According to O.G.C.A. TITLE 7, CHAPTER 4, ARTICLE 1 7-4-2 ( a ) ( 1 ) ( C ) ( 2 ) where the principal amount involved is {$3000.00} or less, such rate shall not exceed 16 percent per annum simple interest on any loan, advance, or forbearance to enforce the collection of any sum of money unless the loan, advance, or forbearance to enforce the collection of any sum of money is made pursuant to another law. ( 3 ) As used in this Code section, the term " interest '' means a charge for the use of money computed over the term of the contract at the rate stated in the contract or precomputed at a stated rate on the scheduled principal balance or computed in any other way or any other form. Principal includes such charges to which the parties may agree under paragraph ( 1 ) of this subsection. Amounts paid or contracted to be paid as either an origination fee or discount points, or both, on any loan secured by an interest in real estate shall not be considered interest and shall not be taken into consideration in the calculation of interest and shall not be subject to rebate as provided in paragraph ( 1 ) of subsection ( b ) of this Code section. In addition, according to The Georgia Industrial Loan Act, Section 7-3-14 ... Maximum loan amount, period, and charges. Every licensee under this chapter may loan any sum of money not exceeding {$3000.00} for a period of 36 months and 15 days or less and may charge, contract for, collect, and receive interest and fees and may require the fulfillment of conditions on such loans as provided in this Code section : ( 1 ) INTEREST. A licensee may charge, contract for, receive, and collect interest at a rate not to exceed 10 percent per annum of the face amount of the contract, whether repayable in one single payment or repayable in monthly or other periodic installments. ( 2 ) LOAN FEE. In addition thereto, a licensee may charge, contract for, receive, or collect at the time the loan is made a fee in an amount not greater than 8 percent of the first {$600.00} of the face amount of the contract plus 4 percent of the excess. Based on the validation information provided by the creditor Acceptance Rentals , Inc., which included payment history on this account, the total payments paid to the creditor exceeded the principal amount of the loan ( {$2900.00} ), paying in full the entire principal balance, and exceeding 16 % interest per annum. In addition, the alleged signed contract provided by this creditor imposes a loan fee of 167 % of the face amount of the loan which violates the above chapters of the Georgia Code and the rules and regulations promulgated by the Commissioner pursuant to the chapters of the Georgia Industrial Loan Act. Therefore, I am not responsible for the dollar amount, debt or balance on this account being reported by this creditor to credit bureaus. This debt is false, deceptive, misleading, unconscionable, and unfair within the meaning of the Fair Debt Collection Practices Act, 15 USC 1692e, 1692f. Therefore, this creditor, Acceptance Rentals , Inc., is in violation of the above-mentioned regulations : FDCPA 15 USC 1692e, 1692f, O.G.C.A. 7-4-2 ( a ) ( 1 ) ( C ) ( 2 ), The Georgia Industrial Loan Act, Section 7-3-14, as well as the provisions of the FCRA. The creditor, Acceptance Rentals, was sent certified notification onXX/XX/XXXXfor full validation of account, in which they responded onXX/XX/XXXX, with information such as a contract and a payment history ledger showing payments. As of XX/XX/XXXX I sent the creditor another certified notification of violation of the above mentioned regulations. OnXX/XX/XXXX, XXXX was also sent a dispute and information of the violation of regulations in which removal from all credit files was requested because of illegal reporting. As of XX/XX/XXXXcreditor responded with a letter stating they will not respond any further and have continuously reported illegal debt to credit reporting agencies.

I have been trying to reach out to Acceptance XXXX, regarding my account for the past 60 days. I phoned, emailed and sent a letter to the corporate office. However, I had no response. I have false and inaccurate information on my credit report. Through the credit bureau XXXX and XXXXI requested that Acceptance XXXX forward me a copy of my original agreement/ contract to the address I provided or email a copy of my contract. When I initially opened this account. I signed up for insurance in the event that I lost my job or was injured ; and could no longer pay. When I lost my job. I gave proof that I was no longer employed and completed the paperwork for my insurance claim, which was immediately received and processed by Acceptance XXXX. My payments were covered through the insurance policy. Which left me with a XXXX balance, because the insurance policy paid the remaining balance. When I signed the agreement, the contract stated that some of my payments went toward my purchase and the rest to my insurance policy.So I made monthly payments to my insurance coverage the day I opened this account. Acceptance XXXX is reporting this account as a charge off/ bad debt. I requested this account be removed from my credit report. I also contacted XXXX and XXXX to inform them that there is fraud and inaccurate information on my credit report. From the creditor, Acceptance XXXX. I requested that this account be removed from my credit report. XXXX 's and XXXX investigation was completed and the results were verified and accurate. Which is not true.This account is not accurate. I requested that the method in which XXXX and XXXX used to validate the validity of this account, be sent to me in writing. XXXX or XXXX never sent me this information. However they sent me a general postcard in the mail explaining the Fair Credit Reporting Act and explaining that they use public records to verify accounts. How could XXXX or XXXX verify through public records fraud and inaccurate information? They can verify I had an account, but the details in which I'm disputing had not been verified by XXXX or XXXX.They have not fully investigated this account. This account was paid through insurance and is being reported as a charge off/bad debt. XXXX has not noted in the comment section of my credit report that I have disputed this account. Therefore, I am exercising my right under the Fair Credit Reporting Act, Section 609, to request information regarding Acceptance XXXX, that is listed on my credit report. As per section 609, I am entitled to see the source of the information, which is the original contract that contains my signature. the scam of XXXX days same as cash for furniture, I purchased {$1500.00} of furniture and was financed by Acceptance Rentals, an additional charge of {$3100.00} was added on to my {$1500.00} purchase a total of {$4600.00}, for XXXX mattresses, bunk bed frame, XXXX box spring, a loveseat and small sofa, that cost {$1500.00}. I contacted the lender and was told that the additional charges of {$3100.00} was for the cost of the lease agreement being maintained, and that they do not charge any fees or interest on the initial loan of {$1500.00}, and that {$62.00} of my $ XXXX monthly payment was applied towards the cost of the furniture and that the remaining {$130.00} was for the depreciation of the furniture while I have possession of the furniture. I want to know what law authorizes such predatory behavior upon low income consumers who rely on credit to afford their basic needs of living. My payment is $ XXXX monthly for XXXX months total cost is {$4600.00}, what a rip-off. I was told by the store representative that processed my application that I can pay of the {$1500.00} in XXXX days and owe nothing and the furniture belongs to me and in the event that I cant pay of in XXXX days, any monies I paid towards the {$1500.00} will be applied towards any remaining balance and that remaining balance will be spread out in the XXXX months, so I was made to believe that remaining balance from the {$1500.00} is all that I will have to pay off in XXXX months resulting in {$62.00}, not this outrageous new additional charge of {$3600.00} for some lease maintenance and the depreciation of the furniture while in my care. I am paying to own the furniture in XXXX months so why am I being charged for the cost of the depreciation of the furniture, the manager told me that in case they have to repossess the furniture for non-payment that the furniture will lose value and they cant sell the furniture to reap their losses, but they never put all this information on the lease agreement I got from the store clerk. the lender further states in the agreement that any statement made by the store personnel is not part of the agreement and that THIS AGREEMENT IS NOT AN INSTALLMENT LOAN OR A DEBT BUT MEMORIALIZES A TRUE LEASE, their agreement also states that although they do n't conduct a CREDIT CHECK BUT RESERVE THE RIGHT TO VERIFY ANY/ALL INFORMATION PROVIDED ON YOUR APPLICATION, yet the store personnel pulled my credit report and based on my credit score it determined how much money I will be loaned, the lender is in partnership with the store merchant to conduct business on their behalf to solicit customers and advise customers of the lenders guidelines and they just ripoff the poor consumers,

I have no idea who Acceptance Rentals Inc is or who they represent. This company entered a collection on my credit report without notifying me or contacting me regarding what this debt was about. I have never had an account with this company or anyone they claim to represent. Acceptance Rentals Inc is indicating that an account with the account number XXXX was opened with their company in XX/XX/2014. I never opened an account with them or anybody else. This account must be a result of identity theft or someone opening an account in my name using my identity. I have no knowledge of this account nor did I give anyone permission to open an account with my name. When a debt collector engages in the collection of DEBT they must provide copies of the following items : 1. Provide a certified copy of the complete credit application that debtor signed to secure the credit with your entity. 2. XXXX XXXX XXXX XXXX XXXX Ct. XXXX NC XXXX My Name is XXXX XXXX, I opened an account with XXXX XXXX XXXX is their number, AcceptanceNOW in XXXX of XXXX agreement number : XXXX. I don't even think XXXX XXXX owes the company now. I had an agreement to make payment once a month for 18 months. I have been making a payment every 2 weeks since that time of {$130.00}, I have never missed a single payment. I have paid well over {$4500.00} dollars for a living room and a bedroom suit, that is probably worth about half that much, not to mention the fees that are added. I have called this company to never get a straight answer from anyone on the staff. it's a shame that North Carolina will allow these rent to own companies to overcharge customers by hundreds of dollars, in the name of doing business. I have made 6 payment of over {$800.00} and have been told for the past 4 months that the balance is {$780.00} after each payment. I check my credit report that showed a balance of {$470.00} and I have made two payment since that time, I have never had this experience with a company, I have nothing but problems since I opened this account, Customer are looked at as numbers, they have no respect for the customer base. I will never do business with rent to own companies again as long as I live. I ask someone to please look into this matter for me, I will be happy to forward all documentation i have on payment and debits from my checking account. I took out a loan for furniture with Acceptance Rental in XXXX XXXX. Each month around the XXXX of each month, an automatic withdrawal was made on my account. In XX/XX/XXXX, I reached out to the company requesting a notice of completion and never hear back. In XXXX XXXX, I was contacted by them implying that I had a final payment due, which I disputed. I advised them that I was disputing any additional payments due and would research on my end. Also, I advised them, that it seemed odd that they would suggest that I owed them monies, when they were withdrawing out of my account each month with no issues. They were reminded that they did not under any circumstances have any authorization to make any additional withdrawals from my account six months later. This morning XX/XX/XXXX, I was checking my account and noticed an automatic withdrawal pending from my account from Acceptance Rental, which I did not authorize and have had absolutely no contact regarding anything. This company took it upon themselves to take money from my account with any notification, acknowledgement or agreement from me.

On or around XX/XX/XXXX, Acceptance now at XXXX XXXX in XXXX XXXX Va was advised via a phone call that payment would be made on XX/XX/XXXX. They proceeded to make two phone calls on XX/XX/XXXX and left two voice mails on my cell phone. One at XXXX and another at XXXX. In the 2nd message the man stated " calling in reference to my commitment to make a payment today still need to get that payment in today call us back at XXXX ''. Never stated his name and made reference to a debt owed on my voice mail. When I called back and requested to speak with the man who had just left the message on my phone, I was not given his name as he would not give it to me, only kept saying what can he do for me. I advised him I told them the payment would be paid on this date and they have called me twice and left two messages on my voice mail. The day is not over yet and the payment has been made. He never apologized for the multiple messages or his disgusting attitude towards a customer. I would never recommend anyone to do business with this company.

I have disputed this account with XXXX and the only response I get is verified. I ask XXXX XXXX/Accptance Rentals for VALIDATION since I live in XXXX & this company seems to be in XXXX. My FCRA rights are being ignored and this is my next plan of action to get the XXXX & FTC involved until this is removed from my credit under Section 611 ( 5 ) ( A ) of the FCRA you are required to promptly DELETE all information which can not be verified. The law is very clear as to the Civil liability and the remedy available to me ( Section 616 & 617 ) if you fail to comply with Federal Law. The Fair Debt Collection Practices Act ( FDCPA ) says debt collectors can't harass, oppress, or abuse you or anyone else they contact. I am being harassed at lease twice a week. I am seeking damages. I asked for the company to validate this debt on XX/XX/2017 according to FCRA 611 ( 15 U.S.C. 1681I ) but they just ignored the request and kept on emailing me.

On XX/XX/2020I paid an account balance for the negotiated about to XXXX XXXX. This payment should have completed my obligation to the company. I have since then called the local office in XXXX, KS and the corporate number with no help to have it removed from my credit report. On XX/XX/XXXX I requested a free credit report from XXXX XXXX. The account still shows as not paid. I called the local office again on XX/XX/XXXX. The associate there told me he got busy and never sent it to the credit bureaus. He also has no way of pulling my receipt to send to the credit bureaus. No one at the corporate office answers or calls back. I have a receipt, which the associate says I can not email to him. I am never able to get additional documentation reporting that I completed my obligation. I recently applied for a car loan and was denied. I believe this account had a huge impact on their decision. I am also trying to prepare for buying a house.

I discovered many accounts that I never applied for. Doing the time that these accounts were open I was XXXX. Since I found these accounts on my credit report. I have placed and fraud alert on my credit report and also file a report with all three credit bureau. Upon my verification, please remove all accounts that have been placed under my name and social security number off of my account. Enclosed is a copy of my ID for proof. Please find attached copies of the time that was in incarcerated. I have contacted XXXX for a year now with disputes - they have not resolved this they only send a generic message - FTCA guidelines etc - which is false and inaccurate. They have a company on my credit report Acceptance Now whom I have called and verified they have a totally different XXXX XXXX with a social XXXX which is totally not my social nor information- this clearly shows fraud but yet they keep saying its mine. This is my fia attention before The Law office working in this files charges against them - When calling this company you can not get through it takes weeks - after getting through they before its my name and similar XXXX but not my social or ID!!! They have failed to provide documents that confirm this is me, signed paperwork required by FTCA. I have nothing but false reporting in my report -

This particular account situation that is lately filing on my own credit document has a seriously unfavorable relation to my personal ability to obtain a present loan application. I highly recommend you generate verification that ACCEPTANCE RENTALS, has been reported completely in accordance with the Fair Credit Reporting Act regulations, it's really a serious problem to mis-report. Moreconfirmation of the aforesaid item too. My proper request mustover, I was never 30 days late in any of my payments and I'm not greatly tuned in to the date opened so I prefer to ask your be investigated as soon as possible and confirmed to be correct. I leased furniture with a company called Acceptance Rentals I returned the furniture all of it they keep stating that I kept a mattress which I did not I have a invoice from them that states all items were returned they keep harassing me telling me I owe them monies for leased furniture I have asked them several times to stop contacting me and they keep sending me emails and asking me to pay what owe they are even reporting incorrect information on my credit report. Acceptance Rentals this company operates and the financing company for XXXX and came to an agreement to pay the account in full. Now a XXXX dollar dinette is now XXXX dollars pass due! I have written to XXXX as was informed the account was paid in full back in XX/XX/XXXX. Now my bureau report XXXX is showing this company with a large balance I do not owe. I wrote the Attorney General Office in XXXX to be advise to contact your agency. I will include the email sent to me which spoke of a closing agreement with a final payment.

I purchased furniture from XXXX using Acceptance Rentals as the leasing company. The furniture totaled approximately {$2400.00}, but without my knowledge or consent, a new lease account was added to my Equifax credit report by Acceptance Rentals showing a balance of {$5700.00} -- more than double the amount of the purchase price. I have paid approximately {$2000.00}, maybe more, for the furniture and realizing that I will pay more than double what the furniture is worth does n't seem fair, right, or legal.
