XXXX XXXX XX/XX/XXXX Last XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I ( XXXX XXXX ) am a victim of Identity Theft. I have experience tough and egregious hardships because someone has stolen my identity. I can not get credit anywhere. This has ruined my life. I lost my job last year and tried to refinance my house and car, I was told sorry, we can not help you. I filed a police report last year on ( XX/XX/XXXX ) ( report XXXX XXXX ) with ( XXXX XXXX Police Department. Ive also mailed in certified letters to XXXXTracking number ( XXXX XXXX XXXX XXXX XXXX XXXX ) I received nothing. The thieves even went as far as filing fraudulent income taxes on my behalf! The thieves are continuing to use my credit. Ive faxed all 3 bureaus, as well as called them, At this point I have hired a Consumer lawyer to assist me in this matter ( XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXXXXXX XXXX XXXX XXXX He notice several instances where XXXX are in non-compliance with the FCRA. Im a victim but Im treated as if Im nothing. XXXX continues to report Fraudulent accounts and inquiries to my credit report and I want it to stop Immediately! Please note that I have already opted out of arbitration and have supporting documents and proof to support all my claims. I am sure that XXXX did not go through the original furnisher to verify these accounts are mine and they must do so under the FCRA.If they did verify, they would have realized immediately that I have no clue of these accounts and they do not belong to me. The Fair Credit Reporting Act requires that you, the credit reporting agency, report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is with this in mind that I request that these listed accounts and items be BLOCKED and DELETED! Policy states According to the FAIR CREDIT REPORTING ACT FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1. Block. Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than four ( 4 ) business days after the date of receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to transaction by the consumer. All furnishers of information to consumer reporting agencies must comply with all applicable regulations. Information about applicable regulations currently in effect can be found at the Consumer Financial Protection Bureaus website, www.consumerfinance.gov/learnmore. NOTICE TO FURNISHERS OF INFORMATION : OBLIGATIONS OF FURNISHERS UNDER THE FCRA The federal Fair Credit Reporting Act ( FCRA ), 15 U.S.C 1681-1681y, imposes responsibilities on all persons who furnish information to consumer reporting agencies ( CRAs ). These responsibilities are found in Section 623 of the FCRA, 15 U.S.C 1681s-2. State law may impose additional requirements on furnishers. All furnishers of information to CRAs should become familiar with the applicable laws and may want to consult with their counsel to ensure that they are in compliance. The text of the FCRA is available at the website of the Consumer Financial Protection Bureau ( CFPB ) : www.consumerfinance.gov/learnmore. A list of tile sections of tile FCRA cross referenced to the .U.S Code is at the end of this document.Section 623 imposes the following duties upon furnishers : Accuracy Guidelines. The FCRA requires furnishers to comply with federal guidelines and regulations dealing with the accuracy of information provided to CRAs by furnishers. Federal regulations and guidelines are available at www.consumerfinance.gov/learnmore. Section 623 ( e ). General Prohibition on Reporting Inaccurate Information The FCRA prohibits information furnishers from providing information to a CRA that they know or have reasonable cause to believe is inaccurate. However, the furnisher is not subject to this general prohibition if it clearly and conspicuously specifies an address to which consumers may write to notify the furnisher that certain information is inaccurate. Sections 623 ( a ) ( 1 ) ( A ) and ( a ) ( 1 ) ( C ). Duty to Correct and Update Information If at any time a person who regularly and in the ordinary course of business furnishes information to one or more CRAs determines that the information provided is not complete or accurate, the furnisher must promptly provide complete and accurate information to the CRA. In addition, the furnisher must notify all CRAs that received the information of any corrections, and must thereafter report only the complete and accurate information. Section 623 ( a ) ( 2 ). Duties After Notice of Dispute from Consumer If a consumer notifies a furnisher, at an address specified for the furnisher for such notices, that specific information is inaccurate, and the information is, in fact, inaccurate, the furnisher must thereafter report the correct information to CRAs. Section 623 ( a ) ( 1 ) ( B ). If a consumer notifies a furnisher that the consumer disputes the completeness or accuracy of any information reported by the furnisher, the furnisher may not subsequently report that information to a CRA without providing notice of the dispute. Section 623 ( a ) ( 3 ). Furnishers must comply with federal regulations that identify when an information furnisher must investigate a dispute made directly to the furnisher by a consumer. Under these regulations, furnishers must complete an investigation within 30 days ( or 45 days, if the consumer later provides relevant additional information ) unless the dispute is frivolous or irrelevant or comes from a credit repair organization. Section 623 ( a ) ( 8 ). Federal regulations are available atwww.consumerfinance.gov/learnmore. Section 623 ( a ) ( 8 ) Duties After Notice of Dispute from Consumer Reporting Agency If a CRA notifies a furnisher that a consumer disputes the completeness or accuracy of information provided by the furnisher, the furnisher has a duty to follow certain procedures. The furnisher must : Conduct an investigation and review all relevant information provided by the CRA, including information given to the CRA by the consumer. Sections 623 ( b ) ( 1 ) ( A ) and ( b ) ( l ) ( B ). Report the results to the CRA that referred the dispute and, if the investigation establishes that the information was in fact, incomplete or inaccurate, report the results to all CRAs to which the furnisher provided the information that compile and maintain files on a nationwide basis. Section 623 ( b ) ( 1 ) ( C ) and ( b ) ( 1 ) ( D ). Complete the above steps within 30 days from the date the CRA receives the dispute ( or 45 days, if the consumer later provides relevant additional information to the CRA ). Section 623 ( b ) ( 2 ). Promptly modify or delete the information, or block its reporting. Section 623 ( b ) ( 1 ) ( E ), Duty to Report Voluntary Closing of Credit Accounts If a consumer voluntarily closes a credit account, any person who regularly and in the ordinary course of business furnished information to one or more CRAs must report this fact when .it provides information to CRAs for the time period in which the account was closed. Section 623 ( a ) ( 4 ). Duty to Report Dates of Delinquencies -If a furnisher reports information concerning a delinquent account placed for collection, charged to profit or loss, or subject to any similar action, the furnisher must, within 90 days after reporting the information, provide the CRA with the month and the year of the commencement of the delinquency that immediately preceded the action, so that the agency will know how long to keep the information in the consumers file. Section 623 ( a ) ( 5 ). Any person, such as a debt collector, that has acquired or is responsible for collecting delinquent accounts and that reports information to CRAs may comply with the requirements of Section 623 ( a ) ( 5 ) ( until there is a consumer dispute ) by reporting the slime delinquency date previously reported by the creditor. If the creditor did not report this date, they may comply with the FCRA by establishing reasonable procedures to obtain and report delinquency dates, or, if a delinquency date can not be reasonably obtained, by following reasonable procedures to ensure that the date reported precedes the date when the account was placed for collection charged to profit or loss, or subjected to any similar action. Section 623 ( a ) ( 5 ). Duties of Financial Institutions When Reporting Negative Information Financial institutions that furnish information to " nationwide '' consumer reporting agencies, as defined in Section 603 ( p ), must notify consumers in writing if they may furnish or have furnished negative information to a CRA. Section 623 ( a ) ( 7 ). The CFPB has prescribed model disclosures, 12 CFR Part 1022, App. B. Duties When Furnishing Medical Information A furnisher whose primary business is providing medical services, products, or devices ( and such furnisher 's agents or assignees ) is a medical information furnisher for the purposes of the FCRA and must notify all CRAs to which it reports of this fact. Section 623 ( a ) ( 9 ). This notice will enable CRAs to comply with their duties under Section 604 ( g ) when reporting medical information. Duties When ID Theft Occurs All furnishers must have in place reasonable procedures to respond to notifications from CRAs that information furnished is the result of identity theft, and to prevent refurnishing the information in the future. A furnisher may not furnish information that a consumer has identified as resulting from identity theft unless the furnisher subsequently knows or is informed by the consumer that the information is correct. Section 623 ( a ) ( 6 ). If a furnisher learns that it has furnished inaccurate information due to identity theft, it must notify each CRA of the correct information and must thereafter report only complete and accurate information. Section 623 ( a ) ( 2 ). When any : furnisher of information is notified pursuant to the procedures set forth in Section 605B that a debt has resulted from identity theft, the furnisher many not sell, transfer, or place for collection the debt except in certain limited circumstances. Section 615 ( f ). The CFPBs website, www.consumerfinance.gov/learnmore, has more information about theFCRA, including publications for business and the full text of the FCRA.Citations for FCRA sections in the U.S. Code, 15 U.S.C. 1681 et seq. : I have provided all of the above listed items within this package. Therefore, I expect these listed accountsto be deleted and blocked within four ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted.

1. 1ST FRANKLIN FINANCIAL Account Number : XXXX Please correct this inaccurate information on my credit report. I recently pulled my credit report from your Bureau and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 30 days late on this account in XX/XX/XXXX. I immediately disputed this information with 1ST FRANKLIN FINANCIAL and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( 4 ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor, or a credit issued to the obligor. ( 5 ) A computation error or similar error of the accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. 1666a. ( b ) Reports by the creditor on delinquent amounts in dispute ; notification of obligor of parties notified of delinquency If a creditor receives a further written notice from an obligor that an amount is still in dispute within the time allowed for payment under subsection ( a ) of this section, a creditor may not report to any third party that the amount of the obligor is delinquent because the obligor has failed to pay an amount which he has indicated under section 1666 ( a ) ( 2 ) of this title unless the creditor also reports that the amount is in dispute and, at the same time, notifies the obligor of the name and address of each party to whom the creditor is reporting information concerning the delinquency. ( c ) Reports by the creditor of subsequent resolution of delinquent amounts A creditor shall report any subsequent resolution of any delinquencies reported pursuant to subsection ( b ) to the parties to whom such delinquencies were initially reported. 1666b. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers, and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA, and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years ' worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements, or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). I DEMAND to see proof that I was mailed my statement to the correct address notifying me of both payment due date and delinquency of payment on the account. If you can not provide 100 % Verifiable proof and proper documentation that the CREDITOR fulfilled its obligations under the ( FCBA ) and ( FCRA ), I, therefore, demand these late payments are removed from my account or I will be forced to be in contact with the Attorney General of my State and the Consumer Financial Protection Bureau. 1 Franklin Financial made a modification to my loan, then withdrew their modification and that same day repossessed my car. XXXX XXXX 1ffc employee XXXX XXXX had been texting me from her personal cell phone. Because my account was past due, XXXX told me on XX/XX/XXXX that she'd get my payments reduced to {$150.00} a month. She then asked if I was going to come in and pay {$150.00} or bring my car? I told her pay I'd pay the {$150.00}. My car was being fixed at the time, so I asked her how to pay a partial payment online because it was only giving me an option to pay {$340.00}. She never responded to that so I paid a payment of {$340.00} on XX/XX/XXXX. On XX/XX/XXXX I also spoke with XXXX XXXX & Mr. XXXX XXXX. I spoke with XXXX about being behind on my payment & my situation. I also told her I was trying to work something out because sadly we are in family counseling due to my childrens father committing XXXX and my daughter is in XXXX XXXX due to her dads XXXX & her grandparents XXXX XXXX her. So I need/needed my car for transportation. She said she'd contact Mr. XXXX to see what could be worked out. Shortly after, Mr. XXXX XXXX called me, explaining the modification that was worked out. {$150.00} per month for 10 months. He then told me to come sign the paperwork, I told him as soon as I got a way I would. My daughter & I went in on 2 separate occasions to sign the paperwork. I went by I believe it was the 1st week of XX/XX/XXXX and they said I'd have to come back when XXXX was there. So on Friday XX/XX/XXXX, I went in again with hopes of signing the paperwork and paying a payment of {$150.00} & again I was told XXXX was out, she was the one I needed to see. The supervisor, XXXX XXXX, called me on Thursday, XX/XX/XXXX and told me this modification or this time as he called it " offer '' had expired & was no longer available. But I wasn't told this was an offer & I wasn't given an expiration date. I was told it was a modification and I was to pay 10 payments of {$150.00} & I wouldn't owe anything else. ( Keep in mind, I paid a payment of {$340.00} XX/XX/XXXX, same same day MODIFICATION was made. ) On XX/XX/XXXX within 2 hours of speaking with XXXX XXXX, 2 repo men knocked at my door & with my car already hooked up and in the road, 1 of the men said " we need your keys. '' They didn't show me an order for repossession or any type of paperwork, just " we need your keys. '' So shortly after, I contacted 1ffc Quality assurance & they said someone would be getting in touch with me. Soon thereafter, Mr. XXXX XXXX contacted me and told me that the modification was an " offer '' & that it had expired XX/XX/XXXX. I told him I was told it was a modification, not an offer, & i wasn't given an expiration date!! I asked Mr. XXXX if I could pay a full payment of {$340.00} and get my car he said no. He proceeded to say the only option i had to get my car back was to pay the past due balance in full or pay {$640.00}. Mr. XXXX didn't seem to care that I tried to sign the paper work & he didn't seem to care about anything I had to say. I called Mrs. XXXX a little later & told her I had {$400.00} & she said I couldn't get my car without {$640.00}, which is a {$340.00} car/loan payment & {$300.00} repo fee. I shouldn't be held at fault for Mrs.XXXX not being at work when I went to sign the papers and 1ffc shouldn't make a modification & then take it back. But i was given no warning of repossession nor was i told the modification was an offer that had an expiration date until Mr. XXXX told me on XX/XX/XXXX. I am behind on my account, which they knew that when they told me on XX/XX/XXXX they was making the modification. I also paid a full payment of {$340.00} on XX/XX/2019. It is not my fault again that XXXX wasn't there for me to sign the papers! According to the modification as you see documented, that would mean I owe {$150.00} for XX/XX/XXXX. But yet without warning my car was repossessed and I know this is not right. I do not appreciate the way I have been treated. Then on XX/XX/19 I recieved a call from 1ffc operations vice president. When the operations vice-president contacted me he was very rude and told me if I wanted my car to shut my mouth and listen to what he had to say.I then put him on speakerphone he said it was nonsense that I had called and complained so many times. He told me if I wanted my car back to take the XXXX cash that I had and for me to sign another loan agreement he also said otherwise unless I paid the past due amount in full I wouldn't get my car those were my choices! He was very rude! He told me not to say a word when I went in there that if anything was said regardless of whose fault it was I wouldn't get my car and he meant it he said and I have a witness! I have been treated like XXXX to say the least. I was forced to sign another modification/loan! I did not choose to accept the most recent loan modification! I was told by operations vice president I had to pay the {$400.00} and sign the most recent loan modification or pay the past due amount in full or be without a car! He also said loud and clear that 1FFC is all about the money. Therefore how they treat people doesn't matter to them. They should stick to the 1st modification they told me before my car was repossessed, which was 10 payments of {$150.00} then it'd be done. And this is what I want honored.

This whole scenario started because I was sent a live check in the mail. I don't know how I received this offer. Ive never interacted with this company beforehand. My open end credit policy was used without my permission.They pre-screened illegally. After I cashed the live check. I then received a call asking did I cash and then I received a billing statment in the mail from 1st Franklin Financial for an alleged debt. ( EXHIBIT 1 ) I then sent in a negotiable instrument for tender and it was refused. ( EXHIBIT B ) *copy will be below ( According to UCC-3-603b Tender of Payment : If tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument and tender is refused, there is discharge, to the obligation of an indorser of accommodation party having a right of recourse with respect to the obligation to which the tender relates. ) I then received a call XX/XX/2022 regarding this negotiable instrument. " Asking what is this? Also, they don't accept this payment. Receptionist even took my number and name down to have someone contact me on my tender payment. XX/XX/2022. A lady, who was supposedly a manager from the company, called me back. Stating that they looked up my negotiable instrument of my tender payment and they do not abide by those laws. These were her exact words. " I CAN NOT ACCEPT THIS FORM OF PAYMENT AND IF I DIDN'T PAY MY FIRST PAYMENT, THEY WOULD MOVE FORWARD WITH LEGAL ACTIONS ''. I have the full voice recording below. Also, she began to threaten me on this call and was very argumentative. Saying if I was refusing to pay cash or check or payment that they were sending me to collections and was going to damage my credit. Remember this was chaos on my supposedly first payment owed on alleged debt. XX/XX/XXXX, XXXX I received a letter in the mail that 1st Franklin Financial sent me stating they did not receive my initial monthly payment when in reality they refused my negotiable instrument. *I will have all attachments below of all documents. ( EXHIBIT 3 ) XXXX XXXX 2022- I received a letter in the mail from 1st Franklin Financial as Notice of Acceleration.Stating that the entire balance of an alleged debt of {$2200.00} was due and payable immediately. Also, that they had started legal proceedings to collect the unpaid balance and may take other legal actions : including repossession of any goods or motor vehicles if pledged as collateral for credit loan transaction. Also, that I may be required to pay attorney 's fees, court filing fees and court costs in addition to the amount stated above. ( EXHIBIT 6 ) * document will be below XX/XX/2022 - XXXX sent out a debt of validation letter to the direct branch here at XXXX XXXX XXXX, XXXX, Mississippi and to the headquarters CEO Virginia XXXX XXXX at XXXX XXXX XXXX XXXX, XXXX, Georgia, XXXX, US. Thirty days is up for verifying debt. Company still could not be verified in court either on XX/XX/2022. A contract between both parties with both signatures was never signed and never given. ( EXHIBIT 10, EXHIBIT XXXX ) XX/XX/2022 - My RING doorbell camera caught a video recording of a constable coming to my door and taping a notice to appear at court on XXXX XXXX for court for the alleged debt said to be owed to 1st Franklin Financial at 9:00am. 15 USC 1681 ( a ) ( 4 ) neglect of privacy. ( EXHIBIT 7 ) ( EXHIBIT 8 was a copy sent through mail ) * camera footage below as well XX/XX/2022- Court was at XXXX. I was referred to First Franklin for a first time loan, on my own. I was told by XXXX XXXX with whom I had a loan with that they would give me a better rate and that the woman I was referred to was a very good friend of that loan officer at XXXX XXXX. I have been out of work since last summer but had been making payments until XX/XX/XXXX when I just was completely unable to pay. I have paid some but am not caught up from being behind. Today they called one of my best friends who owns a business trying to get her to pay. I was told my rate was a very competitive one. I only just found out that it is 30 % interest and they will not negotiate with me or lower my payment. Though I have been in contact verbally with an attorney and I will be either getting a home loan ( if my credit is n't ruined by them ) so I can get away from this awful situation or will have to go bankrupt to settle the XXXX XXXX and the XXXX accounts that have double whammeyed me when I had XXXX and had a XXXX. I also received a letter from XXXX XXXX in the mail offering to reduce my payment and when hubbie and I went in they refused to reduce the payment and they also tried to renew our loan. We do not particularly want to go to bankruptcy but if we ca n't have our interest rate adjusted then we will be forced to do that as our loan debts are too high for us to pay. If we pay them at the 30 % rate there is nothing at all left for food or even for a trip to the doctor or to the dentist. We were tricked by these XXXX companies and by people who worked for them. Our first loan is with XXXX XXXX and it was with my husband and I. I was referred by a loan officer to her friend because she said her friend was new and would give us a better loan rate at First Franklin. Unfortunately, I believed her. The loan I got in my name alone is horrible and no one should get involved with such terrible people. They told us they would lower our rate and a paper they sent requesting us to come in and receive help was not true. They never tried to help us and they never were willing to negotiate a lower amount. They basically reentered our information and ignored all that we asked about getting help. In fact, they acted like they could not help us at all other than to give us another higher loan rate. And they turned down a loan which they suggested and it probably also lowered our credit rating. Which is just like getting beaten up by them over and over. Calling repeatedly during the day and calling my family, my friends is not acceptable business practice. We can not repay this high of a loan amount though we have tried to. We have actually more than paid back the amount we borrowed at XXXX XXXX and due to my loss of job, XXXX and a second illness. We just have no way to make this work out and the humiliating nature of these XXXX companies who have worked side by side to destroy us is unforgiveable.

On Thursday, XX/XX/2020 Myself and my husband went to 1st Franklin Financial located in XXXX, SC so I could make a payment on my loan. When we arrived their I sent my husband in to pay on my account while I care for my children in the car. After him being in there about 5 minutes, I saw him and one of the ladies ( XXXX ) that works in the office walking out of the office. XXXX approach the passenger side of the car where I was seated. She also told me next time I send someone in to make a payment for me i need to call and have them place on my account, and again I told her well if that was so why did she discuss my business with my husband he could have been anyone, again she should have called me in the office to discuss my account. l I was laid off of my job due to covid 19 and struggling to make payment on my account on time and for her to come outside and speak on me not having money in my account was embarrassing. After walking out of the business the men and lady that were parked beside me stop me and told me what she did was so wrong and told me not to feel bad because everyone don't always have the money to pay their bill on time. I have disputed this item twice this year, experian continues to update the dispute as accurate not making any changes. I tried to contact the creditor at the the phone number and address listed on my credit report as contact information for XXXX XXXX. The address in in accurate, the phone number when answered is 1st Franklin -- told by 1st Franklin that they purchased XXXX XXXX and that they have no information in their system in reference to me, that the account was paid and never late when no longer in their system. I took out my first Loan with 1st Franklin around XX/XX/XXXX in the XXXX, GA office in an attempt to build/re-build my credit. I XXXX XXXX up front if they reported to the Major Credit Bureaus and if this would help build my credit! She advised me that they had gotten in trouble regarding the FCRA but that was almost settled and that they were supposed to be back reporting before the end of XX/XX/XXXX and that there WOULD retro back to the inception of my loan and report it accurately on my credit report! I made my payments on time or early each month until XX/XX/XXXX - when Inpaid the loan off in full!! I then went back in XXXX of XXXX and took out a second loan and while speaking with the SAME employee ( XXXX XXXX ), I asked her about their credit reporting and asked why it had not reflected on my report that Inpaid my last loan off in XX/XX/XXXX!? She then advised me that they had experienced a setback and ensured me that they would be reporting by XX/XX/XXXX and that ALL of my loan information would be reported at that time!! Skeptical but desperate to get my credit built I proceeded with the loan! Several months go by and I experience some financial hardship due to some major medical issues and almost loose my car and was forced to get behind on my loan with 1st Franklin! Several more months go by and just out of curiosity, I pull my credit report and see that not only had 1st Franklin NOT reported me paying my first loan off early or at all for that matter but they had reported the a delinquent loan for the months that I had gotten bond on payments!! I had another loan with a different company in XXXX of XXXX that I paid off at the same time I paid 1st Franklin in XX/XX/XXXX and they had reported the loan paid off in full early but first Franklin seem to PICK & CHOOSE what they want to report to the credit bureaus!!!! I dont know if that is legal or not but it is DEFINITELY not fair practice and I feel that if they are going to report to the credit bureaus, then they should be required to report EVERYTHING and not be able to discriminate by picking and choosing what they want to report and hurting consumers credit scores!!!!

I can not wholly blame XXXX for these adverse actions. I am very disturbed as I am writing this complaint and I take no joy in this regretful process. 1st Franklin Financial ( XXXX, Ga ) is reporting to credit bureau, my payments on a previous account as having been paid 60-90 days late each month. In XXXX they filed a judgement against me, after which, per the terms of the judgement, I paid them on time each month, until the debt was settled in XX/XX/XXXX, and I received a letter from them stating as much. While in the process of trying to obtain a mortgage loan in XXXX, I discovered this discrepancy. I initially contacted 1st Franklin, but was told I needed to file a dispute with the credit bureau. When I did, received notice from XXXX that it had been verified, so no changes were made. On XX/XX/XXXX, I went into a local 1st Franklin Branch and obtained a printout of my payments, which were all showing as on time. I then filed another dispute with XXXX, submitting this information as proof. I received a response from them on XX/XX/XXXX, dated XX/XX/XXXX, with payments still showing 60-90 days late. I then visited 1st Franklin again on XX/XX/XXXX for an explanation. I was then told to contact their Quality Assurance dept. It was at this time I was finally told that although I was making payments on time according to the judgement, I was actually still past due, so those payments didn't count in the actual month they were made. After not feeling satisfied with this answer, I was referred the the Regional manager over the XXXX Ga branch. I spoke with him on XX/XX/XXXX, he was very rude, disrespectful, and condescending. He informed me that nothing would change and that I did not pay my debt on time. When I asked why this was not disclosed to me at the time, he just continued to repeat, I did not pay my account as agreed. I do not feel that I was given full disclosure as to the status of my account and how payments were being applied. I never received anything stating I owed anything additional to what I was paying. This sales tactic is also an easy way for anyone to intercept the letter and cash the check, thus taking out a loan under some else 's name with a single signature.

On XX/XX/19 I called 1st Franklin Financial to see about increasing my loan. I was told that there was a flag on my account placed by the manager which stated they would not lend to me because I lived in another state. I explained that is not true and I only work in another state but my legal residency is maintained in South Carolina. I also explained that I could prove this through my taxes or any other documents. XXXX told me that the manager was gone until Monday and that they were not going to bother him and that I could not speak to corporate. She told me she would give the Assistant Manager my number and have him call me back. The next day I got a call back from XXXX telling me the same thing and that I could try back on Monday with the manager. On XX/XX/19 I called back and asked to speak to the manager, to which they would not allow me. Shortly after asking why, the manager got on the phone and asked what I wanted. I explained I would like to increase my loan. He stated he would not take an application and that he would not lend to me because I live in another state. I explained that this was not true and that I could prove it with legal documents, car registration, ID, taxes, etc ... He told me that I was " Trying to commit fraud '' and that I was " trying to pull the wool over his eyes '' He also stated that If I asked him again, he would pull my credit without my permission and send me a denial letter. I told him good day and ended the call. After that, I called their corporate HQ and made a complaint. A few hours later the Regional Manager called and apologized to me for the way I was treated and threatened by XXXX the manager. He offered no solution what so ever. XX/XX/XXXX I took out a loan for {$2500.00} at First Franklin Financial in XXXX, Alabama. The balance on that date was XXXX. I made payments until XX/XX/XXXX when I made a payment of {$1500.00} in order to try and get the loan paid off quickly. My balance was then {$480.00}. My payment was paid up until XXXX of XXXX and my payment is due on the XXXX of the month in the amount of {$120.00}. I mailed a check to them on XX/XX/XXXX for {$120.00}, earlier than the due date of the payment. When I checked the balance on my account, every cent of the amount I paid toward my balance was applied toward " interest '' and " PL fees '' and {$3.00} for mailing a payment to them. XXXX was put toward my balance, which is now {$480.00}. I feel that this is unethical and is taking advantage of people who are trying to pay off their debts. I had planned to have this loan paid off in full by XXXX, but if they are only going to put XXXX toward my balance each month, I will never have it paid off!! I had told them when I paid the {$1500.00} that they caught me up until XXXX of XXXX and they better not charge me any interest during that time. How can a loan company expect you to pay your loan off when they are only taking XXXX from your balance, even when you pay it IN ADVANCE OF THE DUE DATE? I feel that this is very unethical and probably in violation of the Fair Debt Practices Act. I am also filing a complaint with the Federal Trade Commission. I would like for this matter to be looked into and this company held accountable for charging such ridiculous fees for someone who has been paid up and has paid their monthly payment early. An Unauthorized payment from my account by 1st Franklin Financial Corporation in XXXX, XXXX Basically fraud. A payment was issued from the company without permission. In XX/XX/XXXX, I made authorized a payment on behalf of my cousin XXXX XXXX living in XXXX XXXX, GA over the phone. I confirmed it would be a one time payment and that my information was not to be saved on the account. Yesterday, XX/XX/XXXX a charge appeared on my account from the company for my cousin 's account. I informed her of the pending transaction and she assured me she had called and gave her card number for the payment. She called 1st Franklin to make them aware of the error and stated that T**** the representative said it can not be corrected or reversed back to my account. I also called the company and was transferred to T*****. The male person that answered said I had the wrong number. The amount of {$190.00} posted to my account this morning. This is fraud. It was not authorized and they stored my information. So basically they have my account information to do what ever they please with it. To say they will not correct the mistake or if it was on purpose should be illegal. Now I have to pay my bank to attempt a dispute for an account THAT IS NOT EVEN MINE to begin with. I have a loan with first franklin in XXXX al I have received multiple call and voicemails in one day to the point of feeling harassed, I had explained that I changed jobs and would be needing time to get back on track was not a problem till it was late and spoke to several of the girls there they were very hateful with me and threatened legal action because I rolled into a new month told her I have been with them for years and they have made a lot of money off me and that they would get there money on my pay day which was a few days later the girl said she could not guarantee I would not have legal action taken against me I told her if they needed to threaten me over a balance of a few hundred dollars to go ahead she continued to be hateful told her she would get Friday and that I did not need to be treated like someone who does not pay my bills, I then received a letter from the branch manager stating the same. I worked in this industry for years and I know that there are several rules violated here and reach out to the company which tried to call me several times I dont work hours that I can receive there call so I never got to talk to them a few weeks later I received a letter saying they tried to reach and assume that this matter was resolved I feel I was treated unfairly and know that they have had issues in the past with reporting and threatening customers these tactics are childish rude and uncalled for. First Franklin in XXXX, GA obtained my banking information to process payments " ONLY WHEN APPROVED ''. However, they are consistently and randomly withdrawing unauthorized payments from my account. It started with my XXXX XXXX XXXX account, I had to end up blocking their business name from having the ability to use electronic debits. So they then slightly changed the name used to make electronic debts, and started withdrawing unauthorized amounts of money again. I then had to change my entire banking account information just to stop them. Then, XXXX the store manager pops up at my house to make " payment arrangements ''. I have spoken to XXXX, XXXX, and XXXX NUMEROUS times about my account. They PROMISED me that they would ONLY withdraw funds from my account, IF I authorized the payments. After dealing with them for quite some time now, I know and understand their scandalous practices, so I began recording EVERY call between myself and ANY representative from the XXXX office. Despite their promise to me to only withdraw AUTHORIZED transactions, they continue to withdraw monies from my account at their discretion, which are NOT AUTHORIZED. This account became delinquent in XXXX 2019. The company filed court action, after I missed payments. I communicated with creditor but was forced to sign a judgment to be able to pay them and get my account in good standing. Since that time, on XXXX XXXX, 2019 they did a hard credit pull on my credit file without my consent. In addition to this, they also locked me out of the online account ( which is where I can view account details, make payments etc. ) It says I do not have an open account with their company. In addition my most recent payments in XXXX and XXXX, I called into their office to make payments with XXXX. She told me each time the total amount that was due. On XXXX XXXX 2019, I paid the monthly payment amount of XXXX, on XXXX XXXX 2019, I paid the monthly amount of XXXX. Again, on XX/XX/XXXX I called in and spoke with XXXX, he said my payment was due on that day XXXX-19, and that as of then I was not behind. I determined the next day that they are reporting I am 60 plus days late on this account, and not being transparent to me about this. I need help with this. As someone that's had credit issues. I had established finally a good credit score with a lot of hard work. They have dropped my credit score by more than 100 points, and are affecting my job and my family.

I have an account with 1st Franklin Financial for a XXXX $ loan. That somehow became a XXXX loan. They also had me put my XXXX up as collateral on the loan. Issued insurance on the vehicle that I had to pay, I had no idea that I would have to pay for. I had a previous loan with the company the balance was XXXX when I applied for the new loan.I make my monthly payments and I also make overpayments. When checking my payment history I noticed that my overpayments have been pooled as a partial payment. Which is not being applied properly which costs me more in the amount of interest being paid on the account. I lost my job and went 3 months without pay. I still paid until money ran out. I told manager twice about my situation. He agreed for me to pay what I can when I get paid. XXXX First Franklin is absolutely the worst place to trust with your finances. We took out a mortgage to fix our home but got in over heads and need to move. My daughter and son in law decided they wanted to purchase the home from us. First Franklin said they arent doing any new loans and there werent options to change it into their names. So we started making extra payments which were suppose to go PRINCIPAL to pay the loan off quicker accept that isnt what they did with them interest and escrow! So contacted them and were told we are six months ahead but when we given the option for the extra escrow money {$320.00} to go to PRINCIPAL now we are only one month ahead I have all my receipts and my financial counselor agrees this isnt right and the company needs to be reported. I received a loan for {$900.00}. I made 1 payment online. I went to make the 2nd payment and it said my account was closed ( it's not ) and I could not make the payment, nor was I notified I would need to mail the check earlier. First of all, I did not use my vehicle for colateral, nor did I sign to have insurance, or Road side assistance, for my vehicle. I noticed a Man by my Jeep when I was inside, I believe he got my VIN number, and then he came back inside the office. I have a lien on my vehicle already, so why would I do that. Second, the personal property they have in the court they listed are fraud, and so is my Signature is Fraud. I did not sign for such a deal!!
