A landlord, XXXX XXXX, in XXXX, Wa, filed and served an unlawful detainer upon myself and boyfriend by posting notice on the apartment AFTER we moved out. The boyfriend was in XXXX for a XXXX XXXX charge against me at their apartment. They knew he was XXXX XXXX XXXX and accepted the notice I provided them. The month by month contract may be broken so victims can relocate to safe, affordable housing. I provided a forwarding address where they mailed me my refundable security/cleaning deposit, an address also listed on the moving notice I provided them and their rental application. They knowingly improperly spelled my name on the court documents. They failed to properly serve us, and two days after knowing the apartment was vacated, posted notice they knew we would never receive. They won an unlawful detainer and judgment against us that we learned of three years later from a debt collector XXXX XXXX aquired and again, ten years later, in XXXX, another company, 4M corporation, also in XXXX, WA, tried to collect, this time filing a property lien on us before we were able to appear in court to respond. They had provided lawful service and we filed response and spoke in person to 4M when we provided working court copies. 4M told us due to this new information the court date, in two days, would be stricken. But, it was n't and we appeared and they did not. The judge called the office and was told they forgot to strike the hearing. There apparently were more filings on this case a few days later that we were NOT properly served or received. So now nothing has changed or happened to resolve this in court. The unlawfully obtained judgement has been addressed but 4M is n't doing anything to complete their action against us. How any property lien even stand when the collector wo n't appear to be disputed?

I told the XXXX, XXXX XXXX at XXXX to reinvestigate account : XXXX XXXX XXXX # XXXX, XXXX, XXXX XXXX # XXXX XXXX XXXX # XXXX SOLVERITY : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX # XXXX. However, they stated everything was completed and accurate. But how is it that possible if the open date and the day alleged activity and how more is incorrect. According to 15 USC 168199 ( i ) 5 they were supposed to modify accounts that isn't reporting correctly. 15 U.S.C 1681 section 604 A states I have the right of privacy. 15 U.S.C 1681 section 604 A section 2 ; it also states a consumer reporting agency can not furnish an account without any written instructions. 15 U.S.C 61C ( a ) ( 5 ) section also states A consumer reporting agency can not furnish a account without written instructions. 15 U.S.C 1681C ( A ) ( 5 ) Section states no reported agency may make any consumer reporting containing any of the following items of information. Any other adverse items of information other than records of convictions of crimes antedates the report by more than seven years. 15 U.SC. 1681S-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reported agency if the person knows or has reasonable cost to believe that the information is inaccurate. On XX/XX/2023, I received a notice on my credit reports that a company named Solverity placed a tag line on my credit reporting stating that I had a charged off account, owing {$110.00}. After some research it seems that the original owner of the account was owned by XXXX XXXX XXXX XXXX located at XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, WA XXXX. I had a balance on my waste account for ( {$110.00} ) for which I paid on XX/XX/2023, via an online payment using XXXX XXXX website. I even spoke with a customer service agent, and I was never informed my account was sent to a debt collection company. I never received any notification from Solverity about the debt, and I was not allowed to verify the debt as allowed for in the Fair Debt Collection Practices Act ( FDCPA ). " Before a debt collector can report your debt to a credit reporting company, the debt collector must do any one of the following : Speak with you in person about the debt, Speak with you by telephone about the debt, Mail you a letter about the debt and wait a reasonable amount of time ( generally 14 days ) for a notice that the letter wasnt delivered or Send you an electronic communication about the debt and wait a reasonable amount of time ( generally 14 days ) for a notice that the message wasnt delivered.

I have been getting repeated voicemails from XXXX XXXX XXXX. First and foremost, I have not received any written letter from XXXX XXXX XXXX via U.S. Mail, as required by federal law, informing me of their intent to collect any debt from me, nor my right to dispute the debt. Secondly, I have informed them, via my voicemail, that they are to leave a detailed message why and who they are collecting for and if they continue to harass me I will report them. This method has failed as all they leave for a voicemail is, " This is an attempt to collect a debt by a debt collector. Please call XXXX XXXX XXXX at XXXX. Thank you. '' Third, according my credit reports, I have no outstanding debt that has been referred to a debt collector. Ultimately, XXXX XXXX XXXX needs to stop harassing me with debt collection, when they have the wrong number. Here are some of the calling and voicemail records I have of them. XXXX XXXX tire center is trying to collect on an account that was opened with my fathers social security number due to the fact that i did not qualify for credit because I had filed for XXXX Bankruptcy XX/XX/XXXX. Due to financial struggles and health issues my father was forced to file for bankruptcy in XX/XX/XXXX or XX/XX/XXXX to my knowledge. Ive received a book-load of receipts and invoices where my name is shown. Their collection agency has called and threatened the guy was very rude, telling me the collection was going to stay in my credit and he would make sure it did, after I asked for a copy of the application with my social, which they cant seem to provide. Also asked for a credit report where they had ran my credit, they cant seem to find that either. They do n't even have my social security.

I received my paycheck today with a {$300.00} garnishment from 4M Collections, with the names Discovery Financial and XXXX XXXX attached to the order. I was NEVER contacted regarding this debt and have not had any debt for 10 years or more as I filed bankruptcy back when my children were in XXXX school. I do not have any collection agency remarks on my credit, nor have I received ANY phone calls NOR letters regarding ANY type of debt owed. I have tried MULTIPLE times to try and contact them today to get an answer to no avail. They have robbed me and are 100 % wrong in taking my hard earned money. I am a single woman who is barely making ends meet. I do NOT have the money for them to take. Also, the name that they have me listed is, and has NEVER been my name.

XXXX XXXX, XXXX at XXXX am. Received a phone call on my cell regarding a debt. After returning the call, I informed XXXX that I was on the Do Not Call Registry and that I do not have any outstanding debts. He read the last 4 of the SS # that he was looking for, and I told him that was not me and the last known address he had was in XXXX Washington. I informed him that I had never lived in Washington State. He was clearly calling anyone with the same name as me, without regard to violating the Do Not Call Registry. Since I do not trust that XXXX will do what he says, I want all of this documented.

Debtors creditors did not verify this collection. Also there was no written form of communication, contract or signature for this account debt at all.A bill without signature does not validate the debt and anybody can send a bill and say it is mine. Discovery Financial is trying to collect form me XXXX XXXX. I was only an authorized signer on account. My father XXXX XXXX was the actual account holder, he is the only one that signed up for the account. Ive tried numerous times to get Discovery financial to send me a copy of the SIGNED application. They can not provide it. They can only provide a bunch of statements where I did make the payment or signed for tire changes or things of that nature.
