On XX/XX/XXXX I saw an ad on the XXXX XXXX website to refinance your car using autopay.com. I contacted the website on the online form to have an agent give me a call. On their FAQ section on their website it says they first do a 'soft ' credit pull to see if you get pre-approved. And if you are pre-approved, someone will call to show you different rates they may be able to get you. Then, you fill out an application and the agent sends it off to the lender to see if you are approved. That would obviously cause a hard inquiry where you may lose points on your credit score. I ended up looking at the reviews on the XXXX XXXX XXXX and other websites for autopay and I wasn't impressed by what I saw. One of the main complaints on the XXXX website was that autopay was doing multiple unauthorized 'hard ' credit inquiries on people 's accounts before the loan process had even begun. About 30 minutes after I filled out the form requesting a representative to contact me, XXXX XXXX texted me saying that he would like me to call him. So I wrote back to the text message : No thank you. He emailed me and I said I was not interested and please do no credit inquiries. He replied that he would 'close my account '. I was unaware that I had opened an account ... .but I figured that would be the end of it. I have the email saved where he says : " Dear XXXX, Using the info provided, we researched potential loan options and it appears we can not improve on the current loan you have this time. ****Prior to sending an application to a lender, AUTOPAY performs a soft-credit pull analysis. Using that information, we take great care to only send completed credit applications on to lenders when there is a high likelihood that we will be successful in finding a better payment and/or a better interest rate. *** However, it is possible that lenders will consider risk factors that are not available to us when using a soft credit pull. In those times, we may not get the approval we are looking for. '' As you can see from this email they sent me ( if you read carefully ), someone SENT A COMPLETED CREDIT APPLICATION off to a company without my consent. Still, I figured it was just a formality and they hadn't really sent anything off to a lender-maybe this was just the generic response they send to people. The next evening, XX/XX/XXXX, I was alerted that someone had viewed my credit report causing me to lose a couple points. The reason I am upset is because I found this recommendation on XXXX XXXX, so obviously I am trying to raise my credit score and get lower rates on my car loan, and these people are helping themselves to points off of my score! I called XXXX ( the credit reporting agency ) and the woman who answered spoke very little English and was most unhelpful and rude. She told me I had no choice but to wait two years for it to come off. I tried to explain to her, my worry is that this is the first of multiple inquiries like I had seen other people complain about on the XXXX XXXX XXXX website. My score is not high enough to withstand multiple inquiries as it is, and I don't feel I should have this done to me when I did not ask for it. I attempted to call the office where the inquiry was listed : Known only as XXXX XXXX. I looked this company up and it is known as XXXX XXXX XXXX XXXX. The number they ask you to call is mainly a debt collection line and I am having trouble connecting with someone who can help with this false credit inquiry. I sent a handwritten letter off in the mail explaining the situation. I do not want to be signed up for anything against my will or without my permission. I believe autopay is using some VERY shady business practices to lure customers, and I believe they get a commission of some sort which goes by how many lenders they can send people 's information to. I believe Autopay is unwilling to help. I asked them to please send me everything in writing as I can not record phone calls and I simply do not trust them with my information at all! I would beware of this company and look into them because they are using some shady practices. They 'closed ' my supposed 'account ' XX/XX/XXXX and then somehow, the following evening of XX/XX/XXXX they have banks/companies checking my credit score!? It makes no sense and it is concerning.

I applied for an auto loan using Auto Pay as a servicer to source, organize and close a loan deal on my vehicle refinance. Throughout the time of the loan, I experienced multiple scenarios where Auto Pay personnel mismanaged the application, information collection and contracting process. At times, I was asked for immigration documents I could not provide without either a ) falsifying the information or b ) using expired documents for a financial application, which could my wife 's XXXX status in jeopardy by committing such a crime while on a 2 year XXXX XXXX status. The items requested were a valid XXXX, as well as XXXX paperwork, which would be impossible due to my wife being a XXXX XXXX XXXX to a U.S. citizen. I acknowledged that I was not comfortable with my wife using these documents to apply for our loan, because Auto Pay was not the lender, and I was not sure how Autopay was going to use these documents on our behalf to close a loan for us. In addition to this scenario, I was asked to have my cosigner 's name signed off a title that her name was not on. I was also sent our contract via online signature tool, XXXX, 8 times. The contract was sent this many times because representatives at Autopay sent the document in the wrong order, out of order, to me twice, etc and this process had to be voided out a total of 4 times over a period of 61 days. Further, we received numerous communications stating we needed to provide paperwork, then a phone call stating to ignore this communication. We also received emails stating our application had been approved and our contract was on it's way, having signed the loan agreement approximately 8 times. Most recently, we became aware that Autopay had furnished our loan application and documents to the credit union whom was supplying our loan a second time, thus running our credit again and placing a " hard pull '' on our credit reports. Per XXXX, an immediate 29- point decrease was experienced by my wife 's Transunion report and a 2- point decrease on my report. In contacting Autopay, my loan representative, XXXX stated we took too long to finish our loan application, so the company, without our permission, duplicated our initial application, sent the application to the lender as if it were a new application, thus causing the inquiries, and then, as a result of my calls, stated they were going to " back out '' of the process due to my legal action threats. We have requested in multiple scenarios that one of the hard inquiries be pulled from our credit report, and Autopay has refused to do so. To date, the loan has not been fulfilled, although approved, and our credit reports have been harmed by Autopay. We are in possession of multiple pieces of evidence to show mismanagement of the application process, and are asking for immediate help to stop further damage to our personal credit profiles.

Subject : Complaint against Autopay and XXXX XXXXXXXX XXXX for misleading advertising and hard inquiry refusal removal. I am writing to complain about Autopay and XXXX XXXXXXXX XXXX ( Autopay ) for misleading advertising and refusing to remove a hard inquiry from my credit report. On XX/XX/XXXX, I was researching auto loan refinancing options through my bank and received marketing offers from XXXX. I submitted a request for more information about buying out my auto loan lease. I was contacted by XXXX XXXX of Autopay, who deceptively misled me with a multitude of " pre-qualified '' auto refi loan rates as low as 3 %. I have attached screenshots of our email conversation below. After several phone calls with XXXX and her team, they haggled me into misrepresenting me with a refinance rate variance of 3 % to 5 %, based on my XXXX XXXX score, low debt-to-income ratio, and XXXX vehicle lease buyout with a fair down payment. Autopay ran a hard inquiry on my credit report and sent my application to multiple sources, including XXXX XXXX XXXX XXXX and XXXX XXXX XXXX. However, all of the rates I received back were higher than 6.75 % to 8 %. I declined these absurd rates and informed Autopay that I was no longer interested in their services. Despite my decision, Autopay continued to badger me week after week to take their offer. It took them over 60 days to finally give up. My credit report still shows a hard inquiry for this misleading and misrepresented offer that I never accepted. I have reached out to both XXXX XXXX XXXX XXXX and Autopay, but they have both refused to remove the hard inquiry. I am submitting this complaint because Autopay is still misleading consumers about the potential " lowest '' unrealistic rates out there as low as 3 %. These deceptive practices need to be rectified. I understand that advertised rates may not always be exact, but there is a big difference between a plausible variance and a complete scam with more than double the rate advertised, even for supreme prime consumers with over XXXX XXXX scores, very low debt-to-income ratios, and extremely low monthly carry-over debt with over 20 years of managing optimal credit. I can't even imagine what other lower-tier credit consumers are being misled with much higher rates than falsely advertised. All I am asking for is to formally remove the hard inquiry from my credit report from XX/XX/XXXX. Autopay has refused to work with me on this, even after several attempts and call escalations with different representatives. There needs to be more regulation on these scammers and falsely advertised marketing. A hard inquiry should be able to be removed from a credit report if the deal was never a finalized transaction. I am writing this letter to express my extreme dissatisfaction and disappointment with the recent experience I had while dealing with your company, Auto Pay. The events that transpired during my interaction with your agents have left me frustrated and concerned about your company 's integrity and professionalism. Before I submitted my application, I had a conversation with one of your agents who assured me of a two-step approval process. The first step would involve a soft credit pull by Auto Pay to assess the likelihood of approval, and the second step would entail a hard credit check by the lender for final approval. I agreed to these terms and submitted my application based on this understanding. However, my experience took a disheartening turn when I called back with additional questions after submitting my application. To my shock and disappointment, I was informed that my application had been denied, and even worse, a hard inquiry had been made on my credit report. This was in direct contradiction to what I had been told initially, and it left me deeply concerned about the repercussions on my credit score. Upon raising this issue with the agent I spoke to, they acknowledged that it was a mistake and assured me they would note that the unauthorized inquiry needed to be disputed. I requested an official letter or email confirming this, but I was inexplicably directed to " customer service '' and connected with an agent named XXXX XXXX. My interaction with XXXX XXXX was nothing short of frustrating and unprofessional. She not only displayed a lack of empathy but also contradicted the information provided by the initial agent. XXXX informed me that Auto Pay operates as a broker and does not follow the two-step approval process I had been promised. When I requested to speak with a supervisor or another agent, she outright refused and even hung up on me. This behavior is wholly unacceptable for a customer service representative. After multiple attempts, I was finally able to speak with an escalation agent who promised to review the situation and follow up with me. However, the ordeal I went through has already caused me significant stress and XXXX I believe it is crucial to take these grievances seriously and rectify the unauthorized hard inquiry on my credit report promptly. I intend to file a complaint with the CFPB regarding this matter, and I trust that you will cooperate fully to address this issue. I look forward to a swift resolution to this matter and expect a formal response from your company within a reasonable time frame. In the meantime, I request a written confirmation that the unauthorized inquiry will be disputed and removed from my credit report. On Tuesday XX/XX/XXXX I applied with XXXX for a Lease buyout of my current vehicle. I was presented with 4 offers from different loan servicing companies. One of which was Autopay. Autopay showed the lowest rate upfront among their competition and upon further review of their offers there was an even better rate at a different term. The rates ranged as follows : Lease Buy Out Offer From : AUTOPAY Maximum Amount {$33000.00} APR 3.49 % Months* 24 Maximum Payment* {$1500.00} ADDITIONAL LOAN OPTIONS FROM AUTOPAY 3.49 % @ 36 months {$1000.00} 2.99 % @ 54 months {$710.00} 2.99 % @ 66 months {$590.00} Additional Stipulations, Terms and Conditions Check for year, make and model restrictions Check for mileage and loan-to-value restrictions Valid drivers license Proof of insurance Proof of residence Proof of income On Tuesday XX/XX/XXXX I was contact by Autopay to collect additional information to finalize the loan process. That included confirmation of the information provided during the original application and reviewing to confirm the vehicle details. On Thursday XX/XX/XXXX I was contacted by XXXX XXXX at Autpay. She confirmed my details and shared that I had been approved. She confirmed my credit was fantastic and income was well above what was needed. She shared with me that their preferred bank XXXX, I believe, came back at a rate of 5.3 %. That is > a 200 basis point increase from the original offer in a mere 72 hours. I shared my displeasure with XXXX at that time and told her this was unacceptable. I then contacted XXXX to share this incident with them. I spoke with them on Friday XX/XX/XXXX. They asked for a 48 hours to try and reach out to Autopay to understand what was going on. XXXX as manger from Autopay contacted me on XX/XX/19 as I informed them I was unsatisfied with their tactics and wanted to get them an opportunity to resolve before I submitted a CFPB complain. He reviewed my file and acknowledged that I have a near perfect credit score and they vehicle value far exceeds the requested loan amount. He confirmed that per the terms and conditions there was nothing that changed to rationalize a > 200BP rate change in 72 hours. He openly acknowledge that they advertise rates that may not be able to be honored. this is a blatant bait and switch tactic. They showed a lower rate than their competition with no intention to honor that rate. He simply stated that they are at the liberty of their lenders and that is what the final rate came back at. I have additional email documentation on the dates if necessary. Also all calls were on a recoded line by Autopay. If you were to ask for the call logs you will hear for yourselves the same things I heard.

I purchased a vehicle in XX/XX/XXXX from a car lot and less than a year later my loan was sold without my knowledge to another company. I have never signed papers with this company and had no knowledge of the sale until they called me saying I was delinquent. I also had never had the title to the vehicle in question as the original car lot requested that it be sent back to them. So I requested an address and payment information as well as the title from the new company and started making payments. I never did receive the title. Later in XX/XX/XXXX the vehicle in question was stolen. I filed a police report and called AC AUTO LLC to inform them. I also advised them that I would continue working with police to find the vehicle but after it was located I would be doing a voluntary repossession to give them the vehicle back. The vehicle was found in XX/XX/XXXX and I was notified. I retrieved my belongings from the vehicle and called AC AUTO LLC to retrieve their vehicle. I was then called two days later from the tow company that the car was indeed retrieved by AC AUTO LLC. Almost two years later Ac AUTO LLC reported the vehicle to collections in the amount of {$5500.00}. I fought this account as non accurate and it was removed from my credit. On XX/XX/XXXX another collection named XXXX XXXX XXXX showed up on my report for the same vehicle. I contacted the collection agency denying the debt and asked for all information about the original collector. All the collection agency would tell me was that it was from AC AUTO LLC and it was over the XXXX in question. Not only is it on the same vehicle that I do not have possession of, and haven't for many years, but the collection agency has 're aged ' the debt to reflect original debt from XX/XX/XXXX. This is inaccurate and I believe this is in violation of the Fair Credit Reporting Act. I ask that this account be immediately purged from my credit as well as the collection agency flagged. I have not been able to get into contact with the original debtor due to no listing for their business anymore. I have not found an address, phone number, email, fax, nor a matching name while trying to get into contact with AC AUTO LLC.

The car that was allegedly leased was repossessed with the original creditor and was not resold. According to Virginia state law once the vehicle has been repossessed, the original creditor may decide to either keep it as compensation for your debt or resell it in a public or private sale. The original creditor decided to keep the car as compensation and therefore I no longer owe the original creditor for the lease of this vehicle. If this car was resold proper notices were not given. Under the laws of the State of Virginia UCC and State RISA and MVISA statutes a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. State law also requires that the creditor tell you the time and place of the sale so that you can attend and participate in the bidding or If the vehicle will be sold privately, you have a right to know the date of the sale. None of these things have been done or provided by this collection agency to properly validate that this debt is owed. I want to be provided the following : A proper validation with the signed contract with the original creditor A copy of purchase agreement between the original creditor and AC Auto Pay. With the original creditor giving all rights to this debt including the right to receive payment and charge interest to AC Auto Pay. If there have been any other changes or adjustments since the last billing statement from the original creditor, for them to please provide full verification and documentation of the amount you are trying to collect. Explain how that amount was calculated. In addition, explain how the other changes or adjustments are authorized by the agreement creating the debt and permitted by law in my state. Do they have a debt collection license from my state? provide the date of the license, the name on the license, the license number, and the name, address and telephone number of the state agency issuing the license. Provide proof that all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. If the leased vehicle was sold provide proof with a copy of the required State law notice sent of the amount, time, and place of the sale and If the vehicle was sold privately, provide the proper notice with the amount and date of the sale.

On XXXX I agreed on a purchase price with the seller for a XXXX XXXX XXXX on XXXX. I was then contacted by their financing partner AUTOPAY on XXXX who claim to provide stress free financing where they take care of all paperwork and essentially act as a middle-man dealer between two private parties. Between XXXX and XX/XX/XXXX I provided all requested documentation and was approved for a loan. Final loan documents were then supplied by AUTOPAY, with numerous errors ( counterparty name, interest rates, and other crucial pieces of information ), after notifying the firm of the mistakes the loan documents were resent and finalized by XX/XX/XXXX. Between XX/XX/XXXX and XX/XX/XXXX AUTOPAY did not return any requests for information or status of the loan. On XX/XX/XXXX the lender requested a few final pieces of information, all of which was provided within hours. I was then instructed to wire AUTOPAY the down payment, which was sent and confirmed received on XX/XX/XXXX. After confirming the receipt of the wire, AUTOPAY stated it would be a few days maybe when I inquired as to when I could pick up the car and register it. Following this promise there was minimal communication until XX/XX/XXXX when I was told it would be completed by XX/XX/XXXX no problem. On XX/XX/XXXX there was no communication and when I called to inquire they acted as if they did not know what the hold up was. Since XX/XX/XXXX they have made no progress and continue to push off giving explanations as to what is taking so long. Not only have I had to correct loan documents, and title process ( they were grossly unaware of how titles work in NY state ), but I have also spent countless hours on the phone waiting on hold just to be disconnected or told they will call me back which has rarely happened. To date I have not only paid them a {$490.00} financing and paperwork fee but have been out my $ XXXX down payment for a month, paid a full months insurance on a car ( {$100.00} ) I do not have and have had to pay {$22.00} per day to get to and from work via public transportation. They have not only mishandled numerous pieces of information, been extremely untimely and provided false promises but have also cost me a $ XXXX+ in incidental costs due to their mistakes. I would highly recommend staying away from AUTOPAY and their affiliates.

On XX/XX/2022 my car was stolen by a man claiming to have a repo order from ac autopay for my vehicle. He was abusive and threatening and said XXXX XXXX XXXX XXXX XXXX XXXX XXXX so I called police. The police forced me to let him to take my car. They refused to let me get my things out as well, including my XXXX XXXX jewelry and last will and testament, stating I would need to wait on the notice I'd receive after the repossession. I of course never received anything from them. I don't owe ac autopay money and they never had a security interest in my car let alone a valid ( or invalid for that matter ) lien on my title. They are an aggregator that my husband tried to use for a refinance. However, they sent the wrong payoff amount, charged sales tax stating he purchased the car from them when he didn't, and failed to remove my name from the title to complete title work and the lender closed the account and reported it as paid in full on my husband 's credit report in XX/XX/2022. The contract has no account info, is dated over a month before they said they completed paperwork, listed it as a sale including illegally charging sales tax, again they never took me off the title while i had nothing to do with the loan, and THE CONTRACT WAS NOT WITH AUTOPAY BUT WITH A CREDIT UNIION. The lender closed the account because it wasn't a valid contract. We were told by autopay rep that they don't repo cars and we were asking the wrong people where my car is. We have no idea where it is or where our belongings are. We've heard nothing from anyone about any of it. They stole my car. I have verified who the lienholder is and it is listed as the original lender, who did not repossess the car, as we no longer owe them money. They reported the repo on his credit report and we disputed it as fraud and transunion investigated and deleted it from his file. As of today I have had to almost 2 months without a vehicle for my family of XXXX, while my car was illegally taken by people who had no right to it. My mothers jewelry was stolen and no one will tell us anything.

AC Auto Pay located in XXXX, CO claims that I owe a debt of {$8500.00}. I sent the initial letter of dispute on XX/XX/2018. I demanded proof that the repossession of the vehicle was in legal accordance with the following UCC : 9-506. ) EFFECT OF ERRORS OR OMISSIONS 9-611. ) NOTIFICATION BEFORE DISPOSITION OF COLLATERAL 9-612. ) TIMELINESS OF NOTIFICATION BEFORE DISPOSITION OF COLLATERAL & 9-613. ) CONTENTS AND FORM OF NOTIFICATION BEFORE DISPOSITION OF COLLATERAL. AC Auto Pay replied claiming that they sent a NOTICE OF INTENT TO DISPOSE as well as a NOTICE OF SALE OF COLLATERAL AND POSSIBLE DEFICIENCY. On the Notice of Intent to Dispose, the amount owed is {$8100.00}. On the Loan Billing statement, the amount owed is {$8000.00}. On my credit reports, the amount owed is {$8500.00}. As you can see, they have violated the federal law in more than one way. The repossession was not fully in legal accordance with UCC 9-506, 9-611, 9-612, and 9-613. This is a violation of FCRA & FDCPA and the entry must be removed. Furthermore, AC Autopay did not provide proof, bearing my signature on a certified mail receipt that I even received these documents that they allegedly sent via certified mail. I do not recall receiving these documents. Lastly, AC Auto Pay did not furnish the credit bureaus with the required disclosure, within the period required by law. They are required by federal law to place a notice of dispute on the account within 30 days of my dispute, which they signed for on XX/XX/2018 ( I will attach a copy of the signed receipt ). I have retained a time stamped copy of my credit reports, showing that they have violated the Fair Credit Reporting Act, Section 623 ( a ) ( 3 ) and/or the Fair Debt Collection Practices Act Section 807 ( 8 ) by not placing the disclosure within the required 30 day period. As this company have violated federal law, by not properly providing the credit bureaus with proper notice within the required time frame, and I have evidence of such, via certified mail receipts, they must now remove the item.

I am a former employee of AUTOPAY aka AC AUTOPAY. The company consistently and knowingly engages in fraud at multiple levels of the operation. They knowingly provide false/unverified information to their federally insured credit union partners. They send credit applications without verifying length of employment, length of residence, vehicle trim levels and general vehicle options. The lending partners are not aware of this. It's done internally, again, knowingly, with the goal of increasing the number of approvals and ultimately the amount or revenue. This has gone on for several years. Additionally, at one point during the operation they collected sales tax on hundreds if not thousands of transactions, when in fact no sales tax was actually due. This was around XXXX. These were straight refinance transactions and they were collecting sales tax, it was itemized into the loans. Autopay willingly and knowingly allows their employees to use illegal sales tactics. These tactics include lying about the cost of ancillary products, not disclosing basic details such as loan term, and insinuating that the lender is requiring you to buy ancillary products. Only if a lending partner catches on to the lies, will they take any corrective action. Autopay has consistently engaged in illegal advertising. They quote customers rates that they know they will not be approved for, at times, even quoting rates that dont exist. This is done both on their website and through channel lead partners. Finally, Autopay engages in illegal workplace standards, such as, not allowing employees to take full lunches, not paying overtime in any way, and filing false time cards. This is a boileroom operation that needs to be investigated in depth.

On XX/XX/XXXX I received communication from XXXX, from AutoPay.com about the loan request I submitted. I gave him the information he needed ( license, mileage, etc ) and he ran really fast through what needed to happen. He stated all the " add-ons '' that they offer, and that he'll get back to me once he gets approval to discuss my options. He was in constant communication with me, asking if I had time to talk via text. If I texted him, he responded shortly after. There was never any real delay in our conversation. He told me I was approved. Once he emailed me the terms and details, he very quickly contacted me again. I looked over the email he sent. It had every single thing added onto it that he could have added on. None of these were discussed with me. I told him I wanted nothing extra and I only wanted to refinance what I currently owe to my bank. He sounded frustrated and said he'll have to have the contract re-drawn. Something that wouldn't have had to happen if he had ever asked me what I wanted to add on if anything. But he clearly didn't care about that, he just wanted a commission, because that phone call was the last I ever heard from him. I sent him two texts and an e-mail since then. It's been 8 days since I've heard from him so far. The fact that he rushed through everything and was extremely communicative and " friendly '' up until he saw I wasn't going to just sign the documents without reading them, shows he was being fraudulent. I recently got a letter in the mail saying I wasn't actually approved, yet a contract was drawn up, with the amount and monthly payments that I only had to sign to begin? This is straight-up fraud.

XXXX and AutoPay engaged in deceptive practices via the XXXX XXXX website. My son and I recently purchased a used vehicle and financed it through a credit union at 7.64 % interest rate for 60 months. The XXXX XXXX website induced me to apply to refinance the loan and provided 15 pages of offers based on my credit scores. XXXX XXXX also knew the VIN, year, approximate mileage, make and model of the vehicle, so I assumed the offers would be accurate based on all the available information. I applied for one of those offers through AutoPay, going directly to the AutoPay website, application # XXXX. Since I am defined as a " prime borrower '' I expected the best interest rate advertised to me in the XXXX XXXX offers, which was 3.49 % for 60 months. Upon hearing back from the AutoPay representative, XXXX XXXX, XXXX, XXXX, he informed me by phone that the rate and payments would be higher than the rate and payments are on the existing loan. He said " interest rates are just very high right now. '' I asked him " if I don't qualify for the advertised rate, who does?, '' he replied " no one. '' I consider this a bait and switch tactic which induced me to apply for credit and resulted in a hard credit pull on my credit report as well as my son 's. It is very disappointing to me that XXXX XXXX would participate in this kind of fishing expedition by allowing such an obviously predatory company onto their web platform, using it to bait and switch XXXX XXXX users into working with bad actors. I have a printout of the offers provided in my XXXX XXXX profile as evidence of what AutoPay and other lenders are doing on XXXX XXXX 's website.

I applied for a refinanced car loan via AutoPay company. I was approved on XX/XX/XXXX and signed loan docs on XX/XX/XXXX. After signing I continue try contact the Representative that assisted me for the status o of my loan pay off. I applied for and was declined by XXXX XXXX XXXX to refinance my vehicle on or about XX/XX/2020and I received legal notice in the mail I was declined. I did not return the call as I had already secured a refinance with a credit union. I immediatly called Auto Pay LLC on a hunch and the woman I spoke with today XX/XX/2020 confirmed yes they had give permission to their banks to pull my credit, even though I had NEVER consented to this! I advised do NOT pull anymore credit and pull my application, I do not need their services. I am shocked that someone, especially a refinance broker like Auto Pay would give my sensitive information to their banks to pull my credit with NO permission from me, the consumer. I am also not happy with XXXX XXXX XXXX selling my sensitive information after declining me as this could lead to fraud. I read the XXXX XXXX disclosures which only stated the loan may be provided through them OR their affiliates, not that they would pass my sensitive information on to other 3rd party companies AFTER XXXX XXXX XXXX declined me!. I called today to get my pay off amount on XX/XX/2017 and was given {$8.00} pay off with a per diem of {$4.00}. When I reviewed my financial statements I noticed some discrepancies. When I asked for a ledger from AC Autopay I was informed that they do not provide that and that I can request a payment history via email. The payment history I received is still deficient approximately {$40.00} in payment accounting and the total amount financed is incorrect per the truth in lending statement signed by me and my husband. XX/XX/2017 and spoke with XXXX who stated the latest supervisor notes in my account were from you notating that the finance charge and amount were correct when loaded into the system. I requested that they research this further because in my original copies from XXXX and the XXXX agreements my records are showing {$9800.00} loan amount with a {$810.00} XXXX XXXX charge for a total amount financed of {$9000.00}. I have spoken with XXXX XXXX on XX/XX/2017 and he was going to research this further for me but in the converstation I had with him today XX/XX/2017 he stated that the finance charge of {$5400.00} was were the {$810.00} was deducted from and that he encouraged me to have someone take a look at my agreement. They changed my APR and total amount owed several times and the XXXX XXXX is continuously interjecting in my account without supervision. On XXXX XXXX, I contacted AC AutoPay to request a voluntary surrender because it was costing me more to fix different issues with the vehicle than it is actually worth and I could n't afford to keep fixing everything and make the monthly payments. I was told by the representative that the request would be reviewed and I 'd be contacted when a decision was made. On XXXX XXXX, the company contacted me to do a collection call. When I asked about the voluntary surrender I was told that the request had been reviewed that XXXX and they decided not to come pick the vehicle up, that they had abandoned interest. When I asked why no one had contacted me to let me know. I was told they did n't have to. I called back later in the day to request the decision in writing and was told that they do n't provide things like that in writing. I asked to speak with a supervisor. When the supervisor came on the line, he advised that they do n't provide their decisions in writing and hung up on me. A few weeks later, a rep called me to complete a collection call and I advised him that I had no intentions of paying anything else and that I wanted them to come pick up the vehicle. Since that, I 've had to demand that they stop calling my work phone and block them from both my home and cell phones. Then blocking on my cell phone does not stop them from leaving voicemails and they call multiple times a day leaving voicemails where they do n't say anything, just a minute or more of background noise.

We have a title loan through autopay in XXXX colorodo. The balance was {$310.00}. The balance was sent to collections. On XXXX XXXX 2017 we called autopay to make the payment. ( cleared with bank XXXX XXXX 2017 ) They directed us to a collection agency with a number but refused to give us the name. We called and paid it that day. We were then told we would be receiving the title in the mail within 90 days. In the beginning of XXXX we called autopay to find out if the title had been sent out yet, we were told it was not and that we needed to Contact XXXX XXXX. XXXX XXXX said they did n't have anything from us so we needed to call cpcrecovery. We called and they said we needed to email proof and they would send it to XXXX XXXX. So we did and then we were told they would send the title and to again allow 90 days. Here it is the end of XXXX and autopay is saying we never made a payment even with our proof being emailed, then they say they 're waiting for the funds to be released so we can get our title. The story keeps changing. Every call we make to keep checking on it they keep asking when we paid it. It 's like they 're not taking notes, acts like they never heard from us and not caring. It 's been almost 6 months since we paid it off. I ca n't work because we 're down to one vehicle because we 're being refused registration for the vehicle and my insurance is dropping the vehicle. We just want our title.

In XX/XX/XXXX, I voluntarily turned over my XXXX XXXX XXXX to the creditor, AC Autopay due to my inability to continue payments. I was notified the vehicle was sold at auction and that the balance I still owed was {$1600.00}. I received phone calls from AC Autopay to request payment, which I was unable to do. I was then informed that the debt had been sold to a collection agency, identified as XXXX XXXX XXXX. I then started to receive phone calls from the collection agency assigned to this debt, XXXX XXXX XXXX, from XX/XX/XXXX until XX/XX/XXXX. On XX/XX/XXXX, I negotiated a lower amount to charge off this debt and issued a check for {$1300.00} to XXXX XXXX XXXX. I did not hear any more from this debt collection agency and noticed that the debt had dropped off my credit report. On XX/XX/XXXX I received a letter in the mail from XXXX XXXX XXXX claiming that I owed {$1600.00} for a debt originally owned by AC Autopay. I spoke to a man named XXXX on the phone and assured him that I had paid this debt. He requested a copy of the check, which I emailed to him on XX/XX/XXXX. Again, I did not hear anything further about this until XX/XX/XXXX when I was served court papers from XXXX XXXX representing XXXX XXXX XXXX stating that they were suing me in small claims court for {$1600.00} for their client AC Autopay. During the month of XX/XX/2017 on the way back from my monthly XXXX XXXX drill my motorcycle was stolen. I called my insurance company to file a claim and called my financial lender for the loan and let them know that the motorcycle was stolen. There was an investigation done by XXXX county sheriff and the outcome was the bike was uh unable to be recovered. The motorcycle was installed with a XXXX device which was part of the loan agreement when it was financed. To my surprised the XXXX that I was charged for was never activated and thus made the probability of locating the motorcycle nearly impossible replied the detective handling the case. I went through financial hardship paying for transportation because I no longer had a vehicle to take me to work, school etc. It took nearly 4 months for this company to receive a check from my insurance company due to extremely poor customer service. There was a total of 4 checks mail to the my financial lender finally paying the complete remaining balance of the loan. I wrote a good will letter explaining my hardship that I was struggling not having a vehicle and no leniency was given. During this process of my motorcycle being stolen cause you not able to make payments. My account was reported late to the credit bureau causing my credit score to decrease dramatically.

I tried to pay my monthly auto payment through my bank. Payment was scheduled for XXXX/XXXX/2015. On XXXX/XXXX/2015 I called AC Autopay inquiring about the payment and was informed that no payment had been received. I called my bank and was told electronic payments are not accepted by AC Autopay, so they sent them a paper check via US MAIL. I stopped payment on the check since no one could verify it 's whereabouts. I then called AC Autopay again on the XXXX. Explained to them that I stopped payment on the missing check so as to please not submit it for payment. I was assured a note would be placed on my account stating the same. My bank told me to wait 24 hours before re-attempting payment as to avoid double payment. I explained to the AC Autopay customer representative the same and since my note was n't due until the XXXX that I still had time. I called AC Autopay back on XXXX/XXXX/2015. Still no record of any check so I proceeded to pay with my XXXX XXXX right then and there. I received my XXXX statement with fees for a returned check. They found and submitted the check to the bank for payment on XXXX/XXXX/2015 and it was tomorrow ejected. Why submit the check if already aware check was cancelled and account was current. And the dates on the statement entries are questionable.

I found the auto refinance company on XXXX XXXX. I filled out all the paperwork and sent it to them on XX/XX/XXXX. I was assigned to XXXX XXXX. He did not review my loan amount, the cost of the gap insurance and extended warranty. He did not tell me what the interest rate was or that there is a {$500.00} loan origination fee. XXXX did not return my calls, and when I told him I was available he did not make an effort to call me at that time even though I explained the reason why I was not available at other times. He started texting me but even then he didn't respond to my texts. At one point I told him I wanted to cancel the loan. He said it was going to be funded soon and he didn't want to lose the deal. He guilted me into going forward despite my concern that the whole procedure was unethical. I did not get any information about the total of the loan, itemized costs of the Gap insurance or extended warranty ( that I told him I didn't need because I have one ) the loan origination fee, and the interest rate until I was given the name of the Credit Union that the loan is through. I sent an email and received the information two days later. I can get copies of the text messages, and they recorded all our phone calls on their end. This company is unethical.

On XXXX/XXXX/15 I went online to research car refinance rates in my area. I used XXXX and found a site that I understood would provide me with the prevalent rates in my area. They required some personal information to identify the best rates. I completed the form and submitted the information. In no way did I request or apply for a car loan as I only wanted to research current refinance auto loan rates. Unfortunately this site uses deceptive messaging and serves as just a marketing gateway to lenders which consequently ran my credit XXXX ( XXXX ) times thus affecting my credit report/score. Unfortunately I deleted my browser history and do not have the name of the deceptive website but i do have the names of the XXXX finance companies that deceptively acquired my personal information and ran my credit report resulting as a hard inquiries on my credit report. I have attempted to contact the XXXX companies in question to no avail as they all have stated they are not responsible for the deceptive practices of the original website. I disagree and would like them to remove the inquires in question on on my credit report. I 'm respectfully requesting assistance to have the companies in remove their respective inquiry from my credit report.

I applied at Autopay.com to refinance my high interest loan now that my credit is vastly improved post bankruptcy. I fully disclosed the vehicle was under water a bit and that I was 2 years post BK. Rep assured me based on soft pull that everything " looked great ''. I made it clear I wanted ONE app submitted and if declined to discuss options BEFORE anymore apps were submitted. Over XXXX XXXX they submitted 3 applications. One to XXXX XXXX XXXX XXXX, one to XXXX XXXX XXXX XXXX, and the last to XXXX XXXX XXXX. These were fraudulent applications by AutoPay knowing that I did not qualify for membership in ANY of these credit unions. When I called my account rep : XXXX XXXX XXXX he stated he had not read the notes indicating only one app but admitted they knew about the limitation I had placed and had submitted the other 2 but had an approval for me. Did not say which lender. When I declined their expensive GAP insurance and worthless warranty suddenly another {$1000.00} in a " deposit '' would be required to do a loan. NO deposit was ever mentioned in any prior communication and only came in when I refused their hard sell add ons. XXXX hung up on me and I immediately received and email stating I don't qualify for a loan.

On XX/XX/2021 I submitted a preapproval request to Autopay to review potentially refinancing my current car loan. The application stated that a soft credit check would be performed prior to them sending the information along to their lenders, which I agreed to. I received 3 offers based on the information I gave them, and then decided to wait a few days to think it over before deciding. On XX/XX/XXXX, without my consent, Autopay performed TWO hard credit checks on my profile. I immediately called Autopay to inquire as to why they had performed these, and was told that since they had all the information they needed, they went ahead with the hard credit check and that since I applied through XXXX that was my consent to further process my application. I immediately asked them to close my application, however the credit inquiries remain on my credit report and will negatively affect my score. Attached : 1. On XX/XX/XXXX I was approved for a car refinance loan through an Auto Pay lender. I worked with an agent- XXXX XXXX and had the documents notarized and sent the following Monday, XX/XX/XXXX. XXXX called me on XXXX and noted I missed a signature on one of the pages, then noted I needed additional documents. I told him to send me something in writing so that I could get him the documents. I never received an email listing the documents so I followed up with him the next week and was ignored. On XX/XX/XXXX he texted me and said he sent the email but I responded I never received an email and tried to verify my email address. I was ignored again. On XX/XX/XXXX I wrote the company and email asking for a new agent as the loan process has been delayed due to unresponsiveness. A new agent called me on XXXX and said I would have to start the process all over again and would require another hard credit inquiry. I declined applying AGAIN since I did not want another hard inquiry and I don't trust this company. I am concerned my data may have been used inappropriately or stolen. I keep getting numerous calls a day from this same company, I answered today and the person was very rude when I was asking her what debt this was for. She said for me to be quiet and that's probably why I don't know what's going on. i used autopay to refinance a loan. my credit was ran twice and i was told i was approved and given an interest rate. My credit and wages were sufficient to approve me for the loan, but then reversed the loan approval and claimed its because im an XXXX and that they dont loan XXXX.. ive been in this country since 2001 and have never been discriminated against in the financial sector for anything to do with finances ... thats what a credit report and poof of income are for.. when i told the rep at autopay that it was discrimination based on my nationality, he said that because they were a credit union they werent required to follow he equal credit opportunity act and that it only applies to banks ... upon further investigation i found out that the company XXXX werent a credit union but, a premier technology-enabled auto finance company... now i have XXXX inquiries on my report and auto neither autopay nor lengenuity have tried to fix the mistake. Iv had an auto loan, personal loan and credit card for years through a credit union, and ive never been denied because of my country of origin.

On XX/XX/XXXX, I responded to an advertisement on XXXX XXXX from AutoPay to refinance my vehicle at 3.52 % for a 60-month term. The ad suggested that I would see my available rates upon completion of a short application. However, upon completion, I received no rates. Eventually, I received several emails congratulating me on my approval. However, no rates were provided. It's important to note that this application resulted in a hard hit against my credit report causing a small drop in my overall FICO score. On Saturday, XX/XX/XXXX, I received a text message ( uploaded ) from an associate of AutoPay informing me that they could not beat my current 4.87 % loan and suggested I needed to change the terms of the loan or remove someone from my loan. I assumed he meant my wife. Today, XX/XX/XXXX, I received a text stating that removing my wife would not improve the rate and, in fact, rates had gone up. However, when reviewing XXXX XXXX, they are still promoting the same 3.52 % rate ( image included ). This entire experience feels like a classic bait and switch and is very misleading.

Re : AutoPay Changing Terms at End of Loan I received an advertisement on the XXXX XXXX application that I could reduce my auto loan interest rate and monthly payment via a refinance. My credit score is XXXX - XXXX. My current interest rate is 8 % with a XXXX XXXX monthly payment. The AUTOPAY advertised a 5.1 % rate and {$330.00} per month. I completed the application online with Salary, Insurance, Registration and VIN #. The agent texted me several times asking for the same information and called for the loan payoff from my current provider. He then texted me that the rate would remain at 8 % and the monthly payment would be {$390.00} ( for a longer period ). When I texted back requesting why, AUTOPAY cancelled my application. What makes me most upset besides the 2-3 weeks of wasted effort is the hard inquiry on my credit report which impacts my score and I have no refi. I researched on the XXXX compliant site and there is a multitude of similar instances with AUTOPAY via the XXXX XXXX application. This really needs to be investigated as a UDAAP violation

XXXX XXXX was my go to shopping site for auto refinance which make me sign a disclaimer that state lender MAY do a hard pull on my credit account. AutoPay reached out to me offering for the refinance and the gentle man gave me a offer and I clearly told them to wait until I hear from other lenders as I was still shopping. I also told them over the phone to not complete my application and even if they do don't do any hard queries on my account, but soon after I ended the call they did a hard pull on my account and when I called the agent, he apologized me for doing it by mistake and also told me that his manager will call me for the dispute. The great manager called me and said since I signed the disclaimer with lending that gives them the super power to do hard pulls on the account how many ever times they need which is ridicules. I still don't understand when I didn't authorize anything over the phone, they did a hard pull on my account and not willing to dispute it. Now they're not even picking my calls. Please help me hear. This is cheating.

I want to file a complain, against AC Auto pay. I least a vehicle with this company in the past.. Back in XX/XX/XXXX I decided to terminated my lease and return the vehicle. At the time I only owed {$7000.00} on the vehicle. This lease was a option to buy at the end of the lease. And so every month when I make a payment. Money was put a side to buy the vehicle. Today I call and trying to settle this account. The representative and I came to a settlement of {$3500.00}. Through XXXX XXXX it was suggested that I apply with AutoPay to for a lower payment and interest rate. I contacted them and forwarded to them all the documentation requested ie ( driver 's license, pay stubs, W-2 's, insurance ). I was told that I was approved but was unable to reach anyone except through emails and if I tried to call, only got voice mail. Then through texts today I was told they never received my phone numbers, etc and just began to get an " uneasy '' feeling. I FINALLY spoke with XXXX XXXX and she changed the whole conversation that " their lenders '' since the car was a 2012 XXXX XXXX which they have known that, was going to cost higher payments and only do 48 months. When I did a search of " XXXX '' phone number XXXX, it was " unknown ''. Also another number was for her home address. I have copies of texts and can send them to you at a number if you would like. Something just does not feel right with this business and they have all my personal information.

I applied for a vehicle loan on XXXX.com where it estimated my rate based on credit score to be 4 % through a company called AutoPay. I completed the application and shortly afterwards got a text message saying my application was approved. I replied to the message asking what my rate would be, they replied with 2.44 % for 37-63 months or 2.04 % for 0-36 months. I agreed to these terms and decided to proceed at 48 months at 2.44 %. I later received a message from the representative stating that they were responding with the wrong numbers, wasn't sure if my application would be approved, and if so the rate would be nearly 4 times higher. I asked that a supervisor reach out to me. I received a call from a supervisor who stated they were giving me someone else 's rates and they would not honor the numbers quoted. I asked if this was the case to close my application and remove the inquiry from my credit report at which time they stated that wasn't possible.

XXXX XXXX alerted me to a " high probability '' of getting a new loan to refinance my car with AUTOPAY ( an affiliated company? ). Then after confirming my information ( identity, car ) they called me to say that I am qualified for the loan then rattled off the loan, interest rate, monthly payment. The monthly payment was HIGHER and so I said, no. I don't want the loan and the customer service person raised his voice at me and said " I MUST TELL YOU ABOUT ALL THE PRODUCTS YOU HAVE BEEN APPROVED FOR ... '' and went on to tell me that I was approved for their monthly oil change service, which was conveniently added to the LOAN and though he wanted to tell me MORE I said no. This is FRAUD. They were using my personal information to entice me to apply for something I DID NOT WANT NOR ASK FOR. This is fraud. Both XXXX and AutoPay should be punished and all those they defrauded should be compensated. They colluded to commit fraud upon me.

I was told that my application to refinance my car was only going to be sent to one company by Autopay and their company did not shotgun your credit. The application took almost weeks because their employees was not doing there job. I called Autopay to check on my application because I had not been contacted. Autopay.com is the company. I have been having Title issues with getting sent to the Department of Licensing. Vehicle was refinanced XX/XX/2022 and current lien holder does not have the title it is now XX/XX/XXXX. Trying to get a hold of the title department is terrible. They do not answer phones and do not give you a straight answer. I simply asked for the tracking number of the package of the title to prove it was sent to the right DOL. They did not give that to me. I asked several times from their customer representatives to ask the title department for an update on the title and they don't have a digital system that can tell them where those issues are or WHAT the issues are with the title. It has been a frustrating month trying to get my vehicle title information updated, and it is because of those companies lack of urgency to transfer titles to the proper parties ( the DMV and the New Lienholder )

I clearly explained that I did not want a hard pull on my credit report. He explained he could not give me an accurate quote which I was fine with. He heard me out and said they would not be able to remove the inquiry they did and he would look into the recording to be sure I didn't confirm the inquiry. I had filled out an application with Autopay XXXX XXXXXXXX to get a car loan however when I called them 7 minutes after my application had gone through and one lender already denied me. I spoke to XXXX and he gave me two options : That he could take my application out of the system or to just allow my application to go through to other lenders and they would discuss further options. I went onto XXXX to look for an auto refinance loan. Autopay.com was offering me a personal loan quote for my refinance of 3.97 % and a term of 60 months. I applied for this loan offer and spoke to Autopay and informed them that I am only interested in a loan at those terms. They promised me I had nothing to worry about. Later I receive notice from one of there partner lenders that I am being approved for a loan at 8.01 %. I did not apply for any loan at this interest rate. I got a quote from autopay.com for a refinance loan. Their estimated price for the product I selected was $ XXXX/month. After I was " approved, '' the price jumped to $ XXXX/month and included gap insurance I specifically had UN-selected in my application, a {$1700.00} service contract I wasn't even given the option to select or un-select, and over {$500.00} in taxes and fees I had not been told about up front. The price after application vs when I prequalifed rose by over 42 %! Now, I know that these payments do fluctuate based on creditworthiness, but my score is in the 800s, so there should not have been such an alarming hike in the price. Complaint is about the autopay, when I tried to obtain the loan they advertised that load is about 2.99 % XXXX on their website but when I applied the load they offered me 6 % something ( I don't know the exact rate ). I asked loan officer that your website is showing 2.99 % apr and who do you give this rate. That person told me that this is handled by marketing team not me. Also they have reported on my credit that they sent it to a collection company spoke to the company and they told me that they have given the account back to the original company. But now that company isnt answering or responding because that company is closed. Need this off my credit to pursue the home of my dreams.

Im on a joint auto loan with my girlfriend and when she decided to refinance with AutoPay, they ran her credit ( of course ) but my credit as well without my consent. I noticed that someone tried to open an XXXX loan with XXXX ( in the inquiry report it says XXXXXXXX XXXX ) on XX/XX/2023. This attempt to obtain an auto loan was done without my permission. I have since frozen my credit with the XXXX major credit burials. Any loan that is opened with this lender has been done without my knowing.

They lied to me about saying I had no choice but to buy their warranty and gap insurance, they told me they had recorded calls of me and never informed me I was being recoreded, my friend refered me and he said they waived his doc fee because they liked her but when I asked they said no unless I buy their gap and warranty.
