw no problem with the background check as requested by XXXX XXXX ... and provided by a firm by the name of Accurate Background. Before I go any further, I would like to add that every time ( such is sometimes necessary in this industry ) I changed XXXX companies/employers, they also pulled background checks. Each and every time, there was never a problem. Unfortunately, after applying for this part time position ( a position that I would still like to have as a supplement to my income ) Accurate Background supplied a background check to my employer to be, and the data contained ( including but not limited to my DATE OF BIRTH were grossly INaccurate. In essence, the report that they supplied was so far from reality, that I can easily understand why XXXX XXXX ( after several weeks ) decided that they wanted nothing to do with me. As an example, I had a dui almost 8 years ago, no injuries, an unfortunate event. However, they reported me as doing XXXX time for some 300 plus days ... I did not spend one day in XXXX. Naturally your average individual who reviews a background check and sees that this person ( allegedly/incorrectly ) spent nearly a YEAR IN XXXX, must have done something very bad. As I stated via the click throughs, I have attempted to get clarity with Accurate Background all to no avail, other than the fact that they corrected my birthdate! I had what I and the manager thought was a turn key opportunity to make some money, realize a ( albeit nominal ) benefit package ) however, because of a highly erroneous report, I was denied employment. Lastly, my concern ( s ) go further than just this specific lost opportunity, I am also concerned about the ( probable? ) collateral damage this report may have / may cause going forward. The company Accurate Background at XXXX XXXX XXXX XXXX in XXXX, CA provided completely innacuate information to a potential employer and refuse to take accountability. The information that they provided was incorrect, and the process to fixing this situation has been extremely difficult. Multiple employees have lied directly, as well as, indirectly. I was specifically told that I would receive documentation explaining the specifics of the mistakes that were made. It has not happened. Accurate Background informed the employer that I have a " criminal record ''. Their report showed that the disposition was " still pending ''. Neither of these were correct. The case was closed on XX/XX/2018 and the disposition was an infraction. Even if I was guilty of crime, which I was not, how could I have a " criminal record '' without a conviction? Either way this matter is looked at, this company has caused damages that are irreversible. Truly damned if I did, and damned if I didn't. They are refusing to provide documentation describing their fault in this matter, even after numerous promises. Multiple employees have provided poor, unreliable, and false information. Some employees seemed to create department names, and position titles, and other employees stated those departments and titles did not exist. My best inference is that these employees simply do not want to do the job that are employed with. There are hours of recording that exposes this downright scary, and possibly unconstitutional business practices. They are completely incapable of effectively providing this service. They have tried to place blame on the courthouse. The courthouse clerk has stated and verified twice that it has been filed correctly since 2018, and that possibly someone is misinterpreting the reports on Accurate Background 's behalf. I was told multiple times that they have contacted the clerk, but can not offer a name, and that Accurate is at " their mercy ''. The clerk stated on multiple days that this never happened. I believe that the clerk is 100 % telling the truth. I have spent hours, and hours of time, trying to resolve something that is absolutely pertinent to my survival, and to no avail. Over a week has elapsed, regarding something that could be resolved in minutes with a phone call to county courthouse clerk.

I have applied to several positions for work and on three separate occasions, the reports came back with INCORRECT information that belonged to another individual, but were associated with me. This occurred twice with XXXX XXXX XXXX XXXX XXXX/XXXX/XXXX and XXXX/XXXX/XXXX XXXX and once with Accurate Background XXXX XXXX/XXXX/XXXX XXXX. All three times it was the same information that appeared and I appealed each incident. I did not hear back from Accurate Background. I do not feel confident that they will correct this error, even with the information I gave them. I feel this incident will fall by the wayside again and my reputation and background will look much worse and jeopardize any potential future employment opportunities that I may have. The person that I am being associated with is named " XXXX XXXX '' and on the records the notes say that his middle name was taken down as " XXXX ''. That is not my middle name, nor is XXXX my last name. The incidents that occurred all took place in XXXX, IL. I have never lived in XXXX, IL or been arrested there ever in my life. I applied at XXXX and went through a background check with Accurate Background. It began on XX/XX/XXXX and I received a copy of the report on XX/XX/XXXX. The report said that I was found guilty of a crime ( felony misdemeanor ). This report was also sent to the employer. I immediately disputed the report as it was inaccurate. I provided undeniable proof that I was not convicted of said crime the report categorized me as guilty of. I have not been able to reach the dispute team but I was given an email and have yet to get a response. They told me the process is that they will send XXXX a notice saying Im disputing information and they will reinvestigate. I have not been given a timeline or an eta on when the matter will be resolved. This will undoubtedly lead to lost wages due to the delay. Also, because I was not convicted of a crime at all and they reported that I was convicted, it leads me to believe that the team who put the report together were not careful and it could have a real impact on XXXX decision to hire me. If I did not have make sure to check the box to receive a free copy of my report, I likely would not have ever known because I received no call. In my application when I was asked if I had been convicted of any crime in the past 7 years I answered no, so if they thought they found a conviction I should have been contacted before they sent the report to the employer, possibly damaging the work relationship that Im trying to establish. This is very upsetting.

Accurate Inc. According to 15 Untied states Code 1681 ( A ) Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. Should not be reported. However the information on the report antedates in the scope of law by 12 years. Every consumer reporting agency shall make a reasonable effort to verify the identity of a new prospective user and the uses certified by such prospective user prior to furnishing such user a consumer report. After notifying the Accurate INC of out scope information and inaccurate information must be removed on XX/XX/2023. Accurate fail to follow rule 15 United States Code 1681 ( N ) Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum ofXXXX dollars.such amount of punitive damages as the court may allow ; and ( 3 ) in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorneys fees as determined by the court. After receiving a conditional job offer XX/XX/2023. I completed all the steps successfully up to this point. XX/XX/XXXX I received adverse letter stating was criminal findings.Due to this report my employment was rescind. After careful examination I discovered inaccurate and out scope information alone with fair act reporting violations.

I would like to report erroneous, unfair and incorrect information that is on my fcra. Listed is the facts and nature of the case. I have had trouble with the XXXX Virginia court system before and instead of correcting this error I have to pay the price and am losing employment offers.I don't know how you can continue to spread lies and call yourself a justice system. XXXX and Accurate have not responded to my attempts to explain the situation. This is now my third attempt. I found out that I have outstanding warrants in Virginia, I've lived in Florida for 4 years now. I'd like to discuss right now why it is a non issue and that it should not impact my working eligibility in any meaningful way. I literally just got off the phone with the XXXX Virginia Sheriff 's department that can be reached at XXXX and he explicitly told me that XXXX will NOT take action against me and they will NOT extradite. The driving on suspended license should not be an issue since I have a valid drivers license in florida now. I have worked hard to stay out of trouble since living in florida and am ready and motivated to begin working as soon as possible. Should also add for the record that I am in good physical and mental condition and have done this job before, twice in fact. So we are clear and upfront about the situation and there is nothing preventing me from getting this job, thank you for your consideration XXXX

I applied for a XXXX XXXX position with XXXX XXXX back in XXXX. In the onboarding process, I submitted a background check to Accurate at that time. I did not realize until Friday, XXXX when I received a call from Virginia with XXXX XXXX that I had something appearing on my background check and that I should check my email to see what the report provided from Accurate. I checked my email and there was another woman 's criminal information showing on my background who lived in XXXX, VA. In the remarks on the report it stated " verified by close name and close date of birth match. '' I have never lived in XXXX, VA ; nor done these crimes. My middle initial has never been M. I am not this person and she is not me.I reached back out to Accurate and filed a dispute on Monday, XXXX XXXX. I received a denial letter of employment because of this from Accurate on behalf of XXXX XXXX. I filed another dispute today, XXXX XXXX. I need to get this corrected and have this person 's information removed as soon as possible. Please let me know what I can provide or do to have this wrong and inaccurate information removed from my background check. This is not only affecting my employment with XXXX XXXX, but also XXXX where the background check with Accurate is currently pending.

XX/XX/2019 Accurate Background check was issued my information for a background check by their client XXXX XXXX and XXXX XXXX it took them 30 day to complete the background check and yet again they submitted incorrect information about my background to their client which hindered me from several job offers, because in the state of Texas XXXX XXXX is not supposed to come up on a background or be reported or shown to a employer because in the state of Texas XXXX XXXX in Texas is a special kind of XXXX that gives you the opportunity to keep your XXXX off your XXXX record. I had a Motor Vehicle Record background check performed by Accurate Background on XX/XX/XXXX for a promotion I am in line to receive at XXXX. During the check my license was suspended due to a clerical mistake by the Department of Public Safety. I had paid a surcharge off in full but they showed that I still owed {$21.00}. This was due to a discrepancy with a " convenience fee '' when paying online and was of no fault of my own since I had paid the total amount owed. The MVR background check came back showing that my licence was suspended even though I had contacted DPS and had the problem corrected.
