I received an email from my credit monitoring service that informed me that my credit profile was adversely impacted. I found that ACCESS CREDIT MANAGEMENT, INC. had illegally posted alleged collection accounts to my credit report. I have never started nor an opened account with this company. My report shows that ACCESS CREDIT MANAGEMENT, INC. open accounts were opened on XX/XX/XXXX and XX/XX/XXXX with a balance of {$1000.00} and {$500.00}. By federal law, a debt collector is supposed to make contact with an alleged debtor and give them 30 days to validate or dispute before they move forward with collection attempts. I never received a letter in the mail that gave me 30 days to validate or dispute this account. I never received a letter stating that I have an alleged debt with this company and owe a balance on that account. I, a consumer defined under 15 USC 1692a ( 3 ), understand that, under the FDCPA guidelines for collection agencies, they have to provide ( 1 ) legitimate proof that they are the original holder of this debt and can legally hold me responsible for paying this debt and ( 2 ) contractual proof of obligation or an assignment SIGNED from an officer from the original creditors corporation that I am supposed to pay them. 15 USC 1692g Sec. 809 ( b ) of the Fair Debt Collection Practices Act ( FDCPA ) grants me the right as a consumer to request validation of this alleged debt they say I owe. I fully understand 1692g. Validation of debts ( a ) Notice of debt ; that states within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumer 's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. ( b ) Disputed debts - If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) of this section that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. ( c ) Admission of liability - The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer. I never received a notice of right to dispute nor did I receive any information to verify that the alleged debt with this company belonged to me. If I would have gotten anything in the mail from this company before they illegally reported to my credit report, I would have respectfully requested evidence that I am the person they are asking to pay this debt and a contractual obligation that legally binds me to pay them this debt. Upon them receiving my validation letter by certified mail with return receipt, they would have to legally cease from collection calls, letters, and efforts and delete the account from my credit reports until they can validate this debt. But again, I never received such a letter about this account ever in the mail because it was never sent. In order for them to prove that I received it properly, the proper letter should have been mailed certified mail with return receipt or by some form of proof of tracking that would require my signature. And if the company did mail anything to me, where is the legal proof of tracking or my signature stating that I received it? Where is the return receipt or postage signature showing that I received it and signed for it? But again, I never received any sort of mail or package. They have illegally posted and reported to my credit file without adhering to the FDCPA laws. Im not sure if this company is a scam, but I know that this company has broken FCRA and FDCPA laws by reporting an alleged account to my credit report without informing me through mail and I did not receive notice of right to dispute nor did I receive any information to verify that the alleged debt belonged to me. My credit has dropped tremendously in the middle of making a major purchase. Please help me get this account removed immediately. As a consumer, Im publicly publishing this descriptive complaint on www.consumerfinance.gov so that others can learn from my experience and so that this government agency can use this information to help work with other violations and complaints from consumers regarding this company. Under 12 CFR Part 1006 and as a consumer defined under 15 USC 1692a ( 3 ), I'm also preparing to sue under the FCRA and FDCPA because of the numerous consumer law violations committed by this company, damages to my credit and opportunity costs with making a major purchase, and business ventures that must be delayed until this illegal account is removed. It should not be my responsibility to submit proof that this debt does not belong to me. It is the responsibility of the debt collector to submit proof that they can legally collect on the alleged debt, legally report to the credit agencies, and follow all FCRA and FDCPA. XXXX XXXX XXXX debt was liquidated in chapter XXXX that I filed in XXXX. I call this company and spoke with a gentleman name XXXX. I asked him why was he continuing to try and collect on a debt that first of all over 10 years old and secondly it has been discharged in my chapter XXXX in XXXX. he said it was a mistake and he would rectify it. he did just the opposite, He went in an updated the opening of the account for XXXX XXXX. Noted this is illegal and he is practicing fraudulent reporting. I call him again on XXXX XXXX, XXXX. He claimed that he had the updated bill. I asked him to sent me a copy of the account that he said was opened in XXXX XXXX. He then asked me for an account number. Well, the credit Bureau has no account number for this bill because it was discharged in XXXX. I have the records from the bankruptcy courts where XXXX XXXX XXXX was listed numerous of times in my chapter XXXX. This company and XXXX are known for practicing illegal reporting and misconstrued information on peoples. They have been doing these type of tactic for years. XXXX is the person that does all the illegal reporting. After reviewing a recent copy of my credit I came to the realization I have become a victim of identity theft. I recently have submitted ( Identity theft report number # XXXX XXXX which included accounts 1. XXXX # XXXX, 2. XXXX XXXX # XXXX, 3. XXXX XXXX # XXXX 4. Access Credit Management # XXXX. I have reached out to all major consumer reporting agencies including XXXX XXXX XXXX XXXX It has been over 30 days and as per the Fair Credit Reporting Act these fraudulent accounts must be deleted without 100 % accurate verification. Access Credit Management has violated my consumer rights and the Fair Debt Collection Practice act by continuing to report fraudulent established accounts to my credit file after being notified by the credit bureau. In addition, sections 605b, 609, and 611 have also been violated under the FCRA. The fraudulent accounts still remain reporting on my credit file and is a clear violation. I have completed and submitted 2 identity theft reports to the credit bureaus and Access Credit Management continues to still report this fraudulent account to the bureaus. I have no recollection nor recall opening or establishing any of these accounts listed above.

This is a complaint in regards to the practice of Access Credit Management , Inc. in XXXX XXXX AR. First of all a default was put on my credit in 2008 but was not properly served. Secondly, it was served on a bill past the " Statue of Limitations '', as well as, the company sent me a statement with a balance of {$760.00} and would not take payment offer of {$450.00}, but proceeded to tell me only 9 days after statement that was sent, the new balance was over {$1400.00} and illegally said they would continue with the legal process. The company also contacted my employer representing Attorney XXXX XXXX 's office according to the caller ID and stated that to my employer which was an embarrassing and could have caused my job to be in jeopardy. This company is conducting practices that are unethical in several areas and consumers should be protected from these type of junk debt buying people, particular the employee XXXX.

A little less than 60 days ago I reached out the credit bureaus to inform them of my recent encounter of being a victim of identity theft. Repot number # XXXX which included several accounts including XXXX XXXX # XXXX and Access credit # XXXX. These accounts are still appearing on my credit file after these agencies have been notified by me as well as the bureaus. I never received any services or goods in relation from neither of these accounts and they were established from the direct result of identity fraud. It has been more than 30 days and no accurate verification has been made as per the Fair Credit Reporting Act nor the Fair Debt Collection Practice Act. I am familiar with the Health Insurance and Portability Act and its regulations protecting the privacy and security of certain medical information. My consumer rights continue to be violated as well my denial of future credit lines. I find this unacceptable.

Over the past several months I've attempted to resolve wrong/inaccurate identity theft related accounts with a company called Access Credit Management. I have reached out via direct mail with both the three major consumer reporting agencies and directly with Access Credit Management. I've included a copy of an identity theft report # XXXX, affidavits, and dispute letters. In addition Access Credit Management continues to violate the Fair Debt Collection Practice Act and Fair Credit Reporting Act under Arkansas by attempting to collect on Medical Debt more than 2 years old. I also requested HIPPA release documentation which was never provided by Access Credit Management. Despite these several violations of my consumer rights, these fraud related/inaccurate accounts continue to appear on my credit reports. I find these actions unacceptable and Access Credit Management must be held accountable.

I was paying on the balance of several XXXX bills due to XXXX ( XXXX separate XXXX within a period of 4 months, All performed at XXXX XXXX XXXX Hospital in XXXX Ar. ) - I paid on them for over 2 years, Then I was contacted that my payment of {$25.00} was not enough! Shortly afterwards- I XXXX and 5 months later had a XXXX.~ I was off work for quite awhile~ and I tried to get them to work with me~ They did combine XXXX accounts into XXXX, but I could not pay XXXX per month. I am single - live alone XXXX XXXX XXXX and the only income I have is made solely by me~ After rent, utilities, etc. there is no way I can pay that amount! Since then I do have Medicaid, but I do not qualify for any other type of assistance. I got tired of the harassing calls ~ I could not have done anything anyway, the payment plan they set up for me was absurd!

In addition, Access Credit Management who currently owns the debt has failed to provide any original application or documentation as per the Fair Debt Collection Practice Act, section 809. Also, the statue of limitations in the state of Arkansas for medical bills or debts is for 3 years, for contracts not in writing ( A.C.A. 16-56-105 ). 2 years from the date the service ( s ) was rendered for from the date in which the most partial payment was made ( A.C.A. 16-56-106. This company and its debt are unknown to me and it damaging my credit and livelihood. I do not have any financial relationships, debts or legalities with this company because I have never signed any binding contacts stating such.
