I had a debt with XXXX XXXX XXXX XXXX, which I was making payments on. I had paid almost half of the amount, and then discovered via my credit score that a debt had been sold to collections. I received a statement from Accelerated Receivables in XXXX Nebraska. I do not recall the total amount of the debt, but I have bank records to show that I remitted a {$250.00} payment on XX/XX/XXXX of 2019. I shredded the statement with some other bills that I had made payments on. Sometime in either late XXXX or early XXXX, I contacted Accelerated Receivables via their online email option. I requested either another statement, or possibly an email with my account information so I could continue to make payments, as I had shredded my account information. In this email, I advised that I have an unusual work schedule, working second shift at the local XXXX, and that phone calls usually went unanswered since most came during the hours I sleep. I did not screen shot or document the date of this email, I assumed it was a simple enough request and I would be given the needed info to continue paying my debt. The closest thing I received to contact from this company was a phone call on XX/XX/XXXX at XXXX, while I was sleeping. No voicemail was left. I never received a return email, nor did I receive a statement with my account information. I tried several ways to make a payment using their website, but every option I found required my account number, which I didn't have access to. Time passed, and I was served notice that I was being sued, while I was at work, getting XXXX XXXX ready for a XXXX XXXX in the XXXX I was put in a situation where I had to put a XXXX XXXX XXXX XXXX XXXX to stop and find out I was being sued for 'refusal to pay ' a debt that I had attempted to pay. Funds are increasingly limited, and I can not afford a lawyer, so I was unable to do anything in response to this action. Now I'm getting letters about wage garnishment. I do not deny I owe the initial debt. I attempted to pay this debt. Accelerated Receivables was notified that I needed information to continue to remit payment, and refused to provide this information, making it impossible for me to make a payment on this debt. Had this information been provided, there would have been no reason for them to turn it over to the courts, and there would be no lawyers fees and court costs, which have increased the balance claimed to over {$800.00}.

Accelerated Receivable Solutions had me served on XX/XX/2020 for debt that had been paid in full on XX/XX/2020. When I called concerning the summons they assured me without proof that they had corrected the issue and that I would be receiving notification that the court summons had been reversed. I have never received that correction and I am still on the Docket with the XXXX County Court for debt already paid in full. Today when I called the agency, contrary to collection laws, they failed to identify themselves on the phone, failed to identify who they were, asked questions concerning the issue prior to announcing that they would be recording the phone call or that it was an attempt to collect a debt. Then after assuring me over the last several phone calls that all debt had been satisfied, suddenly had hold debt that I had never been notified about in writing in their office and demanded payment. They have to be prompted numerous times to send receipts for proof of payment, and they refuse to send proof of debt when it is requested. Collection laws clearly state they must identify themselves at the beginning of the phone call with first and last name and what the organization is, that it is an attempt to collect a debt and that they are recording you, and this can not wait until after they have talked and badgered you for 10 minutes. Additionally ARS is charging a 30 % processing fee ( XXXX dollars to even take payment on a debt they never notified me in writing upon receipt in their office ). And they stated on the phone that they had the debt in their office for a couple weeks, which meant they were sitting on the debt contrary to collection laws to accrue additional interest before notification. However I have never received notification from this company for any debt, instead I find it on my credit report and have to investigate and locate them. This is also a violation of the credit collection laws in that they are making no attempt to notify the person responsible for the debt that they have acquired it. XXXX XXXX XXXX, and XXXX XXXX have stated through their financial officer that they immediate send the debt to the credit company on the day that they bill the consumer, and in many instances its a fight to get one or the other company to recognize that bills have been paid.

I was sued and garnished for a debt that was not mine and eventually had to file bankruptcy. My sons father, not my husband or ex husband we were never married and never lived together, was court ordered to pay {$370.00} in support as well as keep my son insured till he was XXXX. My name is no where on his bills but because my son lived with me I took him to his appointments. There was consequently no communication from the doctors with me about billing for his appointments. And by the way I was covered by health insurance through the XXXX when these bills for my son were accrued. My son was not on our insurance because he was on his fathers. He subsequently did not take care of his bills or giving the doctors office the proper information they needed to bill his insurance company so his debt went to collections and some how they sued me I did not know until they started garnishment of my wages. I called them immediately and explained these are not my bills and the gentleman laughed at me and basically said whatever! The amount was almost {$6000.00}. So I filed bankruptcy to get the garnishment stopped but when we put the bankruptcy together I had none of my own debt to contribute to it. I dont owe any money, I dont have credit cards. If I need something I pay cash. So why should I have to ruin my credit by filing bankruptcy for his bills? We go to court XX/XX/XXXX for the bankruptcy and I dont want to file it. Its not my debt I shouldnt have to ruin my life for his incompetence. They should not have even been able to sue me for these bills. On top of all of it I have to pay a lawyer {$1800.00} for the bankruptcy. Its none sense. What can I do? Remember he was court ordered to keep my son insured doesnt that mean anything?

I was not aware of this debt until XX/XX/XXXX at approximately XXXX when I was served with the legal papers. I initially tried calling the company where the medical services took place. They refused to help me. They said that the debt was too old and that " I should have read my Explanation of Benefits '' or known the terms of my insurance better. As I explained to them, I wait for the bill so that I know that everything is hashed out between the insurance and the facility. I do not even recall receiving an Explanation of Benefits, but I know that I did not receive any letters. When they refused to help me, I called and talked to XXXX at Accelerated Receivables Solutions. When I spoke with her, she let me know that they had sent me 2 letters since the XXXX date of service. I do not recall receiving either of these. The kicker was that she openly admitted that THEY CALLED ME OVER 160 TIMES. I did not receive any messages and like most people, I do not return calls that I don't know and that don't leave a message. XXXX demanded payment in full and told me that the ability to make payment arrangements had passed. I proceeded to tell her that if they weren't even willing to work with me, that I would see what my options I had in regards to harassment as she herself had admitted the number of times that they called. Looking at the math, that would be 1 phone call every 5 days for the past 2 years and 3 months if you are only looking from the date of service from the original debt of XX/XX/XXXX and I am sure that they received it at least a few months after that date which would make the number of phone calls even worse. I would like to know what options I have her and what I need to do.

In XXXX of 2019, I reviewed my XXXX credit report and it showed three medical collections from Accelerated Receivables Solution and the same information is also shown on XXXX & XXXX. So on XX/XX/2019, I sent a certified letter to Accelerated Receivables Solution requesting to validate the three collections. The company is in XXXX, NE and a part of the request from this company is do they have a license in the State of Michigan to collect this debt in addition to sending me a copy of the actual account from the creditor company. Today is XX/XX/2019 and have not received any written correspondence from Accelerated Receivables Solution. My disputes with this organization are the following : ( 1 ) the company did not respond to the documentation requested from myself for the company to validate that they can legally collect these medical collections : ( no validation of the actual copy of the bill and account, no information of the creditor regarding these collections, no documentation of the company proving that they can collect debts in Michigan-bond ) ( 2 ) All three medical collections on the XXXX report have the same account number with different debt amounts, ( 3 ) they did not respond to the reasonable time ( 30-35 days from receipt of the letter ) to validate that they can collect these 3 collections and the three medical collections are still showing on all three credit reports. Supportive documentation is attached to this complaint.

On XX/XX/2021 I was checking my consumer credit file and noticed an account from ACCELERATED RECIEVABLE for the amount of {$68.00}, I never recievd proper documents from this company. They have violated mutiple laws including 15 U.S. Code 1692e.False or misleading representations ( 10 ) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer. ( 11 ) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.

I was served papers by a debt collection agency as their first point of contact for a debt that isn't mine. They also attempted to charge interest on the debt, which is illegal. When I tried to contact them to resolve the issue, they refused to answer or call me back, which is also a violation of the law. Under the Fair Debt Collection Practices Act ( FDCPA ), debt collectors are required to provide me with certain information, such as the amount of the debt, the name of the original creditor, and my rights to dispute the debt. It's clear that the agency did not follow these requirements by serving me papers as their first point of contact without any prior notification or discussion with me.

On XX/XX/2020 I sent a certified letter to Accelerated Receivables requesting validation of an alleged debt of {$960.00}. They received the certified letter on XX/XX/2020. They have failed to respond to my letter in a timely manner. Them failing to respond they have violated federal and state laws, but also have failed to provide me with a copy of any viable evidence, bearing my signature, showing the account reported accurately. I also sent them a good will letter in attempt to resolve this matter. I have my credit reports from XXXX XXXX showing no update and no comment was added to show it in dispute and I also have one from today XX/XX/2020 the XXXX day showing no update to the account.

I was sent to collections by XXXX XXXX XXXX XXXX in XXXX TN for an outstanding balance of {$140.00} that I was unaware of. As soon as I was made aware of the debt I paid the full amount online in XXXX of 2022. I spoke with an employee of Accelerated Receivables Solutions on XX/XX/XXXX and explained this. I asked for verification of the debt and provided them with the reciept of payment via email. As of XX/XX/2022 I am still receiving calls, messages, and texts from ARS attempting to collect a bill already paid.

This account has been deleted form my XXXX credit account and XXXX Credit Account. Now its on my XXXX Credit account again. I Contacted XXXX and I was told once deleted it could not be put back on my credit report I have disputed it, and it comes back with ( remains the same ) no change on explanation. I want this account to be removed and deleted from getting put back on my credit report.

Ive called them back and my husband has called them as well to see why theyre constantly calling me. They admitted they were a debt collection agency and when I gave them my info they responded with, We have the wrong person associated with your phone number we will remove you from our database. That was three months ago! They call me multiple times a day. Its borderline harassment.
