I am a retired 21 year XXXX XXXX veteran, and I am 60 % VA XXXX, and I have a VA loan through : 360 Mortgage Group, LLC XXXX XXXX XXXX XXXX XXXX, TX XXXX ( XXXX ) XXXX Phone ( XXXX ) XXXX Fax I started going to school full-time under the GI Bill in an attempt to learn new skills for employment in XXXX. My medical issues prohibit me from working in my prior career field, so I went to school to obtain a bachelors degree and a certification. The degree and certification took longer to obtain than expected, and it put my in a financial position that I has taken me a while to correct. The financial problems started two years ago when my GI Bill benefits began to run out, and the GI Bill housing stipend of {$1200.00} monthly ran out. I still had a few semesters left to complete my certification, but I was struggling to meet all of my financial obligations. I attempted to juggle all of the expenses, but it simply overwhelmed my limited income. Two years ago, I filed for bankruptcy, but I continued to make my house payment for another year. However, a little over one year ago a string of circumstances caused me to get behind in my mortgage payments, and I gradually slipped into a dire situation. To complicate matters, up till 2 months ago I was only able to get seasonal part time jobs. My under/unemployment put my finances into a situation that resulted in a default on my mortgage. I attempted to work with my mortgage companys loss mitigation department to make partial payments for a few months, but I believe they grew tired of working with me. Since that time, I have been trying to work with them to find a home retention option to allow me to keep my home. To be fair, they told me during one of those early attempts that I simply did not make enough with my retirement and VA XXXX to qualify for one of their home retention options. However, since that time my financial situation has significantly improved with my wife and I both acquiring jobs. My household income has almost doubled in the past two months, and we can comfortably afford our current mortgage payment. Since our income has risen to an acceptable level, we have been trying to get approved for a VA Home Retention option. I have been submitting all of the documentation requested by my mortgage company, so they could receive it in the time necessary to consider prior to our foreclosure date. However, over the last two weeks they have been sending out notices claiming that I am not communicating with them and they have not acknowledged in writing that they have received all of the required documentation. They have had all documents requested for almost two weeks, and although I was told over the phone by their representative that they were in receipt of a " complete Borrower 's Response Package '' over a week ago, they are now trying to say it is not " officially complete ''. I have listed a string of events that I believe either show deceptive practices or have highlighted a serious lack of internal communication within their own departments that may result in the loss of my home : XX/XX/XXXX, submitted electronically final requested documents to 360 Mortgage Loss Mitigation Department for Borrowers Response Package for VA loan modification. Received electronic acknowledgement of receipt. This was 49 days prior to original scheduled foreclosure date, and 63 days prior to foreclosure sale. XX/XX/XXXX, called and spoke to representative XXXX # XXXX and verified three times that my package was Officially Complete as of XX/XX/XXXX and I had made the deadline for having a complete package. This was over 46 days prior to scheduled foreclosure date, 60 days prior to foreclosure sale. ( This is important, because their policy request that they receive a Complete Assistance Package prior to 37 days of the foreclosure date. ) XX/XX/XXXX, I received a letter from 360 Mortgage Group dated XX/XX/XXXX stating that they have made numerous attempts to contact me and obtain a complete Borrowers Response Package for consideration of an alternative to foreclosure. As of the date of this letter, we have not received a complete Borrower Response Package for our evaluation of your mortgage loan. We consider your lack of response a withdrawal of application. We are still interested in working with you to determine if you are eligible for a Foreclosure Prevention Alternative. There are several problems with this letter, I have contacted them multiple times through email and phone to determine which documents they needed to complete the package, so to say I have not communicated is blatantly false. More dubious is that this letter is dated XX/XX/XXXX, but it appears to have been sent after my conversation on XX/XX/XXXX by the fact that it did not arrive until XX/XX/XXXX, exactly 10 days after they claim it was written. The arrival date of the letter matches with what is the established mail delivery time from XXXX, Texas if the letter were sent on Monday XX/XX/XXXX. To believe this letters timing is coincidence would be have to come with the assumption that mail takes XXXX days to travel from XXXX, TX to XXXX, LA. XX/XX/XXXX, I was called by representative XXXX # XXXX and pressured to accept the a 12-month repayment plan. In this conversation he was asserting that the package was not officially complete, and he did not know if it would be complete in time to save the foreclosure. This statement totally contradicts the XX/XX/XXXX conversation with representative XXXX # XXXX. When I challenged him on this, he said XXXX did not know what he was talking about and the package was not Officially Complete in their system, and they still may need some more documents. Keep in mind that I initially submitted this package on XX/XX/XXXX and they have been asking for additional documents since that date. They indicated that the last two documents I sent on XX/XX/XXXX would be the last documents they needed to make the package complete. According to the message on 360 Mortgage telephone system that is played prior to speaking to any representative, all calls are recorded for quality purposes so all of my claims can be verified by their own system. 360 Mortgage Group has officially state that they want to work with me for a VA home retention option, and this is reaffirmed by their last letter to me. However, their actions and correspondences are calling that into question. I have been served with papers for a foreclosure sale, and I am in fear of losing my home. If I lose my home it will not be because I can not afford it, because if my Borrower 's Response package were ever evaluated it would be determined that I meet the requirements for a VA Home modification.

1. The Fair Credit Reporting Act 15 U.S. Code 1681 " is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. '' 2. We entered into a Mortgage with 360 Mortgage, XXXX XXXX XXXX XXXX XXXX XXXX XXXX, TX XXXX, ( XXXX ) XXXX on XX/XX/XXXX 3. We filed for Chapter XXXX Bankruptcy on XX/XX/XXXX, which was discharged onXX/XX/XXXXthrough the Western District Federal Bankruptcy Court in XXXX, WA. We were represented by XXXX XXXX, XXXX XXXX XXXX XXXX WA XXXX, ( XXXX ) XXXX 4. The lender ( 360 Mortgage ) neither requested a Reaffirmation from us, and one was advised as not necessary per our Attorney, as the Western District neither issues them, nor considers them appropriate for Mortgages ; hence a reaffirmation agreement was not made. We are unable to retroactively obtain said reaffirmation through the courts without re-opening our Bankruptcy, and per our attorney, are likely not receive one, as again, the courts consider them as inappropriate for mortgage loans, based on their enforceability in the security of the Deed and Note. We have confirmed this history through our Attorneys Office. 5. In XX/XX/XXXX, we contacted 360 Mortgage to request accurate reporting of all on-time payments, and to accurately reflect the account as an active mortgage on our credit report. We were advised that this would automatically re-engage in XX/XX/XXXX, and that if it did not, to call back and it would be re-engaged. In XX/XX/XXXX, we called back to learn that it is the policy of 360 Mortgage to cite the Consumer Data Industry Association ( CDIA ) policy to not report a discharged mortgage as accurate nor an active account without a reaffirmation. We continue to struggle with 360 Mortgage to do the legal and right thing by reporting us as an active account, and with on-time and fully made payments as agreed upon. 6. We are unable to provide them with the requested document, as the courts will not grant one to us ; in addition, 360 Mortgage did not request said document prior to our discharge, only now stating they advised us through some comment on a statement that this was their policy. 7. We have attempted to correct this issue through the credit bureaus, however they have failed to act to correct the inaccurate reporting. 8. We feel that the CDIA policies do not trump, nor relieve 360 Mortgage of their legal responsibility to a ) accurately report this mortgage as an active and paid on time account on our credit, and b ) retroactively and henceforth continue to report all on-time payments as made as agreed to all reporting bureaus as required through the Federal Fair Credit Reporting Act. We are attempting to resolve this through channels that do not require a civil suit be brought upon 360 Mortgage. 9. 360 Mortgage maintains they will not report this account as active or paid as agreed for an additional 7 years. 10. We continue to research if this practice violates any Veterans Administration Laws, as this is a VA Loan, and XXXX is a retied and decorated veteran. The actions of 360 Mortgage appear retaliatory and predatory, in addition punitive to us as a consumer. Their actions citing an associations policy, versus the Federal Law further enhance this fact. The associations policies do not relieve them of their legal and moral obligation to accurately report all mortgages they maintain, and the accurate reporting of payments on those mortgages. We can not provide them with what they cite as required, as we have no authority to direct the Federal Bankruptcy court to alter their procedures. We can not use this paid account as a mechanism to reestablish our credit worthiness. In addition, the absence of the account on our bureau lends an inaccurate perception that we are neither homeowners, and based on no rental credit history, also are not renters, hence further increase an already negative perception of our credit worthiness. All of the above are not establishing trust and confidence in the system, hence impair the efficiency of the banking system. We have already been denied credit and suffered damages as a result of this failure on our credit report. Correct of this issue can reestablish the " trust '' in the system in a manner that can be maintained in a fashion of integrity, and the retaliatory and punitive approach of citing an associations policy be over-ridden by the authority of the law. To Whom It May Concern : My mortgage servicer, 360 Mortgage Group, based in XXXX, TX, has failed to honor my valid request to have my PMI cancelled under the Homeowners Protection Act. They are attempting to overlap a separate XXXX " two-year seasoning '' rule to deny the cancellation. I can meet all the requirements under the HPA, however. See a portion of the second e-mail request ( awaiting an official response ) I submitted on XX/XX/XXXX below : " Attention : Escrow Department and XXXX ( Customer-Service Manager ) After consulting with an agent from the Consumer Protection Financial Bureau ( " CFPB '' ), my original loan officer, and an independent mortgage broker, it is evident that your company has violated federal law under the Homeowners Protection Act of XX/XX/XXXX ( " HPA '' ). Upon requesting my Private Mortgage Insurance ( " PMI '' ) be cancelled in accordance with this law on XX/XX/XXXX, I received a follow-up notice dated XX/XX/XXXX from your offices denying the cancellation on the grounds that my mortgage is not seasoned. This is in direct opposition to the law which supersedes any additional guidelines created by a mortgage lender. Please find attached a complete copy of the HPA in addition to the latest CFPB Bulletin dated XX/XX/XXXX concerning PMI and HPA requirements for your convenience. In the bulletin on page six, it clearly states the following regarding the seasoning of a loan : 'The HPA does not contain any requirements for a loan 's tenure before a borrower may request cancellation or be eligible for automatic PMI termination. Nonetheless, in at least one examination, CFPB examiners noted that a servicer imposed a two-year seasoning requirement to automatically terminate PMI, when the HPA does not provide for such a requirement. The CFPB expects mortgage servicers, among others subject to the HPA, to incorporate into their compliance management systems adequate measures to ensure compliance with HPA requirements. ' The above assertion of the CFPB as it pertains to my identical circumstantial denial for PMI removal justifies that you have wrongly rejected my request by overlapping a separate rule of XXXX with the requirements found under the HPA. The HPA outlines the requirements as follows under the section titled Cancellation and Termination of PMI : Non-High-Risk Residential Mortgage Transactions. ( 1 ) I have submitted to you a written request to cancel my PMI. ( 2 ) The principal balance of my loan ( {$110000.00} ) has reached 80 % of the " original value '' ( {$130000.00} ) based on actual payments. ( 3 ) I have a good payment history seeing as I have not made a payment that was sixty or more days past due within the first 12 months of the last two years ( only two months approximately to consider in my case ) prior to the cancellation date, which is, per the CFPB, at my option, the date the principal balance actually reached 80 % ( i.e. XX/XX/XXXX ), nor have I made a payment that was thirty days or more past due within twelve months of this cancellation date. By these two criteria, my payment history is considered " good '' despite my loan being approximately 14 months old. Again, there is no seasoning requirement under the HPA. ( 4 ) I can evidence that the property has not declined below the " original value '' ( XXXX ) upon request by 360 Mortgage Group to obtain a Brokers Price Opinion ( " BPO '' ), a Certification of Value, or appraisal. Any XXXX of the XXXX would be considered valid for XXXX purposes per their guidelines. A couple of homes along my street have recently sold for over {$150000.00}, and I have also made improvements to my pool and the surrounding area along with my sidewalk in front of the house that has likely boosted the property value since the last appraisal was performed in XX/XX/XXXX. ( 5 ) I can also certify that my equity in the property is not subject to any subordinate liens. ''

XXXX XXXX, XXXX I wrote them a letter stating that I wanted to remove my PMI. I waited a month and after receiving no response, I called them. They informed me they had not received my request. I emailed them my request and again, no response. I called again and they responded within the week ( XXXX XXXX ) via email informing me they would be sending my request to their appraisal department for them to " provide me with some options for appraisers in my area. When the list is provided, please order a complete interior/exterior appraisal with comparable properties included. When you have received the completed appraisal, please send it back to us and we will review it for the purpose of removing your PMI coverage. '' So, I waited for the list of appraisers that never came until I contacted them yet again, and finally received a list another month later ( XXXX XXXX, XXXX ). I chose an appraiser off their list and ordered a complete interior/exterior appraisal with comps for {$350.00}. I sent the report to 360 Mortgage, LLC on XXXX XXXX ) and waited. After waiting another month, I contacted them to find out the status and they stated they had not received it ( XXXX XXXX, XXXX ). I emailed it to them again and still the stated they did not receive it. I finally emailed it to them via my work email, requesting a return receipt. Once I received a reply stating 360 Mortgage, LLC had received the appraisal, we waited. We were told it takes approximately XXXX days for the removal of PMI once the appraisal has been received. We waited and about XXXX days later ( XXXX XXXX, XXXX ), we received a XXXX page letter from 360 Mortgage, LLC informing us, that our payment was going up {$150.00} due to an " error '' by their " former sub-servicer ''. They further went on to explain that due to the " error '', they had determined that their former sub-servicer had failed to anticipate the " Mortgage Insurance Premiums '' " MIP '' which resulted in a shortage of {$1800.00}. " This shortage is largely due to the required mortgage insurance premium payments being made monthly, but your reduced payment not contributing into your escrow account to fund the disbursements. '' The informed us they were going to throw us a bone and " spread this shortage in our escrow over XXXX months ( normally this would be spread over XXXX mos ), to reduce the increase in your monthly payment. When I contacted 360 Mortgage, LLC to ask them to explain their XXXX page letter that was extremely confusing, they attempted to walk me through it and explain to me the mistakes by their " former subservicer '', with whom they no longer do business. They also told me they were going to be even more kind to me and order a new appraisal, as the XXXX XXXX they told me to order was not allowed by XXXX. The new appraisal is a minimum of {$500.00}, but they were so wonderful that they were going to pay for the new appraisal, since I paid for the first one that due to their error, they could not use. Another month went by and after I contacted them again to ask them to explain their XXXX page letter, they had an appraiser contact us. The appraiser came out a XXXX later and completed the appraisal ( XXXX/XXXX/XXXX XXXX. The county tax assessor sent a bill this year saying the house was worth {$200000.00} minus our {$7000.00} Homeowners exemption, that is {$190000.00}. The appraisal completed XXXX XXXX XXXX came in at {$210000.00}. The XXXX appraisal ordered by 360 Mortgage, LLC came in today ( XXXX/XXXX/XXXX ), estimated our home to be worth {$160000.00}. Hmmmm, a {$52000.00} difference from the XXXX appraisal and a {$36000.00} difference than the XXXX XXXX Assessor. Now 360 Mortgage, LLC says the home has not increased in value enough to remove the PMI and so they will continue to collect $ XXXX/month until XXXX.

We are having a big problem with our mortgage company, 360 Mortgage. We have an FHA streamline loan that we were convinced to take out by their agents in XX/XX/XXXX. We were misled at origination and told that if we took this new loan that our monthly payment would drop about {$300.00} per month. However, their agents were not telling us the whole truth. In fact, after we did this loan our payment went UP {$300.00}. Their agents led us to believe that their initial quote including the escrow and mortgage insurance, but that was all a lie. In that same year, I was laid off from my XXXX XXXX job after 15 years with the company. This loss of income, coupled with the increase in our mortgage payment ended up with me falling behind on the mortgage several months later. We tried to apply for loan modification assistance, but were told we had to wait until we were three months behind and in foreclosure before we could be considered for anything. After going delinquent, we tried to reach out and it has been a mess ever since. 360 Mortgage has denied us access to homeowner assistance programs that FHA offers and has passed us from department to department and continually lost our paperwork and given excuse after excuse. Now we are in foreclosure and they are telling us the only solution is to come up with $ XXXX to reinstate the loan. We bought our home in XX/XX/XXXX and I live here along with my wife and XXXX children as well as grandchildren. When we were solicited regarding the streamline loan we were only given a portion of the information, and we ended up increasing our monthly payment by {$300.00}. I have no idea how 360 got this to pass their Net Tangible Benefit standard, this mortgage did not HELP me! ( unless they doctored the paperwork or somethingwould not be surprised! ). As explained I had a good paying job but then got laid off so we had no income coming in for a year and a half. We hung on with the savings as long as we could but eventually we could not keep up with the mortgage payment and fell behind. At that time, the promised savings that we never got would have really made a big difference. I immediately reached out to the 360 to discuss options for homeowners who were currently unemployed. I was told that I had to wait till I was three months behind and in foreclosure before I could even send in an application. I dont believe this is an FHA guideline. Once I was behind 3 months we began trying to engage and were stuck in a paper chase with the agents at 360. Paperwork was repeatedly lost, then after acknowledging it was received we would be told that the paperwork had expired and that we had to send in all of the documents again. I know that there are FHA programs for homeowners who are unemployed that allow them up to a 1-year forbearance while they try to find work. However, their agents never considered me for this program or even discussed it. We were eventually told over the phone that we were denied but no reason was given, so we tried to make a good faith payment of {$5000.00} to show that we wanted to make good on this loan. They refused to accept this payment. Instead we were told that we needed to reinstate the full past due amount. I dont know why we were never reviewed for any of these FHA programs such as modification, partial claim, special forbearance or repayment plan. My financial circumstances changed many months ago and I am back at work ( albeit at a 67 % pay cut ). We have tried to re-engage with their loss mitigation department but cant get past the gatekeepers. We do not have an assigned point of contact, we do not have an open review of our current and correct financial information and we are told the only option is to come up with {$41000.00} to reinstate the loan.

We purchased our home in XXXX. We had 7 % as a down payment and PMI was a requirement for our loan because we had less than 20 %. In XXXX, we refinanced our loan with HARP as we were " underwater '' but still wanted the benefits of a better interest rate. There was not an appraisal required -- the mortgage company based our home value off of what they felt were comparable sales and gave us a value we knew to be far lower than our actual value, but we were assured that did not matter. PMI was again required with this new loan. Right now, 3 years and 10 months after our HARP refinance, we have at least 20 % equity/80 % LTV ( based on comparable home sales, local mortgage broker estimates, online home value estimates on sites such as XXXX, etc. ) After researching the requirements of getting PMI off, certain we qualified, I contacted our mortgage company to request that they take PMI off. I learned that my mortgage company has requirements beyond what I read in the Home Owners Protection Act ( HOPA ) and because our loan is less than 5 years old with the company and " their investors '' require that I have 75 % LTV. I think I may actually qualify for 75 %, but wonder how they can have their own rules? PMI protects them/the investors, but if we 've proven ourselves to be low risk ( our income is strong, credit is excellent, all on time payments for 9 years of owning a home, and our Home Value is easy to determine that it has risen above the 80 % LTV ) why would getting PMI OFF be difficult? What is " in it '' for them to make the borrower continue to pay $ XXXX a year while sitting in a home with 20 % + equity? I suspect potential XXXX between the mortgage company and the insurance company? Some sort of kick back? When I asked the customer rep if the mortgage company works with only one insurance company, I was told yes. HOPA mentions 78 % being the legal requirement to have a mortgage company remove PMI automatically. However, this is based on the original home value, which for us would n't be for 10+ years, costing us over {$30000.00} on unnecessary PMI premium payments. This does not seem right and if not illegal, seems to at the very least be poor business practice that costs borrowers thousands of dollars. Because our " original '' value of our home when the XXXX HARP refinance closed was very low, our mortgage company believes our LTV is over 100 % and without me paying for an appraisal, it will not be changed. I believe more should be done on the lender 's end to better determine borrower 's updated home value and therefore expedite the removal of PMI. I was unable to speak to anyone beyond a customer service rep and was told that the first ( and only ) step is me paying {$550.00} for a home appraisal with no guarantees that they will end up removing PMI. If I did not act, my mortgage company would have us pay our {$260.00} PMI payment until the law stated they 'd have to remove it -- this would be the " midpoint '' of our loan on XXXX/XXXX/XXXX. We believe we today ( XXXX/XXXX/XXXX ) qualify to have it removed. We would instead pay the XXXX for 11 more years and 3 months, costing us {$36000.00} dollars. This is not okay. Here are some more information about our loan : Current ( XXXX XXXX XXXX ) Estimated value according to my research : $ XXXX, LTV of 78 % or below Mortgage Company information : LTV=147.4 %, Scheduled LTV 78 % XXXX, Scheduled midpoint=XXXX, Scheduled 80 % LTV=XXXX

360 Mortgage Group repeatedly failed in basic duties owed to me. They acted in bad faith and failed to exhibit fair business practices. -- The problems all started in early 2016 following a gross over-payment of property taxes by 360 Mortgage. My county wrongly charged a punitive tax rate and 360 paid accordingly. Following the payment 360 on or about XXXX 2016 increased my monthly payment by over {$900.00}. At that time I immediately told them I could not pay the extra amount and also let them know I was disputing the tax rate with the county. 360 began reporting my mortgage as not paid and deficient. Even partial payments were not recognized and not reported as received. The problem with my taxes and the increased payment started a downward spiral from which I just now recovered. Ultimately, the county corrected my tax rate and billing. However, 360 Mortgage, following this problem and months of attempted reconciliation, acted in extreme bad faith from XXXX 2016 to present including but not limited to the following : 1. Agreeing to a settlement amount to bring my account current and report it as such to all credit bureaus on XXXX XXXX, 2016 only to then in just a couple days hire an attorney and start a foreclosure action against me. 2. They would not recalculate my escrow account but simply kept telling me I must pay all charges to stop the foreclosure. I sent repeated requests, made numerous calls ( dozens or more ) in an attempt to get my account properly reconciled. 3. They charged legal fees to me that were not incurred. They also included fees that did not apply to my account. Even their own attorney indicated he did not set or charge the legal fees -- only they did. 4. They rejected repeated attempts at Loan Modification even stating that I did not qualify as my loan was not 'seasoned '. -- 5. They used the wrong # s in the financial calculation for my modification and repeatedly rejected the data I provided. Again rejecting the loan modification or any opportunity to 'work-out ' the amount in question. 6. They included my wife on the foreclosure complaint even though she is not on the mortgage note. 7. They have yet to reconcile my account or my escrow for 2016 even though I paid in full the punitive reinstatement amount of over {$20000.00} which included inappropriate fees and expenses. 8. They indicated the 'investor ' would not allow them to work out my account or offer solutions - even though they are the investor and servicing agent of my loan!! 9. They sent people to my house to tell me to call them on the very days that I had at length spoken with them by phone and in writing. 10. They rejected multiple settlement offers even refusing to accept a wire transfer of over {$18000.00}. 11. They proceeded with a wrongful foreclosure action against despite an agreement to settle my account in full. They the repeatedly failed to timely respond to numerous requests and agreements for information exchange/s. 12. They charged late fees even after they indicated they would waive the fees. 13. They damaged my credit, my reputation, my ability to maintain or advance in my employment. 14. They refused to properly reconcile my account instead telling me repeatedly that I did not understand the process and that I needed to pay their entire amount despite legitimate and credible questions.

I am a XXXX veteran who is retired and living on a fixed income. I am in danger of foreclosure because my mortgage company 360 Mortgage Group, has refused to engage with me to try and work things out. Due to my daughters health and XXXX issues which ultimately led to her XXXX I had some financial struggles which caused me to default on my mortgage. I have tried repeatedly to get my mortgage lender to work with me to come up with a plan or a modification or a restructured loan so I can get caught up and resume regular payments. They have conditionally refused to even give me the time of day. My loan is a VA loan that is backed by the government. I was told by a counselor that this company is REQUIRED to conduct a review of my current financial information in order to try and qualify me for government homeowner assistance programs. 360 Mortgage Group has refused to follow the rules and guidelines. I thought I was doing the right thing when I agreed to refinance into this new loan with 360 Mortgage because I was able to use some of the cash out to pay off my debt. I did not find out until after the loan had closed that they slipped in 3 points that I had to pay as their fee! I thought that was not the way that you should treat a XXXX veteran. Even so, I was able to make my monthly payment of {$1800.00}. I began struggling financially because my daughter XXXX had to go into a XXXX and XXXX XXXX program while away at school. This was financially and emotionally draining for me because all of the medical expenses were out of pocket. Due to this fact I had trouble making the mortgage payment. At the time I was so grateful because my daughter got out and it seemed like she was on the right track. However, after she went back to school she XXXX and they found her XXXX in her room from a XXXX XXXX. It was so heartbreaking to lose her at the age of XXXX. Of course there were many costs associated with the funeral and the settling of her affairs and medical bills and I have been in a very bad place for a long time. I have been trying to rebuild my life and have tried on several occasions over the last year to engage with the 360 Mortgage loss mitigation department to try and get a review for homeowner assistance programs started. I have never made any progress ; they have never assigned a dedicated point of contact, they have never opened a review of my financial information, in fact they have not even allowed me to APPLY for assistance. Their agents tell me there is no help available and they act like they could care less about my daughters XXXX. They tell me pay up now or we are going to take your house. I get calls at least 2-3 times a day at all hours from 360 demanding I pay $ XXXX to reinstate the loan. I just dont have that kind of money available. I served my country proudly in the XXXX XXXX and I am now XXXX and retired living on a fixed income. I find it unconscionable that 360 Mortgage Group refuses to allow me access to government programs that they are required to consider me for. I want to get my loan restructured or modified or get some type of forbearance agreement or repayment plan set up. I know there are options besides full reinstatement ( which is not possible ). I need help

My issue is with 360 Mortgage Group. They are engaging in unethical behavior and conduct relating to the servicing of my VA mortgage loan. I am facing a foreclosure sale date on my home on XX/XX/XXXX because they have refused to speak with me, work with me, or consider any options to resolve TWO MISSED PAYMENTS. I suffered a true financial and XXXX hardship when my wife went throughmedical issues and was hospitalized and was unable to make my mortgage payment for two months. I reached out to 360 Mortgage Group to try and resolve this matter and it has been completely silent. I have never been able to talk to a live human about my situationI have never been assigned an account manager, I have not been able to get a review opened of my current financial circumstances to see what could be worked out to resolve my late payments. Every time I call I am sent to voice mail and have never received a returned call. I have tried to submit mortgage payments but 360 Mortgage Group has sent them back. I was only TWO MONTHS BEHIND and now I am in foreclosure! This is wrong! This is a VA loan, there are rules and guidelines and protocols that must be followed. I cant believe this is happening, and I am writing this letter to open a formal complaint and dispute and to make you aware of how this company is handling the servicing of my loan. This is an avoidable foreclosure, but they dont seem to care. I bought my house about 6 years ago and refinanced into a VA loan to lower my monthly payment. I served in the XXXX XXXX for 20 years, and have worked as a XXXX XXXX for the last 10 years. My wife had worked as a XXXX for 24 years but has been having XXXX XXXX issues and is no longer able to work. She was diagnosed as XXXX and could not focus and we have been overwhelmed with medical bills and costs. There was a mistake in her level of medication and she was admitted to the XXXX XXXX for a time so it has been serious. Due to this fact in XX/XX/XXXX of 2016 I could not make my mortgage payment for two months. At that time I began trying to contact 360 Mortgage Group to see what we could do to fix this. No one would respond, so I sent in a payment. It was returned. The next two months the same thing happened. I tried to send in a payment and 360 Mortgage returned it. I tried to talk to one of their agents to find out how to fix this matter and just was sent to voice mail. There were no returned calls and no contact. This is a violation of the protocols set in place for VA loans. I know that I have a right to be reviewed for modification, a restructured loan or at least a repayment plan. I dont know why they are treating my family this way, it is not fair. I need some help here in order to at least get this company to negotiate and deal with me. I can afford my monthly payment, I have tried on multiple occasions to resume making mortgage payments but they are refusing to deal with me. It seems that they are interested in cashing in and having the government reimburse them after they foreclose on me. Please intervene, this is wrong and help me work something out with 360 Mortgage Group. They are engaging in unethical and improper conduct relating to the servicing of this VA mortgage loan.

This is the second complaint I have filed related to XXXX Mortgage. While some of the information is still being disputed from the initial complaint involving wrongful foreclosure there is very material new information which is the basis of the new complaint. Specifically, today I received a large package of information from XXXX. It does include an updated escrow analysis and payment amount. However, there is no mention of why it is just now being received. Nor, is there a mention as to why the prior statement was sent - after receiving payoff funds - still showing I owed over {$4700.00} in XX/XX/XXXX. The package does include the reiteration that XXXX Mortgage did nothing incorrect in servicing my loan. This assertion does not reflect reality. The information also indicates that the VA was wrong in stating that my loan did not have to be 'seasoned ' ( 12 months of payments ) in order to qualify for modification. In addition, the following items, at a minimum, are incorrect in the final reconciliation received today from XXXX as follows : 1. My wife did not sign the 'Note ' and promise to pay -- XXXX provided a copy of the same showing she did not sign. -- - She did sign and was told to sign the mortgage - which appears to be incorrect as she is not subject to the loan underwriting, the 'Note ' nor the repayment of the loan. 2. They agreed in XX/XX/XXXX to settle the matter and gave me a pay-off until the end of the month. They then within XXXX hours hired an attorney to wrongfully foreclose. They disregarded the agreement by taking action so quickly and not giving me anytime to remit funds ( which I explained I had to borrow in a process that would take a few days ) 3. They did not properly reconcile my account upon receipt of the punitive reinstatement charge of over {$20000.00}. 4. Instead, they did send a mortgage statement for XX/XX/XXXX that is completely incorrect showing I owed over {$4700.00}. -- 5. They did repeatedly make assertions that they were not allowed by the investor to work with me on to settle the debt. Now they say they are not the investor but in a recorded conversation in early XX/XX/XXXX they indicated they were. 6. They still show a negative escrow balance which I continue to dispute. 7. The indicate they can arbitrarily offer to reduce late fees only to then reinstate the fees. 8. They indicated the legal fees charged were reviewed and are correct. -- They are duplicate fees and there has been no explanation thereof. 9. They say I was not experiencing a temporary hardship so I did not qualify for a loan mod -- I was, as my house payment had increased {$900.00} a month due to payment of punitive taxes. -- The payment created a hardship. Bottom-line, even after I paid the punitive reinstatement charges, they still failed to properly reconcile my account. Instead they sent the attached statement showing I still owed {$4700.00}. They have since provided additional information all of which says they did nothing wrong. So, I guess I am to yet again disregard written correspondence from them that says XX/XX/XXXX thing and only pay attention when they say they have done no wrong. --

Timeline of events regarding complaint against 360 Mortgage Group and the enormous {$540.00} increase in mortgage payment due to 360 Mortgage Group negligent error in projecting escrow funds. XXXX/XXXX/XXXX loan was re-financed/originated with 360 Mortgage Group by consumers. XXXX County taxes were paid in the amount of {$1600.00}. At that time the balance was already paid by the title company involved in the re-finance, this resulted in a negative balance. XXXX County taxes were paid in the amount of {$60.00}, as this was the difference due following the XXXX over payment and change in XXXX XXXX rate. XXXX/XXXX/XXXX 360 Mortgage Group conducted an escrow analysis and determined that the Consumers ' taxes would only be {$120.00} for XXXX, subsequently they issued an escrow refund to consumers for {$1800.00}. o Please notes : tax history going back to XXXX is average at {$3000.00}. This should have raised a red flag to 360 Mortgage Group. XXXX/XXXX/XXXX an annual escrow account disclosure statement was sent to consumers indicating that the escrow account was severely deficient at a shortage of {$3200.00} which was to be prorated over 12 months at {$270.00} and would raise the payment of {$1400.00} by {$540.00} to {$1900.00}. XXXX/XXXX/XXXX Consumer contacted 360 Mortgage Group and spoke with XXXX who advised her that the taxes were only {$120.00} last year and now they were {$3300.00}. He advised that taxes are calculated based on the previous tax year, which does not make sense as the XXXX tax year had a tax bill of {$3300.00}, nowhere near {$120.00}. XXXX assured consumer that a supervisor, XXXX would call her back by 2 business days or Tuesday XXXX XXXX, XXXX. Consumer asked that this matter be resolved and based on 360 Mortgage Group serious error that they make financial amends for this mistake. XXXX/XXXX/XXXX No call received from the supervisor XXXX. I called and spoke with XXXX who passed me to the supervisor XXXX. XXXX advised that they will spread the escrow payment over 36 months and this will result in a payment of {$1700.00} as of XXXX XXXX, XXXX, and increase of {$360.00}. I requested a call back from a manager several times and she refused and stated that she was all I was going to get and " managers do n't take calls. '' I advised her that I would accept the 36 months but am still asking 360 Mortgage Group to resolve this financially based on their mistake. This puts a huge financial burden on the home owner of a payment increase of {$360.00}. I again repeated my request for a call back and appropriate resolution to XXXX, but as the call was going in circle with her, I had no choice but to end the call. XXXX/XXXX/XXXX XXXX statement received showing payment due XXXX/XXXX/XXXX {$1900.00}. This was never resolved and now the consumers ' payment is increasing by {$540.00}, which is an impossible burden.

We fell a little behind last year from a financial hardship, we applied for a loan modification with 360 Mortgage ( servicer of our VA loan ), as we were in the process we were impacted by Hurricane Irma and placed into a forbearance to offer relief. After the forbearance ( most other mortgage servicers assisted with disaster modifications by placing the payments in the loan ) but 360 Mortgage did not but forced us to apply as a normal loan modification application. My initial application was sent in on XX/XX/XXXX ( it takes 360 mortgage 7 to 10 days to receive and review a document and let you know if it is all they need or to send something else in ) other servicers like XXXX XXXX do this within 24 hours. So then I followed up and on XX/XX/XXXX the requested more documents and I sent in 30 additional pages. Then I followed up and on XX/XX/XXXX I sent in 14 more pages and though surely this be a complete package so my application can go to underwriting and they can place the foreclosure on hold to not violate the dua tracking restriction. I kept following up and on XX/XX/XXXX they need more so I send in 45 additional pages thinking this has to be it since what they claimed was above what was asked for before. I follow up and on XX/XX/XXXX they need more which they did not ask for before so I send in 45 more pages 360 Mortgage is making the application process so strenuous with the intent of denying me the opportunity of having a complete package so per the CFPB guidelines my sale can be placed on hold while the review is conducted. I also received a debt validation letter from the foreclosure attorney on XX/XX/XXXX despite the fact there was already a foreclosure sale date set. I filed a dispute but to no avail as the attorney says their client ( 360 mortgage ) will not agree to stop the sale even though they are in the wrong. My VA representative and loan technicians supervisor stated they requested a post ponement from 360 mortgage but they refused to do it. This is a violation of many regulations and also violating the Fair Housing Act by refusing to accept and discriminating against my VA military XXXX as valid income even though I provided a valid VA XXXX award letter and 2 months bank statements showing the deposit into the bank. 360 mortgage is doing nothing more than a bank does when they don't want to approve a mortgage, they just keep making up more and more requirements so it is impossible to get approved. My wife and I are XXXX US military veterans whose only income is from XXXX and have served this country. We would appreciate help by having this sale post poned so we can be reviewed for loss mitigation options.

On XXXX XXXX , I Initiated a hardship request because of an unforeseen medical situation. Expecting that payments may be late or missed for 1 to 3 months or some time between XXXX XXXX and XXXX XXXX . 360 Mortgage, XXXX XXXX XXXX XXXX XXXX XXXX , TX XXXX , ( XXXX ) XXXX , could not have done anything more to prohibit this request offered by HUD for assistance to lenders for with unforeseen life situations. The improprieties were : 1. In the email correspondence provided, the loss mitigation specialist XXXX XXXX after numerous requests to contact me by phone to clarify conditions on stipulation list never replied although confirmation emails were sent stating a reply would occur in 72 h ours. Replies never occurred, all contact information was initiated by XXXX XXXX . 2. When speaking with Cust Service t he gatekeeper for the Loss Mitigation Dept, those reps stated Federal hardship requests are rarely ever approved b y 360 Mortgage because of the guidelines with FHA. Without seeing the documentation or knowing anything re : the request, how can a Customer Service Rep make that claim? 3. The Document Checklist list for the Hardship Application had 25 d ocument requests, 21 had a box with an " x '' and 4 had a box that was empty. Assuming the " x '' meant required documents, they were sent to Ms XXXX only to find out one day before the doc deadline XX/XX/XXXX that all docs would be required I furiously gathered a re-faxed docs on XXXX XXXX the date of the deadline, only to find out 360 F ax was down that day. *Ms. XXXX denied the request and the hardship application was pulled on XXXX XXXX 3. While this Assistance package nightmare process was going on I feverishly tried to keep up the payments, AND DID. While XXXX and XXXX were late, they were made. 360 reported tot he credit reporting agencies these late payments and now a refinance to go with another lender CAN NOT be attained. I 've requested 360 mortgage to remove these derogatory items and they have declined for XX/XX/XXXX and XXXX of XXXX . Unfair trade practices, customer intimidation, overloaded loss mitigation and customer service staff, failure to follow federal guidelines for home assistance programs, failure to accept responsibility for electronic document transmission errors and erroneous reporting for extenuating circumstances are just a few of the process flaws that are systemic in the Mortgage Origination, Servicing and Cusotmer Service with 360 mortgage. 360 Mortgage has made several billing errors regarding my loan XXXX. The mortgage company is reporting various amounts due in the past 5 months. The company has violated the Fair Billing Act and Fair Credit Reporting Act. The company has added default cost of {$390.00} and " Other Charges and Fees of {$120.00} ''. The company denied me a refinance under the VA refinance loan program or the ability to modify my loan after I submitted multiple applications and request after having a financial hardship and the death of my mother in XX/XX/2016 of XXXX. The after speaking with me initially about my hardship the representative XXXX, who would initially ask me to submit an application ; which I did and she would in turn state I had 15 days to complete and return it with supporting documents such as bank statements. This happened 3 times ; which put my account further behind. XXXX and her Manager XXXX She then requested on the XXXX day into the process to circle all debits and withdrawals that went towards my mortgage and expenses. This information was seen in the monthly statement as debit or withdrawal. This was a tactic that was unethical, racist, and deceptive to compound cost to have my account in a default state to obtain monies in a deceptive manner. The company has violated the Fair Housing Act by imposing overly restrictive rules because I have children and am XXXX. Since I am a veteran I contacted my VA loan representative which monitors my loan XXXX. The company has stated my funds were being held in escrow to pay for insurance and taxes. The company refused to allow me to independently pay my taxes and insurance. Which is now not fully paid as agreed on the Mortgage Note in my Loan Contract and my Insurance was paid before my annual taxes which should have been paid monthly due to my insurance service contract. The company sent me an agreement ( payment arrangement ) for my loan and stated my loan could not be modified and brought current even though I was 4 months behind at the time. The company has charged me " Default Related Charges and Other Charges and Fees '' even though this payment plan included all other fees.

Tuesday, XXXX/XXXX/XXXX In XXXX XXXX I bought a home in Georgia ; this is my primary and only home. The mortgage is with 360 Mortgage XXXX ( XXXX, TX ). I have several concerns, one being my escrow account has started with a deficit every year since I purchased the home, despite the decrease in property taxes and hazard insurance by about {$95.00}, and the increase in mortgage payments last year to cover the XXXX shortage. Also, in XXXX XXXX I notified the mortgage company that effective this year, I am eligible to take advantage of the Georgia school tax exemption. On XXXX XXXX, I called the mortgage company to ask for an explanation about the yearly deficits in my escrow account despite the decrease in taxes. I was told an early insurance payment ( paid in XXXX instead of XXXX ) caused the shortage. Here are my questions : 1. The increase in my mortgage payment last year was to cover XXXX taxes and insurance for that year regardless of when the insurance was paid. If the XXXX analysis of the escrow account was accurate, why did the early insurance payment cause a XXXX shortage? 2. An analysis of my account was performed XXXX/XXXX/XXXX, but I am not convinced that the decrease in my taxes and insurance was taken into consideration. How can I be assured that it was? 3. What other factors could drive my escrow balance to be short every year? 4. In addition to the lesser taxes, will the school tax exemption help lower my monthly payments? 5. Based on my conversation with the mortgage company, it sounds like the difference between the higher XXXX and lesser XXXX taxes were not applied to escrow. Is there a time frame the mortgage company has to issue me a check for the difference? Another concern is regarding the XXXX Form. As of year-XX/XX/XXXX, my mortgage balance was about {$2000.00} less than the amount the mortgage company submitted to IRS. They explained two XXXX forms are submitted to IRS and the second one will have the correct mortgage balance. Is this normal practice and if so, why? I look forward to a response.

In XX/XX/XXXX, I refinance my VA backed mortgage with XXXX XXXX XXXX , XXXX A wholly-owned subsidiary of XXXX. When we started the process the sale point was to lower my interest rate. I was told because I have a VA loan and the Safe Harbor Act I could not get an IRRRL. Which I did not understand why because, I was not or had been 30 days within 6 months late on any of my debts to include the mortgage. I am a XXXX Veteran, at the time I was under a lot of stress and went along with what I was told. The loan was transferred to 360 Mortgage Access for servicing. Then my nightmares began. My loan started out with a payment of {$1200.00}. In XX/XX/XXXX, 360 conducted n escrow analysis and lowered my payment. However they left out my city and county taxes. Once they caught their mistake, my payment went to {$1600.00}. Because they had to recoup the negative escrow amount from their mistake. When I called to workout a different payment arrangement for the negative escrow amount because it caused me a severe hardship. The customer services reps on more that one occasions told me to short sale my house ( with a giggle ). I did not see the humor nor did I think it was professional for them to have such an unprofessional approach to my issue. I suffered through XX/XX/XXXX paying the extra amount by borrowing from friends and relatives. XXXX would not consider a HARP or any other solution. Either XXXX or 360 Mortgage Access or both have predatory business practices. If I was not a Veteran this would not have happened. Now, the most egregious is the fact 360 stated they would conduct another analysis in XX/XX/XXXX and my XX/XX/XXXX payment amount should be lowered ... AS today the action has not taken place. They are still billing me for the extra escrow amount!

During XXXX a property tax dispute caused me to get behind on monthly payments to 360 Mortgage. 360 pursued what I deemed to be a wrongful foreclosure. ( Please see 2 prior CFPB complaints for details ). Fort unately the foreclosure was completely 'cured ' in XXXX of XXXX and all court action/s dismissed. Even so, as of XXXX / XXXX / XXXX my home is listed on a public web-site as in foreclosure. Apparent ly 360 while pursuing a punitive foreclosure based on a very credible difference of opinion h ired XXXX XXXX XXXX to market my home for sale. XXXX XXXX XXXX then published information on my house, that as of XXXX XXXX , XXXX , has not been removed, updated nor corrected. I recently sent 360 and XXXX instructions to take down the false information and immediately stop advertising my house as in foreclosure or having been foreclosed. This information has resulted in damage to my credit, my ability to get a new job and/or my ability to transact business. 360 Mortgage demonstrated bad faith throughout this process and their failure to remove this information and/or instruct their vendor to do so continues a pattern of horrible market conduct that should be punished. 360 wrongfully pursued fore closure and then continued to market my house for months directing others to publish false, inaccurate, and incorrect information. I spoke with XXXX at length and they assured me they were simply following the direction of 360. I put both 360 ( and it 's foreclosure atty ) and XXXX on written notice of this issue. As usual, I have yet to get a response. 360 has again demonstrated unfair trade practices, and perhaps breached RESPA requirements/standards.

Step 1 : What is this complaint about? According to the reports provided to the Credit Bureau by 360 Mortgage Group, it shows eight ( 8 ) months of being late 30+ days and one ( 1 ) month of being late 60+ days. See below for the months/years and attached image ( Credit History - 360 Mortgage ). However, I have bank statements from XXXX XXXX XXXX XXXX ( XXXX ) showing proof of payment, and I've attempted on numerous times to work with the company with no success. I even provided the bank statements ( per their request ) to show proof of payments. For the XX/XX/XXXX late payment report, the house was sold that same month. Months/Years - 30+ days late XX/XX/XXXX XX/XX/XXXX - proof in bank statements XX/XX/XXXX - proof in bank statements XX/XX/XXXX - proof in bank statements XX/XX/XXXX XX/XX/XXXX - proof in bank statements XXXX proof in bank statements XX/XX/XXXX Months/Years - 60+ days late XX/XX/XXXX - house was sold, see Seller 's Final Settlement Statement Step 2 : What type of problem are you having? We applied for a mortgage modication through our mortgage company. We sent in applications for XXXX type of modifications. XXXX application was through the HUD website and the XXXX was from the mortgage company. XXXX were rejected for additional information which was the whole modification package plus more information. It was very clear we were getting the " Run Around '' They told us the application was blank in certain areas and items were missing. The application was not blank and was scanned and emailed to the mortgage company as well as sent by priority mail via the post office. We completed alot of paperwork spending hours of our time. We bought printer ink, printer paper, stamps for priority mail and spent our precious time completed XXXX documents for this modification. We kept copies for our records. We do agree with a few minor math issues but it was clear to my wife and I that 360 Mortgage was running us ragged. Wasting our time and telling us we sent them blank applications. Of course we did not send in blank modification applications. We have decided not to send further paperwork until we speak to an attorney. It is clear they have their own motives for delaying us with requests for documents that were already sent. 360 Mortg age Company has fraudulently used my name and also has committed Identity Theft by claiming they were me. My new insurance company XXXX XXXX which I 've had sine XXXX XXXX 2017. stat ed someone called and authorized changes on my insurance account. The changes were to change my personal information and begin sending all correspondence and billing documents to them. I also received a refund of my monthly payment and a letter of closing my payment plan account which I opened. The XXXX XXXX representative XXXX out of the XXXX IL office and she confirmed the Mortage com pany 360 Mort gage made changes to the account. I was on my XXXX XXXX online account and witness the changes that were made without my consent. The representative also stated that the XXXX XXXX Agent XXXX XXXX was the only individual who could authorize changes to my account. This is an invasion of privacy concerning the Information Privacy Act and shows an intent to practice fraudulent and deceptive business claims. The representative XXXX also stated that my phone number was verified by the 360 Mortgage Company. The phone number that was used has not been in service for years. I do believe XXXX XXXX didi not know the details of what 360 Mortg age was internally practicing.

I am a XXXX Veteran, using my VA loan. I purchased this house in XX/XX/XXXX. The house came with a separate lot, that has nothing on it, with a separatelot # and legal description. My intention was to sell this lot to pay off bills. When Itried to sell it, the mortgage company said I had to own it for one year before Icould sell it. XX/XX/XXXX, I refinanced at a lower interest rate, and to sell the lotright away. I have many emails from 360 mortgage saying that after we refinanced, we could sell it right away. On the day of signing the new papers for mortgage, Ihad to call 360 mrtg to ensure that it could be done right away. I was told yes, andthat I had to sign papers that day as they were time sensitive and would all have tobe redone if I did n't, so I signed them. Now, here we are in XX/XX/XXXX, and it all is nofurther than in XX/XX/XXXX. I spoke to the VA company, and was told that it can be done, and that 360 mrtg is just not doing it, and wants to charge me all these fees on topof the {$8000.00} some dollars they have already charged me. My realtor has also been involved in this entire process and can attest to everything, and has also receivedemails stating it will be no problem. Ca n't I sue them for breach of contract, since I have proof of what tey said? They are 360 Mortgage Company.

I just checked my credit reports as of XXXX XXXX 17 and only partial information was fixed. The request for the removal of 30 days late was not take off. Transunion had fixed their information around XXXX XXXX 17 and my score and account were fixed. However, it has since been reverted back to 30 days late for some reason even though all the information shows it was n't late. XXXX updated their information on XXXX XXXX 17 ex cept still showing as 30 days late. I am requesting 360 resubmit the request for the 30 days late be removed and the current status to reflect CURRENT or PAID AS AGREED. Never late. I request this be done immediately as a future loan is pending this correction and is causing serious headaches for me. I have wrote t he President of 360 again t o make him aware of this and to see if this will be fixed quicker as well. I understand 360 will have 15 days, however, i need to have this done in the next 7 days as my future loan and home depend on this. 360 Mort gage is acting in bad faith in connection with a real estate transaction and acting as a foreclosure mill in refusing to adhere to standard real estate practices. At issue is borrower is looking to avoid foreclosure and has had an offer to sell their proper ty. 360 Mortgage has advised that the offer is too low based on their appraisal which is almost 6 months old. We have contacted the investor who has advised they are opening and working on a value dispute and that dispute should be completed by the end of the month to determine the value of the property. 360 Mortga ge was made aware that investor has opened a value dispute but has determined on their own to take the property to foreclosure sale prior to the value dispute being completed. This is completely unethical and acting in bad faith while parties are in the process of negotiating a real estate transaction. Additionally 360 Mortgage 's appraisal is set to expire in approximately 2 to 3 weeks at which time they will be required to order a new value. 360 Mor tgage would rather foreclose on the borrower than to comply with standard real estate rules and regs when negotiating offers. This is unacceptable.

360 Mortgage LLC in XXXX Texas has been collecting payments via escrow for Property insurance for the subject property. 360 mortgage 's under-educated Insurance group is refusing to pay the property insurance policy because they want to change the policy/ dictate to the insurance company and property owner how the policy needs to be titled. ( they are listed as lienholder - that is the only matter they are entitled to dictate ). We have had this discussion each year for the past three years. Now they have refused to pay the policy and I have received a notice of cancellation of the policy. Whether this is just under-educated people attempting to practice law without a license because they do n't know local laws or insurance underwriting, or whether this is a wholesale attempt to cause the existing policy to lapse so they can force-place a more expensive policy thru an affiliate, it smacks of fraud. They represented they were collecting insurance payments each month into an escrow account so that the policy could be paid - when in reality they have now refused to pay the policy. I recommend their loan servicing practices be investigated for consumer abuses.

I contacted 360 Mortgage group on XX/XX/XXXX regarding endorsing a insurance check from damage occurring to my property from hurricane Florence. I was advised by a representative named XXXX that my mortgage had been sold out to XXXX XXXX XXXX as of XX/XX/XXXX and they were not endorsing my check. I even offered to overnight the check to 360 mortgage and pre-pay for them overnight the check back to me. After reaching out to XXXX XXXX, XXXX advised me they had no records of receiving my mortgage from 360 mortgage and they could not help me. After playing phone tag back and forth I called 360 mortgage back and XXXX again answered the call and I advised him of what XXXX XXXX had said he then again refused to help me. I asked to speak with a supervisor and he refused to let me speak to one saying one was not available. Can someone help me? I need my house fixed and the contractor is ready to start. I have tried contacting the insurance company but without documents from 360 mortgage stating my mortgage has been transferred they can not change the name on the insurance check. 360 mortgage is refusing to provide documents for this transfer.

My mortgage with this company ( 360 Mortgage Group ) was paid in full on XX/XX/XXXX. To date, I have not received the escrow funds due to me. I have called on numerous occasions, only to receive the " run around. '' I was told the check was issued on XX/XX/XXXX ; my first call to them was on or about XX/XX/XXXX. At that time, I stated that it seemed a bit odd, that I still had not received the check if was issued on XX/XX/XXXX. They told me they were not responsible for the delay of the mail service. I asked if the check could be stop paid and reissued. They stated they would have to give it at least two weeks after the issue date in order to stop pay, which would have been XX/XX/XXXX. Again, I called to inquire only to be told they couldn't stop pay it until XX/XX/XXXX. So, as of today, XX/XX/XXXX, I'm still waiting to receive my escrow refund. I asked if they could over night it as a courtesy ; they stated " yes ''. However, when I called back on XX/XX/XXXX to advise that I did not receive an overnight package ; they stated, " they put it in the mail. '' Please help me in receiving my escrow refund.

360 Mortgage has made several billing errors regarding my loan XXXX. The mortgage company is reporting various amounts due in the past 5 months. The company has violated the Fair Billing Act and Fair Credit Reporting Act. The company has added default cost of {$100.00}. My loan was on a repayment plan from XXXX through XX/XX/2015. The representative 's XXXX and XXXX stated it was due to the company having to send someone to my house to verify residence. I asked the representative 's to submit me proof or remove the charge from my statement and they stated they could not. The company has continued to call several times a day and harass me to about paying the amount. I have been trying with Lender 360 mortgage, but I am behind so they will not accept partial payments only full payments with prearranges included also. since XX/XX/2016 they called me every two weeks to remind that they newer a debit collector and gave the new behind payment amount. Consumer law says they are on the lead of this to stop sale but the same questions of payments and intent of property are first and not take a payment. Now three weeks later we are still doing a hard ship letter again with same reasons but further explained as if the circumstances have changed much. But I have now got bad credit with giving up on credit score to keep home and now two weeks to sale I don't believe they have or even care of the impact this will have on my psychological state I have no other recourse due to college students [ children ] need expensiveness and garnishment for child support.

I refinanced my VA home loan with XXXX XXXX XXXX. My home loan was with 360 Mortgage, I closed on my refinance on XXXX XXXX, 2017 with XXXX XXXX XXXX. The loan funded the next day on the XXXX. 360 Mortage dispersed my escrow funds out to the county tax collector that day after I requested my escrow funds be refunded to me which are entitled to me by the Real Estate Settlement Procedures Act governs the administration of escrow accounts. RESPA is part of the United States Code of Federal Regulations and gives specific guidelines regarding any escrow overage or shortage amounts. The law mandates that escrow amounts in excess of legal requirements refund to the homeowner.This is a deceptive business practice.

I had refinanced my loan with 360 mortgage but they keep reporting negative information to the credit bureau, the loan was paid in full before it was 30 days delinquent. Yet they keep reporting that it was late and it has dropped my credit score by XXXX points. I have called them numerous times and they say to dispute the charge through the credit bureau. I have done this twice. The first time the issue was fixed, then all of a sudden they reported that the account was late again so I have to dispute a second time. When I call them they offer no assistance even though they know they reported the information incorrectly. I need this issue resolved as my good credit is being damaged by lazy credit reporting.

I applied to re-finance my home in XX/XX/2018 with 360 Mortgage- since they were my current mortgage I though the process would be easier. The initial process went very smooth -- our application was approved and all documents were signed -- the appraisal ( which raised some eyebrows was {$700.00} ) which is not industry standard but we agreed. 5 days before we were about to close I received a call from the underwriter stating that she denied the new loan due but could state why. 20 days later I was informed my loan was sold to XXXX XXXX. I have been in an active review with my lender since XX/XX/XXXX. There was no active foreclosure sale date every set, as I was told proceedings were on hold.
