In XXXX of XXXX I received a call from a company stating they were the Department of Education to complete a loan consolidation. I spoke with a representative named XXXX XXXX XXXX XXXX ) who gave me the fax number and information that I needed to submit with my application. And I also spoke with a manager named XXXX ( XXXX ) as well. When I called back to make sure I had noted all of the requested documentation. I was mailed an application for the Federal Direct Consolidation loan application packet and I faxed it in on XX/XX/XXXX, with my check stubs from XXXXXXXX XXXX XXXX. I completed the application that was already pre-populated with an account number of XXXX in the amount of {$22000.00}. I added the XXXX account number XXXX in the amount of {$66000.00} to be added to the 4 small loans I already had with XXXX. In XXXX of XXXX, I received a letter from XXXX stating that my consolidation application had been completed in the amount of {$110000.00}. I immediately started calling XXXX and the Federal Student Aid to try and figure out how my loan amount got to be so high. XXXX kept stating that they received their information from the Department of Education. Federal Student Aid could only give me loan amounts that they had noted in their system. My college XXXX XXXX College lost its accreditation in XXXX and had been erased from the Federal Student Aid system and the college itself doesn't have any records on file. So trying to get a complete breakdown as to why the total was so high was like hitting a brick wall. In XXXX I received a call from XXXX XXXX with the Department of Education stating that I had a loan in default from XXXX. I asked if they had a promissory note and they said they did not and I advised that I would not pay it until they could prove that it was mine. I advised that when I completed my loan consolidation I added all the loans that I was aware of. This going back and forth went on for years trying to still figure out how the loan amount was derived. Finally, in XXXX I requested a breakdown of each loan from XXXX. They mailed me a copy of my Federal Direct Consolidation Loan Verification sheet that showed the date of release and loan amounts all totaling {$110000.00}. There was a sheet in between the two pages that stated that an error in the amount of approximately {$30000.00} was made but could not be retracted at the time making the total {$130000.00}. My application was completed by an employee at Account Control Technology by the name of XXXX XXXX. ( agent # XXXX ) was XXXX by XXXX XXXX and Authorized by XXXX XXXX on XX/XX/XXXX. all of their initials are o the certificate. On the spreadsheet, there was a loan for one semester XX/XX/XXXX in the amount of {$41000.00}. That was an immediate red flag. I called XXXX to try to dispute it and they repeatedly stated that they received that information from the Department of Education. I called Federal Student Aid and tried to get them to explain where they got their documentation from. I advised that I never received on loan for {$41000.00} ever. A representative stated that something was definitely wrong because the maximum one can receive a semester is {$25000.00}. At first, I thought XXXX had processed the loan consolidation and made errors ; but they stated they recieved the information form Department of Education. I then made a complaint to Ombudsman with the Department of Education advising that someone had made up loan amounts that were not correct. An Ombudsman representative investigated and responded stating that since I signed the loan consolidation I was responsible for it. I advised I never signed anything that looked like that. I would have never signed something stating that I received {$41000.00} for a semester. This made me angry and I went through all of my paperwork. That thankfully I had always held on to. I still had a copy of my original application that was in my handwriting, along with the check stubs that I submitted via fax in XXXX. XXXX XXXX mailed me a copy of the application that they had received from Account Control Technology. When I opened the envelope page 1 was a copy of my same page one except someone had scratched out the address that I resided at when I submitted the application and they listed my current address where I still reside now. This was odd because I didn't move to this address until XX/XX/XXXX. So my address should have been the same as when I applied. When I turned to page 2 that is when I saw for myself that my application had been altered. Someone at Account Control Technology had removed pages 2-4 and submitted a typed consolidation application, complete with the account numbers that only the Federal government had access to. After all these years I had finally figured it out, Looking at the application the person who processed it had noted that I had requested to not add XXXX loan to that application. They listed account number XXXX with no amount listed at all. The amount field was completely blank. Now, why would I ask to leave off an account and not enter the amount? I have never had access to the account numbers that Federal student Aid has for my loans. You can't access those numbers online, They are not anywhere on the Federal Student Aid website. This loan that they stated that I requested not be added, is the loan that went into default and was with Debt. Resolution. That is how they received it because it was not consolidated with the remainder of my loans. So page one was in my handwriting, they slipped in what they wanted to and they slapped the last page my handwritten signature page. Why would a legitimate application be half in handwriting and typed? I could not get any assistance with trying to figure this out, I had to reach out to an Attorney Generals ' office in another state for help. She submitted it back to Ombudsman for re-evaluation. The representative after months of reviewing came back and said the same thing the original representative said. I was responsible for it because I signed the original application. I was already angry that someone had violated me by submitting a fraudulent application, caused me to have a defaulted loan on my credit and I am having to prove this was a fraudulent document. I called the Department of Education in Washington DC and spoke with an administrative assistant in their office who stated that Student Aid and the Department of Education does not work with 3rd party vendors. She advised me to call the new Chief Operating Officer XXXX XXXX XXXX. I left him a voice mail and he had the same representative that the Deputy from the Attorney Generals ' office had reached out to contact me. I advised her that this is not what the verification certificate sheet said. It clearly had Account Control Technology working on behalf of the Department of Education processing this consolidation, they even mailed the payment to the Department of Education in XXXX, GA. So I began to research some more. And what did I find? The actual contract that Account Control Technology had with the Department of Education stating the contract started in XX/XX/XXXX until XX/XX/XXXX. There it was in black and white a spreadsheet of all of the contracts held with Federal Student Aid, I even came across an article where Account Control Technology and another company came together and sued the Department of Education for not doing business with small companies. I am guessing this contract was part of the settlement. I immediately called the representative from Ombudsman back and advised her that I found the contract and then asked her how could she not see that there were XXXX separate applications. And she stated she never saw the original application and only saw the one that XXXX XXXX had on file. I advised that I had attached to all documents, I resubmitted it and they reviewed it and saw that there were unexplained discrepancies. And that I could not be responsible for the defaulted loan and they discharged the defaulted loan in XX/XX/XXXX. I advised that no one knows the true amount of the loan listed for {$41000.00}, the pre-filled account number XXXX for {$22000.00} was really for {$2800.00}. Account number XXXX {$4500.00} is not mine. They are still trying to figure out the true amount of the {$41000.00} that loan. XXXX XXXX only has the falsified application that Account Control Technology submitted to them. I am still in shock that a company could do this especially if they were working with the government and handed all of my information. How does a company mess up so bad and break the law by falsifying applications? How many other people have done this to, don't have a clue and think they are really responsible for the outrageous amounts in school loans. My rights have been violated, my credit scarred with a defaulted loan. I couldn't even apply for some jobs because I knew I had a defaulted loan. I ended up paying a higher APR on my car because of it. Just think, if I had paid that just to make it go away I never would have known how it originated. And the reason XXXX XXXX couldn't provide a promissory note was because they got if from my consolidation application which they never stated. Account Control Technology has some explaining to do and needs to have charges brought against them for falsifying a federal document and submitting it with my signature as if I approved it and I never saw it before requesting a copy from XXXX XXXX. and XXXX XXXX representatives have verified that something crooked was going on because noting was matching what they could see. Some reps would tell me others would hang up on me. This became my third job. Hours of phone calls for answers. This has had me stressed out and luckily for me, I am a fighter who never gives up. I was going to find answers and I did uncover a very huge problem. Account Control Technology owes me some answers and this is truly a fraudulent business practice that is going to continue to haunt me because no one knows the true amounts of my loans.

I received a notice of collection from Account Control Technology , Inc ( ACT ) at the beginning of XX/XX/XXXX regarding an education debt due to XXXX University in the amount of {$5900.00}. After speaking with XXXX about this, they assured me that they did work directly with ACT regarding collections, and I was referred back to ACT to settle the debt. On XX/XX/XXXX, I called ACT and spoke with XXXX ( who refused to give last name ), who told me that they were authorized to offer me a settlement amount of 70 % of the total debt, which would then equal {$4100.00}. She said I would have about a month to pay this amount and that it would be reported to the credit bureaus on XX/XX/XXXX if not paid. I was also told that I could make payments online through the company website ( XXXX ). When I created an account on this site to make payments, it showed the original amount of {$5900.00}. As a test, I made a {$300.00} credit card payment on XX/XX/XXXX, to see if the payments would reflect on the account. When I checked a couple of days later, the payment did reflect, but the balance was still the original amount and not the 70 % balance. I then spoke with my father who is an attorney and he suggested that I call back and get this settlement offer in writing. I called back on XX/XX/XXXX, and spoke with XXXX, who claimed to be a supervisor ( again, no last name given ) and reiterated my initial conversation with XXXX and he acknowledged that the settlement offer was made and was valid ( 70 % ) and also said that if it was not paid by XX/XX/XXXX it would be reported ( negatively ) to the credit bureaus. I asked for this settlement offer in writing, as the original letter did not have any dates listed on it but was told that their policy was that they could not send any written correspondence out via email but that the call was recorded and there was a record of the settlement discussion. This made me hesitant, but I did not feel as though I had much choice. When I asked how I could know that the settlement offer would be honored if I paid the 70 %, he replied that I would just have to trust him because they were an honorable company. Again, what choice did I have, as I did NOT want to ruin my credit and they were threatening to report it if not paid. When I created an account on this site to make payments, it continued to show the original amount of {$5900.00}, less the {$300.00} credit card payment that I had already made. I asked XXXX about changing this number to reflect the settlement amount ( XXXX ) and he told me that they were not able to do that but once the 70 % was paid off, then they would zero out the account and mark it as settled. Again, this did not make me comfortable, but I continued making payments online ( see the three ( 3 ) attached transaction receipts ). On XX/XX/XXXX, I made a {$2000.00} payment, and then on XX/XX/XXXX, I paid the remaining balance on the 70 % settlement offer of {$1800.00} the total of all three payments equal {$4100.00} XXXX 70 % of {$5900.00} ). On XX/XX/XXXX, I called ACT one last time to make sure they received the payments, and that the debt was settled and would NOT be reported ( negatively ) to credit bureaus. I spoke with XXXX ( again, no last name given XXXX who said that she could see the previous conversations, including the settlement offer but there was an issue. The issue was that I made XXXX payments and the settlement offer was only valid if I made TWO payments?!?! I have NEVER heard of anything so ridiculous. I was offered a settlement amount to pay a debt, which I paid in full, and now at the last minute, they tell me that the deal was null and void because I made three payments instead of two! XXXX then said she could now offer me the same settlement offer ( 70 % ) on the remaining balance of {$1700.00}, which did not make any sense to me as I had paid the amount agreed in full already. I asked to speak with another supervisor and got XXXX ( again, no last name ) who informed me that I was only allowed to make 2 payments to fulfill the debt and 3 payments canceled the original offer. I told him that none of the people I had spoken with previously had told me that and it shouldnt matter because I paid the amount due. He said there was nothing he could do. I asked if I could just pay the balance of what their system shows as due ( {$1700.00} ) and he said that it was after XXXX EST and the payment would not reflect until Monday, XX/XX/XXXX and that the account would be reported ( negative ) to the bureaus on Sunday, XX/XX/XXXX. This is preposterous! Not only did they renege on the original settlement offer that I paid in full as promised, but they told me that I would need to pay the whole balance but they could not guarantee that it would not report negatively to the credit bureaus. So, ultimately, even if I paid the entire balance originally due, it wouldnt matter. This makes absolutely no sense and I feel as though this was a complete scam from the beginning. I have no idea where my {$4100.00} went or even if it went to the debt owed to XXXX. XXXX said he could send a message to client services asking for the account to be marked as settled but he could not guarantee that it would be done by Monday, XX/XX/XXXX and that it still could report negatively on Sunday, XX/XX/XXXX. I asked if he could send me something in writing that showed that my payments were made and that he sent correspondence to client services and he said they were not permitted to do that! I asked to speak with HIS supervisor, and he told me that his supervisor did not take phone calls from clients, nor could his supervisor receive or reply to emails. NONE of this makes any sense and I feel I was completely scammed! Now I fear that I am going to get a huge hit to my credit, even though I honored the deal that was made and was completely misled and misrepresented. This company asked for and took money without any acknowledgment and once they went back on their offer at the last minute, they still asked for an additional amount to be paid but also would not accept a payment to completely settle the account! How does anybody win in this situation? It is as if they just WANT to ruin peoples credit! Also, after some additional research, I found that there have been MANY complaints against this company for similar reasons of misrepresentation and outright lying and I am prepared to sue them and fight this as far as it will go. I satisfied my debt, and this company just wants to financially hurt consumers at any cost! All I want is for my account to be marked as satisfied and not to be reported ( negative ) to the credit agencies for a debt I paid in full. Especially in this time of COVID and loss of job/income, it was hard enough to pay the settlement amount but I did because it was owed and I have very good credit that I do not want it to be destroyed. Information I found about ACT company through a XXXX search : " The XXXX has closed 59 complaints against Account Control Technology , Inc in the past three years, with 23 closed in the past 12 months. Most of those complaints allege problems with billing and collections, but several complaints about customer service have also been posted. Since XX/XX/XXXX, the Consumer Financial Protection Bureau ( CFPB ) has received 60 complaints about ACT. Justia lists at least 10 cases of civil litigation involving Account XXXX XXXX. '' From XXXX : XX/XX/XXXX Customer Complaints 32 complaints closed in last 3 years 12 complaints closed in last 12 months *Let this correspondence reflect that as of XX/XX/XXXX, the settlement offer of {$4100.00} ( 70 % of {$5900.00} ) has been paid in full ( see attached receipts ). I will be filing additional complaints with XXXX and have consulted an attorney.

I have attached documents to support my case : It has been brought to my attention recently a collection agency, Account Control Technology has illegally charged interest on my federal student loans between the dates of XX/XX/XXXX to current. On XX/XX/XXXX, the Coronavirus Aid, Relief, and Economic Security Act became law, providing relief measures on Education Department owned federal student loans. This law has been extended to XX/XX/XXXX. Under this law, interest rate is 0 % for federal student loans, even those in default. My loans are owned by the U.S. Department of Education and serviced by XXXX ( refer to XXXX page dated XXXX ) who is a loan servicer for the U.S Department of Education. Please refer to the XXXX page dated XX/XX/XXXX. This was the last paperwork that I received about my student loans until the week of XX/XX/XXXX. You will see at this time ( XX/XX/XXXX ) I owed {$39000.00} total with interest. I do understand there are 23 more days of interest being added to my loans till the Cares Act became law. In this 23 day period, there is no way over {$2500.00} dollars in interest could be added. Please refer to the ACT paperwork dated XXXX XXXX. According to ACT, {$2500.00} in interest has been added since XX/XX/XXXX. Account Control Technology is breaking ( 2 ) laws that I know of according to the Cares Act : 1. Collections of federal student loans owned by the Department of Education must stop under Cares Act. 2. Interest has been charged to my Student loans under the Cares Act, which is illegal. I hope legal action can be taken against ACT and whoever else might be involved in this theft and deception immediately. I have listed some of the Laws from the Cares Act related to my case. The following information was found on studentaid.gov. https : //studentaid.gov/announcements-events/coronavirus On XX/XX/XXXX, the office of Federal Student Aid began providing the following temporary relief on ED-owned federal student loans : suspension of loan payments, stopped collections on defaulted loans, and a 0 % interest rate. On XX/XX/XXXX, the Coronavirus Aid, Relief, and Economic Security Act ( CARES Act ) became law, providing for the above relief measures on ED-owned federal student loans through XXXX XXXX, XXXX. On XXXX XXXX, XXXX, the COVID-19 emergency relief measures were extended on ED-owned federal student loans through XXXX XXXX, XXXX. On XXXX XXXX, XXXX, the COVID-19 emergency relief measures were extended on ED-owned federal student loans through XXXX XXXX, XXXX. On XXXX XXXX, XXXX, the COVID-19 emergency relief measures were extended on ED-owned federal student loans through XXXX XXXX, XXXX. 0 % Loan Interest Interest is being temporarily set at 0 % on federal student loans. Which loans does the 0 % rate apply to? From XX/XX/XXXX, through the end of the COVID emergency relief period, the interest rate is 0 % on the following types of federal student loans, but only if they are loans owned by ED : Defaulted and nondefaulted Direct Loans Defaulted and nondefaulted FFEL Program loans Defaulted and nondefaulted Federal Perkins Loans Defaulted HEAL loans Please note that some FFEL Program and HEAL loans are owned by commercial lenders, and some Perkins Loans are owned by the institution you attended. These loans are not eligible for this benefit at this time, but you can contact your servicer to ask about what benefits may be available. If we transfer your federal student loans from one servicer to another servicer, your loans will still be owned by ED. The transfer to another servicer simply means that a new servicer will provide the support you need to fully repay your loans. Heres what you should expect if your loan is transferred to a new servicer : You will receive an email or a letter from your assigned servicer to inform you about the transfer. You will receive a welcome letter from the new servicer after the new servicer receives your loans. This notice will provide you with the contact information for the new servicer and inform you of actions that you may need to take. All of your loan information will be transferred from your assigned servicer to your new servicer, but you may only be able to see online information that covers the period since your new servicer took your loans over. There will be no change in the terms of your loans. Your previous loan servicer and new loan servicer will work together to make sure that all payments you make during the transfer process are credited to your loan account with the new servicer. After you receive the welcome letter from your new servicer, you should do the following : Begin sending your loan payments to your new servicer. If you use a bank or bill paying service to make your loan payments, update the new servicers contact information with the bank or bill paying service. Follow the new servicers instructions for creating an online account so that you can more easily communicate with the new servicer and keep track of your loan account.

I have tried un-successfully to request a Hearing for Loan Garnishment with ACT, Account Control Technology due to hardship. I have attached the following documentation for review Letter and Loan Rehabilitation dated XX/XX/2018 appealing for hearing by phone which I never received, and I sent all documentation ( letter attached ) Letter from ACT on Federal Student loan letterhead denying my request dated XX/XX/2018 Letter, and Loan Rehabilitation to ACT dated XX/XX/2018 appealing again for a hearing in person, and I again submitted all documentation. Copies of Post office receipt showing the package was mailed to ACT and Federal Student Loan Department on XX/XX/2018 and received by ACT on XX/XX/18 Letter XX/XX/2018 to ACT explaining they did not give me credit for my Mortgage with XXXX in amount XXXX, and requesting another hearing in person due to the amount was not applied in their denial letter dated XX/XX/18 Copy of Garnishment payments been paid to Account Control Technology since XX/XX/18 totally payment in amount of {$6800.00} as of XX/XX/18 Email from XXXX Customer Service requesting complete Final Discharge of Debtors, I responded with complete papers and mailed to Bankruptcy unit in XXXX XXXX MN in XXXX, and completed Bankruptcy papers was included in appeal letter, requesting hearing, and Rehabilitation loan papers dated XX/XX/18 Account Control Technology is a predator collection agency charging high interest at a rate of 75 %, I have had a total of {$6800.00} garnishment payment deducted, with only {$160.00} credited toward the loan amount principle. Please see documentation attached showing {$4700.00} payment received by ACT crediting at a rate of 75 % toward interest. A letter I received from ACT dated XX/XX/18 indicating interest was supposed to be at 4.133.63 %, and the amount of {$160.00} toward the principle is not calculating interest at 4.133.63. These high interest payments are against the usury laws, and this practice of charging high interest rates and fees at absorbed amounts should not be allowed. I borrowed only approx. 21,000.00 from the Federal Student Loan Department, and I have received a letter dated XX/XX/18 stating I owe XXXX and XXXX dated XX/XX/18 stating I owe XXXX, XXXX. I have requested explanation for the over {$10000.00} different, and have received only federal codes from Account Control Technology that these fees are allowed to charge at this amount. I would like to have the actually meaning of all the federal codes, along with the rights to me as the borrowing the proper appeal process beside stating if I do not like it I can sue in Federal Court as mention in the letter dated XX/XX/2018 from Account Control Technology. I have been threatened by ACT when requesting hardship hearing ( Rehabilitation Loan ), if I do not like their decision I can sue them in Federal Court which is a terrible way to treat a person, a consumer which is only trying to get help per Federal guidelines. I file a complain directly with Federal Student on XX/XX/2018 reference the threat, and I was not given full credit of all monthly payments. I was told by the Federal Student Loan department when speaking with a supervisor only to refile again ( please see letter dated XX/XX/18 ). If I was given full credit for all my monthly payments, and my mortgage was taken into consideration in the amount of {$1500.00}, this could have affected the outcome of ACT decision no tot grant my hardship request. I feel this was a deliberate done on ACT part in order to not grant the garnishment request. I was not granted the phone hearing requested in the first appeal on XX/XX/2018, and I was advised by supervisor at the Federal Student Loan number name XXXX to resubmit the request again. I sent another request on XX/XX/18, requesting a in person hearing along with all documentation, and as of today no respond from Account Control Technology. The garnishment has been a serve hardship to my family, and I am only requesting a lower payment amount. I have borrowed funds from family to help with my monthly payment due to the garnishment has left me in a financial hardship. Act Control Technology practice is inexcusable and should not be allowed, requesting the necessary hearing, Rehabilitation Loan, and following the procedure have left me to no avail with ACT. I supply documentation and they claim they are not there, calls go unanswered, and letters is returned from ACT is standard and they do not answer any question. In XXXX of XXXX, I was provided by my employer, XXXX XXXX, an Administrative Wage Garnishment Order for the U.S. Department of Education issued through Account Control Technology INC. 1. At no time did I receive any notice either written or by telephone from Account Control Technology INC. regarding any debt they claim I owe. 2. I was never given an opportunity to dispute the debt or request debt validation before garnishment. 3. I was never provided the nature of the amount of the debt. 4. I was not provided an opportunity to inspect and copy records relating to the debt. 5. I was not given the opportunity to object to the garnishment as a means to collect the debt. 6. I was not given the opportunity to avoid garnishment and provide voluntary payments. 7. I was not given the opportunity to enter into a written agreement under terms agreeable to the U.S. Department of Education to establish a voluntary repayment agreement. 8. I was not given the opportunity for a hearing to present and obtain a ruling on any objection by myself to the existence, amount or enforceability to the debt. 9. I was not given the opportunity for a hearing to present and obtain a ruling on any objection that garnishment of 15 % of my disposable earnings would produce an extreme financial hardship. 10. I was not given the opportunity to have garnishment action suspended by filing a timely request for a hearing, until the hearing is completed and a decision issued. In XXXX XXXX, I sent to Account Control Technology INC., via certified mail ; return receipt, a request for debt validation for the debt they claim I owe. It was delivered on XXXX XXXX, XXXX. After leaving school & subsequently defaulting on my student loans 10 years ago, I recently sought to begin repaying my student debt. Per ed.gov website instructions I contacted student loan manager at the school holding the debt on my Federal Perkins Loan, who then referred me to the collection agency now responsible for resolving the [ XXXX XXXX ] debt. The collection agency in charge of my Perkins Loan insisted that in order to resolve the Perkins Loan [ {$7600.00} ] debt I must " Consolidate '' all of my [ other ] outstanding defaulted student loans with them. I declined and specifically requested to " Rehabilitate '' only my defaulted Perkins Loan with this agency now in charge of the Perkins Loan debt. The collection agency refused to offer me " Rehabilitation '' on my Perkins Loan at all, and again insisted that my only option was to " Consolidate '' the debt. I declined, and that was the end of the conversation. Immediately following that phone conversation I emailed the student loan manager at the school and advised her of my concerns that the collection agency was being less than honest about my repayment options, she advised me that although the agent I spoke to was incorrect about my option to " Rehab '' the loan, the agency was trustworthy. One day later the collection agency called me back and I was advised that in order to " Rehab '' my Perkins Loan I must accept a minimum payment of $ XXXX/month. I declined again as I simply can not afford that payment. Again I immediately contacted ( by email ) the student loan manager at the school explaining that I have been out of work for an extended period of time and I can not afford such a high payment, and requested an appeal or other process to reduce what I am being told is a mandatory minimum payment to " Rehabilitate '' the Loan. The student loan manager emailed me back stating that the collection agency is correct, the minimum payment possible in order to " Rehab '' my Perkins Loan is $ XXXX/mo. I researched the issue of repaying defaulted Perkins Loans on the Dept. of Education website here : XXXX ( page XXXX-XXXX ) and found that the DOE requires schools to offer repayment of defaulted Perkins Loans " sufficient to satisfy the outstanding balance on the loan within a 10-year repayment period. '' This was directly contradicted to me several times in email & phone conversations that I had with both the collection agency and the university student loan manager. Further more, on the Consumer Financial Protection Bureau website " Repay Student Debt '' page here : XXXX it states that defaulted Federal Student Loan borrowers `` have the right to set your payments based on how much money you make. Your payments can be as low as {$5.00} per month if you are unemployed or have very little income. Your debt collector is required by law to offer you this income-driven rehabilitation payment plan. '' I realize this ( $ XXXX/month ) policy may not be specific to Perkins Loans. My complaint is that a ) the collection agency has been intentionally dishonest regarding my repayment options ; b ) both the collection agency and the university 's student loan manager continue to insist to me, on the phone & by email, that my minimum " Rehabilitation '' payment must be significantly larger than that indicated by the DOE 's published regulations regarding defaulted Perkins Loans, despite knowing that such payments would cause significant " hardship for the borrower '' [ me ], and in direct contravention of the DOE guidelines ( see XXXX page XXXX-XXXX ).

They were angry at me for doing my job as XXXX XXXX XXXXwhich was to report their financial malfeasance, racism, student endangerment, and misogyny in audit reports distributed to the university 's board of regents. With no job/no income, my home is now in foreclosure due to being 4 months behind on mortgage payments. Although now employed, my salary is so low that I'm still near poverty wages. Despite 30+ years of XXXX/XXXX XXXX, corporations here dont hire experienced XXXX females. So as a XXXXXXXX XXXX XXXX for a small XXXX, I make {$50000.00} per year -- before taxes and medical insurance. I direly need my refund to catch up on the 4 late mortgage payments -- to keep my home! Yet the Department of Education seized my ENTIRE XX/XX/XXXX refund of {$8800.00} for a Parent Plus Loan that they've allowed a collection agency to double the balance owed on -- from approx {$9000.00} to {$18000.00}! For the Department of Education to contract with a spurious agency like Account Control Technology ( ACT ) and allow ACT to double my loan balancewith no explanation, no documentation, no applying my previous loan paymentsto {$18000.00}, and then seize my tax refund after I've been jobless for a yearit 's horrific! Background on my interactions with ACT : In XX/XX/XXXX, while still employed, ACT contacted me about my Parent Plus Loan. I was suspicious of ACT, and believed it to be a scam agency because their representatives ( 1 ) used high-pressure, abusive and demoralizing language, ( 2 ) refused to explain how the loan doubled from my owing approx {$9000.00} to {$18000.00}, and ( 3 ) refused to send me any documentation about the loan and the additional {$9000.00} in charges -- unless I first verbally agreed to enter into an agreement with them by phone, which they would record. After receiving several calls from ACT in XX/XX/XXXX, I contacted DOE, who confirmed that my loan was sold to ACT, but refused to explain how my loan balance doubled to {$18000.00}. I then called ACT back to work towards making a payment arrangement. I was laid off, however, before I could make payment arrangements. Today, XXXX XXXX XXXX, 2015 - I notified Account Control Technology, Inc. at XXXX XXXX ) XXXX regarding my student loan payments. I spoke with XXXX. I have been faithful in my payments and have automated withdrawals from my personal banking account. However, I received a letter dated XXXX XXXX 2015 stating payments would begin posting payments to my account on XXXX/XXXX/2015. I was shocked. I had no idea at this time my promissory payments had stopped. I am careful with these payments since I do not want an OFF-set of my taxes! So with this information, I immediately sent documentation to the Federal EDU collection, Acct. Control Technology asking for payment consideration, why they stopped since I have never missed a payment - I asked if the correspondence reached the office and if so, please read the documentation. Oh, did she read it! She was quite aware that not only had I not known about the payments that I had also spent the past 5 months with my helping my mother who had significant and XXXX at The XXXX XXXX Hospital and XXXX XXXX XXXX. She then kept asking if I wanted to begin a new account. I can not believe A NEW account. This was not my fault in the first place. No letter of termination, no financial funds, we are sorry you have defaulted on your promise to pay - NOTHING!!! XXXX then stated to me that the representatives had made calls to my phone and to my mother. I hit the ceiling. How can mother speak to anyone - SHE CA N'T. I knew then these people were lying. I offered to have a letter of medical confirmation sent to the department, they refused. XXXX then went to her supervisor who was just as nasty. Kept asking me why I not paid on my account. I explained again it was not that I did not pay, I did NOT know my payments WE 'RE not going through! To Whom It May Concern : From XXXX XXXX XXXX I had wage garnishment occur from Account Control Technology on behalf of XXXX/The US Department of Education for defaulted student loans. The amount they stated owed was {$6700.00}. During this time, they deducted {$6700.00}. Since I owed this money, I did not contest it, but the garnishment was a significant financial hardship at the time. I have the wage garnishment forms they sent to my employer and paystubs that show the garnishment occurred. However, the funds were never applied to the loans, and paperwork was never sent to me as requested, indicating I had paid the loan in full. My Federal Loans that equal the amount Account Control Technology deducted are still active on the US Department of Education website in the amount of {$6500.00}. The loans have since been moved to other companies. On XX/XX/2022, I called Account Control Technology and spoke to a representative named XXXX. XXXX acknowledged the collection but can not or ( will not ) send me proof the garnishment was applied to XXXX loans or that the US Department of Education was informed the debt was paid in full. XXXX states Account Control Technology can not provide anything in writing and are " just '' a third party that worked on behalf of XXXX, not the US Department of Education ; however, this is contrary to what they stated in the letter they sent to my employer. Account Control Technology is a third-party contractor for the US Department of Education . XXXX also stated the account was released back to XXXX once I completed the garnishment and the debt was paid. XXXX has no record of receiving this payment and applying it to any of the loans that were with them from XXXX. They have sold some of these loans to new companies. XXXX informed me she would forward my concerns to Account Control Technology 's accounting department, and someone would contact me within 7-10 business days. Account Control Technology took ( {$6700.00} ) of my hard-earned wages and stated they can not or ( will not ) provide any insight as to where the money went. As of today, XX/XX/2022, I am still waiting to hear from their accounting department. Due to their mishandling of these funds, my legal counsel has informed me Account Control Technology violated several consumer laws. I am in the process of notifying the appropriate agencies to investigate and may pursue litigation. I 've contacted this company since XXXX XXXX XXXX regarding my account that was taken over by XXXX as of XXXX XXXX XXXX. I was told by XXXX an account manager that a letter went out to my employer the week of the XXXX My employer finally received a letter dated XXXX/XXXX/XXXX, 9 days after what I was originally told. I called in on XXXX and spoke to XXXX myself, requesting a fax letter releasing my garnishment. XXXX stated she 'd have that letter faxed to me the same day. On XXXX I still had n't received the letter to provide my employer so after calling and leaving repeated messages I called back again and asked for XXXX 's supervisor, to my surprise XXXX answered and stated that she 'd get the letter faxed for sure. After repeating myself to XXXX countless times I finally received a fax on XXXX releasing my garnishment dated XXXX. I called her back AGAIN, I asked for a corrected letter releasing with the proper date. She kept going in circles about my employer receiving a refund once they received my payment since there was no account to apply it to. I have a payment that needs to be made to XXXX. This has become a headache trying to get these people to correct what was a simple request. If there will be no account to apply the payment to why ca n't a corrected fax be sent to my employer instead of waiting about a month to receive funds that do n't belong to them? I have to make my payment to XXXX with the funds that were withheld from my checks and it 's becoming difficult. The following email was sent on XXXX/XXXX/XXXX at XXXX I have attempted to reach out multiple times with failed attempts. My employer and I have yet to receive this letter that should have taken 1-2 days at the most based on their location. XXXX also stated that shed have a letter of release typed up and faxed to my employer. Finally received the fax on XXXX/XXXX/XXXX with the date of release XXXX/XXXX/XXXX. When I received the fax I called in AGAIN and spoke to XXXX stating the release was dated with the date the fax went out, which was XXXX/XXXX/XXXX not XXXX/XXXX/XXXX. On or around XX/XX/XXXX, ACT and I agreed to a 10 month rehabilitation repayment agreement where I was to pay {$5.00} a month beginning XX/XX/XXXX and due every month thereafter on or around the XXXX of each month. This repayment plan agreement was entered to help get my student loan debt out of default as my wages are currently being garnished. The agent I spoke with that set up the repayment plan explained that after 5 on time payments, my wage garnishment would be terminated. On page 4 of 6 of the agreement I agreed to and signed, bullet number seven, it states that " if you are currently subject to administrative wage garnishment, XXXX or its authorized agent will suspend the garnishment after you have made five qualifying monthly payments under the agreement. '' All my payments to date have been made as instructed by the agreement and I have currently made 7 on time payments. The fifth payment was due in XX/XX/XXXX and my wage garnishment is still in place. It was never terminated as agreed per our agreement. ACT has currently illegally withdrawn 5 extra wage garnishments as my 5 month anniversary was XX/XX/XXXX. My fifth payment was made weeks before that fifth month anniversary. At the moment my fifth payment was received, ACT should have issued a termination of wage garnishment to my employer. That did not happen. Five extra garnishments were taken from my paycheck which I am demanding ACT issue me a refund of those 5 garnishments immediately. I have all my paycheck stubs and willing to provide the exact amounts, but I am positive ACT has the exact amount of all five of those illegal wage garnishments. I recently sent my XX/XX/XXXX payment along with a letter demanding ACT terminate my wage garnishment or I will hire an attorney to litigate this in court. I did not hear from ACT. I then called ACT on XXXX and left a message demanding ACT call me to discuss this breach of contract alleging ACT is in violation of UDAAP and FDCPA misrepresentation violations. A few hours later, I received an email from ACT informing me they have issued a termination of my wage garnishment to my employer and that they have confirmed my employer has received the termination letter. I appreciate the issuance of the termination letter to my employer, but I will not be satisfied until I receive the refund of 5 breach of contract wage garnishments. I expect this refund to be issued immediately. I am also asking for a reasonable amount of statutory damages for the UDAAP and FDCPA violations committed by ACT. I will seek legal representation if the amount of statutory damages is not a reasonable agreed amount. I have access to a team of FDCPA Attorneys and will not hesitate to escalate this dispute in court which would probably cost more than settling this dispute.

Account Control Technology , Inc., has not honored my cease and desist telephone communications requests. Several times inXX/XX/2019, specifically, XX/XX/XXXX, and XX/XX/XXXX, I had rather intimidating and belittling phone calls with a representative ( Id # XXXX ), who used demeaning and aggressive language towards me. On one of the calls, she instructed me to get a prepaid card ( on which I would accrue monthly fees ) in order to make a payment and when I asked her if there were any other options available to me, she reiterated that if I did not make a payment within 30 days of receiving the notice of wage withholding, my wages would be garnished through an administrative garnishment. Under the threat of an administrative garnishment, not having the money, feeling belittled by ACT, and based on the threatening and condescending manner with which they spoke to me, I purchased a prepaid card in order to make the payment and enter into an arrangement for subsequent monthly deductions from the card. ACT collected money from me in order to execute the agreement. However, on the same day that I made the payment, prior to providing ACT with my card information, I requested that they provide me proof that I owe the debt because I could not find documentation it based on a review of my personal records. Today, XX/XX/2019, I again received several calls from a number that ACT called from on XX/XX/2019. On the XX/XX/2019, call, I told the representative that I requested that they stop calling me a few months ago and that I only wanted letter communications. Also, today XX/XX/2019, ACT sent me an email about the debt. It has become unbearable. Also, I spoke with XXXX, the federal student loan servicer, to ask if ACT was collecting on their behalf and the XXXX representative said " no, '' which increased my suspicion of ACT. ACT began each call with me by stating that " they've been hired by XXXX '' to collect, which caused me a lot of stress. I ask that all the calls connected to the account on which ACT is attempting to collect be reviewed. In those calls, you'll find evidence that : - I requested that ACT not call me ; - My communications with ACT reps were abusive ; - ACT reps deceptively represented to me that they were hired by XXXX to collect the debt ; - ACT used the threat of garnishment to take a payment from me before providing me proof that I owned the loan ; and - ACT may have committed other violations of consumer protection laws and infringed on any rights granted to me under those laws.

O n Frida y XX/XX/XXXX i was contacted by Account Control Technology about 3 outstanding student loans. I explained that I was in the process of consolidating all of my loans through XXXX and that I needed additional information in order to add these loans to the account. after giving me a hard time supplying the requested information, they provided me with the account numbers and the amounts of the loans ( total since they said they were unable to give me a breakdown ) I contacted XXXX about adding these 3 loans to the existing account and they emailed me a form and explained it will take a few weeks. Today, XX/XX/XXXX i received another call from Account Control Technology. ( every time they call, they call from a local number and the line stays quiet, i have to call back only to find out who they are. If i never called back i would have never known who they are yet they can consider this a " contact '' on their records. ) On todays call i explained to the guy who answered that I had already spoken to them just this past Friday and that I already contacted the company which is doing my consolidation loan and provided them the info. I asked that they give me 2 weeks and to please refrain from calling till then. If by that time they have not resolved I would be happy to make arrangements in the meantime. The guy replied " your account is already placed for wage garnishment of 15 %, i will remove you from the call list and if we happen to have your account in 2 weeks we might be able to speak then '' i told him that there is no way they can garnish my wages without notice, there has to be a hearing or some other type of notice. he said " no ma'am, its the department of education all it takes is a flip of a switch '' I was so upset i said goodbye and hung up. I contacted the DOE and they advised that this is not true. I explained what my intentions are and what I have done so far and she advised that what I am doing is correct and do not need to worry about this. She apologized on their behalf and notated my account. The information that they are giving at Account Control Tech is incorrect and used to intimidate people into making payments. As per their conversation they are recording the calls. the acct is under my SS # XXXX and the name on file is XXXX XXXX ( my married last name is XXXX ) The number they are calling me from XXXX XXXX, fl though they are in XXXX, CA. their number is XXXX the numbers that are calling me are XXXX, XXXX. my phone number they are using to reach me is XXXX XXXX

My name is XXXX XXXX and I am XXXX XXXX graduate of the XXXX XXXX in XXXX program. Following graduation I re-enrolled at XXXX to pursue higher education. After review of my records I was enrolled and granted approval to register for three courses. Two of those courses were scheduled to begin on XX/XX/XXXX. The third course was scheduled to begin on XX/XX/XXXX. Unfortunately I had a dire family emergency come up which required a significant amount of my time. Realizing this, I contacted the college for guidance on withdrawing from my courses with the hopes of registering for them the following term. I was advised by phone that if I were to withdraw 0-3 days prior to courses starting I would receive a refund for the tuition and to submit a request in writing to the Office of the Registrar using email XXXX. I submitted the written and signed request to the email I was provided on XX/XX/XXXX at XXXX. I received no further communication from the college and assumed the withdrawal had been taken care of. In XX/XX/XXXX I attempted to obtain course approvals. I sent a message to my advisor to inquire about the status of those approvals and I was advised that my account was on a " fiscal hold '' and that I needed to contact the bursar 's office to " settle my account ''. I did as such and was advised by a person named XXXX that my request was not processed for the withdrawal and that I owed approximately {$4500.00} for the courses. I advised her that I didn't feel this was right but that I would try to pay the balance rather than file a complaint on the college that had afforded me so many opportunities. So I proceeded to try and save up enough money to pay the balance over the next several months. In XX/XX/XXXX I contacted the bursar 's office to set up a payment plan for the balance on my account but I was advised that my account was submitted to a collections agency and that I did not qualify for a payment plan. I then lost faith in the college and pursued my education elsewhere. However, my current educational institution requested that I send a copy of my official transcripts to them and upon attempting to do so I was notified again via a message on the website that I could not request my transcripts due to an issue with the bursar 's office. I followed the college 's policy on submitting my withdrawal request and it was on time ( prior to courses starting even! ) and because of what I assume to be a clerical error I am expected to pay thousands of dollars.

I have been contacting Account Control Technologies and have been on and off the phone with them for two hours trying to get my itemized statement over the phone. For one thing, they never sent a written statement that the debt sent to their agency, which is my right. The XXXX XXXX office says they do not have access to it and can only mail it within 7-10 bu siness days. I have asked for how the collection fees are broken down and XXXX XXXX has refused to give it to me. I have been directed to corporate offices in Ohio and California and three times have been transferred back to their office. They refuse to give me information on my account. I have asked for a written document detailing that if I have my debt paid in full before XXXX / XXXX / XXXX , that it will not be reported to my credit. They have outright refused to put anything in writing outside of the itemized statement. They told me that over the phone and do have recordings of that conversation, but I wanted it in writing because I know how shady and deceptive those places are. I have been put on hold for extended periods of time until I finally hung up and called back. My call has been outright ignored three times when I began requesting that it be elevated outside of their office. XXXX XXXX has said that they are the only office that will deal with my account and speak to me about it, but they do not have access to my itemized account information. In the period of two days, I have been told that they can add fees to my account while it is in their office ( by XXXX ) , which he was corrected and told that my college still owns the account and they have no authority to add anything, but the " fees '' and they are the ones who set the date to report to my credit ( by XXXX ), but then when my call was elevated to XXXX and then XXXX , they would not tell me what those fees were. They said they can add up to 18.25 %, but did not have the percentage and said that was n't the only fee that would be on there. I just need my financial information and I am trying to protect myself. I have called the university and ACT is contracted through them, so they handle all accrued fees from when it is handled by them. I just need to be informed that I am paying the correct amount!!!! I need this information quickly before XXXX XXXX or it will completely screw up my credit.

I found out I had an outstanding student loan this year after I filed my taxes, when my refund was taken. I made contact with the XXXX XXXX loan and the collector.I explained the situation and that I was disputing as the information that they had on file was from over 20 years ago : the address was from when I still lived at home with my parents, my phone number was incorrect, my email was incorrect and I was not aware of having this loan. I was told that I would need to file a dispute and contact them when I heard back - this would have been in XXXX. I started the dispute and requested copies of the paperwork at that time. I was assured that it would be sent. I never received it. In XXXX I received apx 20+ calls from number I did not recognize that only left partial recordings on my voicemail- none identified the company, who they were trying to reach, or why. In XXXX and XXXX the same. Multiple calls from a robodialer, sometimes minutes apart. None identifying who they were, why they were calling, other than " an important matter '', and a partial message on my voice mail. I actually spoke with a XXXX ( or XXXX ) XXXX in XXXX. I answered the phone and was immediately bombarded with rude and abrupt questions and threatened with having my wages garnished if I did n't immediately do as she said. I attempted to explain that I was disputing the loan and her reply was " You 've had enough time, you need to pay this now ''. I asked for her to send me the Promissory note- she told me that she would not. I asked if it could be emailed, no. I asked for her supervisor and was told that he was n't available and that he would n't be able to help me. I hung up the phone and called back after work- The Company that has my loan is Accounts Control Technology. I spoke with a XXXX XXXX who claimed to be XXXX Supervisor. I explained the issues I had been having, requested the paperwork again, and was told no problem, he would mail it out. It 's been 3 weeks and I still have n't received the paperwork. The phone number they have been calling from is XXXX. The extension I was given was XXXX. These people are harassing, threatening, bullying, and intimidating me in an attempt to get money for a loan that I am trying to prove I did not take out to begin with. Contacted by Account Control Technologies in XXXX of XXXX. Informed them not to contact me at my place of employment and to email or hard copy mail all correspondence to my residence. They called a few days later at my place of employment even after being informed. Spoke with several representatives including XXXX XXXX, XXXX XXXX, XXXX XXXX. Found that they had an incorrect address for me and I had not received any documentation prior to this contact. They had " XXXX XXXX '' instead of " XXXX XXXX. '' Never received any documents prior to this phone call. Signed rehabilitation agreement on XX/XX/XXXX. Signed for them to auto draft my checking account on the XXXX of each month of {$5.00} for 9 months. Emailed copies of 2 paychecks on XX/XX/XXXX as per their request. Requested an amended letter stating the actual amount due two times via email and have not been received as promised by XXXX XXXX. Their letter reflects amounts including a charge of {$2400.00} collection fee and a charge of {$520.00} interest fee. Was informed in writing via email on XX/XX/XXXX to not contact me via phone but by email / letter only. Resent paycheck copies on XX/XX/XXXX. Was informed that all collection calls, tax refund offset would not occur, etc. and credit reports would be updated showing payments if payments were made on consistent basis. Which they have been since XXXX. Contacted ACTS on XX/XX/XXXX, XXXX found they did take my XXXX tax refund of {$4900.00}. They also took XXXX refund of approximate {$6000.00}. Was bounced around to four different representatives, given the run around and told I was misinformed of the agreement. Also, XXXX XXXX was completely unprofessional and threatened to contact my employer to garnish my wages. A man by the name of 'XXXX XXXX contacted my boss on Tuesday XXXX XXXX, XXXX and left a voicemail which we have a recording of. This company is fraudulent, harassing and dishonest. All communications have been documented. I refuse to speak to them anymore via telephone. XXXX XXXX also informed me that sending an email is a courtesy?? Today, the president of my company held a conference with me, payroll and human resources regarding the attached document from Account Control Technology , Inc. regarding my employment status. I dont know who this company is or why they are trying to v erify my employment. What disturbed the president of my company is was the fact that it states via fax " ATTN ; PAYROLL / GARNISHMENT DEPT ''. From what I know, I dont owe this company any money and if I do, I was notified properly. I had to leave work today due to XXXX XXXX and visit my doctor ( i have proof of this ). I needed meds to calm down because I was having a XXXX XXXX - something that has n't happened to me in over XXXX years. Because of this unannounced meeting with my company president, payroll and human resources, I had to leave work. This is not fair to me as a consumer because I dont know who this company is and why they are inquiring about my employment status without my written consent and the wording " GARNISHMENT DEPARTMENT '' in their correspondence with my employer. Had I known about a potential debt owed, I would have challenged it pursuant to the FDCPA and requested they send me information regarding the validation of the debt, the original creditor, how they came to the amount they 're seeking, licensed to collect in my state, etc ... none of this was done. They 've hinted to my employer, without validation that I owe money because they attention their unwarranted job verification letter to " PAYROLL/GARNISHMENT ''. The fact that they 've used " GARNISHMENT DEPT '' suggests dissemination of personal financial issues without validation. I 've submitted a complaint with the XXXX Attorney General, Attorney General of XXXX and with your office. I will continue to prosecute this matter until a fair decision is made. When I attended XXXX XXXX my last name was XXXX but now I am remarried as XXXX which I also referenced in my letter. I have checked the original letter & my credit report and there's two different addresses listed for Account Control Technology , Inc. for sending correspondence. How can the consumer know if their letter is being received to the appropriate address. Second, Account Control Technology , Inc. signed for the green card on XX/XX/2018 which I referenced the acct number on the green card & envelope as stated in the original letter. If there was an issue the person that signed for the letter should have forwarded the letter to the appropriate division especially that a reference number was included on the letter. Third, Account Control Technology , Inc. should honor my dispute letter & that is was received timely and that any/all adverse information be removed from my credit report as soon as possible. XXXX XXXX of XXXX, CA collected - through garnishment- an old student loan account for XXXX . 1 ) This corporation allegedly sent a " release of garnishment '' for the collections to stop, but my company never received it from them, however, did receive one from XXXX once I contacted XXXX about the matter. XXXX XXXX claimed to have sent it out on XX/XX/XXXX and my company/employer NEVER received this alleged copy of THEIR release of garnishment. Furthermore, they refused to provide me with a copy of the alleged release that they sent. My company/employer only received it because I followed up with XXXX. 2 ) XXXX XXXX over collected on this debt, because the release of garnishment was never sent/received by my employer as they stated they did. For a month I have been in communication with XXXX and they stated that there was not an overpayment showing and that I should follow up with my employer. My employer - payroll department, representative XXXX XXXX confirmed that XXXX XXXX cashed the check that was sent to them, the check was cashed on XX/XX/XXXX. XXXX XXXX confirmed to the payroll representative that they received funds in the same check sent to them for funds for other employees of my company, but deny having record of getting the portion that represented my overpayment. THESE FUNDS WERE SENT to XXXX XXXX ON THE SAME CHECK, not separate checks. ( Amount of my overpayment is {$380.00} ) 3 ) XXXX XXXX has never tried to help me resolve this overpayment or getting a copy of the alleged release of garnishment - that was never received FROM THEM by my employer. I have only gotten false information and the run around. I would like my funds back IMMEDIATELY, because it has been proven that they have them. They try to defer to XXXX, but the monies were sent to them directly and they have never recorded it so that XXXX can see this additional overpayment. Summary : XXXX XXXX was negligent in the handling of XXXX XXXX forms needed to have tuition payment submitted to the accounting department within a timely manner, which ended-up having them take a strong collection against me and utilizing a collection agency that is not licensed in Florida where I reside ; over an incident that occurred during the fall of XXXX. Additionally, the business office of XXXXXX/XX/XXXX is now, which I believe, is trying to cover-up that collection because they submitted to XXXX XXXX on XX/XX/XXXX the deferment letter I sent to them during the fall of XX/XX/XXXX, which was a requirement of XXXX XXXX. The representative, XXXX XXXX, Recovery Specialist Business Office, Direct Line : XXXX, called me on XX/XX/XXXX to let me know that she was authorized to reduce my debt by {$200.00} off the {$1900.00}. She also stated that she would call-back XXXX XXXX XXXX to avoid any further collection from them. As of XX/XX/XXXX, my collection report shows that the balance of {$1900.00} is still being reported by the collection agency, with a new update on XXXX that was reported XX/XX/XXXX. My earlier conversations, which extend back more than a year or so, have argued with the business office that I was demanding the school take responsibility for the mishandling and negligence of my XXXX XXXX Form that would have allowed the school to receive payment for the Fall Semester, especially when there was money available on my XXXX XXXX account. The school refuses to admit fault. On XX/XX/XXXX, a call was placed to XXXX at XXXX XXXX, which I had left a message on her voicemail with my findings on how I thought it was odd that her department would send over the Deferment letter to XXXX XXXX on XX/XX/XXXX. There is various incident with this company for not presenting the entire options to me but only asking me to pay 82 % when I asked if there was any other option they told me. They have constantly emailed me stating my information will be sent to collection. I expressed on XX/XX/XXXX to the first agent I am not able to make that payment. I told her she can reach on a specific date which she never did, I had to call to follow up and when I did she literally started screaming at me telling her this, not her credit that will be damaged and she does care. This call was recorded I was upset and felt disrespected and the same time. She then apologizes. The information they are presenting is not accurate and they are not being very clear with what they are doing. I reached l on XX/XX/XXXX to clarify what was going on. They then mentioned there were various payment plans available this time but this was not stated in my first conversation. After they reported it to the credit agency which drops my score down 60 points. If I knew was making payment before given these payment options my account would have not been reported to the credit agency. I express this to the supervisor here name was XXXX # XXXX, before the called transfer to her there was literally a conversation about me and they had a full-blown laughing fest before speaking to me, how is this professional. She came with these very dismissive attitudes on the phone. I am not sure this agency should be in operation and their practices are not professional at all. In XXXX I noticed that a large portion of my paycheck had been garnished. I had to reach out to my employers pay roll department to even find out what the debt was and why I was being garnished. I found out ACT the company that is garnishing me ( in the middle of a pandemic and my hours have been significantly reduced ) was collecting a debt for the Florida Department of Education student loan. I was under the impression that this debt was in forbearance and I never received in correspondence that my debt was being sold to a collections agency. The only way I knew anything about the loan being in default was when my paycheck was garnished. I did not receive any phone calls written correspondence nothing. When I called ACT and explained that the garnishment was financially devastating me they gave me only one option I could set up an additional 5 month installment plan of {$5.00} dollars while the garnishment of roughly {$1000.00} per month is still being deducted. I mentioned the freeze on student loan collections and garnishments I was told by a representative with ACT that they were free to collect the debt since the student loan collection freeze had lapsed. So after the President signed the new economic impact bill mid-XXXX I called back to see if the garnishment could be stopped I was told to contact my original creditor The Florida Department of Education, the representative with the Florida Department of Education advised me I should never have been garnished in the first place. I called ACT back they advised that they would be stopping the garnishment then when I inquired about the payments previously taken out of my check, would I be getting those payments back since I am still in a financial bind due to my work hours being decreased and the added burden of the garnishment being taken. I was told I would receive a call back which I have yet to receive. This sounds like predatory collections practices and unethical.

My Federal Tax Refund w as recently garnished by the Treasury Off-Set pr ogram for a fraudulent debt. I have n't received any prior warning to my home address of this debt or collection agency. Account Control Technology ne ver reported this debt to any of the XXXX major credit bureaus essentially leaving me uninformed to resolve the issue. I could have acted sooner, before the treasury offset garnishment, however the debt they 're trying to collect was from when I briefly attended a XXXX scho ol ( XXXX College ) several years ago, which I had around {$3000.00} in federal loans for. I stopped attending after a month or so after hearing a previous graduate tell me that her class and the class before hers were not being placed in jobs like the school had promised, falsifying job placements. Years later they closed this schoo l ( XXXX College ) for fraud and for falsely stating they would place students in jobs and never doing so, along with other illegal lending practices. I figured the loan would be forgiven since I never saw it appear on my credit report. I saw this was not the case when I found out that they took my tax return which was {$2800.00} to pay this debt for a school that was found fraudulent and closed down. I have read in several articles that these collection agencies are collecting on loans they know are eligible to be forgiven. Can I do anything about this? My loan was put into the offset program which caused a major financial hardship for my family and I. I needed that money for other financial obligations and I also have XXXX -month-old son. Things have been very difficult for me since I was injured in a car accident last year and I 'm currently being treated and have n't been able to go back to my delivery work.

ACT contacts my job daily, despite asking them to only contact me via my cellphone. I can not receive calls at work, and calls have to be transferred to me, disrupting others work day, including mine. This was discussed when I've talked to them before. I work in a school and can not receive calls at any part of the day. Their communication is abrasive, fast, confusing, and purposely predatory. When the do call, they are usually talking very fast and quiet in order to confuse whoever is talking to them. I had payments set up with them, and was still unsure what it that I was agreeing to because the nature of the calls are so purposely quick, confusing, and threatening. At that time, I did ask them to not contact me at work, and they call daily despite that. They were given my cell phone number and my work times so that they know when I am able to be contacted. When they contact me on my cell phone, they do not leave messages, so I am unsure whether a number or contact is legitimate or spam. I do not feel comfortable contacted unknown names and numbers when they are quick talking and asking for personal information, and threatening to garnish wages if you don't make a payment, but you have no clue who they are. I have attempted to change my bank information online, and am not able to. I received a call on XX/XX/2021 which was so quiet and unclear that I couldn't hear what they were saying, and the person continued to try and go through their fast talk and threats, even when I asked if I could have a number to call from my cell phone or if he could contact me on my cell phone. In XX/XX/XXXX, XXXX agreed they would close or sell all their schools in the next few months.The U.S. Department of Education announced former U.S. Attorney XXXX, a well known corruption buster, would monitor the sale and closure of for-profit career colleges owned by the failing XXXX. On XX/XX/XXXX, XXXX sold XXXX of its XXXX and XXXX campuses and online programs to the XXXX, a new subsidiary of the XXXX. These institutions never existed in the Los Angeles California area historically nor at the time said claim had taken place. A court judgement that conclusively finds that I am and were a victim of identity theft has not been provided for I never pressed criminal charges on individual ( s ) who committed the crime due to lack of information on identities or individual ( s ). None of the options on the previous screens truly described my situation so I hope this gets to the right place. A week ago I tried renew my NC vehicle registration and was told that I was not allowed to register based on a hold placed by Account Control Technologies ( XXXX ) XXXX. They stated that I had a toll balance that had gone to collections over a year ago, I had never received prior invoices or notices of this balance and had no knowledge of it. I called the collection agency and had no choice but to pay the debt if I wanted to continue to be able to drive my vehicle. I made that payment on XX/XX/2019 at XXXX XXXX ( literally immediately after I became aware of this debt ). The payment came out of my account on XX/XX/2019, and as of XX/XX/2019 ( the date my registration expired ) they still had not reported the payment to XXXX XXXX to allow me to reregister my vehicle. A representative from XXXX XXXX called Account Control Technologies with me, Account Control Technologies confirmed that I did pay but stated that they had no control over when the system would send notification to NC XXXX and would not help me. So Account Control Technologies is holding my rights to reregister my vehicle hostage over a debt I was never aware and paid immediately upon being notified of it. This means I can not drive my vehicle which could affect my job. Please help me to get this rectified and save others from this same fate, collection agencies should not be able to prohibit an US Citizen from being able to register a vehicle over a debt that has been paid to them. I feel that they are using the collection powers provided to them by the State of NC in an abusive manner which could harm me and my family.

I am being garnished by a collection agency identified as Account Control Technology. XXXX, CA. XXXX. The above listed company failed to notify me regarding the intent to garnish my wages. As a result this garnishment has caused financial hardship leading to an intent to evict from my apartment and loss of medical benefits. The company has failed and refused to send me legal documentation regarding the nature of the loan. The company initially identified itself as part of an Obama program and in association with Federal loan servicing, after doing much research this company is not a part of either program. They keep trying to get me to agree to a verbal contract. I have requested written documentation and as of this date have not received any legal documentation from this company. ACT aka Account Control Technology , Inc., called my father and left threatening messages and where I was about a student loan serviced by XXXX. The person really upset my father, as not only did he know where I was, he was being called and threatened. My father is willing to make a statement about the constant phone calls threatening him and I. I got the number of the ACT collector, and he told me I had to pay {$18000.00}, with a total due of {$19000.00}. I was at the time homeless and in XXXX with the Veterans Administration. I had also applied for Federal Loan Forgiveness, ( XXXX Discharge ) and it was approved. I negotiated two payments of {$3200.00}, ( {$6500.00} ) which was debited from my savings by XXXX not ACT. This was all a shady collection tactic because I believe they knew that XXXX was about to forgive all of my private loans once they were contacted by XXXX ( XXXX XXXX XXXX ) & The Dept. of Veteran Affairs. I think that ACT new this was the case but still took the money which is unfair. My father is still traumatized by the nasty collections tactics they did, in which nasty and threatening conversations were threatened towards me via my Father and directed at my Father, with threats that if he is harboring me then he is liable. I was getting treatment for XXXX and XXXX XXXX from XXXX XXXX XXXX ( XXXX ). On XX/XX/2021 I called and spoke to a representative at Account Control Technology to settle an account that I had with them. Upon coming up with an agreement we settled the account for the amount of {$2000.00}. After doing so I had requested a settlement letter and was assured that I will receive one in 5-7 business days. It is now XXXX and I have yet to receive the letter ; it is affecting my credit and approval for a mortgage loan. Once again, on XX/XX/2021, I had called Account Control Technology to explain that I have never received the settlement letter. I was referred to XXXX XXXX, the school that I had previously attended, and told that it was the school 's problem, not theirs. After that conversation, I had contacted the school immediately after to which they said they could not provide the letter since the account was paid to the collection agency, not them ; which I had already known but wanted to get that confirmation from XXXX. I had called Account Control Technology a third time on XX/XX/2021, and spoke to a representative by the name of XXXX XXXX and then a man who claimed to be the supervisor by the name of XXXX XXXX ( he did not want to disclose his last name when I asked for it ). I had told them what was explained to me by XXXX and they continued to say " the company can not provide a letter stating a settlement '' and that it was " out of their hands. '' They continued to refer me to XXXX to solve the problem, which is not possible considering the amount that I had paid was to the collection agency and not the school itself. In XX/XX/XXXX I spoke to a representative of the company ( XXXX, XXXX. ) to establish payment terms for Connecticut State income taxes. We agreed to the amount of {$200.00} per month. The last payment, according to the rep would be final on XX/XX/XXXX. I received a number of confusing statements with amounts that did not match the agreed terms. I called several times to ask for clarity and was told the statement had not caught up with the payments and I was up to date. On XX/XX/XXXX I contacted them again. I spoke to a representative named XXXX. When I asked him about the final payment made XX/XX/XXXX he informed me that I had an outstanding balance of {$320.00}. I asked for further clarification on was told to contact the CT IRS and provided me their contact number. I was confused by this however I contacted CT IRS on XX/XX/XXXX to review the case and they informed me that I was up to date and there was still an outstanding amount due. They indicated I owed a different amount then I was told by XXXX, XXXX. I was referred back to the collection company to resolve the issue the debt was in their hands. I called XXXX, XXXX on XX/XX/XXXX asked for XXXX and was told he was not available and someone would call back in 24 hours. In XXXX, I attended XXXX XXXX and left early due being mislead by the program. In XXXX, I filed Student Borrower 's Defense with the Federal Government against XXXX XXXX to have my student loans that I received from XXXX to be discharged due to their misrepresentation of the school. In XX/XX/XXXX, I received notification that Account Control Technology was added to my credit report as a collection. I was never notified from Account Control Technology so that I could dispute the debt or request debt validation. This debt is also from XXXX, and they have re-aged the debt to reflect opened as of XX/XX/XXXX Account Control Technology stated that they were sent over information from XXXX regarding a mailing address that they mailed all correspondence to. When I attended XXXX XXXX, I always received correspondence through email because that was my preferred method of communication. I NEVER received any mail through the physical address because we NEVER received mail at this location, we always received mail at our po box . When I called today, XX/XX/XXXX, a representative told me that it did not matter when I submit a dispute on the account. I informed the representative that evidently it does matter when I dispute the account, because since I was never given the 30 days to dispute the account that now it is on my credit report. When I called this company, I I went over the issues pertaining to them illegally placing this on my credit report without properly giving me the chance to respond. On XX/XX/XXXX Account Control Technology Inc. responded to the complaint I filed on XX/XX/XXXX. In the original complaint I had 2 issues I asked the CFPB to oversee. Failure to contact BEFORE Wage garnishment. Failure to Validate debt. Company appeared on my credit XX/2017 without proper notification as they were obligated to do in accordance to FCRA rules. I have no knowledge of this account and the company has never sent me any correspondence given me the opportunity to obtain validity prior to reporting on my report. Prior to filing this complaint I called the credit bureau and was informed that the company provided proof that the account was mine because of matching addresses on file and birthday but the social didnt match and they flagged my file as having a double credit file and sent out notices to the company to send proper validation with my social or delete from the file. When I tried to call because I have no idea what this is from the customer service agents was unable to speak with me unless I verified my information. I gave her my social and the account number furnished on my report. She was unable to speak with me as the information didnt match. When I asked her to send me a letter stating they had the wrong information the call conveniently disconnected. I called back and asked another agent and he said its against their policy to discuss the account because the information doesnt match, when I asked him to send me verification of the debt and to cease collections he stated they wouldnt collect anymore but he couldnt stop it from going on/remove it from my credit if I didnt pay. This complaint is in regards to debt collection efforts being made by a collection agency called Accounts Control Technology.This company without notice began garnishing 25 % of my substitute teacher pay every period since XXXX XXXX. My income as a substitute teacher does not meet U.S. poverty standards my pay is only {$80.00} a day. The company states they are part of the Department of Education. To explain further Accounts Control Technology garnished my check without notice. In addition they only notified my employer about the garnishment. When I contacted them by telephone they were very rude and hung up on me. Not being allowed to dispute the debt prior to garnishment has caused a tremendous amount of emotional distress. It is my understanding that my employer was told not to give me any written information about this matter in spite of my calling and providing written notification requesting a copy of the notification sent by Accounts Control Technology. Most important Accounts Control Technology grossly and falsely overstates the amount of the debt that is allegedly in default. Finally I am experiencing sever financial hardships and am suffering from the impact of the actions of this company. ACT and I agreed on a settlement offer on an account to pay 50 % of an account and for that to be accepted as full payment. I have attached the letter that ACT sent to me with the offer terms. I made that payment over the phone following receiving a written commitment from the ACT. On the phone, the person I spoke to confirmed that the payment would be accepted as a settlement. However, Account Control Technologies has been reporting incorrect information to the credit bureau for the last two months and as such has been violating my consumer rights. When made aware of this when I filed a dispute with the credit bureaus, account control technologies doubled down on this infringement of my rights and DECLINED to fix the information that they are reporting incorrectly, and falsely claimed that the information reported was accurate. In XXXX an Item with Account Control Tech ( ACT ) for XXXX XXXX University was placed on my credit. I immediately disputed the debt with ACT as well as the credit agencies and It was removed from my credit report. I also contacted ACT directly and told them I have never attended XXXX XXXX University. They stated that according to their records I was set to attend one class to start my XXXX and never paid. I told them verbally that I never attended XXXX and that I inquired about the degree but never signed any documents. They claimed they would look at it. I also sent them a certified letter requesting all of the documentation for the debt. They first replied back with an envelope and form letter with nothing else in it even though it stated they had attached information. To this, I called and wrote another letter. Then they replied back with an agreement that did not have my address on it with no signatures and initials on the document that looked nothing liked my signature. She calls my wife and I from different numbers with our respective cell phone area codes ( mine : XXXX hers : XXXX ). This morning my wife received an unknown call from XXXX. She ignored it but then received a call from her brother. Her brother stated that a student debt collection agency had called him and his wife ( my wife 's sister-in-law ) from the same number she had ignored. This happened within a two minute period. They were all trying to get a hold of me and stated that it was an urgent matter and needed to get a hold of me right away. I called the number back on my phone. They stated that I had given them all three of their numbers as permission to call them. This is not true at all and a form of harassment. I have no idea how they were able to research and obtain my brother and sister in laws phone numbers. I don't even have my brother and sister in law 's phone number. What makes matter worse is that they were trying to get information about me from both my brother and law and sister in law. When they refused to provide information, they kept asking questions about me. When I was on the phone with them, they admitted that they already had my phone number and home address. A company called " account control technologies '' ( XXXX ) XXXX keeps calling me about a student loan in collections for a borrower with whom I have no relationship. This is a loan for which I did not sign anything. The borrower listed me as a reference ( without my permission or without notifying me ), and the company " Account Control Technologies '' is calling me using phone numbers that I provided to the loan company XXXX XXXX for ANOTHER, UNRELATED account. Its not right for them to call me over and over again about a loan that I have absolutely no legal relationship to and when I asked them to stop calling me a few weeks ago, they called again today ( twice ) on all of my phone numbers. Today, I asked to speak to a manager, and he told me that not only will they continue to call me but they " legally '' can refuse to provide me a copy of the loan documentation where my name appears. On XXXX/XXXX/2016 have been in a hardship situation I spoke to several representatives at ACT ( Account Control Technology ) The rep did not offer me any options outside of a Debt Consolidation for my Defaulted student Loans with the Dept of Education. I am currently unable to pay a High ( {$530.00} for 3 months ) amount that is being charged by this third party collection agency company to resolve my balance and come out of default. I have a complaint that violated 805 ( b ) of the Fair Debt Collection Practices Act ( FDCPA ) because the message disclosed the existence of a debt to a third party. I had a message left on a voice to someone who was not me. ACT misinformed me about how to get a federal student loan out of default. ACT lie to or mislead me about the ability to get a federal student loan out of default. A federal student loan is considered to be in " default '' if the borrower goes 270 days without making a payment. Once the loan is in default, a 25 % collection fee may be tacked on. A borrower may also be able to get the loans out of default by consolidating into a single loan. This company called contacts on an old debt file from a payday loan. When they contacted my brother on XX/XX/18 regarding this they disclosed personal information such as, we will serve court process at work and he owes a lot of money, which I believe violates my confidentiality. My phone number is XXXX XXXX XXXX XXXX. I was given that number 20 years ago as part of a family plan under my parents. That number has not been associated with my father in any other manner, and has not been a part of a plan which includes his phone number in over 15 years. However, I have received repeated phone calls from Account Control Technologies asking for my father, whom I am not in contact with. I have repeatedly told them they have the wrong number, and they have repeatedly continued to call after assuring me my name would be taken off their list. While I find their phone calls irritating, the bigger issue that I have is that by calling my number and asking for my father when they are clearly a debt collection / reconciliation agency they are disclosing or indicating that he is in debt, which should be his private information. I received a letter only, never a call from a collection agency about a debt for tuition. I had federal financial aid for the courses but the school returned the aid when I could no longer attend due to XXXX. The school never sent me correspondence or called about the debt so I did t know it existed until XXXX when I received a letter from a company requesting the money. A company called Account Control Technology , Inc ( XXXX ) has been calling family members, acquaintances and friends saying they have " time sensitive information '' and must reach me right away. They are calling the children of family members as well. In many cases they are calling these family members at work. Yesterday they called my cousin at work and listed off by name every member of our family and said they would continue to call until they reached me. My contact information has not changed in 19 years. This is not a strategy to reach me directly this is merely a tactic to attempt to cause embarrassment and work related issues. They refuse to give the name of the company. We found the name of the company by reversing the phone number. Many of these calls have been recorded because they are on work lines. My attorney advised me to submit this complaint prior to taking any additional action. I received a call from this Account Control Technology at XXXX XXXX time from XXXX. I was n't able to answer the call, but called back at approximately XXXX. I followed the prompts and got " XXXX '' on the phone. XXXX took my cell number and attempted to contact the department that was handling the claim. XXXX came back and told me that that department was closed and that I 'd have to call back. I asked how that could be since they JUST called my house. On XX/XX/XXXX XXXX XXXX University was notified that they were included in my Chapter XXXX Bankruptcy. They contacted me during this process which my lawyer advised them that they could not collect this debt. Once my BK was discharged in XX/XX/XXXX they continued to still contact me and I had sent them the list of creditors and copy of BK discharge, they sold the debt to a collection company and I supplied the old collection company with the same info and it seemed to stop. Settled Student loan in XX/XX/XXXX-XX/XX/XXXX. Recently received notice that ACT was going to garnish my wages which started on XX/XX/XXXX. Called ACT to explain that the debt was paid. They said they have notes in their system about a settlement but do n't show proof. Tried to file a hearing to review but they said I need proof of settlement. Company : Account Control Technology XXXX Debited out of my account on XX/XX/18 after a recorded phone call. This collection is for tuition debt to XXXX University in the amount of {$2100.00}. I paid my collection on XX/XX/2018. I was told by the representative that the collection would be removed from my credit report. He stated the " School '' would remove it. The call was recorded. Company sent me a collection letter mid XXXX XXXX, 2017 and when I tried to call because I have no idea what this is from the customer service agents was unable to speak with me unless I verified my information. ACCOUNT CONTROL TECHNOLOGIES recently began reporting Account number XXXX as derogatory on my credit report, after I initially requested validation of this debt a year ago. To this date, I have yet to receive validation of the debt. It was however removed until recently. XXXX, Account Control Technologies, and the original creditor, XXXX XXXX failed to provide debt validation in the time allowed by the FCRA. As such, this derogatory, and unverified information should be immediately removed. This debt was never even mine as it belonged to my son. Hi, I received a letter from a collection agency ( Account Control Technology ) in regards to an account they claim I have with XXXX University. I have never attended or applied to this school. On XX/XX/XXXX, I requested a validation of debt, via mail. On XX/XX/XXXX, they sent me an account statement. This account statement appears to claim I was enrolled in the school for the Summer XX/XX/XXXX quarter. This claim is absolutely false. On XX/XX/XXXX, this account was added to my credit report. I have disputed this claim with the Credit Bureaus.

This is not the first time this school has tried to collect money from me. I have gotten this account removed from my credit report two times : XX/XX/XXXX and XX/XX/XXXX. This debt keeps being re-inserted under different collection agencies.

I have no knowledge of this account and have never applied to nor attended this school.

I am not the person who has the debt. But they are in close relation to me, they 're my partner. However I had no knowledge of of them having any time sensitive issue as was stated to me. And it would have been better for them to inform me themselves as opposed to a company calling me, and my family members who are in no way related to anything concerning the matter. There were questions asked about my partners place of residence, there were questions ask about their contact info etc. and any legitimate company would at least provide some sort of ground based information as to how paramount the case at hand is. Account Control Technologies ( ACT ) contacted me several months ago in reference to my student loan debt via telephone. I repeatedly asked during the phone call to be sent information detailing the acquisition of control over this debt, and was repeatedly told that they could n't send me any information, that it was up to me to contact the XXXX. My tax refund was recently seized by ACT, and when I contacted the XXXX I was told that they could n't give me information about the debt, and that ACT was the only XXXX to speak with. I was told that this payment was made to them almost a week ago, and I have received no paperwork from any agency of any kind ( public or private, state or federal ) relating to the seizure of my entire federal income tax return. I was told by Account Control Technology, that they were contracted by XXXX XXXX XXXX to collect delinquent student loans. I was to pay XXXX for seven years and after that the rest of my student loan would be forgiven. They called it the forgiveness program. I 'm a XXXX Veteran and my wife and were trying to purchase a home, to discover the negative student loan on my credit report. I called the FSA they told me no money had been paid on my loan EVER! In XX/XX/2019, I had settled a debt wit Account Control Technologies who was collecting on behalf of XXXX XXXX University. I was informed on a recorded line that upon settlement of the debt with Account Control Technologies, a request would be submitted to the credit bureaus to have this account removed from my credit records. As of today, the zero balance account is still reporting on my credit report. I had contacted the collection company a different occasions requesting assistance and was instructed to dispute the account with the bureaus, in which I have, twice. The dispute was completed each time with the same results validating the account, not acknowledging the dispute reason of what I was informed about. Additionally, the original delinquency date through the original creditor is well over sever years now.

I was speaking a a XXXX XXXX about entering a debt rehabilitation program. I was explaining that I had no means to repay the debt at the moment but would appreciate if they could stop calling. I was later transferred to a supervisor named XXXX, she explained that this was a Federal loan and it had to be paid. She battologized the word " Federal ''. My wages were garnished for student loan debt for two years, ending in summer XXXX. The creditor used a collection agency. I got a letter of release of withholding from the collection agency in XX/XX/XXXX. In XX/XX/XXXX, I received a letter from the collection agency saying that I still had a balance due - which shouldn't be legal, first of all. I called the collection agency in early XX/XX/XXXX and tried to pay the entire balance due off and they wouldn't take my payment, saying they had to verify the balance with the original creditor and that it would take a week ... while interest collects daily. These procedures should be illegal - if I call and wish to pay my balance immediately ( like their letter offered ) I should be able to pay the debt stated in their letter immediately.

On XX/XX/2019, I received a credit alert from my credit monitoring service stating that I had a new collection reported to my account. When I viewed the alert the collection was placed from a company called ACCOUNT CONTROL TECHNOLOGY, opened XX/XX/2019 in the amount of {$4800.00}. Actually this is regarding their refusing to discuss the XXXX XXXX XXXX XXXX option with me for my debt. I am currently unemployed and wanted to discuss the option. I continue to receive phone calls from an agency looking for someone with the same name as me. The agency 's phone number is XXXX. The main person that has been calling me is XXXX. I have actually returned the calls to speak with people there and even spoken with XXXX regarding the mistaken phone number. When they call me, they immediately want to confirm personal information which puts me on guard because in today 's world, someone calling you wanting to " verify '' your birth date and address as soon as you confirm your name, puts up a bit of a red flag. They would not go into more detail as to why they were calling other than to apologize about the mistake. However, it continues to happen. On XX/XX/19, Id found out I allegedly had an outstanding federal student loan owing an estimated $ XXXX so I requested paperwork and proof of the loan before I considered even setting up any type of payment plan with them. ACCOUNT CONTROL TECH is a collection agency collecting for XXXX University in the amount of {$4100.00}. I dispute was sent to the collector and all three Credit Bureaus over 60 days ago. I was contacted by XX/XX/XXXX on 1XX/XX/XXXX about a school loan that I do owe. I made a agreement with them on that date to pay {$110.00} per month to bring loan out of default. I made a payment on that date of {$110.00} to enter the program. they notified me that I had to do this right now to avoid garnishment. I have been contacting Account Control Technology since XX/XX/2020 at phone # XXXX about selling the debt for my student loans. My employer was contacted directly via mail for 15 % wage garnishment but I was never contacted. Every time I have called, I get differing amounts of what my student loan amount is. I finally settled the debt on XX/XX/2020 and spoke with XXXX. She has not processed my payment and would not give me a confirmation for my payment. I received a copy of my credit report and noticed Account control technology reporting negative. I have no idea who they are so I looked them up on Texas Secretary of State website and found out the company is NOT bonded or licensed to collect in the state of Texas and they are in violation of Section 392.102 of Texas finance code reporting rules. ( See attached ) Secondly when I called the agency and gave them the account number my social did n't match what they had on file so I was unable to discuss the what 's but moreso why 's of why this account is reporting on my credit report. Account sold. Nomaccounting information being provised on this account after repeated inquiries. Master promissary notes are not original contracts. Accounts have multiple servicers and can not obtain accurate information on none of these accounts. All i get is threats of wage garnishments. The amount on the account is grossly well above the cost to attend the institution. Amount on credit reporting agency is XXXX but letters sent to me is XXXX. School doesnt cost nowhere near that to attend. Accounting information needed to verify this account. Multiple Issues. Last week I received a call that appeared to sound like it came from an autodialer. My phone is a cell phone. My student loans are in default. I have entered into a payment arrangement with ACT, the collection company for the loan issuer. The Dept of Education tells m e they will not report my payments to the credit bureaus.The loans will stay in default. Account Control Technology XXXX has been contacting me wrongly for many months ( over 4 ) at times between XXXX-XXXX from a Wisconsin number ( XXXX ) multiple times a week. The thing is, they are looking for someone who shares the same Surname with me, but it 's not me. I do n't even have any outstanding debts as I write this now. XXXX university wrongful sent a XXXX XXXXXXXX debt to collections which was removed by credit reporting agencies as i was not responsible due to a billing error for the XXXX of XXXX ( covid beginnings ) XXXX was also defendant in class action in XX/XX/2022 which paid out to former students which i received a share of proving that no actual debt existed or the share would have been retained and applied to this debt. I spoke with a representative from Account Contol Technology in reference to my federal student loan. The amount I owed initially was {$1700.00}. I agreed to take a settlement amount of {$1200.00} on XX/XX/XXXX the agreement stated I had until XX/XX/2018 to pay the agreed upon amount. The company calls consistently from various numbers and never gives any information as to the nature of the call. Each representative says that in order to release any information about the call, I had to provide all of my sensitive information including social security and annual income. They also refer to the call as a " personal matter ''. When I tried calling the number listed on my credit report and also listed on their website, it goes straight to voicemail and no one has returned my calls. I am constantly contacted about another person with my name. This has went on for several years. She has a different birth date and social security number.
