To Whom it XXXX concern, On XX/XX/XXXX i filed an initial complaint under # XXXX with the Consumer Financial Protection Bureau XXXX XXXX alleged unverified and unvalidated debt attempting to be collected by Absolute Resolutions Investments LLC XXXX XXXX of XXXX. To summarize the complaint, In XXXX of XXXX i was made aware that an alleged debt collection account was opened and placed on my Consumer Credit Reports on or about in XXXX of XXXX by Absolute Resolutions Investments LLC. Not receiving any prior notice to this alleged debt, I sent a written letter to the furnishing company of Absolute Resolutions Investments LLC requesting verification, validation, Proof of ownership, and included a request for documentation as well as the original contract with my aledged signature. This also included a request for the alleged contract I somehow unknowingly was alleged to have with the furnisher " Absolute Resolution Investments LLC ' that they were attempting to collect. The written letter and request was sent via CERTIFIED XXXX MAIL on XX/XX/XXXX and conformed being delivered to Absolute Resolutions Investments LLC on XX/XX/XXXX at XXXX hours. STILL TO THE CURRENT DATE OF XX/XX/XXXX, Absolute Resolutions Investments LLC still has not sent the requested information and documentation to validate and verify this alleged debt as well as proof of ownership along with the requested original contract. Furthermore, In their response they claim that they sent and provided me with the requested information on XX/XX/XXXX VIA a XXXX party and their process server at the time of XXXX, XXXX, XXXX XXXX XXXX, PA in the form of a Validation Dent Packet. THIS WAS NEVER RECEIVED BY ME, The alleged responsible party of the alleged debt. Additionally, Absolute Resolution Investments LLC XXXX in their response that " XXXX XXXX has received several validations of debt packets on behalf of XXXX ''. This is also untrue as i have never received any of the requested information that was requested in the written request or associated documentation. Absolute Resolution Investments LLC still provided inaccurate, unverified, and unvalidated information to my consumer XXXX XXXX in violation of the FCRA. Additionally, in an attempt to correct their false reporting of the alleged debt, they made numerous changes to my consumer credit reports prior to submitting their response to my complaint in an attempt to conceal their inaccurate reporting and still currently are reporting inaccurate, unverified and unvalidated information for the alleged debt they claim i owe them or responsible for. See the attached complaint and their response as they can not provide any certified records or receipts of the information, they claim like i provided for my request. But now i have an additional complaint and clear violation of my FCRAP rights in addition to the other violations they have committed. Found within my normally delivered XXXX Mail while attempting to locate the alleged debt validation packet they claimed they sent me as requested, I located ( XXXX ) letters from 3RD PARTY DEBT COLLECTORXXXX claiming they were attempting to collect a DEBT on BEHALF of Absolute Resolutions Investments LLC. The first letter is dated XX/XX/XXXX and was sent by " XXXX XXXX XXXX '' as a notice of intent to settle. " XXXX XXXX XXXX '' is a XXXX party vendor contracted on behalf of XXXX XXXX XXXX XXXX according to their letter of " Notice of Intent to Settle ''. The second is a letter from XXXX XXXX which is ANOTHER XXXX party vendor that shows a statement with an alleged amount due, and states they are attempting to collect an alleged debt for and on behalf of Absolute Resolutions Investments INC. Furthermore, in their own response to my first initial complaint with the Consumer Financial Protection Bureau, Absolute Resolutions Investments LLC. claimed they had their process server of XXXX, XXXX XXXX XXXX XXXX XXXX XXXX send me a validation of debt packet, WAS NEVER RECEIVED. This as well is another XXXX party vendor acting on behalf of XXXX XXXX XXXX XXXX. According to a court ruling on XX/XX/XXXX in the case of XXXX XXXX XXXX XXXX collection and XXXX XXXX XXXX, The XXXX XXXX XXXX XXXX XXXX for the United States of America ruled that a debt XXXX transmittal of a consumers personal information to a dunning XXXX party vendor was a third party communication in violation of XXXX U.S.C XXXX ( b ). Additionally, by XXXX XXXX XXXX XXXX transmitting my personal information in reference to this alleged debt they still have not verified or validated, violated my rights under the FCRAPA ( Fair Credit Reporting Act, Privacy ) as rendered in the United States XXXX XXXX XXXX XXXX XXXX by way of transmitting my Name, Alleged outstanding balance, The fact that the alleged debt resulted from another XXXX company to the XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, as well as who they claimed was their process server of XXXX, XXXX, XXXX XXXX XXXX PA, all who of which used this data to create, print and mail dunning letters to me the consumer in the form of " Notice to intent to settle '' sent by XXXX XXXX XXXX, " Statement ' by XXXX XXXX, and what they claim was a Debt Validation Packet sent by XXXX, XXXX, XXXX XXXX XXXX in their own response by XXXX XXXX XXXX XXXX which was never received by me. XXXX Resolutions XXXX in addition to violating my rights under the FCRA as it pertains to my right to request proof and documents of the alleged debt to include original contract signed by me, have also now violated by Rights and privacy listed under the XXXX by transmitting my personal information to ( XXXX ) separate XXXX party vendors. XXXX XXXX XXXX XXXX transmitted my personal information regarding the unverified and unvalidated alleged debt in violation of FDCPA section XXXX ( b ) which provides that without prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a post-judgement judicial remedy, A debt collector XXXX not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, or attorney of the debt collector. Additionally, the findings rendered by the XXXX XXXX XXXX XXXX XXXX for XXXX XXXX XXXX XXXX XXXX also rendered in their decision that for their violations, The violating company is now actionable for money damages. For these numerous violations and misrepresentation of facts purposely done and reported by XXXX XXXX XXXX, I demand complete removal of the unverified and unvalidated alleged debt, as well as that they be held responsible for their purposeful violations of the FCRA and XXXX. A copy of this complaint will be processed with the Attorney General 's office for the XXXX of Maryland for review as well as legal representation due to their neglect, and violations.

I was taken advantage of by a debt counseling program which was resolved by the attorney generals office. At the time it was resolved and I was made whole, I contacted both creditors involved. They were both owned by XXXX XXXX, but one was a Visa and the other was an XXXX XXXX. The Visa department had no issue with working with me and keeping the same arrangement and terms. They were willing to refund the fees and interest as well as reduce the APR. They were understanding of the fact that if not for the lack of actions by the debt counseling program I would have made timely payments. I started out owing them over {$1100.00} and currently owe them {$550.00}. The XXXX XXXX division refused to work with me. They basically said that they did not care why the payments were not made that the fees would stand. Additionally, they would not keep the terms that they had previously agreed with the debt counseling program with me. I continued to call them and battle with them and eventually they sold off the account. At that time I received correspondence from two entities claiming that I owed them for this account. XXXX XXXX XXXX and Absolute Resolutions. I called both explaining to them the previous circumstances and that I needed something in writing stating that they were the owner of the debt. They basically laughed at me, mocked me and threatened me with suing me and ruining my credit, which was already being done. I left voice messages, I clicked on the contact us button on Absolutes website leaving messages regarding the situation. When I would call they would route my call to the same guy and he would harass me by speaking down to me and asking me many questions to verify who I was and some I was not comfortable with answering or did I think was necessary, especially since they were not willing to verify their position or control of the debt, therefore he would proclaim that he could not tell me ANYTHING and would end the call. I explained over and over the situation previously resolved by the attorney generals office and they just mocked me, called me a dead beat in so many words and just refused to work with me on any level. I first placed debt with the debt counseling company in XX/XX/XXXX. I have been diligently tracking this account since for 23 months and it has been as taxing as a full-time job. Even when I explained to Absolute that I had lost my job and was still willing to work something out, they just refused me at every turn to create something in writing. They wanted me to send in blind payments or pay it in full I was not willing to do the first and not capable of the latter. If any one of the entities, XXXX XXXX, Absolute Resolutions, or XXXX XXXX had been willing to work with me and give me something in writing, be fair and understanding to the fact that I was doing everything I was capable and topped with being defrauded by the debt counseling company we would NOT be in this situation, today and they would have received much payment as well as releasing their hostage hold on my credit score. It is because of their negligence that we are in this situation now. The emotional toll and the stress of my due diligence has been significant ( I have received professional counseling, due to the toll it has taken on me ) and I deserve to expect compensation of these damages, not to mention the detriment to my credit. I believe XXXX XXXX was more concerned with running my credit into the ground and sticking it to me than they were willing to work with me. My credit has suffered due to this for 23months preventing me from any other credit options or financing to remedy this. I believe Absolute Resolution lumped me into a group passing judgment on me rather than listen and realize the special circumstances and work with me., either way it is there negligence things have come to this point and my damages at this point are more significant than theirs, complied by the fact that I have been in contact with someone regarding this account every month for the last 18months minimum, I dont feel they should be allowed to collect. At this time, Absolute is suing me in XXXX XXXX Court. Additionally, it was not until COMPLAINT ID XXXX SUBMITTED ON XX/XX/XXXX was answered that I knew emphatically whom the debt was owed, except for the fact that just a week or so prior to receiving the answer they sued me. I have no other accounts in collection ; all of my accounts are paid as they are supposed to - my reputation and status of ALL other accounts proves that I was willing at all times to pay this debt, if I had just been allowed.

Good morning, To whom this may concern, I am outraged that this alleged debt collection company continues to report inaccurate, unverified, and wrong information to the 3 major credit bureau 's after ignoring my written request for validation, verification and proof of documents now almost 3 years ago which was sent via certified mail and confirmed delivery. All collection efforts per the FCRA were to stop until they provided the requested verification and validation for the alleged debt they are illegally reporting. In XXXX of XXXX i was made aware that an alleged debt collection account was opened and placed on my Consumer Credit Reports. Not receiving any prior notice related to this alleged debt, I sent a letter to the furnishing company of Absolute XXXX Resolutions XXXX requesting verification and validation to include documentation pertaining to the alleged debt they were reporting. My written request was sent on XX/XX/2020 via certified U.S. mail, and confirmed delivery on XX/XX/2020 at XXXX hours. after sending the written request for validation and verification to include requesting documentation, Absolute XXXX Resolutions XXXX did not respond at all to my request completely ignoring it and continued still to this day attempting to collect an alleged debt that they still failed to validate and verify. Additionally, Absolute XXXX Resolutions XXXX continues to report inaccurate, unverified, and unvalidated information to the ( 3 ) major credit reporting agencies to include reporting DIFFERENT information to all 3 credit agencies. On one report they are listing past due amounts with a term limit. A collection account is past due by default. A term limit is defined as " An agreed upon time between the consumer and business '' which i have had NO CONTACT, and NEVER AGREED to anything. Furthermore, they are reporting the account as OPENED which is also false and being that they ignored my request for validation and verification, they were to stop ALL collection efforts until they validated and verified it which they have ignored. Additionally, The account they are alleging to collect on, the records i show for the alleged account are reflecting PAID OFF COMPLETLY, however i have no knowledge if this is even the same account. I Demand that for their negligence, their refusal to answer or acknowledge my written request for almost 3 years, and their continued inaccurate reporting of unverified and unvalidated information, this account be immediately removed from my credit reports, and Absolute Credit Resolutions be held accountable for the multiple violations of the FCRA, in addition to the financial harm it has caused me. Also, I have disputed the alleged information Mutiple times with the ( 3 ) major credit reporting agency 's. ALL ( 3 ) credit bureaus have also FAILED TO INVESTIGATE my claims and continue to allow the unverified, unvalidated, and false information to continue being reported WITHOUT properly investigating my claims pursuant to the FCRA. The FCRA extends my rights as a consumer to a COMPLETLY FAIR AND ACCURATE CREDIT REPORT, and they MUST properly INVESTIGATE disputed inaccuracy 's, which all of the disputes they FAILED to PROPERLY INVESTIGATE, and simply stated they " Verified '' with the furnisher. I DEMAND to know HOW they verified it as it clearly shows inaccurate and different information on ALL ( XXXX ) reports which if the information was accurate should ALL be reporting the same as well. I have attached and provided documentation of my claims, and prof that Absolute XXXX Resolutions violated my rights provided to me under the FCRA as well as the Credit Reporting Agency 's for failing to report accurate, verified and validated information, as well as allowing me to have a 100 % accurate credit report free of errors and inaccuracies, as well as failing to investigate my disputes, and causing me financial harm in the process.

Subject : Demand to Delete Fraudulent Collection from Consumer Report Dear Sir/Madam, I am writing to you in regards to a fraudulent collection that has been reported on my consumer report. I demand that Absolute Resolutions immediately remove this fraudulent collection from my consumer report within four business days from the receipt of this letter. Failure to comply with this demand within the specified timeframe will result in legal action against Absolute Resolutions for each violation, seeking damages of {$1000.00} per violation. I am legally refusing to pay the debt associated with this collection, pursuant to the provisions set forth in 15 U.S. Code 1692c ( c ). This code clearly establishes the consumer 's right to refuse payment of a debt that is deemed fraudulent or not properly validated. I must emphasize that Absolute Resolutions shall be held liable for violations of several crucial federal laws and acts, including but not limited to : 1. Truth in Lending Act ( TILA ) 2. Fair Credit Reporting Act ( FCRA ) 3. Gramm-Leach-Bliley Act ( GLBA ) 4. Consumer Financial Protection Act ( CFPA ) 5. Sherman Antitrust Act 6. Robinson-Patman Act 7. Clayton Act 8. Federal Trade Commission Act ( FTC Act ) 9. Racketeer Influenced and Corrupt Organizations Act ( RICO Act ) I believe that Absolute Resolutions ' actions in reporting and maintaining this fraudulent collection on my consumer report are in direct violation of the aforementioned laws and acts. Specifically, 15 U.S. Code 1692 ( a ) grants consumers the right to privacy and protection from unwarranted disclosure of their non-public personal information. By having and using my non-public personal information, Absolute Resolutions is committing identity theft. I hereby demand that you immediately and permanently remove this fraudulent collection from my consumer report within XXXX business days from the receipt of this letter. Failure to comply with this demand within the specified timeframe will leave me with no choice but to file a lawsuit against Absolute Resolutions for each violation of the applicable laws and acts mentioned above, seeking damages of {$1000.00} per violation. Please be advised that if legal action becomes necessary, I will seek appropriate damages and remedies as provided for by the law. I am confident that a resolution can be reached amicably, and I hope to avoid any further escalation of this matter. I expect a written response from Absolute Resolutions acknowledging the receipt of this letter and confirming the removal of the fraudulent collection from my consumer report. Please provide me with written confirmation from the credit reporting agencies reflecting the removal of the collection. Please direct all future correspondence regarding this matter to the address listed above or via email at XXXX. I trust that Absolute Resolutions will handle this matter with utmost urgency and in compliance with the laws and regulations governing consumer rights. XXXX XXXX XXXX is threatening to execute a judgment obtained without proper service, and there are concerns they might use it in a deceptive manner. I haven't informed them of this issue yet, fearing potential retaliation. XXXX XXXX XXXX initially contacted me regarding an old debt in XX/XX/XXXX, representing Absolute Resolutions VI LLC. This was my first contact with them, and upon checking, I found the last activity on the account dated back to XX/XX/XXXX. In response, I disputed the debt due to exceeding the time limits for collection. I requested proof of the last activity date, stating that the debt surpassed the statute of limitations, and further discussion was unnecessary. They replied on XX/XX/XXXX, including a copy of a judgment granted on XX/XX/XXXX, which I was unaware of. They attempted to serve me at an address where I no longer lived, and hadn't for four years. Upon investigation, I found evidence suggesting they should have known about my new address. The lawyer who filed the suit, XXXX XXXX XXXX, XXXXXXXX XXXX XXXXXXXX, XXXX XXXX XXXX XXXX XXXX, should have easily determined the correct address. This raises questions of either a failure in due diligence, an incorrect address from Absolute Resolutions VI LLC, or a deliberate attempt to serve papers at an outdated address. The last possibility may seem like a strong allegation, but there are reasons supporting it : XXXX. I have a credit report from XXXX listing my current address since the change in XXXX, available to any collection agency. XXXX Letters from XXXX XXXX XXXX XXXX XX/XX/XXXX and XX/XX/XXXX, representing Absolute Resolutions VI LLC , show they knew my correct address. Speaking with XXXX XXXX XXXX, they told me that it is the responsibility of the collector and not the holder of the debt, Absolute Recovery VI, LLC to update the debtors address and will sue skip tracing if needed to get this information. As I prepared to inform the court about this, XXXX XXXX XXXX sent another letter threatening to execute the judgment. Given the lack of my knowledge about this judgment and its potential deceptive use, there should be a way to prevent them from taking action. My plan is to notify the court in XXXX XXXX, New York, where the judgment was filed. I hesitate to directly complain to XXXX XXXX XXXX, unsure if honesty is the best course given potential retaliation. I hope filing a complaint with your office will lead to a resolution without retaliation or deceptive practices from XXXX XXXX XXXX. I have an outstanding debt that I have been paying to Absolute Resolutions Investments , LLC ( XXXX ) through their collector, XXXX, XXXX, XXXX XXXX XXXX, XXXX ( XXXX ) The arrangement was formalized with a court hearing in XXXX. 1 ) The company that I owed the debt to XXXX XXXX an affiliate of XXXX XXXX XXXX sold the debt to ARI 2 ) XXXX XXXX contracted with ( XXXX ) to collect the debt 3 ) XXXX sent me a letter dated XX/XX/XXXX advising that they now owned the debt and I needed to pay in full or make payment arrangements 4 ) I called XXXX and made arrangements to pay monthly letter of confirmation dated XX/XX/XXXX 5 ) During the time of the payment with no missed payments XXXX sent me a confessed judgement letter to be signed by myself and to continue with the same payment arrangement as before. After receiving notification that there's been a change to my credit report I have sent multiple letters to Absolute Resolutions. At first, I admittedly was ignorant to the process of how I had 30 days to get them to validate the alleged debt. However, after being denied for car loans, credit cards and other opportunities, I decided to educate myself on my rights as a consumer. I came to find out that I had the right to ask them to validate the debt by sending me all documentary evidence including all reports, accounting ledgers, contracts that would give them rights to holder in due course. This company has never had my expressed or implied consent. This company has never attempted to satisfy my requests although in my letters I explained that it was not a refusal to pay, however its my right to validate. The only thing that I received was terms and agreements that did not bear anything that showed my name, signature or consent. Since XX/XX/XXXX, I have written multiple letters and sent via certified mail explaining my situation and what I would need from the company to resolve this issue. My last dispute had taken place in XXXX. I have all specific dates from copies of my correspondences, certified mail return receipts and the terms and conditions that they sent me that did not accompany any other documents that bear my endorsement. However, I'm typing this from the library and did not bring those documents with me. I could however bring these documents back and scan them if it would help me get relief from this nightmare. I also had filed multiple disputes with XXXX and XXXX through certified mail and these disputes have came back verified. However, when I asked for the method of investigation, who conducted the investigation and the information that was found to substantiate the right to furnish this on my report I have gotten nothing. My report showed that the " dispute is resolved but the consumer disagrees ''. I was under the assumption that consumer reporting agencies had a grave duty to with impartiality to make sure that they report fair and accurate information. This dispute has taken countless hours of my time going to the library to research, type letters, mail said letters, and ultimately wait for no results to date. This reporting has tarnished my image, misrepresented me as a natural good person and caused my financial damage while missing out on opportunities to better my life. 15 usc 44, irs publication 583, ucc 3-302, 15 usc 1602 ( a ) ( 5 ), 15 usc 1692 a-k, 15 usc 1611, 18 usc 1961 , 15 usc 1681 604 ( a ) ( 2 )

Good Morning ARC Compliance Team ; This is unreal! - I was shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity. You have 30 days upon receipt of this letter to provide strict proof of contract. In the event you can not provide strict proof of contract, you must cease and desist any and all collection efforts and immediately remove any derogatory information reported to the consumer reporting agencies. In addition, you will need to provide me your agreement, in writing, that you are closing your file, ceasing collecting activity, and deleting all information related to this reference number from any and all credit reports youve furnished the information to. In the event you transfer this account to an attorney without providing proof of contract, and proving your claim, he/she will be immediate reported to the America Bar Association and Professional Liability Fund for code of ethics violations.

Absolute Resolutions Corporation is trying to recover what they claim to be a purchased debt, yet the amount owed and the charge off date do not match what is on my credit report. They first tried to collect on a debt originally owned by XXXX, who closed the account according to the CRA in XX/XX/XXXX. Absolute Resolutions Corporation first used XXXX XXXX XXXX to attempt to collect the debt on or around XX/XX/XXXX. XXXX XXXX XXXX in addition to attempting to collect with the wrong amount owed and charge off date also violated The Truth in Caller ID Act. After filing a complaint with the Attorney General 's Office of Missouri, XXXX XXXX XXXX made the decision to no longer pursue the debt and promised to send it back to the original creditor. They interpreted their statements as Absolute Resolution Corporation being the original creditor not fulfilling what they stated they would do. On XX/XX/XXXX, I received a letter from XXXX XXXX XXXX XXXX, claiming that the debt had now been placed with them and they were also trying to collect with the same incorrect and misleading information regarding the charge off date and amount owed. Another complaint was immediately filed to the Attorney General 's Office of Missouri. On XX/XX/XXXX, I received a letter from the Attorney General 's Office stating that ARC claims no wrongdoing and that their office is unable to provide the relief I'm seeking and that my complaint is not without merit and I should consult a private attorney. Again, ARC claims that the debt is validated and produces various documentation that doesn't reflect the same information that was reported by the original creditor on any of my credit reports. With no judgment against me, no lawsuit filed against me, no open account for this debt on my credit report, one collector who decided to no longer pursue my account, and a lot of information online saying Absolute Recovery Corporation and XXXX XXXX XXXX are scams, I do not feel like they have the authority to collect this debt. Absolute Recovery Corporation despite providing documentation has failed to validate by providing inaccurate and misleading information on the charge off date and amount owed on this debt. I am happy to provide all correspondence they've sent through the Attorney General 's Office, in addition to my credit report, to prove that what they claim doesn't match the information reported by the original creditor to the three main CRA 's.

In XXXX, XXXX, I received a notification from a credit monitoring app that a new collections account was listed on my credit report with the name, " ABSOLUTE RESOLUTIONS INV '' collecting the amount of {$19000.00}. This is the only reason I have any awareness the collection agency, as they have made absolutely no attempts to contact me directly. I have been working with XXXX XXXX XXXX XXXX to help me negotiate debt settlements since XX/XX/XXXX and I immediately notified them of this new account. They contacted your ABSOLUTE RESOLUTIONS INV to try to settle this collections account several times. On XX/XX/XXXX XXXX failed to deliver a certified letter, that I can only assume was sent from ABSOLUTE RESOLUTIONS INV, because I was traveling to support family members with COVID-19 infections. On XX/XX/XXXX, I received a letter from the Superior Court of Arizona regarding case XXXX. The plaintiff ( ABSOLUTE RESOLUTIONS INV ) entered a Ex Parte Motion on XX/XX/XXXX to Allow Service Under Ariz. R. Civ . P. 4.1 ( k ). The motion stated Defendants are evading service of process but the plaintiff provided no evidence to support the allegation. The court denied the motion as the fact the Defendant ( me ) lives in a secure building does not constitute evading service. Between XX/XX/XXXX and XX/XX/XXXX, XXXX XXXX XXXX XXXX has worked on my behalf to make several offers to settle this debt, with no response from ABSOLUTE RESOLUTIONS INV. This collections company has failed to contact me directly about this matter since acquiring the debt, and it has become clear to me that they would prefer to abuse the Arizona courts system, using it to intimidate and harass me and waste taxpayer resources. I am trying to arrange funds and have good intentions of paying off as much of my debts as possible. I have emailed them directly, including the attached letter regarding my recent financial hardship for their consideration, assuming it acts as valid proof that I have attempted to settle said debts. ABSOLUTE RESOLUTIONS INV has made no attempt to contact me directly or respond to my numerous attempts to settle this debt without the Arizona Courts. I am submitting this complaint because ABSOLUTE RESOLUTIONS INV is abusing the Arizona Courts to harass and intimidate me. Regards, XXXX XXXX XXXX

The debt collectors by the name of XXXX XXXX XXXX ( " XXXX '' ) and XXXX XXXX XXXX who falsely identify as Attorneys which violates 15 U.S.C. 1692e ( 3 ) took legal action against me twice for the same debt that has been illegally sold numerous times for a consumer credit transaction that I initiated for a credit card on issued by XXXX XXXX for a XXXX XXXX retail card. I am the original creditor for the consumer credit transaction. Credit sales took place without my consent which constitutes unauthorized use pursuant 15 U.S.C. 1602 ( p ), " use of a credit card by a person other than the cardholder who does not have actual, implied, or apparent authority for such use and from which the cardholder receives no benefit ''. The attorneys received compensation which is a violation of 15 U.S.C. 1692e ( 2 ) ( B ). XXXX XXXX furnished me with deceptive forms under the guise they were offering me something of substance and value and created the false belief that I was indebted to them which violates 15 U.S.C. 1692j ( a ). I did not give XXXX XXXX my direct consent to share my private identifying information with anyone. That includes selling it for profit to other debt collectors including Absolute Resolutions who hired debt collectors XXXX and XXXX to take legal action against me twice which violates 15 U.S.C. 1692i ( b ), " Nothing in this subchapter shall be construed to authorize the bringing of legal actions by debt collectors ''. XXXX XXXX and Absolute Resolutions also did not have the permission from a court of competent jurisdiction or direct consent from me to communicate with XXXX or XXXX and make my private identifying information public. This was all done for monetary gain and greed. XXXX took legal action against me by filing a lawsuit against me. This resulted in me being subjected to a default judgment against me and my wages were garnished. My private identifying information for my former name appears on a court dockets which violates 15 U.S. Code 1692d ( 3 ), " The publication of a list of consumers who allegedly refuse to pay debts ''. This is very stressful and upsetting that my consumer rights are being violated in relation to my own credit.

In XXXX of 2021 I submitted my initial complaint against Absolute Resolutions. It is as follows : On XX/XX/XXXX of 2021 I checked my credit report and found an collection account that I didn't recognize. Knowing this entry had to be a mistake I sent a debt validation letter to Absolute Resolutions that same day. On XX/XX/XXXX of 2021 I received a response from the company saying that an investigation was going to be done into the matter and in the meantime the account would be deleted from the credit reporting bureaus, that was never done. I never received any update or validation into this erroneous account. Instead, it remained on my credit reports and continued to lower my credit scores. On XX/XX/XXXX of 2021 I sent a following up request into this matter directly to Absolute Resolutions. I let them know that it had been over 5 month since my initial request for validation and advised them that they had violated my consumer rights by having the account removed from my credit reports and by not validating the debt while continuing to report it. I advised them that their silence was obviously and admission of silence and I was under the impression that the debt should have been removed because they failed their legal duty to answer my claims. They in response they sent me a letter stating that my request for validation was frivolous and irrelevant even though they never followed up their legal end of the deal. I am requesting for this account to be removed from all 3 of my credit profiles immediately. The response I received was that this company didn't believe they violated my consumer rights and they continued to report the account as collection account with missed payments. Following that response I paid the account in full with agreement from the company that is would be removed from my credit reports. Since then it has been removed from my XXXX reports but not from my XXXX and XXXX reports. This account is continuing to report as if I am missing payments each month which in fact is not true as this account is paid and should've been removed. My validation letters to the company have been ignored for the last 6 months.

I sent a debt verification letter to the company on XX/XX/XXXX requesting the following documents to verify the debt pursuant to 15 USC 1692g Sec. 809 ( b ) of the FDCPA : -Copy of my social security card. -Copy of my valid Photo ID. -Contract signed by me. -Bill with my address ( within 30 days of the account opening ) -Any other documents. Absolute Resolutions and its attorneys provided me just with statements that anybody could create, I been asking them to verify their allegations that I own the alleged debt with valid proof, Why they are alleging that I own the debt? but they failed to provide or verify the debt appropriately. Since Absolute Resolutions and its attorneys are violating the FDCPA and FCRA and they still collecting the debt and have 2 cases open in XXXX XXXX Justice Court against me without sufficient evidence to do so I am requesting the following documentation to Absolute Resolutions today XX/XX/XXXX : Agreement with your client that grants you the authority to collect on this alleged debt. The following corporations Absolute Resolution, XXXX XXXX XXXX, and XXXX XXXX are reporting income to the top three credit reporting agencies, XXXX, XXXX, and XXXX. Income is not part of any XXXX, XXXX, or XXXX credit reports. This needs to stop immediately. According to XXXXXXXX XXXX own web site It states ( see provided upload ) " Your credit history does not include income information. And according to the IRS web site publication 525 and 4681 ( see provided uploads ) The IRS clearly makes it known that 1099c is to be considered income to be reported on tax returns as such. And as such income is not and can not be a debt therefore income can not be reported to the credit reporting agencies. I have uploaded the proof of income 1099C along with the IRS publications and as well as XXXX confirming that income can not and does not get reported to the credit reporting agencies. Absolute Resolution, XXXX XXXX XXXX, and XXXX XXXX must remove, delete all income from being reported to my credit reports In summary it is abundantly clear to all parties, that the IRS considers 1099C cancelled debt to be reported as income and accordingly the credit reporting agencies as well as Absolute Resolution, XXXX XXXX XXXX and XXXX XXXX themselves should not be reporting income.. See below more clarification regarding the fact that income can not be reported to the credit reporting agencies, ie 1099c being income to be reported on tax returns Can income be reported on credit report? Income isn't even on your credit reports so it can not be considered in credit scores because credit scores only consider what's on your credit reports, XXXX explains. In fact, no wealth metrics are factored into your credit scores. What information Can not be included in a credit report? For example, a credit provider might ask you for information about your income when you make an application for credit. The credit provider can not give information about your income to a XXXX to be included in your consumer credit report

I have a host of issues with these debt collectors however I picked the attempt to collect the wrong amount about my complaint. On my consumer report there is reported information about of an amount XXXX flat alleged owed however the collection agencies are asking for amounts of XXXX, XXXX and or XXXX federal law states they can not collect ANY amount unless expressly authorized. I have no agreement with this company and I never received any paperwork, no contract anything, that would allow me to validate anything 5 days after since this initial communication was sent to me. Instead I am told I have " generous settlement terms. '' Settlements only happen to avoid suits. All I see is settlements and settle within this notice and I am scared like XXXX? And I can confirm they are trying to scare me into believing this is a legal matter because they put on my consumer report " assigned to an attorney. '' This can't be legal! How can I possibly be sued without this information verified on amounts that are not consistent from two different debt collectors? Yeah one is named Absolute Resolutions Investments LLC and they are telling me I allegedly owe them money by they said themselves they paid for the debt, so how is that even possible? Then they are telling me to not pay them but pay another company by the name of XXXX XXXX XXXX XXXX This seems like a scheme to defraud of money I do not owe either company. They have also committed debt parking by placing this false debt on my consumer report saying it was assigned to an attorney. I believe between debt parking and quoting settlements, this was a strong attempt to extort money from me illegally and I am asking for the CFPB to put an end to this situation please. I have been unable to use to extend my credit for the entire year of 2020 and this made it extremely difficult to get a job. I haven't been able to get reliable work because they always check my credit and see this XXXX account on my credit report.

This account was added to my report end of last year. I have never received correspondence from the company, a dunning letter, or any validation. I have disputed this account twice with the bureaus requesting that the account be verified as I have never had an account in my name with XXXX which Absolute Resolutions shows as the original creditor ( the only thing I have ever had with XXXX was an authorized user account with my mother - which is active ), so I am genuinely confused as to what this is for. Could it be fraudulent? I have been working hard to repair my credit from hardships that happened back in XXXX when I became very ill and was out of work so this new debt for something I have never heard of was completely terrifying. I have sent two rounds of disputes to the credit bureaus requesting verification, but never received any written responses or any proof of this account. Additionally, I have sent two validation letters to the creditor with no response, which is a violation of my consumer rights. I wanted to try submitting a request to you guys before submitting any complaints with FTC and my Attorney General. I know there is a lot going on with the pandemic right now and I have been very patient in a resolution, but it is completely unfair that the bureaus have been given leniency in addressing requests and then failing to do so while consumers sit with legitimate errors and possible fraudulent accounts on their reports. So that's why I am here, I know you guys are essentially Big Brother over the bureaus and creditors and will look into this and provide at minimum some information which the bureaus and the creditor have now failed to do numerous times. I sincerely appreciate your help in this matter as I am very concerned that it may in fact have been a fraudulent account so I really need help in looking into it - thank you kindly!

Ive submitted several request for XXXX XXXX XXXX XXXX to provide me with verification/proof ( Original Consumer Contract with my Physical Signature on it ) in regards to the unverified account of my credit report ( XXXX XXXX XXXX XXXX ) XXXX which they have not. I provided enough information for you to carry out a reasonable investigation of my dispute, since you obviously did not investigate this account thoroughly enough the last time I submitted one. If you had investigated properly, you wouldve forward me a copy of proof when I first inquired, which you clearly dont have! Under the FCRA you must provide an Original Consumer Contract with my Physical Signature on it. A copy of ANY original documentation required under Section 609 ( a ) ( 1 ) ( A ) & Section 611 ( a ) ( 1 ) ( A ) ( a consumer contract with my physical signature on it ), and under Section 611 ( 5 ) ( A ) of the FCRA you are required to ... promptly DELETE all information which can not be verified. The law is very clear as to the Civil liability and the remedy available to me for negligent noncompliance ( Section 617 ) if you fail to comply. Under the FCRA, unverified accounts must be removed/deleted immediately. I demand for this account to be removed/deleted immediately, due to failing to verify. Under the FCRA, failure to verify/provide me with a copy of verifiable proof that I physically signed and agreed to this account, then you must remove the unverified account. I demand the following account be removed/deleted immediately! If you do not comply, as is my right under the Fair Credit Reporting Act, I will have to take legal action to protect my credit rating and myself. As Im sure you are aware, each violation of the Fair Credit Reporting Act allows damages of {$1000.00} USD should this matter end up in court. I look forward to an expedient resolution of this matter.

I am writing to express my deep concern and file a formal complaint against Absolute Resolutions I, a debt collection agency, for actions that have had a severe and adverse impact on my consumer rights and credit standing. I believe this company has engaged in troubling practices that are in direct violation of federal consumer protection laws. My primary concerns are as follows : Lack of Written Disclosure : Absolute Resolutions I furnished information about an alleged debt to consumer reporting agencies without any prior written disclosure to me. I was never provided with a notice of the alleged debt, its origin, or any written communication prior to this information appearing on my consumer report. Failure to Validate the Debt : Despite my requests, Absolute Resolutions I has failed to provide any validation of the alleged debt, including the required documentation to substantiate its legitimacy. The impact of these actions on my financial well-being has been significant. This lack of written disclosure and failure to validate the debt has resulted in negative entries on my credit report, potentially harming my creditworthiness and limiting my financial opportunities. This situation is deeply concerning, as it not only affects my financial stability but also violates my rights as a consumer under the Fair Debt Collection Practices Act ( FDCPA ). I kindly request the Consumer Financial Protection Bureau 's immediate intervention to address this matter and ensure that Absolute Resolutions I complies with all relevant consumer protection laws. I believe that Absolute Resolutions I 's actions are in direct violation of the FDCPA and have had a detrimental impact on my credit report. These practices are not only unjust but also harmful to consumers like me who are working diligently to maintain their financial well-being.

I have overpaid to XXXX XXXX XXXX XXXX XXXX ( hereinafter " XXXX '' ) for benefit to their client Absolute Resolutions Corporation ( " ARC '' ) {$1000.00}. I have been repeatedly assured by representatives from XXXX and from ARC that the overpayment which was received from my employer in the form of wage garnishments that the companies executed, then failed to stop upon receipt of payment in full, would be or have been returned to me. The most recent response from XXXX through the CFPB states that a refund in the amount of {$560.00} was sent to me along with a letter confirming that the judgment was satisfied on XX/XX/2018. As of this date ( XX/XX/2018 ) I have not received any satisfaction letter nor any refunded amounts from either XXXX or ARC. I have contacted 'XXXX XXXX ' at XXXX via phone on XX/XX/2018 @ XXXX XXXX XXXX and was told that the refunds had not been sent and that the XXXX accounting department would be contacted to follow up on the issue. I was also told that the additional {$480.00} which was garnished and sent to XXXX from my employer on XX/XX/2018 could not be located and I was asked to follow up with my employers payroll company for assistance in locating the funds. Both XXXX and ARC submitted responses to my CFPB complaint dated XX/XX/2019 that this matter was either resolved or in the process of resolution. As of XX/XX/2018 that is not the case. I would like both companies to provide proof of every correspondence regarding this matter that has been sent to me as well as copies of the checks that have been received on this account and refund checks that have been allegedly sent to me on XX/XX/2018. As of this complaint, ARC through it's representative XXXX, owes me the total overpayment amount of {$1000.00}.

This debt collection agency has engaged in practices that are explicitly prohibited by the FDCPA, which include abusive, deceptive, and unfair actions. They have reported an account that I did not agree to nor sign any agreement for. A legal contract necessitates the agreement of two parties, and I had no involvement in any such agreement. Moreover, they failed to follow the proper five-step validation procedure, further highlighting these unfair practices. Additionally, the " date last active '' is different from what another credit bureau is reporting, despite the requirement for all information to be comprehensive and accurate. I also have uncertainties regarding whether I ever held an account with the original creditor. Notably, I received no correspondence notifying me that this account was sold to ABSOLUTE RESOLUTIONS, constituting another violation. It's important to note that my personal information was compromised in a data breach, information that your company, along with the credit bureaus, would have been aware of had an investigation been conducted. Furthermore, I received no communication by mail leading up to the reporting of this collection account. This account was added to my records in XX/XX/2023. Consequently, I am formally requesting a copy of the correspondence that was supposedly mailed to me during that time, informing me of this debt with your company. Failure to provide this documentation would constitute yet another violation under the FDCPA, which entitles me to seek {$1000.00} per violation. If this account is not removed within 15 days, I will have no choice but to involve my legal attorney to address this matter through small claims court.

Absolute Resolutions Investments claims a right to collect a debt from me of {$3900.00} and a right to report bad credit to my credit reports.. On XX/XX/XXXX they broke the Fair Debt Collections Practices Act by discussing my credit reporting while trying to collect, something the Consumer Financial Protection Bureau warned them in XX/XX/XXXX. My CA-DOJ registered XXXX XXXX XXXX XXXX XXXX under my Power of Attorney was told, " If you are looking for a deletion I would start by paying in full '' instead of the 75 % off they were willing to settle for if I did not want credit report deletion.. The company is also violating the CA Consumer Credit Reporting Agencies Act with inaccurate reporting on my credit reports regarding the account " date opened '' and the " date of last activity '' with XXXX, the original creditor they say they bought collection rights from.. Finally, XXXX previously sold my defaulted debt before it defaulted. XXXX makes offers of debt sales on their website and reports the sales to the XXXX XXXX XXXX XXXX XXXX, it is all public information. This means Absolute is lying and trying to defraud me with a claim of rights to collect. I am sure that Absolute commits this fraud on many Calif consumer, they even file lawsuits with no standing to convey to a CA court of law = Abuse of Process, Abuse of Court Process, Undue influence, Unfair & Unlawful business practices, fraud and more. PLEASE CONTACT ME BY EMAIL FOR EVIDENCE OF WHAT I JUST SAID.. To the best of my knowledge the above is true. XXXX XXXX

On XX/XX/XXXX of XXXX I checked my credit report and found an collection account that I didn't recognize. Knowing this entry had to be a mistake I sent a debt validation letter to Absolute Resolutions that same day. On XX/XX/XXXX of XXXX I received a response from the company saying that an investigation was going to be done into the matter and in the meantime the account would be deleted from the credit reporting bureaus, that was never done. I never received any update or validation into this erroneous account. Instead, it remained on my credit reports and continued to lower my credit scores. On XX/XX/XXXX of XXXX I sent a following up request into this matter directly to Absolute Resolutions.

In XXXX of 2021, I noticed that Absolute Resolutions added a derogatory mark on my Credit report per XXXX XXXX. This derogatory mark is now reporting on my XXXX and XXXX credit reports. Upon further research, this account was transferred/sold and I am not responsible for this account. Debtor 's creditor did not verify this collection. Also, there was NO written form of communication, contract, or signature for this accused debt at all. A bill without a signature or confirmation of debt does NOT validate the debt. Anybody can send me a bill or notice and tell me it is mine. I sent a debt validation letter ( on XX/XX/2021 ) and what was sent to me was a copy of a court filing stating I owe the debt ( by default ). A court appearance that I was never served notice about and therefore never appeared to defend myself. On XX/XX/2021, I requested copies of the original debt statements/payments/ and contract, again stating that I never had dealings with the original creditor and requested these documents so that I could file a fraud report through the FTC and my local police precinct. Instead of these document, Absolute Resolutions again sent me a copy of the court filing, with judgement made by default ( without my presence ). According to the FCRA, Absolute Resolutions has violated my rights as a consumer and I'm requesting legal action to remove this account immediately.

Dear ABSOLUTE RESOLUTIONS INV XXXX ; XXXXXXXX XXXX XXXX. XXXX XXXXXXXX XXXX ; I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. 3. I reached out to this company because I saw their name was listed on credit report and I wanted to try to rectify this instead of taking Bankruptcy. Upon calling Absolute Resolutions, I realized and was informed that another company is managing the debt and they are simply recording the information to my credit bureau. They stated that XXXX XXXX at XXXX is managing this, but I have never received any communication from XXXX XXXX or from Absolute Resolutions in reference to this debt. In an attempt to try to settle the debt for {$1000.00} XXXX XXXX stated that Absolute Resolutions would not accept this offer. This is highly confusing to me. I never received anything that stated anything about this debt. I never got informed who to contact or call. Even when I spoke with XXXX XXXX, they did not even know my mailing address and throught I still lived in XXXX XXXX, FL, which I have not lived in for over 5 years. I really wish to settle, close, and have this collection removed from my credit report. If Absolute Resolutions has done something illegal in this endeavor, they need to zero out the account and remove this from my credit report immediately/ The offer is valid for {$1000.00} and I will not offer a XXXX more. Absolute Resolutions must handle this debt and a 3rd party of a 3rd party is not going to be acceptable to me.

I have tried to get a collection resolved and removed from my credit report that Absolute Resolution is reporting that is not mine. In my request to get information about this account, they haven't provided me with any documentation or any results from my request I sent to them. Instead, they sent me information that has no agreement or any other information that this items belongs to me. Items I asked for were as follows : 1. The date you contacted the creditor 2. The contact information for the creditor 3. The name of the person who verified the item to you 4. The method of communication you used to verify this information 5. Did the creditor provide you with my SSN, address, and Date of Birth? 6. What the money you say I owe is for 7. Prove the Statute of Limitations has not expired on this account 8. Show me that you are licensed to collect in my state 9. Provide me with your license numbers and Registered Agent Still to these day, none of these items was provided to me from Absolute Resolution. Furthermore, I never had an account with XXXX, as well as I never lived in XXXX from which this company show that i lived at and never have lived in. I have no idea what XXXX uses to continue to validate this debt. I have yet to see any proof this debt was initiated by me. Absolute Resolutions reprinted my account as collections XX/XX/XXXX. They didnt even send me a notice stating I owed money to them. I only found out my reviewing my credit reports. I called and they transferred me to a debt attorney to make payment. I paid the balance in full with the debt attorney. I can provide all records of this along with letter showing account satisfied/paid in full from the attorney. The letter was sent to Absolute Resolutions showing payment in full and to remove my account on credit reports. They refused to do this so I disputed it with the credit bureaus. The credit bureaus researched and proofed I did pay full balance and updated account to reflect. Everything was good. Until Absolute Resolutions reported yesterday, XX/XX/XXXX to all the credit bureaus that I still owed the full amount and that my account was in collections. I called them today and they denied doing and stated there was nothing they can do about it. Im in the middle of purchasing a house and this is really causing problems that they reported it after everything was cleared and paid for. They are falsely reporting a balance that I dont owe.

At that time, I sent XXXXXXXX XXXX XXXX correspondence requesting the same info as the amount was incorrect. My wife spoke with them two times via phone- repeatedly asking for this info. She was told by XXXX XXXX XXXXXXXX XXXX XXXXXXXX that the amount due doesnt matter. We can work around that. We sent a settlement offer which was supposedly denied at end of XX/XX/XXXX. Sent XXXX emails with no response until today when we discovered a claim had been filed on behalf of XXXX. Have not been served yet but got info off court website. Both XXXX and XXXX XXXX XXXX have made it very difficult to work with them and provide a true solution to clear up this issue. Non- communicable on both parties.

After reviewing my credit profile on XX/XX/2023 I identified a discrepancy with account listed under Absolute Resolutions and validation was requested as this was an account that I did not recognize. I reviewed my credit report again on XX/XX/2023 and the account continues to reflect on my credit report and I have not received any correspondence from creditor to validate this account as correctly belonging to me, nor has my credit report been updated to reflect that the account is disputed and therefore a 2nd validation letter was sent out on this day. After reviewing credit report again on XX/XX/2023 there have been no updates and account is still reflecting on the report. Absolute Resolutions has been reporting information to XXXX, XXXX and XXXX that is inaccurate and fraudulent under 18 U.S Code 1028 ( d ) ( 12 ). They have consistently tried to sue for monies not owed to them. They have NOT provided proof of any kind, with a LAWFUL two-party contract binding both parties signed in wet ink by both parties, bearing my signature, to prove I in fact owe this debt. Therefore they are committing fraud to collect on a debt not owed. They have failed to comply with FDCPA, 15 USC 1692g Sec. 809 ( b ) which states I have the right to dispute the debt and request validation of the information they claim to have on file. I have been sent NO proof. They have currently violated 8 of my rights as a consumer and continue to not comply with the Fair Credit Reporting Act, the Fair Debt Collection Practice Act and The Uniform Commercial Code. I am taking the next step to seek remedy for damages per violation at a minimum of {$1000.00} each. It has been over 90 days and I am requesting to have this account deleted immediately and cease further attempts to collect on the said debt before further action is taken.

Absolute Resolutions purchased a credit card debt. In XXXX I negotiated and paid a settlement to them. The have marked the balance down to {$0.00} but refuse to report the account as closed on the XXXX system so that it looks like I have an open collection account that is dropping my score by more than XXXX points. I have asked XXXX to correct the report, I have put in several online disputes and finally sent a written dispute to XXXX which was denied in XX/XX/XXXX because Absolute Resolutions affirmed that the account is still open. I called XXXX today and they have reopened the dispute but there is no guarantee that it will result in a correction. Absolute Resolutions is deliberately leaving this account as " open '' to punish me for settling the account instead of paying it in full. I attached the settlement letter to the mailed dispute and the account history clearly shows that the agreed upon amount was promptly paid. Before I began disputing the account, it still showed as owning the remaining {$310.00}. They finally marked it as {$0.00} owed but continue to keep it as an open collection to punish me.

I have written this company multiple certified letters demanding they provide me with proof to collect the debt they claim I owe them. They claim I owe them {$800.00}. I have never heard of this company, I never signed a contract with them, and I never agreed to do business with them. I have been a victim of fraud and identity theft and I believe that this debt was obtained by the company illegally. I have requested the following multiple times : The debt balance and original bill/documentation including an explanation of any interest charges and additional fees. The full account number that is associated with the debt that they claim I owe them. The date of default including the date of the last payment, The name and last known address of the debtor as it appeared in the charge-off creditors or debt buyers records prior to the sale of the debt. The names of all persons or entities that have purchased this debt. I have already submitted a complaint to the North Carolina Department of Justice. My next steps are to file and police report and take this company to small claims court and sue them.

I have previously filed complaints against XXXX XXXX XXXX and they have provided you with false or misleading information, While it is true one of the loan agreements is in litigation, as of this writing it is not in arbitration because XXXX refuses to pay the fees. The second loan agreement is not part of any litigation or arbitration and therefore their response is false on its face and they are refusing to engage in arbitration as required under the loan contract. They are obviously not taking these complaints seriously and are providing you with false information. they are also in violation of the Federal Arbitration Act and CFPB regulations. Because of the agregious nature of their acts I am requesting that the CFPB file an enforcement action against Absolute Resolutions and their attorney and collect a civil penalty in accordance with the regulations. To be clear, in their response they said that both loan agreements were in litigation. One was and one was not. Neither are in arbitration at this time. I do not owe any debts to Absolute Resolutions. This company has violated my rights under the FCRA. Absolute Resolutions by law had a responcibility to notify in writing of any debts owed to them prior to reporting to any third party credit agencies. They did not do so and can not provide any written documentation addressed to me. I filled for bankruptcy In XXXX of XXXX. Absolute claims that the debt owed to them is from XXXX. If that was true when I filled for bankruptcy in XXXX of XXXX Absolute resolutions had a legal onligation to appear in court and file for anything they felt was owed. They did not because they I did not then or now owe a debt to them. Also, because my bankruptcy was public my address was on file for Absolute resolutions to contact me regarding the debt. This debt is not owed. This is not a valid debt. Any further attemtps to collect this debt will result in lgal action against Absolute resolutions for violating my rights.

This is in regards to a previous complaint, XXXX. The original complaint was about XXXX Credit card not allowing me to pay off my credit card and refusing payment. This account was closed in 2021. I have not used it since then. After the complaint, I received a letter from XXXXXXXX XXXX managing bank, XXXX, stating that they'd now accept my payment, and I was able to pay it off in full and be done with it. I did just that, immediately paying off the balance in full. They removed the account from my credit report and listed it as paid. Until now, they're saying that somehow I owe {$700.00}. They've sent me another statement, and they've put it BACK on my credit report. It appears they have possibly sold debt to " absolute resolutions investments ''. So they accepted my payment and then sold non existent debt? I just want this to be done with and for them to leave alone. I thought I resolved this months ago, but apparently not

The Company in question : Absolute Resolutions Investments , LLC has committed numerous violations of the Fair Debt Collection Practices Act under title 15 USC 1692. They had a sheriff serve me with what appears to be a summons with no actual court date, yet are persistent to attempt to force me to pay a debt in which they have yet to validate. I sent them a response within the 30 day window asking them for debt validation and all they sent back were moot statements which had no validity. The company has not yet sent me an contract agreement with my signature on it nor any of my other required exhibits for validation. ( Actori incumbit onus probandi ). In my initial response I did inform them of my intention to sue if any negative information was placed on any of the three major Credit Bureau 's and yet they dishonorably placed negative remarks upon it in an act of unethical practices.

I have been disputing this account with the credit bureaus for sometime now. Each time they would say that ABSOLUTE RESOLUTIONS would verify the debt. So I took it upon myself to ask ABSOLUTE RESOLUTIONS for validation of the debt. Are they legally able to collect on the debt? How did they calculate the amount they claim I owe? How do they know I am the owner of the debt? Im curious because I have never done business with them or the original creditor. Well, it has been more than 30 days and I still have not received anything proving the debt is mine. They received my letter on XX/XX/XXXX. Here is the tracking XXXX XXXX XXXX XXXX XXXX. I was under the impression that if they didn't respond it would automatically deleted from my credit reports. Silence is being in agreeance. I am sure there is a law that proves it.

A company by the name of Absolute Resolutions INV is stating that I owe a collections " debt '' that is unjustly being attributed to me which is extremely disturbing. I believe this is affiliated with a XXXX office that I went to back in 2016 called XXXX XXXX + XXXX in ( XXXX, Arizona ). The lead XXXX of this office stated verbally to me that my insurance during my time of employment with a company called XXXX was 100 % in network and accepted meaning there was no out of pocket cost from myself required. When I switched employers I started to receive phone calls saying that I owed a debt which was baffling to me being that my insurance was 100 % accepted which was impossible. At this point evidently I was lied to by the head XXXX running the office which is very unjust and disturbing to say the least.

This debt is also being inaccurately reported to multiple credit reporting agencies without my permissible purpose and is hurting my financial and personal reputation. They have also harassed and threatened me with multiple inconvenient forms of communication such as phone calls and letters stating that they are attempting to collect a debt. I had sent a notice to this company to cease all communications as described in the fair debt collection practices act ( FDCPA ) in regards to the following account XXXX The FDCPA describes communication as " conveying of information regarding a debt directly or indirectly to any person through any medium '' and credit reporting is an indirect medium that this company has chosen to continue to communicate with me. This violates the FDCPA and my right to privacy as a federally protected consumer. At this point I demand compensation for their willful and knowing violation.

This account was furnished to the credit reporting agencies against me though I have no signed contract nor did I verbally agree upon doing any business with this company.
