I got an interesting letter from the law office of XXXX XXXX XXXX. She has notified me that I'm in default of debt in the amount of {$5900.00} for a company called XXXX XXXX XXXX XXXX. She states that they are processor scheduling a hearing in district court against me and wants me to call her to answer questions about this debt. Here 's the problem : 1 ) XXXX XXXX XXXX is a lawyer for ARSI, not just a stand alone law firm, which she didn't disclose. She is the legal department director for ARSI, which did send me a letter about this debt over two years ago. I requested validation of debt from ARSI, but the collection company never send me paperwork showing what this debt was for or the date that this debt supposedly happen. 2 ) I live in Oklahoma and have lived in Oklahoma for over 5 years. I check Oklahoma 's case search, and XXXX XXXX has filed nothing. So if she did attempt to sue me, she did in a state that I didn't live in. Hence, I was never served, in that state of Kansas, and in the county of XXXX, the XXXX serves the debt, not a process server. 3 ) This debt is in my maiden name. I have been married for over 6 years, so this debt is not in the realm of the statute of limitations for this law firm to even try to sue me. I guess that is why I never got the validation paperwork. 4 ) XXXX XXXX XXXX is permanently closed. I don't know when it closed, but on XXXX and yelp, it shows permanently closed. I try to contact the numbers that were associated with this company, but they are disconnected. So how is it that I owe money to this company that doesn't exist anymore? XXXX ) I have no idea when this debt happened, but I had health insurance for over 8 years, so there is no way I could have ever had a bill for that amount. Lastly, Which is the most important. This is the first time I have ever hear from XXXX XXXX XXXX 's XXXX XXXX. I have never received a XXXX 'S letter letting me know my rights. So how is it that she could skip that part of the collection process and go directly to suing me?

I have repeatedly contacted this company via e-mail in order to pay a debt placed by XXXX XXXX XXXX. Once I determined that I owed the debt, since the original bill they sent me was unclear, I contacted them on XXXX/XXXX/2015 requesting that if I pay the debt in full that they remove the account from my credit bureau. When I did n't hear back from them, I contacted them again on XXXX/XXXX/2015 by e-mail. Again, when I did n't hear from them, I contacted them on XXXX/XXXX/2015 with a final request. In this request, I stated if they did not address my request that I would need to turn the problem over to the Consumer Financial Protection Bureau and the XXXX. This should be an easy request to address. Moreover, they should feel fortunate that I am paying this to begin with, because the physician at XXXX XXXX XXXX is overbilling me considering the services he provided. He saw me for about XXXX minutes, did n't run correct tests, and sent me away with medication that did n't even work for my problem. The hospital initially billed by insurance provider almost {$500.00} for his services, and they state I owe about {$250.00} of it despite paying my {$300.00} deductible at the time of service. The total bill was well over $ 3k. And when they billed me, they did n't even bill me correctly. They stated it was for XXXX services rather than physician services, which lead me to believe I had already paid the bill with the deductible. When they finally cleared it up, they placed it with a collection agency before I had the opportunity to pay it and failed to send me notification that stated they were going to place it with an agency. Then, when the collection agency initially billed me, they stated it was for the ER visit rather than disclosing the physician 's visit. Confusing to say the least.

ACCOUNT RECOVERY SPECIAL XXXX XXXX XXXX XXXX XXXX. XXXX XXXX XXXX XXXX, KS XXXX The company above has 4 collection accounts listed on my credit. I contacted them yesterday at XXXX XXXX central time in an attempt to pay off all 4 of these collection accounts. When i called the guy went through the " This is an attempt to collect a debt '' asked where i work, where my wife works, what my number is, what my address is .... I proceeded to tell the person there are 4 accounts on my credit I would like to pay off. He refuses to let me pay them off, insists that I owe XXXX, that the bills are mine and my wife 's and insists I need to set up a payment plan to pay them all off I said to send me an itemized list of the other amounts that he claims I owe because I know nothing about them but i want to go ahead and pay off the ones that are showing on my credit. He tells me I need to pay them all, that they have sent bills and allegedly left messages on my phone and since none of the bills had been returned I owe them and must have received them or something. I tell him I have no idea what these bills he says i owe are, to send me a list, he then starts talking over me and keeps trying to force me into agreeing to do a payment plan, at which time I told him I'm not doing this and hung up on him. This guy wouldn't even let me pay the bills I know of, and refused to provide any proof of any other bills he claims I owe, and was also holding my credit ransom over my wife 's bills he claims she owes

On XXXX/XXXX/2015 and XXXX/XXXX/2015, I received robocalls from ARSI that were left on my call notes. On XXXX/XXXX/2015, I called back and spoke to a person named XXXX. She stated that the calls were regarding a bill that I owe to Emergency services. I told her I had not heard of them ; moreover, I had not received a bill from their organization or ARSI. I asked her when the bill was sent from ARSI, and she stated on XXXX/XXXX/2015. Therefore, they began calling me before I could have possibly received the bill. When I told her that I was disputing the charges and to cease calling me in the future for payments, she continued to talk over me, continued to attempt to collect the debt, with the latter not legal once a consumer has stated they are disputing it. She should have simply honored my request. When I requested to speak to a supervisor, she transferred me to a person named XXXX. XXXX stated she would make sure I did not receive calls in the future, but she further stated they were not doing anything illegal. I find it to be pretty shady that they are trying to collect on a bill where the provider is unknown and there has been insufficient time to have received a bill that states my credit rights and the option to dispute the bill. After the phone conversation was over, I sent a written notification via their e-mail XXXXXXXXXXXX to cease placing calls and that I am disputing the balance.

ARSI continues to try to collect a debt that is over 7 years old and can't report to the credit and 4 years out of statute of limitations for them to sue me. But they continue to send me letters stating that if I don't respond to pay the bill, the attorney may file a sue against me. I have sent ARSI several times my FTC paperwork because the debt they are trying to collect is fraudulent, they continue to disregard the paperwork and keep sending me threatening letters. I contact ARSI at the beginning of XXXX when I received their last letter. I wanted to know when this debt occurred because the letter that was sent to me doesn't have the notice that this debt is out of the statute of limitations to collect or to report. On the first call, I was disconnected after I stated who I was. On the second call, after I verified myself, XXXX tells me that I have to speak with legal counsel XXXX XXXX. Then they inform me that he was on the phone and will have to call me back. Well, that is impossible because I have a cease and desist on file with them. If I accepted a call back from their legal counsel that would negate the Cease and Desist. I don't understand why ARSI keeps violating the Fair Credit Reporting Act in attempts to collect a debt. And why do they keep harrasing me by sending me threatening letters? But at this point, I'm done.

Greetings, I am writing to inform you of a business conducting unfair debt collecting practices. Agency : Account Recovery Specialists , Inc . Address : XXXX XXXX XXXX XXXX. I have other amounts they have billed me charging interest as well, unfortunately I do not have those letters with me at this time - however, I can do a follow up regarding this information. ARS, Inc. has also contacted an attorney regarding a debt concerning my husband, XXXX XXXX and myself. I am reporting them for the below information : 1. Debt Collectors can not collect interest, fees, or other charges on top of the amount you owed, unless the original contract or your state allows it. a. There was no original contract as this is pertaining to a medical bill ; medical bills are not subject to interest. b. Kansas Debt Collection laws adopt the FTC laws that do not allow a debt collector to collect interest on a debt. 2. Statute of limitations for ARS to sue regarding this debt in the XXXX of Kansas is 3 years. The debt is far older than 3 years and now considered Time-barred. In the first week of XXXX it occurred to me to check my credit score and I realized that I had a collection account and that my score dropped drastically. Look at the company and it was A.R.S.I. I called them and they told me that I had a medical bill from XX/XX/2020 for the amount of {$480.00} that had not yet been paid and that they often sent me letters but I never received anything because they sent it to another address I told them that I was willing to pay but to remove that from my credit report but they told me that it was not their fault that I had not received the letters and that they could not change it so I spoke to the doctor 's office I told them what had happened and the misunderstanding to them I explained that I had already paid one bill but that I never knew about this another one becarse I never received it and they apologized and accepted the full payment of the bill and told me that they would send a letter to ARSI I don't know if they did but they keep calling me asking for payment and until then they will remove my collection from the FICO

I have a collection on my credit report Numerous times with all three credit bureaus only to have them come back and see that it is verified. So today I finally called this collection agency. I asked them for original proof that this was something I entered in to prove my identity and signature something to prove that the account belong to me. Provide me anything at all not even tell me anything because they can not even collect this debt in the state I live in they are not license thats XXXX XXXX XXXX XXXX XXXX la. Contact XXXX XXXX and XXXX XXXX and they are very disrespectful when Im trying to explain this they want to cut me off and they are unable to hear reason that they have been violating my rights to report accurately verify the information when I dispute it because I have disputed it multiple times and if they cant give me the information this company they sure as heck cant give it to Bureau because they can not practice collections in the state of North Carolina. Had verbal agreement with ARSI to make payments monthly with the understanding that the monthly payment would be shared with all accounts. By using ARSI website payments were entered and selected on all accounts. After further notice the website of ARSI did not distribute payments to all accounts as indicated on website. The company only selected a few accounts and paid limited accounts in order to gather more interest on accounts. Even some accounts were paid in full but still had a balance due to interest. This tactic seems to put myself in a revolving account by only paying interest and not disclosing this information to myself with the verbal agreement that ARSI had with myself that all any payments would be distributed evenly to all accounts. No written notice was given to me with negatively affected accounts that were reported to credit bureau after ARSI showed balance on certain accounts were not being payed. ARSI did not all myself to dispute any unpaid accounts because I was not properly notified.

On XX/XX/2018 I received a letter from the XXXX XXXX XXXX out of XXXX XXXX, Kansas stating that I owe an outstanding balance of {$8100.00}, of which includes the {$2500.00} hiring fees of the person ( s ) attempting to collect on this debt. Outside my home people drive by yelling out, " You owe restitution '', " It has to be paid ''! I am harassed everyday of my life by this! At work I'm subjected to every inadequacy possibly imagined because of this. The real truth of this matter is that I am being wrongfully charged for this collection. I'm not responsible for this. I was assessed this fine by a Court because they had no one else to pin it on. I have reached out to this debt collection agency twice via phone calls. I also have reached out through mail twice asking for verification of debt for XXXX account reporting to the credit bureaus. I have also sent the same formal letter requesting verification via XXXX. This notification was received even though the representative attempted to acknowledge what actually letter was forward to them. I still have not received verification in the appropriate time to date. The agency instead have continuously added and reported more interest monthly. They have also have the account listed as seriously past due when a collection account is past due by default and should not be reported as such. Account recovery has also flagged my credit report numerous times within days apart on the same debt to affect my credit. In addition, although they may say theyre collecting on behave of a XXXX XXXX they still have to follow the same regulations to include HIPPA law.

XXXX Hospital and many other hospitals in Kansas and probably elsewhere are ignoring the Obamacare Rules supposed to be enforced by IRS and in 501 ( r ) of the regulations. Only one provision of that section has any fine imposed. Many hospitals are ignoring the rest of the rules, and their cpa firms seem to be encouraging that practice. The debt in my case was sold to XXXX XXXX 's law firm in XXXX Kansas. This is all explained in a court motion I made in the collections case, and the Treasury article attached hereto. Also the law firm attempted to pad the judgment by approximately {$200.00}. The said I owed interest and etc amounting to over {$1000.00} and needed to pay that amount to avoid going to a hearing in aid of execution.. Later they could not substantiate that amount and were probably hoping I would n't notice. The could only account for less than {$900.00}. This also is explained in detail in the attached court motion.

I was served by XXXX XXXX sheriff a notice to appear in court at the end of XX/XX/XXXX. Court date was XX/XX/XXXX. I appeared to court that day and talked to XXXX women representing A debt collector. We agreed on a {$50.00} a month payment plan for 4 months. I paid {$50.00} on XX/XX/XXXX which I have a copy of the payment receipt { # XXXX ) from that transaction, and an additional form stating the agreement for 4 months on it. I work for the XXXX and I get paid once a month. On my XX/XX/XXXX paycheck there was a garnishment of {$460.00} from the debt collector I just made an agreement with, less than 2 months ago. I was not informed, or sued by the debtor, or given the chance to request a hearing but they took my money anyway without me knowing about it until I received my paycheck. This has completely devastated me and left me the inability to feed myself until my next monthly paycheck.

I initially contacted ARSI regarding some medical bills that were turned over to them that needed to have charity applied to them. Despite the dispute that charity is supposed to pay, ARSI took no steps as required of them by both the Fair Debt and Collection Practices Act as well as the Fair Credit Reporting Act. Further, I contacted ARSI on XX/XX/2019 and spoke with a representative. It was at that point that I advised ARSI that I no longer owe the bills as my husband is XXXX XXXX and the Soldiers and Sailors Act would prevent suit from being filed on these accounts as well as prevent the accounts from being reported to my credit bureau. Despite my calls to ARSIs agents. ARSI has taken no steps to comply with the law or provide an answer to the above disputes.

On XX/XX/XXXX, I pulled my credit report and noticed that Account Recovery Special is reporting and trying to collect on an account which they state was opened on XX/XX/XXXX, for {$360.00}. Please note that I have never entered into a contract with Account Recovery Special. In addtion, pursuant to Kansas Statutes, more specifically, Statute Number : 60-512, the statute of limitations of 3 years has passed on collections of this type of account. On XX/XX/XXXX, I wrote to Account Recovery Special indicating that I disputed the alleged account and that the Statue of Limitation had run. They received my letter on XX/XX/XXXX. Today, XX/XX/XXXX, I pulled my credit report, and they are still reporting and trying to collect on the alleged account.

Me and my wifes bank accounts were completely seized on XX/XX/2015 by ARSI for her being 10 days late paying her bill, she had not missed any payments and even paid the late payment. I had over {$1500.00} and she had over {$100.00} in our banks accounts. All the money in both our accounts are from paychecks being direct deposited from our jobs and now we have no way to pay our bills at the end of this month. This should be completely illegal to take all of a married couples money right out of their bank accounts and I want it all back. Company responded to last complaint threatening to sue. Ironically enough they share the same address with the attorney ( is this even legal? ) something is a little off about all of this - the company needs investigated. Also - they threw Kansas Statutes Annotated 16-201 in my face for interest however, it states NO MORE than 10 % per annum - according to their response to me the debt isnt even a year old and theyve racked up almost 12 % in interest fees already. Id like more information regarding the debt in question, as I believe its less.

I didn't receive any written or phone communication about this debt from the collection agency. I saw it on my credit report and promptly paid in full. This was supposed to be paid by insurance and I have since put a claim in with my insurance company. The full amount was for {$430.00}. I was also never given written documentation about being able to dispute the debt in order to get it off of my report. I called the agency and they said that since I paid it there was nothing they could do to help.

Arsi garnished XXXX $ from my savings account due to my mother 's debt to them she was a secondary signer due to me being underage for the account.
